How your annual rental Increase is calculated

In these tight financial times, nobody wants their rent increased, but landlords and agents have to adjust their rentals in relation to market factors. Having some insight into the contributing factors to a rental calculation will help you to understand what influenced your rental increase this year. As a rule of thumb, rents are usually increased by 8% to 10% annually, but Pieter Janse van Rensburg, the franchisee for Just Property in George, explains that a number of different factors are taken into account when calculating a rental, and shifts in all of these will be passed on to the tenant.

“It’s also worth bearing in mind that many of the costs of property ownership – including interest rates, insurance and municipal rates – do not remain static, so landlords have to recalculate annually to ensure that their operating costs remain viable,” says Janse van Rensburg. THE COMMUNAL SCHEMES OMBUD SERVICE ACT - A COMMENTARY In 2011, Parliment passed two pieces of legislation that had a direct impact on the South African Property Ownership regime, namely the Sectional Title Schemes Management Act (STSMA) and the Communal Schemes Ombud Services Act (THE CSOS). Although these acts were approved in 2011, they were only promulgated, and brought into law, on 7th October 2016.

These could include, for example, the Memorandum of incorporation or the Constitution of a Property Owners Association, and most decidedly, and importantly for Sectional Title Owners, all Management and Conduct Rules, and any variation thereof. No variation or amendment to any scheme governance documentation is of any force or effect, even if unanimously approved by members, unless it has been submitted to and accepted by the Ombud.

It is this last function which is likely to be that most utilised by the public. What was not fully appreciated by many lay persons, is that the STSMA applied to all classes of Sectional Title Schemes, be they for residential, commercial, industrial or agricultural usage. There is a misconception that the CSOS applies to Sectional and other types of communal housing schemes only. This would, for example, then only include residential shareblock, timeshare, and the homeowner association type of residential scheme, in addition to Sectional Residential Schemes. In truth, the CSOS applies to every land ownership scheme, be it residential, commercial, industrial or agricultural, in which ownership of the shared (common) property is obligatory for and limited to the owners of the properties benefitting thereby, or an association or other legal persona of which only such owners are obliged to be and may be members.

A disaffected member may challenge any rule which he considers to be unfair, unreasonable, or discriminatory. 6. Establishing New Rules A disaffectd member may seek an order from the Ombud compelling the governing body to establish a new rule which is fair, more reasonable and more equitable to all members, even though the members themselves may not have voted in favour thereof. 7. Strike Down a Resolution A member might complain that a resolution passed at a meeting of members was improperly obtained, whether by lack of a quorum, invalid notice, and so on.

A member who clearly requires that he be allocated the Exclusive Use and enjoyment of a portion of the common property, and is denied such Exclusive Use by his co- owners, may call on the Ombud to grant him such Exclusive Use. 9. Witholding Information

1. Financial Matters A member might, for example, believe that inadequate provision has been made in the monthly levy for the cost of any item of expenditure required to be covered. Conversely, the Scheme Management might refer a delinquent member in arrears of his levies to the Ombud, and request that the Ombud order him to pay.

Why was CSOS passed into our law in the first place, you might ask? In simple terms, the purpose was threefold:-

This order of dispute is very wide, and embraces, for example, an order to have a non-Sectional Title entity submit its financial records to audit, or to secure an order against a defaulting absentee owner so as to ensure that his tenant pays his rental directly to the association.

So, for example, a shareblock company memorandum of incorporation, plan of allocation of exclusive use and enjoyment of units within its scheme, relevant exclusive use and enjoyment agreements, conduct rules, and so on, would be deposited with the Ombud.

The CSOS dispute resolution mechanism will produce a far cheaper, and, hopefully more efficient service than the current arbitration and court process formerly used. It is anticipated that vastly increased numbers of disaffected owners will wish to take advantage of this dispute resolution function of the CSOS. One hopes that there will be sufficient numbers of adequately trained personnel to properly provide this service. A further unusual feature of the Ombud’s dispute resolution process, is that neither party to a dispute is entitled to legal representation as a right to any hearing to be adjudicated on by the Ombud. Such representation is only permissible if allowed by the Ombud.
