Lifestyle is determining location in property choice Location, always a major factor in property selection, is being redefined by in terms of lifestyle choices rather than investment returns.
“Location, price and security are generally the ‘big three’ for homebuyers and that will no doubt continue to be the case,” says Shaun Rademeyer, CEO of BetterLife Home Loans. “However, the focus used to be on potential investment returns and buyers would scramble to buy in areas which had proven to deliver above-average property value growth or where prices had continued to rise, even when the economy was not doing so well. “Now, however, lifestyle factors are coming to the fore. Fore example, buyers will target a certain school they wish their children to attend and then buy a home close to that school. Or they will choose to buy in an area close to work so they don’t have to spend hours commuting or perhaps in an area that is close to the beach or has a lively nightlife and so offers them great leisure facilities. “In short, the way they envisage actually living in their new home and community has in many instances become more important to them than the returns they stand to make when they sell that property. This is of relevance to home sellers and their agents because it presents an opportunity to target buyers based on their interests and preferences. “The shift in priorities may well have something to do with the fact that first-time buyers are currently much older, on average, than their parents were when they bought their first homes, and so do not expect – or want – to move as often as their parents did. “Many first-time buyers now are already in their mid-30s and in many instances they are buying a ‘forever’ home in which they intend to raise their family and bequeath or sell to their children when they retire. So it is no surprise
that they are looking for locations they feel will offer them all the facilities they need in the long-term, as well as a community they can relate to.”

Where Do I Lawfully Park My Vehicles Within A Sectional Title Scheme ?
The concept of vertical ownership of portion of a building , together with an undivided share of the underlying land (the Common Property) came into being in South Africa with the passage of the Sectional Titles Act , No 66 of 1971 , which was promulgated in 1973 . This first generation of Sectional Title legislation envisioned the division of high rise buildings ( such as the American so called condominiums ), rather than the more usual simplex/duplex development now so prevalent , and so no provision whatever was made in the 1971 Act for the allocation to owners of exclusive use garden areas , parking spaces and so on . What the 1971 Act did allow for was the notarial, registered lease of portion/s of the Common Property and in order to have the authority to enter into such a lease, an unanimous resolution of the members of the Body Corporate was required . This formal and costly procedure, involving unanimous resolutions of the members, attestation of appropriate deeds by Notaries Public and registration in the Deeds Registry, was clearly unsuited to the demands of sectional ownership as they evolved in South Africa . Furthermore, the statutory management and conduct rules laid down by the Legislature for the control and management of these Sectional Schemes proved to be woefully inadequate . A more workable set of these Rules was created by banks ,property lawyers and the South African Property Owners, working in association with one another. The Rules so fashioned , called the SAPOA Rules, were an immediate hit . For example, banks would generally not lend mortgage finance on the security of a Sectional Unit , unless the Scheme within which such unit was situate, had adopted the SAPOA Rules . As one might expect , the SAPOA Rules were far more sweeping in respect of the communal issues dealt with , than the original Statutary Rules had been , and one of these communal issues now dealt with , was the matter of the allocation of exclusive use areas to individual owners . Although there were minor variations in the SAPOA based rules adopted by various Schemes , it was generally a provision of them all that exclusive use areas might be linked to specific units by means of a Special Resolution of the members .
In order to have an exclusive use area allocated to an owner once the SAPOA Rules had been adopted , one no longer required a unanimous resolution of members , attestation by Notaries Public and Deeds Office Registration , but rather a Special Resolution of members only. There was a downside to this , however ,as an allocation of exclusive use could as easily be taken away by Special Resolution . There was no form of security
of tenure offered by the SAPOA Rules, as the 1971 Act did not provide therefore.
The first generation of Sectional Title legislation was deeply flawed , and did not meet the needs of South African Society, as has been indicated above . Accordingly , the second generation of Sectional Titles legislation saw the light of day with the promulgation of the Sectional Titles Act No 95 of 1986 . This 1986 Act was a vast improvement on its predecessor . In the first place , the statutory Management and Conduct Rules designed for the management and control of Sectional Schemes, now embodied most of the positive aspects of the old SAPOA rules and more particularly considerable attention was devoted to the matter of allocation of exclusive use areas . In the first place , the original developer of the scheme might delineate exclusive use areas on a Sectional Plan prior to the registration thereof . On registration of the plan , the Developer was then issued with Certificates of Registered Real Right to the exclusive use areas so delineated on the plan which could then be ceded (transferred) to buyers of units . These certificates were , in terms of the 1986 Act deemed to be registered titles to urban immoveable property , capable of being ceded to another person , of being mortgaged, leased and so on . Real security of tenure was now afforded to holders of rights of exclusive use to portions of the common property in a scheme . Furthermore , should the developer himself not reserve Exclusive Use Areas at the time of opening of the Sectional Register , the Body Corporate , acting under authority of an unanimous resolution of the members , might have an exclusive use plan prepared and registered , and then pass title of individual exclusive use areas so depicted on the plan it had prepared , to members . This manner of transfer of Exclusive Use Rights by the Body Corporate had precisely the same benefits as were bestowed when the developer transferred such rights . Although a vast improvement on what had gone before insofar as allocation of exclusive use rights was concerned, it was felt that the unanimity of members required before a Body Corporate might itself allocate exclusive use rights , was a retrogressive step in comparison with the SAPOA Rules and their requirement of a Special Resolution only . Accordingly , Section 27A was added to the 1986 Act . In terms thereof, the Body Corporate , acting under authority of a Special Resolution could by an amendment to the Scheme Conduct Rules, allocate the exclusive use to portions of the Common Property to members . The exclusive use
rights so created were not registered in the Deeds Registry, and the holders thereof were not deemed to be the owners of urban immovable property. However, in order to achieve some security of tenure ( a failing in the SAPOA version ) , the holder of a Section 27A exclusive use right could not lose this right without his written consent . We have now seen the advent of the third generation of Sectional Titles legislation, with the advent of the Sectional Title Schemes management Act of 2011, which was promulgated in October 2016 ( The STSMA). This Act has had a dramatic impact on how Sectional Title Schemes are managed and such impact and the introduction of the Communal Schemes Ombud Services are subjects worthy of an entirely separate article . However, the STSMA did introduce a variation to the allocation of exclusive use areas . These may only be allocated by means of registered titles issued in accordance with exclusive use diagrams prepared by a Land Surveyor and approved by the Surveyor General . Once again , the developer may delineate exclusive use areas on a Sectional Plan prior to the registration thereof , or the Body Corporate, under authority of an unanimous resolution of members , may have an exclusive use plan prepared , approved , and pass title forrights of exclusive use to portions of the Common Property to members . Inevitably, as seen above, this can be a very formal and very costly procedure . Most regrettably, the STSMA saw the repeal of the old Section 27A method of allocation of exclusive use rights in terms of the rules which was permitted in terms of the 1986 Act. This is indeed a pity. From the aforegoing, it is clear that the issue of exclusive use rights to portions of the common property in a Sectional Scheme is both complex and controversial. In simple terms, unless an owner has exclusive use parking rights to a portion of the common property allocated to him in accordance with the relevant provisions of the Law in operation at the time of allocation, he may not park any vehicle on any other portion of the common property. Unauthorized utilisation of common property for the purpose of parking vehicles is one of the most common sources of discontent between Body Corporate members
