Many first-time buyers don’t understand the difference between taking possession of their new property and taking occupation, or the provisions in a sale agreement for the payment of occupational rent. “Actual possession only happens when the transfer of ownership from seller to buyer is officially registered in the Deeds Office,” says Shaun Rademeyer, CEO of BetterLife Home Loans. “However, buyers are sometimes allowed to occupy their new home before the transfer process has been completed, and this can lead to some confusion”, he says.

Notifying a mortgagee about an extension of a section in a Sectional Title Scheme

The procedure for extending a section is governed by Section 24 of the Sectional Title Act No. 95 of 1986, as amended, (the Act). This section states that if an owner proposes to extend the boundaries or floor area of his or her section then such owner shall with the approval of the body corporate authorized by a special resolution of its members have a land surveyor prepare a sectional plan of extension and have it approved by the Surveyor general. The approved sectional plan of extension is then lodged at a Deeds Office by a conveyancer to record the new extent of the section as reflected on the sectional plans of extension against the Title Deed of the section. The most common reason for an extension of a section is where an owner encloses a portion of the common property by including patio to his/her section, which then becomes part of the living area of the section. Prior to the extension being registered in the Deeds office the conveyancer attending to the registration must study the sectional plans of extension to determine, by what percentage the participation quota of the section in question has been altered. It is very important from a conveyancing point of view to determine this as there are two separate procedures applicable depending on the percentage deviation of the participation quota. Where the Deviation is less than 10 percent In terms of Section 24(6) (d) (i) of the Act a land surveyor or architect must certify stating that there is not a deviation of more than 10 percent in the participation quota of the relevant section as a result of the extension. Where the Deviation is more than 10 percent Section 24(b) (d) (ii) states that if there is a deviation of more than 10 per cent, a certificate by a conveyancer stating that the mortgagee of each section in the scheme has consented to the registration of the sectional plan of extension of that section. This procedure places an onerous task on the conveyancer attending to the registration of the sectional plan of extension, due to that the conveyancer must conduct a search of the entire sectional title scheme to determine if there are bonds registered over each section in the scheme. If there are any bonds registered over any section in the sectional title scheme the conveyancer is required by section 24 (6A) of the Act to send a notice to each mortgagee advising it of the extension and providing certain information to the mortgagee in order to obtain the mortgagees consent to register the sectional plans of

extension. The difficulty arises when the conveyancer has to obtain this information from the members of the body corporate in the sectional title scheme in order to properly advise the mortgagee of the sectional plan of extension and to obtain the necessary consent. In practice a conveyancer will request the following information from those members of the sectional title scheme that has a bond registered over his or her section; their full names and surname, Identity Number, the Section number, name of the mortgagee and bond account number in order for the conveyancer to provide the mortgagee with sufficient information relating to the bond which it has over a particular section in the scheme. In order for the Mortgagee to be in a position to issue the consent which is required in terms of the above section this information must be provided to the mortgagee. Most members in the sectional title scheme are reluctant to provide this information as they are of the view that such information is of a personal nature and, more so for fear that it could be used for fraudulent transactions. The harsh reality is that we are in living in times where fraud and identity theft occurs more often than ever before and therefore people in general must be more careful with their personal information and to whom they provide such information too. Their reluctance is well found when considered against this background.
