It is clear that it is possible for a Trustee to purchase property from the Trust wherein he or she is a Trustee, however, the process should be carefully considered by taking into account the facts set out herein. Should you, as a Trustee, wish to purchase Trust property, engage honestly with the other Trustees and the beneficiaries of the Trust and follow the mitigation steps mentioned above.
