Community Schemes Ombud Services (hereinafter CSOS) dispute resolution process In terms of the Act a dispute, lodged with CSOS undergoes a five stage process before the matter can be said to be finalised. While under the control of the ombud there are four stages which the dispute undergoes.

the affected parties setting out the details of the dispute, the relief sought, details of the place and times when the documentation relating to the application can be inspected, invite written submissions with regard to the application and provide the parties with a list of the ombuds current list of adjudicators.

What follows is a basic summary of the four stage process while under the control of the ombud.

Stage Three – Conciliation

stage One – Submission Of Application Any person may make an application if such person is a party to or affected materially by a dispute. The application has to be completed in the prescribed form issued by CSOS. The application must be lodged with the ombud. It can be lodged by the applicant hand delivering a copy at the offices of CSOS or by emailing a copy of the complete application to the ombud. The application lodged by the applicant is made up of four distinct components namely: 1. A Factual Statement 2. The relief sought by the applicant. The applicant must ensure that the relief sought falls within the scope of CSOS 3. Name and address of each person the applicant considers to be affected materially by the application 4. The ground on which the relief is sought Stage Two – Communication Of The Application To Affected Parties Once an application is received by CSOS the Ombud may require the applicant to submit further information or documentation in support of the application and to provide evidence that an internal resolution mechanism has been unsuccessful.

On acceptance of an application and after receipt of any submissions from the affected persons or responses from the applicant, if the ombud considers that the there is a reasonable prospect of a negotiated settlement of the dispute set out in the application the ombud must refer the matter to conciliation.
