Budget speech signals opportunity for first-time home buyers… Property buyers and sellers alike should be delighted with the Finance Minister's recent announcement that the Transfer Duty threshold on home purchases is to be raised from R750 000 to R900 000.

Consumers across the board are breathing a sigh of relief at the fact that there was no increase in VAT announced in the Budget, and no general increase in income tax.

"This will reduce the transaction costs for buyers at this level by about R15 000 to R20 000, and will benefit first-time entrants to the market who do not have equity in an existing home that they can use as a deposit, but must instead save up 10% to 15% of the purchase price, plus the transaction costs, in order to qualify for home loans," says Shaun Rademeyer of BetterLife Home Loans

The Minister's decision to focus the overall Budget on promoting growth, boosting confidence and attracting investment in order to ensure enterprise development and job creation is a brave move that will also have a positive effect on the property market in the medium to longer-term. People buy property when they have confidence in the country and when they are employed and there will no doubt be more people entering the market if these measures come to fruition.

"We expect to see a significant increase in home loan applications from first-time buyers as a result of this change, which is clearly part of a new government focus on trying to promote home ownership as the basis of personal wealth creation and one of the cornerstones of a more inclusive economy." Samuel Seeff, chairman of Seeff Properties, concurs: “The raising of the threshold for transfer duty exemption from R750,000 to R900,000, effective from 1 March, is the most positive and welcome outcome. It will certainly enable more first-time home buyers to get onto the property ladder.”

"Household budgets are of course still under pressure from higher food, electricity and water costs, and they are going to feel the pinch of higher transport costs when the fuel levy and the road accident fund levy are increased in April. But most will at least not have to pay higher taxes this year - and if interest rates stay as they are, this may give people a real opportunity to start reducing their debts and increasing their savings."

"Home seekers obviously also prefer to buy in places where they have access to water, reliable power supplies, clean roads, good public transport and fast internet connections, and the allocations announced in the budget to significantly improve municipal management capacities and improve our urban environments are also very welcome." Says Rademeyer.

IDENTITY THEFT

Identity theft is a very serious crime and very much a reality. The term “identity theft” refers to the act of obtaining another person’s personal information with or without their permission and then using it for illegal purposes. These may include obtaining another’s personal data for purposes of obtaining credit or other services by means of fraud or deception most often for economic gain.

Identity theft is that type of crime which not only includes the identity thief running up debts in your name but may also include cases where a person provides police officials with incorrect information thereby resulting in the person whose identity has been stolen having a criminal record for a crime not only that he or she did not commit but which they did not know of.

Shoulder surfing?? Yes it exists, you have probably come across it but just did not know it. Shoulder-surfing as the name suggests is where the imposter/thief simply aligns himself next to you or within distance (think of when you are standing in a queue at Home Affairs/Motor licensing offices) just enough to allow him to get a glimpse as you fill out personal information on a form or even listening in to your telephone conversations as you give out your personal or credit card details What If I Am A Victim Of Identity Theft? If you suspect that you are a victim of identity theft - The South African Fraud Prevention Service (SAFPS) is a unique South African-bred service which is committed to combating fraud in society by protecting consumers against impersonation and identity theft. The SAFPS provides shared fraud data services to all South Africa's major banks as well as many retailers, asset finance organisations and micro-lenders. If you happen to realise that your personal data has been stolen, you firstly have to report the case to the Police and obtain a case number. Once you have a case number, you can register your identity or passport number with the SAFPS. The SAFPS will then circulate your details to all major banks and retailers to try and stop the criminal usage of your identity.

There are two types of identity thefts, namely ‘true name” identity theft and “Account takeover”.

Procedures In Place for the Protection Against Identity Theft and Similar Crimes

True name identity theft entails a situation where the identity thief makes use of your personal information to obtain benefits such as cell phone contracts, store card accounts, writing up and cashing cheques as well as open new bank accounts.

We now have a Personal Data Protection Act (Act 4 of 2013) in South Africa which will bring many changes in our attitudes, behaviour and responsibilities. It also emphasises the rights of privacy as far as children are concerned which is something we have generally been rathercavalier about so far. It is not yet in full operation but it is anticipated that it should be fully operational during this year (2017).

Account takeover is where the identity thief uses personal information for the purposes of gaining access to existing accounts whereby he changes theaddress (be it mail or other communication) associated with such account to prevent the victim from receiving notification and allowing the thief to then run up huge amounts of debts way before the victim of theidentity theft becomes aware. Ways of Obtaining Personal information Dumpster Diving?? Although one might think that it is the loss of personal interaction (which has been taken over by internet transactions) that makes us vulnerable to identity theft and similar crimes, however, it is more likely that identity thieves will make use of rather ‘old-fashioned’ means of obtaining another persons’ personal information, such as

The Protection of Personal Information Act will allow you to ask once a year to see information held about you and get it corrected if it is wrong.

Any person, organisation or entity holding your personal information must use it fairly meaning only for the purposes that you gave it with your traceable consent after being told it was required and how it would be used, keep it secure, make sure the information is accurate and keep it up to date. It must also be securely disposed of when there is no longer any need for its retention that is, its purpose is completed. The Act will also give you the right to stop your personal information being used for unwanted marketing.You will also have to specifically and traceably opt in before any marketing use can be made of any of your personal information. It will not be legal for any marketer to approach you on the basis that you can opt out if you do not want to receive any further communication from that marketer. An example would be when you receive an SMS offering some deal and you are told to "opt out" by texting the word "no". Not only will this be illegal but you should also never respond to such messages as you are confirming that your contact details are “live” and they could then be sold to spammers. Therefore, we should be very wary about how, where and when we give our personal information because with enough identifying informationabout a person, an identity thief can commit a wide range of crimes using another persons’ identity.
