Questions to ask the conveyancing attorney Ownership of a property takes more than a signature on an Offer to Purchase or for that matter the payment of the purchase price. The property needs to go through the process of transfer and needs to be registered in the new buyer’s name at the Deed Registry Office, which is where the services of a conveyancing attorney are required. According to Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa, the process of purchasing a home can be complicated, and there are several aspects that buyers may be unsure of during the various stages of the transaction. He adds that there are a few questions that buyers can ask the conveyancing attorney that will provide them with more clarity and give them a better understanding of what is required. How long will the registration and transfer process take? On average the process should take around three months from the date of sale. However, this depends on a few key elements, such as the due date of the buyer’s bond grant, along with the guarantees stipulated in the deed of sale. If there are no complications, the process can be expedited. Likewise, if there are complications, registration can be delayed. Staying in communication with the conveyancing attorney will help buyers stay abreast of the situation and possible timing.

How much will the transfer and bond costs be? The transfer duty payable is based on the purchase price of the property, while the bond costs will be determined by the total loan registered with the bank. Either the estate agent or the conveyancing attorney should be able to provide a fairly accurate answer to buyers based on a schedule of bond and transfer costs.

When are the transfer costs due? The transfer costs will be due a few weeks after the sale of the home when the transfer attorney requests the documentation to be signed. The conveyancing attorney is required to pay the transfer duty in advance, along with any rates and taxes or levies required to obtain the necessary clearance certificates. The longer it takes for buyers to pay the transfer duty, the longer it will take to transfer the property into their name. To whom do I pay occupational rent? If the buyer moves into the property before registration has taken place, they will be required to pay a predetermined occupational rent. The buyer and seller can come to the agreement that the rent be paid directly into the seller’s bond account. Consecutively, the buyer can pay the occupational rent to the estate agent or conveyancing attorney, and they will ensure that it is paid either into the seller’s bond account or directly to the seller.

The meaning and the importance of the property clause: vis-à-vis the use of immovable property as surety when securing a loan, especially for property in rural areas.
Property defined in simple terms is a physical (tangible) object of a real right or ownership right, however in terms of section 25 of the South African Constitution (“the Act) the definition of property is much wider. The definition includes: physical objects, real rights in immovable tangible property (land and permanent attachments to land), real rights in movable tangible property, intangible property rights for example personal rights with regards to tangible property such as short-term lease of land and much more. In the case of Laugh it Off Promotions cc V South African Breweries International, intellectual property rights are also considered property and protected under the property clause section 25 of the Act. The purpose of the property clause: 1. It provides immunity against arbitrary deprivation or uncompensated expropriation of property. Meaning even the state cannot lawfully take property away from an individual without paying for it or providing an alternative for that individual being deprived of their property. 2. Provides a right not to be excluded from class of property-holders. For example a law that prevents blacks and women to hold property/land.
South African property law regulates the rights of people in or over certain objects or things therefore the property clause applies universally to everyone and it does not exclude anyone.
There are no documents that are signed to act as proof, the only thing that is considered as “proof” are the witnesses (neighbours) who attend the event of the allocation of the land by the chief.
In terms of property law you must have a title over the property, meaning the property must be registered under your name. A title is a bundle of rights in a piece of property in which a party may own either a legal interest or equitable interests. It may refer to a formal document such as a deed that serves as evidence of ownership. Due to the fact that people in rural areas do not have title or ownership over the property because it is owned by the chief it places them in an unfavourable position when they try to secure a loan. A secured loan is a loan in which the borrower pledges an asset as collateral for the loan which then becomes a secured debt owed to the creditor who gives a loan.
This system of allocating property in rural areas in this manner has it pros and cons, just like everything else. The biggest con however is that the properties allocated to the individuals in the rural communities are not registered in the Deeds Registry, which becomes a problem when individuals attempt to secure loans using the property that was given to them by the chief. In rural areas the allocated land and properties on the land are semi-permanent and also not registered in the Deeds Registry, because the property is not registered the financial institutions do not consider it as collateral this places the people in a disadvantage.
Immovable property in rural areas include, the land, buildings, and crops and for the grazing for livestock. However the land use in rural areas is under the control of an Inkosi (chief), meaning the members of the community do not own the land as private property. Therefore the land cannot be bought or sold but it is allocated to residents for erections of a building or homestead and for soil cultivation. One would say it is relatively easy to acquire land in the rural area because any person can be allocated a piece of land, even people from outside the area and you have to meet certain “requirements” in order to be allocated that piece of land.
It is not said that the system used in rural areas is wrong and should be changed completely, however the rural communities must be atleast given some sense of ownership some sense of entitlement that enables them to use the property as a collateral to secure loans.
