Women in the South African property market. The past decade has seen a significant increase in the number of women buyers in the South African property market. According to a report by FNB, women in property are catching up to men in all aspects of home ownership, including investing, with figures showing single women making up an estimated 10.3% of buyers‚ while single male buyers topping out at 7.0%. Whether through being employed in more managerial positions or owning their own businesses, South African women are making use of their money wisely. Mike Greeff, CEO of Greeff Christie’s International Real Estate says, “We have seen a steady increase of women in the property market over the past ten years. This is encouraging as the property market is an excellent place to invest one’s money. I would encourage all women to consider property as an investment and as a wonderful way to diversify your investments.”
Ultimately, the statistics available point to the fact that women are playing an increasingly important role in the property market. Women are choosing to establish themselves in their careers and as a part of that process they would be building up a wealth portfolio including investment property and, in some instances, diversifying their property by investing in different types, sizes and property locations. South African female realtors who are doubtful of their position in this industry should take inspiration from the late Pam Golding. The results of a recent South African census show that even though the average South African household is still headed by a man, the number of female breadwinners is on the increase and is currently at 16%. Stats SA recorded the number of households headed by single women at about 14%. Female buyers, especially single or single mothers, place security very high on the list of priorities when purchasing property. Security estates or sectional title units prove to be the most popular choice as they tend to have sufficient security including high walls, security gates, electric fences and more often than not an alarm system that is linked to a reputable armed-response company or the on-site security. Another factor that women buyers take very seriously is home maintenance and the need to avoid any unnecessary complications in that regard. With this being said, most women buyers tend to buy new homes or homes in very good condition. As with most other demographics, they also pay special regard to homes that are eco-friendly and feature smart design.
She became an inspiration to women across generations throughout South Africa and was held in high regard by her peers, the property industry and the business sector at large.

Choose your training service provider wisely. Every industry has its rogue agents. In the training world these rogues are called fly-by-night colleges and, just like rogue agents, they capture a bigger share of the market than they should because they are cheaper, but there are many risks to the consumer in dealing with them.

One way that rogue training providers claim they can offer lower cost qualifications is by offering recognition of prior learning (RPL) instead of training. RPL is an accepted process that is typically aimed at people who have been working for a while and who have learnt everything about a topic on-the-job. offering a new intern the option of completing their qualification through RPL as a sole methodology. It’s exactly the same as the rogue estate agent offering discounted commission structures to your client to win their sole mandate. Why is it wrong? Well because the qualification is complex and even agents with a lot of experience have battled with RPL in the past. Typically, agents do not do get exposed to all of the content in the National FET Certificate: Real Estate. For example, theoretical concepts such as business planning, economic market analysis, self-development strategies and code of conduct theories are not typically learnt on the job as an agent. So, if experienced agents battled with RPL, why does anyone think it is a good idea for new interns? The truth is that no one really does. They just see the price of R2500 for a full qualification through a rogue provider vs R18 000 for the same qualification through a provider who is properly accredited and doing the right things – and they go with the cheapest. And yet we all know that quality has a price and that cheapest is rarely the best choice. This “buy-cheap” strategy is risky. The Services SETA (who quality assures both providers and assessment outcomes) is being regularly alerted to these dishonest RPL practices and they are developing a policy to judge the providers against. The SETA is not afraid to take action against rogue training providers, just ask the agents who studied through providers who charged cheap but were de-accredited. Thousands of agents and principals have paid money to these rogue providers in the past, done all the work, not been certificated and
they had to pay a new provider and start again. The same is about to happen again soon with the rogue providers offering RPL to interns who are clearly not RPL candidates. How can you avoid being scammed: Check the providers DHET certificate (it must list the qualification you are paying for) or they must at least be able to prove that they have applied for registration; Check the Services SETA accreditation letter (it must list the qualification you are paying for) and if you are doing RPL the letter must state that the provider is accredited to offer the qualification through RPL; If you are being sold RPL, ask them to do a pre-assessment with you to see if you are really an RPL candidate; Remember that the SETA itself has set a rack rate of R18 000 for the training of a full qualification. Ask yourself – what corners are the provider cutting to be able to offer this so much cheaper than the SETA’s own rack rate. Bottomline – RPL is for experienced agents. RPL is not for new interns. Partial RPL and partial training may well be a solution for interns with some work experience but they will not find it easy. Choose your training service provider wisely. How to cancel a residential lease? PART 2

A continuation to article published 28 July 2018, “How to cancel a residential lease?” we are all now aware of the various Notice Periods, Acts and Laws that withhold a lease. This week’s continuation of the article highlights the 3 most important questions that will arise when you endeavour to cancel a residential lease. Several difficult questions arise;
1. If your lease says 7 days’ breach notice is required, but the Consumer Protection Act says 20 business days’ written notice is required to cancel the lease, how do we reconcile the two? 2. Is it still possible to cancel a lease after the ‘third strike’ (ie third breach) by a tenant, without giving further notice, as many leases provide for, in light of the Consumer Protection Act? 3. If a lease agreement (either oral or in writing) does not specify the early termination period, does the Consumer Protection Act ‘kick in’ and result in a situation where the lease is not prematurely terminable by a landlord at all, and is only terminable on a breach by the tenant?
#1: Breach notice period and cancellation period
Firstly, look to the provisions of the lease itself. Most leases contain a breach clause, which indicate a period of a number of days that are necessary to be given as notice to the tenant of a breach. If there is no breach period specified, it will be a ‘reasonable period’ in terms of the common law. If you give notice of the breach, and it is not remedied in the breach notice period, this means that you can take action to sue for whatever is owed or even issue summons and attach the tenant’s goods by evoking your landlord’s hypothec, but you cannot cancel the lease and evict. The reason for this is that you need to have given 20 business days written notice to cancel the lease (and therefore to evict, because you can’t evict without
having cancelled the lease) in terms of the Consumer Protection Act. So if you ultimately think that you would like to or need to cancel the lease and evict, you can only do this after 20 business days’ written notice has been given – during which time the tenant has failed to remedy the breach. Many landlords. include both time periods in their breach notice, saying that if the breach is not remedied in 7 calendar days (or whatever number of days is stipulated in the lease, or whatever number of days is reasonable in terms of common law) then they will take action to recover amounts owing; but if the breach is not remedied in 20 business days, then the lease will be cancelled and the tenant evicted. This way you give one notice, but it is valid for both time periods and the tenant is adequately warned of the consequences of non-compliance, as well as how and when he needs to remedy the breach to avoid those consequences.
#2: How To Cancel A Residential Lease
These are clauses in a lease that provide that once a tenant has breached the lease (usually with specific reference to late payment) three times, the landlord is entitled to cancel the lease without further notice to the tenant. In instances such as these, the landlord would not give the tenant a third opportunity to remedy the breach, but would simply send a cancellation letter. However, it is questionable whether this is legally permissible in light of the Consumer Protection Act, which provides that the landlord may only cancel the lease on 20 business days’ written notice, and after the tenant has failed to remedy the breach. It thus seems that these ‘third strike’ clauses are no longer legally valid. In the author’s view, this is a grave injustice to landlords, because it means that they are forever doomed to accept late payments and other breaches of the lease by their tenants. Provided that the tenant remedies the breach with the 20 business days’ notice period, the landlord will not be entitled to cancel. The only way to get rid of a pesky tenant in such a situation would be to allow the lease to run its full course and ensure cancellation without further renewal.
#3: Is there an early termination period if the lease does not specify, and what is it?
If the parties have agreed that there is an early termination period applicable and they have agreed on what that notice period is, then either party can cancel by providing the requisite notice to the other side. This will apply as long as the
lease is not one affected by the provisions of the Rental Housing Act – ie. where the written lease expired and the parties simply continued with the lease on a month to month basis thereafter. If the lease is a month to month lease as contemplated in the Rental Housing Act, then it can only be terminated by either party by providing one full calendar month’s written notice. If the parties did not contemplate at all that early termination would be permissible, then it is not an option – other than as provided for in clause 3.2 above, which is more a refusal to renew the lease again than an early termination of the lease. If the parties have agreed that there is an early termination period applicable but they have not agreed what that notice period is, then the common law will kick in and one full calendar months’ notice should suffice – provided that this is ‘reasonable’ in the circumstances. In some instances, however, the Consumer Protection Act will be applicable – which means that if there is an early termination clause providing for termination by agreement where the tenant has not breached the lease agreement, the landlord will be precluded from giving such notice by virtue of section 14 of the Consumer Protection Act, which stipulates that fixed term agreements can only be cancelled on 20 business days’ written notice where the tenant has actually breached the lease agreement and where the breach has not been remedied. However, it appears that this will only apply where the Consumer Protection Act is more beneficial to the consumer than the other laws that apply to the same scenario. This is because the Consumer Protection Act expressly provides that where there is a conflict with its provisions and any other law, the law that is the most beneficial to the consumer will apply. The authors are of the view that this is an unreasonable situation for the legislature to have created for the property industry as it creates massive uncertainty as to when early termination clauses will be upheld, because what is beneficial to the consumer in one instance may be prejudicial to the consumer in another. Hopefully, our courts will give us guidance on how to navigate this mess soon – but until then, take care when relying on early termination clauses as they may be invalidated by the Consumer Protection Act.
