WOMEN AND PROPERTY OWNERSHIP Women all over the world and more specifically in Africa contribute immensely to farm labour food processing, storage and transport. Yet women often lack rights to land. Women continue to experience discrimination in accessing land tenure rights in traditional areas, and suffer from a lack of standing and influence in traditional councils with respect to land issues. Land rights tend to be held by men and or kinship groups controlled by men and women mainly gain access through a male relative (e.g. Father and or husband). Such limited access is tenuous and can be easily lost and as such African women remain vulnerable. Women's rights to equality and their property rights have been protected by the Constitution Act 108 of 1996 (the "Constitution") since 1996, yet many women continue to face obstacles, both social and legal, to accessing and using property.

Women under customary law were considered to be perpetual minors and could not own any property without assistance of a husband or father. All women are now regarded as adults in the eyes of the Law. Section 6 of the Recognition of Customary Marriages Act 120 of 1998 explicitly confers equal status on women married in terms of customary law. This means that adult women may acquire and dispose of property.

What needs to be done?

What is the rule of primogeniture? The rule of primogeniture meant that the estate would bypass the wife and female descendants and go to the male heirs. Women left destitute and without property. The Bhe case successfully challenged this rule.

In community of property: The Engelbrecht case reads in part as follows: "Joint ownership of another's property is a right which each of the spouses acquires on concluding a marriage in community of property. Unless the parties (either before or during the marriage) make precisely equal contributions the one that contributed less shall on dissolution of the marriage be benefited above the other if forfeiture is not ordered. This is the inevitable consequence of the parties’ matrimonial regime. The Legislature does not give the greater contributor the opportunity to complain about this. He can only complain if the benefit was unduly granted." This regime ensures that women have access to their half share of the joint estate in the case of dissolution of a marriage.

Out of community of Property: A couple may elect to exclude any assets (by entering into an Antenuptial Contract) that they don’t want forming part of the joint estate. This grants women security of Women’s Property Rights on the dissolution of a marriage have not property in the case where she elects to exclude any property yet received much attention and have tended to be ignored to their obtained before entering into the marriage. This Regime challenges detriment. Where legal advice is available it tends to focus on the position of the Children and arrangements for their futures. Litigation is cultural norms by liberating women and making women completely equal to men in terms of Property ownership and control of personal expensive and poor women are generally not able to secure their finances. Do women have secure property rights?

means that during the marriage, each spouse controls their own assets, and is responsible for their own debts. On the dissolution of the estate, by death or divorce, the value of each spouse’s assets obtained during the marriage is calculated, and the spouse whose estate has grown less than the other’s estate during marriage will get half the difference between the growths in their respective estates.

Land titles: the western development promoted to overcome the shortcomings of customary law. This policy helps to ensure that women secure their legal rights to properties. Legal institutions responsible for instituting land laws need to operate equitably, be friendly to women and extend their reach to rural areas. UN agencies such as the UN Women and UN Development fund are working with non-governmental organisations to raise awareness among women of their rights and to support efforts to entrench equality of access in National Laws. The UN Women’s Africa programme for rural women has several pillars through which women’s role in agricultural transformation can be enhanced. It considers equitable land allocation as critical to such a transformation. Although much work still needs to be done in the encouragement of women in land ownership we must however celebrate the development of our law concerning Women Equality post 1994.
