The number of non-paying tenants would shock any potential investor from considering owning and managing a rental property, says Louw Liebenberg, CEO of PayProp, a processor of residential letting transactions. “In a recent review of the claims history of our DepositGuarantee product, we found that 13% of tenants who move out of a property do not pay their last month’s rent. Combined with other industry statistics which show that on a month-to-month basis nearly 6% of tenants do not pay their rent in the month that it is due, the problem is larger than some landlords would like to admit.� Liebenberg has five tips to deal with non-paying tenants:
1. Use an estate agent The reality is that estate agents have access to tools that the average private landlord will not readily find. Firstly, they have far more sophisticated tenant assessment tools, more thoroughly prepared leases, legal resources and, most importantly, time to deal with these issues. Secondly, they have seen ‘every trick in the book’ and are therefore usually immune to some of the strategies used by tenants to delay payment.
2. Sign a mandate If you use an agency, ensure that you sign a written mandate with them. The mandate details what the obligations of the agency are towards you and the tenant. Most importantly, it should also outline the limits of the authority you grant to the agent in dealing with a non-paying tenant. For example, has the agent clearly outlined the process that they follow in the case of non-payment? At what point can the agent start incurring legal costs that you as a landlord will be liable for? If you do not clarify these upfront, it may cause massive confusion and delays in dealing with a delinquent tenant.
3. Insist on a proper credit check Insist on seeing the detailed credit check performed by the agency. Don’t just look at credit scores, but try to also understand the tenant’s debt position relative to their income and the rental you are asking. PayProp has found that the average tenant has monthly debt commitments that are 1.3 times that of the rental being negotiated. Therefore, just looking at what someone is earning (or driving or wearing) and thinking that they earn enough to afford the rental, is misleading. In fact, the recent PayProp Rental Index found that the percentage of high and very high risk tenants increases for tenants requesting rentals that are above R15,000.
4. Inspections, leases and deposits Never allow a tenant into a property without having a signed lease, received proof of payment of the deposit and a signed incoming inspection. Once a tenant is in a property on the promise of paying
a deposit at a future date, you have no guarantee that you will ever get the deposit – leaving you as the landlord at immense risk should non-payment or damage occur. Also, if no incoming inspection exists, you have no grounds to claim damages when the tenant moves out. Not having these in place severely limits the recourse available to you in the case of non-payment.
5. Deal with non-payment quickly and harshly A relaxed attitude to late payment often gives the tenant the impression that performing on the lease agreement is optional. Our advice is to start by reminding a tenant that payment is due a few days ahead of the agreed date. If payment is not received on the agreed day (i.e. the first of the month), immediately let the tenant know that you have not received the funds. If you have not received the money after that, (i.e. the second or third) immediately proceed with a legal Letter of Demand. The Letter of Demand is crucial in two ways. On the one hand it lets the tenant know that you as the landlord are serious about their non-payment. PayProp has recently launched an integrated Letter of Demand offering with Koegelenberg Attorneys. In the first 90 days almost 2,000 letters have been sent to non-paying tenants. More importantly, 74% of those tenants paid their arrears within 20 business days of having received the letter. On the other, it creates the opportunity for the landlord to legally terminate the lease, and start the process of eviction. When it gets to this point, it is crucial that you involve a lawyer to ensure that you have the best possible chance of a successful eviction.

Property, in particular, is subject to a vast array of influencing factors, but industry experts believe learning to spot a few key indicators can significantly increase your chances of financial success. “If you time your entry into a hotspot suburb well, catching the market as it hits its upswing, you can see strong growth over a relatively short space of time,” says Schalk van der Merwe, a Rawson Property Group franchisee. “This allows you to amass equity very quickly, which can then be used to expand your portfolio.” Recognise the signs In order to buy at the right time, however, you need to be able to recognise the signs of an area on the cusp of popularity. This, Van der Merwe says, requires a combination of a birds-eye view of the general property climate, as well as more detailed information on potential suburbs. “If you look at national property trends at the moment, it’s clear that the market is slowing down, with average house price inflation at 5.2% as of August 2016,” he says. “Not all areas are being affected to such a great extent, however, and these are the spots investors are likely to be looking at in the near future.” CT takes top spot Currently, the City of Cape Town is taking the top spot for property growth, sitting well above 10% per annum. Gauteng metros are less exuberant, but still offer solid potential with Ekurhuleni, City of Tshwane and City of Johannesburg growing between 4% and 6% per annum. “Within these areas there are smaller trends at work as well,” says Van der
Merwe. “Statistics indicate that low- and mid-value market segments are doing far better than high-end, luxury properties. Sectional title properties are also outperforming freehold homes on average – partly because they tend to fall into the more affordable market segments, and partly because they offer security and community benefits that are becoming more popular as time goes by.”
high-growth area, experiencing growth of their own thanks to the positive changes and increased popularity of the neighbourhood next door.” Van der Merwe recommends paying close attention to suburbs with median prices more than 5% lower than their trendy neighbours. “This is often a sign that they’ll be playing price ‘catch-up’ in the near future,” he explains, “and if you monitor their price trends closely, you can catch the upswing as it begins.”
With these trends in mind, Van der Merwe suggests doing some research to find a suitably promising suburb. Here are a few indicators to look for:
High demand, low supply
Gentrification “Keep an eye out for suburbs that may have had a poor reputation in the past, but are now attracting an increasing number of young residents with decent incomes,” says Van der Merwe. “New retailers, cafes and restaurants opening up are good signs, as is an increase in renovation or new construction in the area. Together, these factors breathe new life into tired suburbs, and if the momentum is maintained, can turn them into trendy hotspots with excellent growth potential.” Large-scale infrastructure projects and/or developments Large infrastructure and development projects create jobs, and jobs draw new residents to an area. If you see a big office park, lifestyle or shopping centre going up in a suburb, chances are the property values will soon improve. “It’s best to wait until construction is underway, however, as projects don’t always get off the ground as promised,” says Van der Merwe.
The ratio of demand to supply is a key driver of price growth, so Van der Merwe recommends looking for suburbs with little to no capacity for new construction, and increasing demand. “Rising rental yields can be a good indicator of suburbs that are likely to see this balance changing in favour of investors,” he adds, “as they indicate popular rental areas, and renters typically buy in the same suburbs in which they rented.” Asking prices below replacement costs In most cases, newly-built homes in developments cost between 10% and 30% more than second-hand properties in neighbouring suburbs. In these cases, it can be a great idea to opt for the more affordable properties and wait for their prices to join those of the more expensive estates a few years down the line. Once you’ve identified a potential high-growth area using the indicators above, Van der Merwe suggests contacting an estate agent who is active in the area to discuss more localised buyer trends.
Ripple effect “If you miss the boat and the suburb you’re interested in has already outgrown your budget, consider a purchase in a neighbouring suburb,” says Van der Merwe. “We often see something of a ripple effect, with suburbs bordering a

New sectional titles schemes legislation set to boost demand and prices Source – Biz Community, Seeff
The much anticipated and long-debated Sectional Titles Schemes Management Act and the Community Schemes Ombud Service Act that finally came into operation at the start of October, are both vital for this growing property sector for a number of reasons. Sean Guy, manager of the Seeff Southern Suburbs Sectional Title Division, says that the sectional title property is the fastest growing property sector and the pace of growth is not going to slow down any time soon.
The nature of this type of property has introduced many complexities that often require vital and specific legislation to clarify and bring about effective management of these schemes. Guy says that this legislation should be seen as a refinement of regulations to better meet the practical needs of this type of property ownership. The two acts introduce significant changes to scheme management law. Notably, the establishment of the Office of the Community Schemes Ombud will impact on dispute resolution in sectional title schemes, homeowners’ associations and other community schemes. The amendments provide for the more efficient management of schemes, says guy. This includes an important mandatory requirement to establish a reserve fund for each scheme specifically intended to finance future

maintenance as well as new rules around the limitation of the use of proxies and an obligation to notify the Ombud of the domicile of the body corporate. The Ombud’s office will now assist schemes to recover arrear levies, remedy an inability to obtain either a special or unanimous resolution, resolve conflicting management and conduct rules interpretation and will ensure the safe storage and availability of these rules.
Guy says important points around the mandatory reserve fund include a suggested (but not yet confirmed) amount of 25% of the projected annual levy figure. Thus, should the projected levies for the next financial year be calculated at R800,000, then an additional reserve amount of R200,000 must be collected from the unit owners and specifically allocated to the reserve fund. The aim of the reserve fund, he adds, is to ensure that funds are at hand for future maintenance and repairs to the common property. For sectional title schemes that have not been conscientious in maintaining a healthy “war chest” and have little or no reserves, this will inevitably result in a significant increase in levies. It is important though to note that rather than add to the financial burden, these provision meet an identified need since many sectional title properties fall into disrepair as a result of inadequate and inattentive financial planning and generally poor management. This becomes important when you want to sell and also for the buyer to for example obtain a home loan. While the spirit of the legislation is to be endorsed, it may well create initial
difficulties for many sectional title owners, the smaller schemes in particular, says Guy. That said, a healthy reserve fund will lessen the need for future special levies. Trustees and managing agents have ninety days from the publication in the Government Gazette, which was the 7th October, to implement these new statutory provisions. Guy points out that banks scrutinise the financial statements of a scheme when considering a purchaser’s bond application. Should it appear that the scheme is poorly managed and not financially sound, a financial institution will decline a bond over a unit. It is therefore in the interest of all sectional title owners to ensure the sound financial position of the body corporate.
