A LETTER FROM THE PRESIDENT

It has been a great privilege for me to serve as your 99th President, and to be able to preside over the celebration of our centennial anniversary; and what a year it has been! Just a bit over a year ago we began planning what we thought would be a year of celebration to culminate our centennial anniversary and planning the beginning of our next 100 years. There is no way we could have foreseen what this year would actually bring.

2021 ended with Kentucky REALTORS® coordinating a response to the horribly devastating tornadoes in Western Kentucky. On December 10th, 2021 a series of tornadoes blew through a number of our Western and South Central communities, including Mayfield, Benton, Dawson Springs, Princeton and Bowling Green. We requested and received a grant of $1.5 Million from NAR’s REALTORS® Relief Foundation (RRF) to assist displaced homeowners and renters in the affected areas. Much of the first months of the year was devoted to promoting the grant and processing applications for relief. We ultimately dispersed over $690,000 to help 311 families as they recovered from the disaster.

Several lessons learned from the administration of the relief funds resulted in changes to RRF guidelines for future grants. The lessons learned led directly to the creation of the Kentucky REALTORS® Relief Foundation and to the initiation of disaster planning for Kentucky REALTORS®.

Our 2022 legislative session saw the review of 109 bills with some impact or potential impact on real estate and private property rights. We were very happy to see passage of our signature legislation, The County Clerk Modernization Bill. For the first time in recent memory, we were able to assist in blocking more bills than we supported. Our relationship with our legislative REALTOR® champions has never been stronger.

In May, in National Harbor, MD, Kentucky REALTORS® was recognized for the 5th straight year for achieving the coveted RPAC President’s Cup. We also witnessed a record 10 members from Kentucky walk across the stage at the NAR Legislative Meetings and be inducted into the NAR RPAC Hall of Fame. During the ceremony, inductees from 2019, 2020 and 2021 were recognized, including many of our pastpresidents and leaders of KYR.

Our CEO departed on December 31st, and much of the early part of the year was focused on the search to find a replacement. Al Blevins spearheaded a search committee that engaged with a search firm and interviewed the replacement candidates. This search resulted in the hiring of Josh Summers from The Villages, Florida as our new CEO. Josh arrived just in time to engage with our members at the summer business meetings in Bowling Green at the end of June.

Josh arrived just in time to take the helm and manage the response to historic flooding that hit portions of 13 Eastern Kentucky counties. We again engaged the REALTORS® Relief Foundation to obtain a grant to support families impacted by the flooding. We received an initial grant of $500,000 (later raised to $750,000) and to date have assisted over 255 families. As we continue to evolve, and thanks to the creation of our 501c(3), the Kentucky REALTORS® Relief Foundation, we were able to receive and directly review and approve requests for housing assistance and relief. The implantation of online applications has made it easier than ever for the victims to apply for relief, as submitting paper applications during the tragedy in Western Kentucky was quite cumbersome for all parties. Our new full-time employee, Hathlyn Chapman, has worked tirelessly with a committee composed of Charles Hinckley, Brenda Gooslin, and Donna Gregorich to manage the review process.

As we end the year and transition leadership to a superb leadership team headed by 2023 President Elizabeth Monarch, we note that here is a sense of renewed energy, cooperation and optimism among our members. We can feel it and people outside the state are seeing it as well. Our reputation is growing in a number of ways. We are connecting like never before, within the state, across our NAR Region, and with NAR itself. Our interaction with the RRF has been much appreciated and recognized across NAR. The feedback we gave with the Tornado Relief led to direct changes in the program that impacted the Eastern Kentucky floods and Florida Hurricane relief efforts.

Finally, our advocacy and RPAC successes are firing on all cylinders. We end the year in an excellent position in terms of funds available to carry out our advocacy program, we have a strong relationship with the legislative and executive branches of state government, and with our congressional delegation. Our base in energized and focused as evidenced by a record year of RPAC fundraising and participation. For the first time in Kentucky REALTORS® history, we have become a half-a-million-dollar PAC.

It is exciting to see how far we have come, and it is even more exciting to look forward to where we are headed. We’re looking forward to Elizabeth Monarch being installed in December and serving as our 100th President. It has been eleven years since Kentucky REALTORS® had a female president, and we have the honor of being led by two consecutive female presidents for the first time in our history, as Elizabeth will be followed by Pam Featherstone. The future of our Association is bright with these leaders at the helm. n

DIVERSITY EQUITY INCLUSION

In this time of increasing social change and uncertainty, it is more important than ever to ensure that Kentucky Realtors be diverse, equitable, and inclusionary both within our organization and in the communities we serve. In 2021, with this goal in mind, the Kentucky REALTORS® Diversity, Equity & Inclusion Committee was created. It is tasked with promoting diversity and unity within KYR membership, as well as educating REALTORS® on how to be more inclusive with peers and clients alike.

In a brief time, we have made great gains, however, there is so much more to accomplish. Some of our successes have been the creation of the Open Books, Open Minds book club, which to date have discussed six books, with topics covering racial, gender, and sexual discrimination. The creation of a new annual award, the “Winds of Change Award”, given out annually to a REALTOR®, their representative, or an entity that has demonstrated sustained support for advancing diversity, equity, and inclusion in the KYR organization and/or community. Pat Parks was the 2021 recipient, and Lester Sanders in 2022. Congratulations to both, very well deserved!

As we move forward into 2023, we ask all Kentucky Realtors® to look for ways to make our industry more open and welcoming to all. We also ask you to consider completing NAR’s Fairhaven, Implicit Bias, and At Home With Diversity trainings. It will open your eyes!

A Source of Relief in Times of Crisis

It is difficult for any one of us to wrap our minds around the fact that within less than one year, our state of Kentucky bore two historic and heartbreaking disasters. I was hired into a new position at KYR as Disaster Relief Coordinator working part-time through college, without knowing the full-time devotion I would make to the victims of these disasters.

I will never forget the overwhelming feeling I had on my first day as the actuality of my new job set in. I remember opening my email inbox to the reality of the condition the tornadoes had left Western Kentucky in. There was no way to prepare myself for the real-life accounts of what a 45-second storm had done to these families. I would open pictures of what once was a home to an entire family and not be able to determine what I was looking at. I would answer calls and listen to stories about how one night would result in a lifetime of PTSD for one victim or how a resident spent the night listening to all of the different cries for help down his entire street as his neighbors were trapped under the aftermath. It became clear to me that there were many more stories similar to these and I would spend the next several months reaching as many victims as possible.

To find the good in a bad situation, I was truly delighted to work firsthand with these victims and provide them with those first steps back to some normalcy. Our REALTOR® Relief Fund was seemingly a drop in the bucket, but to the people who had their entire worlds destroyed by the tornadoes, covering their housing costs for 3 months meant much more than I could ever understand. Granting over

$690,000 to our tornado victims was undeniably an honor. From a check as small as $120 to the maximum $3000, it was heartwarming to know that assistance coming from our REALTOR® fund would be the aid that brought hope to those who weren’t so hopeful.

Just as we thought we were finding the right steps in disaster recovery; Eastern Kentucky was hit with one of the most devastating floods in the state’s history. When I thought I had seen the worst, it came in another form. The image of children’s toys stuck in the tops of trees, homes completely lifted of their foundations & washed away, and black mold intruding living spaces completely bemused me. As the news of this flood came in, I had so many questions. But the most important one being: how do we help?

Recovering from a flood is a much different process than recovering from a tornado. When a tornado strikes an area, the damage is done in an instant. With a flood, the rain can continue for days causing damage to accrue taking days or even weeks to reveal its full extent and recovery to be delayed. We found that this was the case with the Eastern Kentucky flooding. We had to somehow act fast but also take our time to make appropriate modifications in providing relief to a different beast.

We spent several days analyzing what we had learned from the tornado victims and amending those details to meet the needs of the flood victims. In doing that, we were able to set up our REALTOR® Relief Fund with the help of the National Association of REALTORS® and quickly began

providing aid to the flood victims in a volume we hadn’t seen before. Furthermore, we were able to raise money to well prepare ourselves in the case that another disaster falls upon our state.

In continuing to provide relief to the flood victims of Eastern Kentucky, each day we are learning how to best help disaster victims. With each penny that is disbursed in the $423,000 to Eastern Kentucky and over $1 million between both disasters, we have prioritized offering our aid to those who need it most.

Through this unprecedented time of uncertainty, the one irrefutable facet I have found myself holding onto is the strength of the commonwealth and the unity of our REALTOR® family. This has not been a one-man job. From the beginning, there were always emails, text, and phone calls from our members reaching out with their continuous efforts and support. As we work through recovery, I am grateful to have not only the state of Kentucky behind us, but also the REALTOR® members all across the country. We hope that our state of Kentucky does not deal with another nightmare such as the ones of this past year. But should that be our unfortunate reality, I have no doubt that the past 10 months of experience will guide us through a smooth recovery. n

Meet Our New CEO

In June 2022, Kentucky REALTORS® hired Josh Summers as the new Chief Executive Officer for the Association. Josh has served on every level of staff leadership from MLS Director to Government Affairs Director, and CEO prior to joining KYR. His wealth of experience in association management and leadership have already proven valuable as the Association crossed the $450k mark in RPAC funds raised for the first time in our history and has impacted the community through streamlining our processes for the relief efforts in both Western and Eastern Kentucky.

Josh is a native Floridian and spent his early years on his family farm raising cattle, riding horses, and learning the importance of a strong work ethic from a young age. He earned a bachelor’s degree from Florida University, and immediately became familiar Real Estate industry through his property development firm, which focused on developing affordable and student housing across the country.

Josh values spending time with his two daughters, Sarah Grace and Jaclyn, and wife Cameron. He takes great pride in being “a girl dad” and doing so while balancing his career and family responsibilities. In his free time, Josh enjoys golfing, boating, and traveling, although the latter is all a part of the job. In his first four months of being CEO, Josh and President Mike Inman have visited nearly all eighteen of our local associations, attending many member meetings, installations, and RPAC events.

With a strong background in advocacy, Josh’s 10+ years of association management will be useful as KYR looks to become a half-a-milliondollar PAC next year, and rapidly increase the number of major investors throughout the Commonwealth. Kentucky is in a unique position as our voice has never been heard louder when it comes to advocacy and the new CEO looks forward to leading the charge as KYR “moves from a position of defense to offense” when it comes to advocating for the rights of REALTORS® and property owners, says Josh Summers. n

Since 1969, the REALTORS® Political Action Committee (RPAC) has promoted the election of pro-REALTOR® candidates in Kentucky and across the United States.

The purpose of RPAC is clear: REALTORS® raise and spend money to elect candidates who understand and support their interests. The money to accomplish this comes from voluntary contributions made by REALTORS®. These are not members’ dues; this is money given freely by REALTORS® in recognition of how important campaign fundraising is to the political process.

RPAC doesn’t buy votes. RPAC enables REALTORS® to support candidates that support the issues that are important to their profession and livelihood.

RPAC is one of the most bipartisan PACs in the country, giving to both Democrats and Republicans alike. The only stipulation is that the candidate be a member of

As the voice of real estate and private property rights, Kentucky REALTORS® knows the impact homeownership has on neighborhoods, communities, and the overall vibrancy of the Kentucky economy. Kentucky REALTORS® advocates for policies that increase access to the American Dream of homeownership by promoting growth, attracting new jobs and talent, and encouraging positive community development. Kentucky REALTORS® serves as the voice and the champion of its over 13,600 members that live, work, and invest in every corner of the Commonwealth.

During the 2022 legislative session, Kentucky REALTORS® Legislative Quick Response Team was tasked with advancing KYR’s Advocacy Agenda and Policy Positions: County Clerk Modernization, Tax Reform, Kentucky Real Estate Commission, and Wholesaling.

COUNTY CLERK OFFICE MODERNIZATIONPASSED

Issue: As many County Clerk offices closed during the pandemic, REALTORS® came together with other stakeholders due to shared concerns that closure of their offices would effectively stifle a significant portion of Kentucky’s economy. Closure of these critical offices prevented title searches, timely title filings, and in some cases delayed transactions causing significant challenges for buyers and sellers.

Position: Kentucky REALTORS® SUPPORT efforts that would bring uniformity and efficiency to the County Clerk’s Office to increase adoption of electronic recording of documents, searching real estate documents online, funding for increased use of technology and standardized procedures for closure of offices.

TAX REFORM - PASSED

Issue: Kentucky REALTORS® SUPPORT tax policy that encourages growth and development but believes that tax reform measures should not place a disproportionate burden on homeowners and the real estate industry. Kentucky REALTORS® believes that good tax policy should encourage homeownership, not deter it.

Position:

• SUPPORT and PROTECT the Mortgage Interest Deduction

• OPPOSE any sales tax on professional services

• SUPPORT programs that incentivize home ownership such as First Time Homebuyer programs

KENTUCKY REAL ESTATE COMMISSION –IN PROGRESS

Issue: The primary responsibility of the Kentucky Real Estate Authority (KREA)/Kentucky Real Estate Commission (KREC) is to protect the consumer by regulating the real estate licensees in Kentucky. Kentucky REALTORS® is concerned with how the KREA/KREC is currently resourced to protect the consumer. Additional staffing is needed to help with regulatory enforcement and licensing approvals in a timely manner.

Position: Ensure the Kentucky Real Estate Commission has adequate resources to provide protection to consumers. Kentucky REALTORS® SUPPORT additional funding the KREA/ KREC may receive to hire additional staff for regulating the licensees.

WHOLESALING REAL ESTATE – IN PROGRESS

Issue: The practice of "real estate wholesaling" occurs when an individual enters into a contract to purchase real estate and immediately attempts to resell, for a profit, their interest in that real estate contract to a different purchaser before closing on the property. This practice is often indistinguishable to the consumer from the activities a Kentucky real estate licensee engages in when marketing a property for a seller, yet the wholesaler is currently not required to hold a Kentucky real estate license.

Position: Kentucky REALTORS® SUPPORT implementing regulations on the practice of wholesaling real estate. Wholesalers that publicly market an equitable interest in a contract for the purchase of real property should be required to hold a Kentucky real estate license so that the KREC has regulatory authority over their actions. This is a consumer protection issue.

The KYR Legislative Meeting was back IN-PERSON for the first time in two years last week. During that week, our members were able to visit with their legislators at the KYR Legislative Reception and during the REALTORS® Day on the Hill. Of course, we would not be able to have our REALTORS® Day on the Hill without taking our annual picture in the Capitol. Legislative Reception at The Elizabeth in Frankfort Another highlight of the week took place when KYR President Mike Inman and KYR President-elect Elizabeth Monarch were recognized in the Senate and House of Representatives galleries when both Chambers passed resolutions honoring Kentucky REALTORS® Centennial year. Thank you to Speaker Pro Tempore David Meade and Senator Damon Thayer as they were the sponsors of the resolutions.

the session. Chaired by Angi Cline in 2022, this committee is designed to be a fast-acting committee that analyzes legislation that could impact the real estate industry in Kentucky. The QRT met every Friday while Session is in to discuss any relative bills and guide the decision process for KYR to support, oppose, or monitor those bills based upon their impact on REALTORS®, homeowners, and the health of the real estate industry.

This session, the QRT voted to support 16 pieces of legislation, oppose 20, and monitored 37. In total, the QRT kept track of over 70 bills this legislative session. As you will read below, many of the bills the QRT voted to oppose were unfriendly landlord bills.

Here are a few of the Supported Bills:

HB 8 (Petrie, J): This was the tax reform legislation that was passed by the legislature this session. It will reduce the individual income tax rate to 4% for taxable years beginning on or after January 1, 2023, and provide a further rate reduction in future years if certain thresholds of total general fund receipts are exceeded. Additionally, this bill added quite a few services to Sales Tax. Real Estate services continue to the exempt from Sales Tax!

HB 86 (Bridges, R): This measure would establish the nonrefundable Kentucky affordable housing credit.

HB 238 (Meade, D): would prohibit a property valuation administrator from using the asking price of a property actively listed for sale in the determination of the fair cash value of the property unless other evidence demonstrates that the asking price is the price the property would bring at a fair voluntary sale.

HB 315 (Meade, D): would appropriate $300,000,000 to the Broadband Deployment Fund.

The funds would come from the State Fiscal Recovery Fund of the American Rescue Plan Act of 2021.

SB 161 (West, S): relating to affidavits of conversion to real estate for manufactured homes, to set forth an alternative process by which an applicant may show proof of lien satisfaction.

HB 377 (Meredith, S) and SB 135 (Howell, J): is the County Clerk Modernization legislation that is a major priority of KYR’s this legislative session. This measure would establish deadlines for all county clerks to maintain online portals for electronic filing and searching of records.

Additionally, $25 million was put in the final budget to help all county clerk offices implement the online portals.

SB 171 (McGarvey, M): is a civil rights bill that would prohibit discrimination in certain housing, real estate, and other financial transactions, to include sexual orientation and gender identity.

HB 526 (Koch, M): would allow a person to qualify for licensure as a land surveyor if he or she has graduated from a two-year board-approved program and has obtained a minimum of six years of progressive experience in land surveying, with four of those years under the direct supervision of a practicing land surveyor. Additionally, this measure would allow graduates of two-year board-approved programs to be eligible to take the Fundamentals of Land Surveying Examination after two years of progressive experience in land surveying and the principles and Practice of Land Surveying Examination after six years of progressive experience in land surveying.

HB 574 (Meade, D): This bill would redefine "real estate brokerage" to include advertising for sale an equitable interest in a contract for the purchase of real property between a property owner and a prospective buyer. Also, the bill would limit this type of advertising to licensed real estate brokers.

Here are a few of the Opposed Bills:

HB 89 (Tate, N): The bill would require the Kentucky Real Estate Commission (KREC) to add a section to KREC Form 402 (seller’s disclosure of property condition) to include “proximity to a military installation”.

HB 131 (Scott, A): This measure would permit the governing body of a consolidated local government to enact rent control ordinances in a development area.

HB 152 (Kulkarni, N): This legislation would apply the Uniform Residential Landlord and Tenant Act across the Commonwealth. Only a handful of cities in Kentucky have adopted this language.

HB 159 (Kulkarni, N): Would provide automatic expungement of records in actions for forcible entry and detainer.

HB 160 (Kulkarni, N): This measure would specify the duties of a landlord with respect to abandoned personal property.

SB 21 (Thomas, R): This measure pertains to the screening of tenants. It would limit applicant screening charges, prohibit landlords from charging screening fees without notice, require screening criteria, disallow landlords from considering applicant’s certain previous actions, arrests, or criminal charges.

SB 52 (Hornback, P): Would require a $100 per acre state conversion charge on land which has been converted from agricultural or horticultural to any other use.

SB 191 (Alvarado, R): This is the “HOA Bill” that you should be familiar with by now. This bill would place unnecessary burdens on new and existing HOA’s in Kentucky.

The recipients of this year’s Jess and Carolyn Kinman Award are Senate President Robert Stivers from Manchester and Senate Majority Floor Leader Damon Thayer from Georgetown. Sen. Stivers represents SD 25 which serves Clay, Jackson, Knox, McCreary, Owsley, and Whitley counties. Sen. Thayer represents SD 17 which serves Fayette (part), Grant, Kenton (part), and Scott counties. The Kentucky Real Estate Commission ended the policy of license recognition on December 16, 2019, with the new regulations allowing for license reciprocity. The Kentucky Real Estate Commission is currently negotiating reciprocal agreements with individual states. The KRI Trustees award scholarships on an annual basis as a way to meet its mission of enhancing real estate professionalism and knowledge by providing quality educational services and programs for the real estate industry and the public. KRI makes scholarships available to members who want to obtain the GRI designation, Broker’s license, as well as provide scholarships to Kentucky residents who wish to pursue a career in real estate.

We are proud to announce a new scholarship called "The Linzie Craig Broker Education Scholarship". This new scholarship has been named in memory of our good friend and fellow REALTOR® Linzie Craig. Being a Broker and his love for education, we wanted to keep his memory alive with this new scholarship.

Applications are available on the KRI website and must be submitted and received no later than May 31, 2023 at 11:59 PM EST. Scholarships will be reviewed in the month of June and all applicants will be notified by July 1, 2023.

Realtor® Code of Ethics

NAR's Board of Directors approved a change to the Code of Ethics training requirement, extending it from every two years to every three years. A new three-year cycle began January 1, 2022. The deadline for this cycle is December 31, 2024.

REALTORS® are required to complete ethics training of not less than 2 hours, 30 minutes of instructional time. The training must meet specific learning objectives and criteria established by the National Association of REALTORS®.

Training may be completed through local REALTOR® associations or through another method, such as classroom courses or online courses. A Look Ahead Into the Future of Kentucky REALTORS®

After an exciting close-out of our first century as an Association, Kentucky REALTOSRS® is poised to charge into the future with ambition, drive, and above all, integrity. We look to continue the momentum created this year and look forward to bringing new and exciting member benefits to all of our members this year.

In the first quarter of 2023, we’re looking to launch a brand-new market stats program. This program will be integrated into our website, and members of KYR will be able to pull reports and view interactive housing data from across the state. We are in the process of pulling this aggregate data from every corner of the Commonwealth and look forward to launching this program that will allow each and every member of the Association to have real statewide data at their fingertips.

Additionally, KYR is actively researching and interviewing health insurance providers, with a goal of providing affordable health insurance to our members. REALTORS® often overpay for health insurance, and KYR wants to provide truly affordable health insurance that does not come at the expense of your coverage, as your health is of the utmost priority. We are excited to offer insurance opportunities in 2023.

Also on the horizon is a focus on commercial real estate in Kentucky. The importance Kentucky plays in the commercial field often goes unnoticed, but our Commonwealth is uniquely poised to expand in economic development and bring more jobs into Kentucky. KYR is looking to make a name for ourselves when it comes to attracting new businesses, and will have a seat at the table for those discussions. Additionally, there are a number of emerging technologies relating to the commercial field that KYR is looking to offer to our members. Stay tuned for more information on member benefits for those working in commercial real estate or those looking to expand their business.
