Not a week goes by that I don't receive a call from a desperate landlord who has rented to a tenant directly and now has a tenant that is not paying their rent or utilities. The following needs to be followed in order to remedy the situation.

The starting point would be to check the terms of the lease. The date on which rent must be received should be clearly recorded. It is usually the 1st day of the month. Many landlords believe that a debit order is preferential to an EFT but this is not true. Debit orders can be reversed by the tenant up to 40 days after they have been paid. Effectively what this means is a landlord may believe he has been paid two months’ rental only for the tenant to instruct the bank to reverse the debit. An EFT is a far safer option. Assuming the due date is the 1st of the month the tenant would be in breach on the 2nd of the month. There is a common misperception that tenants have a grace period of 7 days. There is no grace period and landlords can place the tenant in breach the day after rent is due. If rent is due on a weekend or a public holiday, common practice is to extend the due date to the next working day. Again, one would need to check the lease to identify where notices need to be served. Normally, notices need to be served where the tenant occupies the rental property. The lease may specify that if the letter is posted, it will only deemed to have been received after a certain amount of days. Should the dispute escalate you may well need to show proof of posting, so I highly recommend that landlords always send any correspondence via registered email. Alternatively, a high-quality lease will normally record an email address as an acceptable domicile (legal address), and include a clause that states that delivery is deemed to be on the day the email is sent. It is critically important that should a tenant not pay that the tenant is placed in breach as soon as possible. If the tenant pays, then the breach is remedied. Should the

lease be subject to the Consumer Protection Act then the tenant must be given 20 business days to remedy the breach. There has been much confusion on this point and in my opinion a critical error made. Since the inception of the CPA and with the obligation to provide the tenant with 20 days to remedy the breach many attorneys have changed the letter of demand from 7 days to 20 days. A distinction must be made between the demand period and the breach period. Simply put the tenant may have 20 business days to remedy the breach before the lease may be cancelled but the demand is not subject to this period and can remain at 7 days, which was the norm previously.

Should the tenant not pay after the demand period, then the landlord may take the next step, which is to issue summons against the tenant. If the rent remains outstanding 20 days after the tenant is placed in breach, then the landlord may cancel the lease. Again, it is important to send the cancellation to the tenant’s recorded domicile, either by registered mail or via email. All the above helps place the Landlord in a strong position to take further action if needed as quickly as possible. However, delinquent tenants may still ignore both the demand for rent and the cancellation and continue to live for free in the landlord’s property. To stay on the right side of the law and taking into account that the Rental Housing Act details heavy fines and even jail time for landlords who take the law into their own hands, it is crucial for landlords to act correctly. Should a tenant not vacate after the lease has been cancelled, then the next step would be to approach a reputable attorney for a PIE application (more commonly known as an eviction order). It may seem complex but, in reality, managing defaulting tenants can be done in a few steps. If done swiftly and correctly, landlords can mitigate the effects a bad tenant can have on their rental return. As always, I recommend that landlords carefully screen their prospective tenants to ensure they are financially sound before a lease agreement is entered into.

Their access to credit is also a clear indication of banks’ appetite to lend money and increasing numbers therefore usually translates to a stronger economy. “Based on the interest we are experiencing thus far this year we are expecting good numbers of
serious investors present at our first auctions of the year, which will take place early in January. These range from property and moveable sales, to business assets and motoring among others,” says Roy. He adds that these early auctions usually represent good opportunities for investors who can profit from year-end capital raising attempts of businesses to fund 13th cheques for their employees or individuals wanting to fund holiday expenses. Property and business sales are also usually buoyant at this time of the year as non-core assets are disposed of to fund new ventures.
“Whatever the reason and whatever the investment, we believe that 2018 will be a better year for the auction industry as people steadily learn the value of buying and selling goods on auction.
