How to get home loan finance and buy property on auction... Buying a house or flat on auction can be a good way to secure a home at an excellent price, but the process is more complicated than most people think and there are some important precautions that potential purchasers need to take. “The first of these,� says Rudi Botha, CEO of BetterBond, SA’s biggest bond originator, “is the need to establish the market value of the property before the auction, so that you can set a limit on how much you are prepared to bid and not get carried away in the excitement and competitive atmosphere of the auction. “And your best course of action in this regard is to seek help from a qualified and experienced estate agent who is familiar with the area where the property is located and can draw up a comparative market analysis (CMA) for you. This will provide details of similar properties recently sold in the area and the actual prices achieved.

In fact, he notes, the Conditions of Sale will usually also provide that if you default on the sale after the auction, the property seller will have the right to take legal action to compel you to fulfil the contract – or to forfeit the deposit and any other monies that you

have already paid as “rouwkoop�. “In most cases (unless you are paying cash for the property), the ‘guarantee’ you have to provide will be an assurance from your attorney that your bank has granted you a bond for at least the balance of the purchase price and is ready to pay that over to the seller’s attorney on transfer of the property into your name. “So your best move is to consult a reputable originator like BetterBond and go through the bond pre-qualification process before you go anywhere near an auction. You will then have peace of mind about being able to secure a bond and finalise the transaction – and also know what your spending limit is, so you will not be tempted to overbid.� To obtain bond pre-qualification, you will need your ID, proof of residence, proof of income, bank statements, a list of assets and liabilities, and a statement of your monthly expenditure. Your consultant will then guide you through the pre-qualification process, with reference to your gross and disposable income, the maximum monthly bond repayment you can afford, any deposit available, the additional costs associated with most property purchases, and best bond options available to you.

Questions Property buyers Forget to Ask

There is so much to consider when purchasing a home that it’s not difficult to understand why so many buyers forget to ask some of the most important questions before they sign along the dotted line. “Purchasing property is a long-term commitment and – as exciting as it might be to find a place you love – buyers need to take the time to ask all of the relevant questions before rushing into a purchase,” says Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa. Broker/Manager of RE/MAX Property Centre (Durbanville), Rhonell Julyan has dealt with many sellers who suffer from unfortunate cases of buyers’ regret because they did not consider all of the relevant aspects of the property. “Durbanville attracts many buyers who are looking for their perfect family home. As a result, many buyers purchase the property

with the intention of renovating it to suit the growing needs of their family. But, many do not have a clear idea of the cost, expertise and time involved in achieving the vision before they make their purchase. If a buyer is planning to renovate – even if it is just a minor change – it is important that they find a contractor who can answer all of these questions before they place an offer on a property,” Julyan advises. Below are some of the other questions buyers in her area tend to forget to ask: 1) Non-disclosable Information “While sellers are legally required to provide full disclosure of property defects prior to concluding the sale, the voetstoots clause protects the seller by forcing the buyer to prove that the information was deliberately withheld from them. In order to protect themselves, buyers ought to ask some awkward questions they wouldn’t normally think to ask, such as whether there has ever been a death in the house, if there has been any disputes or boundary issues with unpleasant neighbours, and whether there is any sort of pest problem (with snakes, mice, bats, bedbugs, cockroaches and ants being the most common suspects).”

2) Maintenance Questions “For budgeting and planning purposes, it is important to ask when last certain features of the home where maintained so that you are not caught off guard by the unexpected expense. For starters, a roof is expected to last anywhere between 20-30 years. If you are purchasing an older property, it is important to ask how old the roof is so that you do not get thrown-off by this project. If the property has any thatch roofing, you also need to ask when last the thatch was combed. Asking whether there has ever been any plumbing or electrical issues will also be helpful in determining the lifespan on these related fittings. Lastly, you should ask roughly how much the monthly utilities cost the previous owner so that you can budget accordingly.” 3) Practical Points “In the flurry of excitement, buyers often tend to forget to check practical things such as dimensions. If you have a large SUV, for example, make sure that you have checked the dimensions (height included) of the garage to make sure

that your vehicle will fit. If you have a large family, you should also ask how large the geyser is so that you know if you’re going to have to set up a bathroom schedule just to ensure that nobody has a cold shower.” As a final word of advice, Goslett suggests that buyers across South Africa do research on their new suburb before making a purchase. “Many buyers spend so much time looking at the property that they completely forget to look beyond its boundaries. If you happen to see a neighbour when going to view the property, chat to them and find out what it’s like to live in the area. Beyond this, buyers should also take some time to visit the suburb to see what it’s like at different times of the day,” he concludes


Agreements Of Sale Of Immovable Property In todays modern world, where most people have access to the internet, it is easy to obtain a template of a sale agreement for immovable property. However, certain legalities have to be complied with in order for the agreement concluded between the parties to be valid and binding. In terms of Section 2 of the Alienation of Land Act (No. 68 of 1981), in order for an agreement relating to the sale of immovable property to be valid, it must be in writing and signed and dated by both parties (i.e. the seller and the purchaser). At the very least, the agreement must contain a description of the seller and the purchaser, a description of the property being sold,and the purchase price. These are known as the essential terms of the agreement. But that is not the end of the matter. Additional terms which are material to the sale must also be recorded in the agreement. These material terms are not easy to define but one must bear in mind that if a material term has not been finally agreed upon and is left open for further negotiations, there is no

valid agreement. When dealing with the sale of immovable property, examples of material terms include the manner of payment of the purchase price, the time within which the purchase price must be paid, the suspensive conditions and any other special conditions, as well as the occupation date and any occupational rental which may be payable. The method or manner of payment of the purchase price must be clearly set out. In a pre-printed agreement, any options not exercised must be deleted as any defect may render the agreement void. The parties must set out if a deposit is payable and when it is payable. If the purchaser requires mortgage finance to buy the property, then the amount required as well as the date by when the finance must be approved must also be clearly set out. The sale of immovable property usually includes the fixtures and fittings. These are items that are permanently attached to the structures or buildings on the land. There are some ambiguous areas, namely structures such as sheds and wendy-houses, items used in conjunction with a fixture such as garage door remotes and batteries for solar power systems. Should the purchaser wish to include these types of items in the sale, the clause setting this out needs to be as specific as possible. It is difficult to enforce verbal agree-

ments in this regard. A suspensive condition is a material term and therefore must be in writing and clearly set out in order to avoid uncertainty. The sale being subject to the purchaser obtaining mortgage finance is a standard suspensive condition. If the event does not occur, ie the purchaser does not obtain bond approval, no agreement comes into existence. It is important to make sure that all blank spaces in the agreement are filled in or crossed out. If there is no consensus between the parties in respect of something that has not been filled in, there is no agreement.
