Tenants have all the rights
We often get told that "tenants have all the rights these days". Without looking a bit deeper into the legislation one might agree. Tenants can now in terms of the CPA(Consumer Protection Act) give 20 business days’ notice and simply leave, so what is the point of a lease?
It is important to remember that the CPA does allow penalties to be charged. These vary on how long the contract still has to run, the likelihood of finding a replacement tenant and a few other factors. In most cases the Landlord would be able to charge the tenant for at least one month rental after the tenant has vacated and in some cases it could be as much as 3 months. Each situation is different. It is important to note that the CPA does not always apply. I will go into this in more detail in future articles. Another common question is "what is the point of a lease if the tenant can just break it?” The lease may have over 100 clauses such as the tenants obligations in so far as looking after the property, the breach clauses and many others. Many of the clauses protect the landlord and his asset. The lease would also protect the tenant from any unlawful action. The lease may no longer be as binding as it was in terms of time frame but all the other clauses

are incredibly important. It should also be noted that the amendments to the rental housing act 1999 makes it compulsory to reduce all leases to writing. We expect the amendment to be finally signed early next year.

The law has also changed with regards to evicting a tenant. Previously the landlord had a common law right to evict a tenant if he did not pay. This has all changed with the PIE Act. Landlords now have to apply for a court order to have the sheriff remove the tenant and his goods from the property. This can take time and be costly. The best way to avoid this is to vet the tenants very carefully in the beginning.

In the unlikely event that you do get a bad tenant it is critical to have an up to date lease that will allow an attorney to take the required action. For example the Landlord may in terms of his hypothec attach the tenant’s goods if the tenant has not paid. In certain circumstances this can be done almost instantly.

Generally buying a tenanted property isn’t a problem, if the buyer bears in mind that old adage of ‘huur gaat voor koop’.

If becoming a landlord, even if only for a month, is a deal breaker, then it’s best to look for another property.

Therefore the new owner of the property is required to honour any existing lease agreements to the letter until such time as the lease expires and as the new owner you will need to take that into account.
