It is a special moment most people want to celebrate. However, before you can sit back and enjoy your new home, there are few things that you will need to do first, as well as adding a few personal touches. This is why each new homeowner should have a plan of action to get their home looking and feeling like their own personal space in no time at all.”

Here is a simple five-point action plan that will assist you to get their home into shape: Start with the practical issues first Start by making a list, prioritising the most important elements so that they can be addressed first. It is best to start with the practical easy repairs and upgrades, especially those that have an impact on day-to-day life. “A few subtle and cost-effective changes can instantly make the home better, such as fixing a leaking tap or replacing outdated fixtures. The Estate Agents Entitlement to Commission No estate agent has an automatic right to be paid commission on having sold a property. His right to commission is founded on contract. The agent is given a mandate by a seller to find a buyer for his property, or by a buyer, to find a property to purchase, and the party granting a mandate agrees to pay the agent a commission against his successful completion of a mandate. As they are the most commonly encountered, we will deal with seller’s mandates in this article. Classes of Mandates There are a number of ways in which a mandate may be given to an agent by a seller. 1. Implied The seller’s property is for sale, and the agent learns of this. He contacts the seller, introduces himself as an agent, and requests permission to show a prospective buyer the seller’s property. Should the seller agree, a mandate has been granted even though no specific request or authority to sell has been granted. 2. Oral and Open

identified. The mandate may have no automatic extension as an open mandate on expiry, and any continuing open mandate of the sole mandate expiry must be renegotiated. Further, the agent must state the marketing strategies he will employ to sell the property. The sole mandate must state clearly the commission to be paid, when the commission will be earned and when it will be paid, and the consequences to the seller if he breaches the sole mandate.

CASE 2 : A buyer viewed a property with Agent A, and loved it. After some deliberation, she and her husband concluded that the property was unaffordable. They advised Agent A that they were no longer looking for a new home. The purchasers mentioned, in passing, to Agent B that she had seen the original property with Agent A, but she and her husband had elected not to buy as it was unaffordable.

Irrespective of whichever mandate an agents holds he is not entitled to sue for the recovery of commission unless he is in possession of a Fidelity Fund Certificate valid for the period when the property was sold and the commission earned.

Agent C now arrived on the scene, and persuaded the owners of the property shown by A to the purchaser, to reduce their selling price, on condition that Agent C was given a sole mandate to sell.

Generally, in order to justify a claim for commission, agents who hold the mandate jointly with other agents, need to prove that their introduction of a willing and financially able purchaser was the real effective cause in having the sale concluded.

The owners phoned other agents to advise of the reduced price. One of the agents phoned was Agent B. Accordingly Agent B phoned the purchasers to spread the good news of a price reduction, and the purchaser then bought the property through B.

What follows are scenarios relating to the complexity of those competing commission claims.

The commission arising from the sale was shared between B & C by mutual arrangements. The original Agent A sued the seller for commission, alleging that it was his introduction that was the more effective cause in bringing the sale to frutation.

CASE 1 : An agent (A) introduced a potential purchaser to a property, which she and her husband liked very much. After consideration they concluded that the property was unaffordable, and all negotiations ceased. Months later, the purchaser and her husband received an unexpected cash windfall, which improved their financial position.

The Court found that Agents B & C were instrumental in concluding the sale, but their actions were not the main effective cause thereof. It was A’s introduction of the purchaser to the property which was the influential event. Agent B then, through the work of Agent C, learned of the reduction, in price and ultimately sold the property to the purchaser.

3. Sole Mandate

The purchaser elected to view possible suitable properties with another Agent B . In passing, she mentioned that she was interested in the property that Agent A had shown her , which at the time, was unaffordable. Agent B knew that this property was still for sale, and in due course, the purchaser purchased it through Agent B.

The Estate Agency Affairs Board, a Statutory Body, which regulates the Estate Agency Profession, has declared that any attempt to secure a sole mandate, granting an agent the sole right to sell a Property, must contain the following distinct characteristics :-

Agent A argued that it was his original introduction of the property to the purchaser that had induced in her the desire to buy and claimed that his introduction was the effective cause, and that he should be paid the commission.

It must be in writing; it must contain a clear commencement date and a clear termination date; the authority of the person granting the mandate must be clear, and the property to be sold must be suitably

The mandate need not be in writing to be valid, and so an oral request for permission to sell the seller’s property does constitute a mandate, but never a sole mandate.

The sad ending to this sale was that the seller paid a double commission, the first to be shared between C & B and the second to be paid in full to A.
