Exclusive use areas in sectional title schemes: Can you do whatever you like with yours?

Exclusive use areas are widely used but often misunderstood and people often feel that they should not pay anything towards maintenance or levies on such areas whilst they think they can use them as they wish. What is an exclusive use area? It is a defined portion of the common property set aside for use by a particular owner to the exclusion of others. It can either be created by including allocations in the rules often with sketch plans showing the areas in question or by formal survey and issue of a separate title deed for that exclusive use area which is linked, however, to ownership of a unit or units in the scheme.

No person who is not the owner of a unit in the scheme may have an exclusive use area in that scheme though there are still some hangovers from earlier when it was not necessary to own an unit in the scheme to have an exclusive use area in that scheme, often a garage.

What is common property?

It is everything in a sectional title scheme that is not a unit and can include general garden areas, roads, lifts, stairs, corridors, store rooms and parking areas. It is owned by all owners in proportion to their unit sizes expressed as a fraction of the overall area of the units (which is their participation quota) and is used to determine the share of the overall levy payable by each owner. Any owner can use any part of the common property. Can you do whatever you like with an exclusive use area?
