How to buy the ideal property for your business... Eventually, your business is going to need a physical establishment to organise its workers and potentially attract clients. When you do, you'll need to decide whether to lease or buy the property. Though leasing is attractive to business with limited capital or those uncertain of the future, buying offers a lot of advantages, such as earning you equity over time and allowing you to sublet to other tenants in your building. However, you’ll need to buy the right property if you want to be successful. Buying the right property There are a few key factors you should consider before buying a business property: • Understand how property prices fluctuate A lot of research is required to calculate the price of a building. Its age, its composition, its condition, and its location are some of the biggest factors, but one of the most important and most overlooked, according to real estate professional Roxanne DeBerry, is the price that people are willing to pay. If there’s high demand for a given area, prices may rise above the “real” value of the properties, but if demand is low, you may be able to get a good deal. Learn what makes a property valuable, and keep an eye out for prices that seem lower than what the property is actually worth. It’s an easy way to make more from your investment when it comes time to sell. •Choose the right location Of course, the location may matter more to you than the value of the deal you’re getting. According to Edward Lowe, your location should depend on what type of business you’re running. If you’re selling or working with a specific type of product, you’ll need to plant yourself in a location where that product is available. If you’re planning to partner with other businesses, you’ll need to be reasonably close to them. Otherwise, you’ll need to consider the accessibility of your location - both to employees and clients. • Choose the right size It may be tempting to get the biggest building you can afford, and there is some prestige that comes with that, but overbuying can be dangerous. If you don’t fill the space efficiently or sublet to enough tenants, you could
easily lose money. On the other hand, buying a property that’s too small could cause growth issues, and force you to move within a year or two—which is equally demanding of your time and money.

• Know the best way to finance You’ll have a few options for financing you purchase. The Introduction of the Community Schemes Ombud Services. The introduction of the Community Schemes Ombud services (“CSOS”) and the promulgation of the Sectional Titles Scheme Management Act of 2011 (SMA) and the regulations allied thereto, which govern the management of schemes, have brought about a few uncertainties (to put it mildly) since coming into operation on the 7 of October 2016. In order to clear up the uncertainty regarding the payment of levies to CSOS and which rules will govern a scheme since the coming into operation of the SMA the ombud has issued Practice Directive No:1 of 2017 and Circular no 1 of 2017 respectively in an attempt to clarify these two thorny issues. In keeping with our long standing mission statement we have found it both necessary and useful to inform you about these new developments and to explain what impact these developments might have on your pocket and on the scheme you live in or manage.

How does one make payment? 1. The CSOS is listed as a Public Recipient with FNB and Capitec. The registration as Public Recipient with ABSA, Standard Bank, Nedbank and Investec is being finalised and should be done on or before 30 April 2017. The schemes that are banking with ABSA, Standard Bank, Nedbank or Investec should submit a request for the CSOS bank account to the following email address nathi.dube@csos.org.za. If there is a scheme banking with a banking institution not mentioned above, please forward the request for details of the CSOS ban account to the same email address. 2. Payment should be done through Electronic Funds Transfer (EFT or Internet Banking) or ATM deposit. Only under circumstances where it is impossible to pay through EFT may payment be done over-the-counter at the Bank. 3. Cash payment of levies or fees at the CSOS offices is not allowed. 4. When making payment it is imperative that the correct payment reference number or scheme registration number is quoted to ensure that payments are easily identified and correctly allocated to the schemes' account. 5. After the schemes have paid the levy, the schemes must e-mail proof of payment to levypayment@csos.org.za and a schedule detailing the amount paid by each unit. The reference number or schemes registration number must appear on all the documentation. The Payment Intervals of the CSOS levy
Payment Of Levies What is a CSOS levy and who is liable for payment of it? It is the levy payable by a unit owner calculated as prescribed by in terms of the Community Scheme Ombud Services Regulations: Levies and Fees, 2016. However in terms of Regulation 11 (1) of the Community Scheme Ombud Service Regulations, 2016, "every community scheme must pay the levy referred to in the Community Schemes Ombud Service Regulation: Levies and Fees on quarterly basis". The schemes have an obligation to pay to CSOS, the CSOS Levy irrespective of whether the unit owner has paid the Scheme Levy or not. In the event that, the unit owner has not paid, the scheme must use the normal debt collection mechanism to collect the levies from the defaulting unit owner. It is the responsibility of the Scheme to ensure that payment of the levies is received by CSOS. What is the current prescribed rate in terms of the Regulation?
Levies are payable to the CSOS on a quarterly basis on or before the dates mentioned hereunder: • 31 March • 31 June • 31 September • 31 December For the schemes where payment of the Scheme Levy is done annually, they can opt to pay the annual CSOS Levy in advance on 31 March. What constitutes a unit for the purposes of the CSOS levy? In a Sectional Title Scheme, a unit consists of a section and undivided share in the common property. A section is a part to which the owner has title. This could be a flat or townhouse.

Note - the CSOS regulations, which provide for the calculation of the levies due, whilst promulgated on the 7th of October 2016, only came into effect after a delay of 90 days. Accordingly liability to pay the levies shown in the schedule above, only commenced on the 6th of January 2017.
Within a Share Block Scheme, it is acknowledged that the members do not have ownership of the section but share in the use and enjoyment of the section jointly with other members, with such enjoyment calculated at a rate prescribed in the Use Agreement. A chalet/flat in the Share Block Scheme will constitute a section. As such the CSOS Levy will be calculated on the combined contribution towards section plus costs towards the maintenance of the common property (which combined makes a "Unit"). Furthermore, a communal housing scheme such as a mini sub development, where the common property is managed by a housing association, and owners within the scheme have access to such managed common property, is deemed a communal scheme for the purposes of CSOS . Is CSOS a VAT registered entity? CSOS is not registered as a VAT vendor and as such the CSOS Levy should
We endeavor to clear any uncertainty relating to this issue that you may still have with regard to which of rules are applicable to your scheme or the scheme you are managing by briefly summarizing the situation as follows: 1. The Minister of Human Settlements (the Minister) has made regulations prescribing Sectional Title management rules and conduct rules (which are now in place in terms of the SMA and the Regulations), and those new rules now super cede the old Annexure 8 and Annexure 9 management and conduct rules contained in the 1986 Sectional Titles Act 2. However, if a Body corporate made management or conduct rules which differ from the old 1986 Act management or conduct rules, and those amended rules were then filed in the Deeds Registry prior to the 7th of October 2016 then, to the extent that these rules are incompatible with the new SMA rules, these old rules still apply in conjunction with the SMA schedule 1 and Schedule 2 rules. 3. Section 10(2) states that the management rules can be substituted, amended or repealed by the developer or by unanimous resolution of the body corporate. The conduct rules can be substituted, amended or repealed by the developer or by special resolution of the body corporate. 4. The commencement of the substitution, amendment or repeal of a rule/rules comes into effect after approval by the Ombud (i.e. on the date of the issuing of a certificate as contemplated in section 10(5)(c)). 5. The substitution, amendment or repeal of a rule/rules must be reconcilable with the provisions of the prescribed management rules and conduct rules, the SMA, the Constitution of the Republic of South Africa, the Community Schemes Ombud Service Act, 2011 (Act No 9 of 2011), and any other applicable legislation and the relevant By Laws. The substitution, amendment or repeal of a rule/rules will not be approved by the Ombud, if the Ombud believes it is not reasonable and appropriate for the scheme. Has CSOS commenced its adjudication functions? CSOS had issued its first adjudication order on the 23 of January 2017.
