Social Media mistakes that may cost you your case... Picture a situation in which you find yourself in a courtroom and are just about to hit a “home run” and win a case for your client. The client you are representing was involved in a motor vehicle collision and is now seeking damages for personal injury and boom! Just when you feel the case is yours the opposition pulls out a “selfie” that was posted on facebook on the date of the collision which very much shows your client taking a selfie whilst on the road.

Social Media in this case may be seen as a curse rather than a blessing. As much as it is an efficient and fun way to stay in contact with one another and what is happening around the world it can very much also bring about the demise of many aspects of one’s life. It is no secret that social media exposes outsiders to find out and know information about you that only you know about. The all famous “check-ins” on Facebook enable these strangers to obtain and use the information you post on your social networks to collect data they can use for unsavoury purposes. It is for this reason that not only as a lawyer but also as the user of social media , one begins to worry about their client’s personal information available on social media, especially during the process of a pending a case. So, the question as whether which is the safer way to use social media during the proceedings of a case? The appropriate answer here is that, they shouldn’t. But because of the hunger society feels to

be constantly connected, it has become almost impossible to avoid social media altogether. As such, here are five ways you can get your client to keep their personal endeavours on the low during the time of processing a case. • Advise your client to keep their location impossible to locate - This is possible on social networks such as Facebook and Linked-in by easily hiding or making your information private under privacy settings. GPS-enabled cellular devices, location networks –systems are in almost every App or social network site which makes it easy to share your location – these networks are a “No-no” during case proceedings. case. A second parties are almost always closely watching your client, and location information can hurt the chances of a win for you and your client. An app such as Snapchat should be avoided. Even though one’s pictures are only supposed to last a couple of seconds, anyone with an iPhone can take a “snapshot.” Additionally, there are now applications that allow you to secretly save Snapchats without the users’ permission. • Talk to your client about making their social media platforms private - It is hard to keep up with what is being shared on all these social media platforms. It’s best to make all your social media private. That way, cutting the chances of social media lurkers to gain access to your client’s accounts without your client being alerted of this first. • Ask your client to ignore any e-mails that could be phishing attacks - Phishing attacks are any kind of emails that ask for any personal information and claim to be from a trusted source, such as a bank. Usually they are accompanied by a link. These links could be run by a hacker who, in a matter of

minutes, can have complete control of a client’s e-mail accounts – which may hold important legal information pertaining to a legal case. • Be careful of what kind of photographs your client has tagged of themselves. Perhaps, your client has come to you with a case that involves drunken driving. This may make it harder to represent them for an incident that occurred once – when on their social media, they have multiple videos tagged of themselves with cans of beer in their hands and singing along with the hashtag- “enjoying the open road” or “Durban here I come”. • Remind your client that anything shared can be used against them - Without a doubt it may prove to be difficult to ask your client to stay away from sharing not only their own but also other people’s lives as well. Facebook has become a playground for persons to share controversial videos and posts.

While these instructions may seem a bit over the top, it is important to cover all social media bases, during a case. Let us not forget that, anything can be used against your client. And it is possible that the opposition may manipulate any shared information – whether it is created by or shared to your client.
