Believe it or not, the South African property sector is valued at R5.8 trillion, according to the latest Property Sector Charter Council’s (PSCC) report — aimed to determine the size of the country’s property sector. This study, builds on baseline research that measured the size of the property market in SA at a massive R4.9 trillion at the end of 2010. It shows a meaningful increase of nearly R1 trillion in four years. The Council reviewed market size estimation that provides a snapshot of the South African Property Sector using figures from the financial year 2014/2015. The report comes to clarify the parameters of the PSCC whose property charter was gazetted in June 2012. The charter seeks to ensure participation of black people to the tune of 25% of the total value associated with the property industry within the next few years. It reveals the property sector’s size at R5.3 trillion with a further R520 billion land officially zoned for commercial and residential development. Commercial Property carries a value of around R1.3 trillion, up from some R780 billion, with almost R790 billion held by corporates, R300 billion held by REITs, R130 billion by unlisted funds, and R50 billion by life and pension funds. Of this, retail property has the highest value at R534 billion (R340 billion in 2012) followed by office properties at R357 billion (R228 billion) and industrial properties at R281 billion (R187 billion). Hotels and other property accounted for R94 billion in value (R25 billion).

The public sector contributed a total of R237 billion, of which around R102 billion is estimated to be in the hands of the Department of Public Works, R66 billion held by SA’s 19 largest state-owned enterprises, and R69 billion owned by metros and selected local municipalities. The research is part of a larger project by the council, which provides a point of departure against which various transformation charter imperatives can be assessed. CEO of the Property Sector Charter Council, Portia Tau-Sekati says: “For a sector this big and this important it is crucial to have a hub of knowledge that consolidates information to support a common and consistent understanding of the sector.” Tau-Sekati explains that by regularly updating this research the council also creates a measure of the effect of property cycles on the sector’s value, which can be significant. The report was compiled by MSCI for the Property Sector Charter Council (PSCC). It remains the first and only research of its kind in the country. Its significance is far reaching. The study also supplements PSCC's SA Property Sector Economic Impact Report that estimates the property sector’s contribution to GDP at a significant R191.4 billion in 2012 in terms of annual income and expenditure flows generated by the sector and a R46.5 billion contribution to the fiscus.

Commonly used in commercial rental agreements, fair wear and tear is a phrase essential to understand in the context of a commercial lease.

â&#x20AC;&#x153;Perhaps the most helpful thing to understand is how this term is defined and its distinction to the damage of a property,â&#x20AC;? says Leon Breytenbach, national manager of the Rawson Property Groupâ&#x20AC;&#x2122;s commercial division.
Damage to property
Fair wear and tear The term fair wear and tear refers to deterioration in the condition of the property, caused by normal, everyday usage during the period of the lease. This accepted norm will differ depending on the type of business which is carried out at the premises. For example, an office employing a small clerical staff will have less impact on the flooring than a retail business with hundreds of customers walking through the premises. Weathering caused by natural elements would also be considered as fair wear and tear. â&#x20AC;&#x153;A property which is not newly built or recently refurbished, will have some level of deterioration of condition when leased,â&#x20AC;? Breytenbach states, â&#x20AC;&#x153;thus

â&#x20AC;&#x153;In contrast to fair wear and tear, damage to property is any deterioration outside the definition provided and can also be defined as negligent or accidental destruction to the property,â&#x20AC;? states Breytenbach. This might be a carpet ripped while desks were being moved, or stains which cannot be removed despite professional cleaning. Nails hammered into walls in order to hang pictures may also be unacceptable, while painting the walls a different colour, without the ownerâ&#x20AC;&#x2122;s consent, would certainly require the tenant to make good the situation or forfeit a portion of the deposit in order to return the property to its original state.
Cleaning the property It is accepted that the tenant should keep the property clean and in good condition during the lease period, but at the end of the lease the property should be handed over in the same state in which it
was received, allowing for fair wear and tear. â&#x20AC;&#x153;The cost for cleaning should fall to the tenant,â&#x20AC;? explains Breytenbach, â&#x20AC;&#x153;but if the tenant fails to comply, then the landlord is within his right to use whatever portion of the deposit to restore the premises to an acceptable level of cleanliness.â&#x20AC;?
Preventing disputes In order to avoid possible dissention between the landlord and the tenant, Breytenbach offers a couple of suggestions: â&#x20AC;&#x153;It is essential that you insist on an in-going inspection of the premises so as to ensure that both parties are fully aware of its condition. It is also advisable to take photographs of any area which may later come into dispute, as these pictures may be the clinching proof in settling a dispute at a later date. Discuss the primary use for which the property is required as well as the most likely wear and tear which may be anticipated, before drawing up the lease. Make sure that the lease stipulates which party will be responsible for what maintenance or repair.â&#x20AC;? Similarly, an out-going inspection provides both the landlord and the tenant with complete assurance that the condition of the property is of an acceptable standard.
PPI : New Obligations For Sectional Titles Scheme Owners, Trustees, Managing Agents And Others
The Protection of Personal Information Act 4 of 2013 (“PPI”) gives effect to the constitutional right to privacy whilstalso advancing the right of access to information which will both become areas of major focus in 2017 and beyond.The right of privacy for personal information has just been a major issue in the Constitutional Court case involving the State Social Services Agency
For sectional title schemes, PPI will mean that the body corporate must not intrude on any owner’s privacy to an unreasonable extent. All information must be collected for a specific, defined and legitimate purpose and it cannot be further processed for a different purpose.

The body corporate must maintain information quality so anything retained must be accurate , complete and not misleading and must be updated where necessary. Furthermore, the body corporate must have appropriate technical and organisational security safeguards for the information so it has significantly increased information security requirements apart from information quality requirements.
and there will be many more such cases. We now have an Information Regulator (www.justice.gov.za/inforeg/index.html)in place who is currently preparing for the full implementation of the Act and will be issuing applicable regulations during this year. The Regulator is currently hoping that the Act will be able to be brought into full operation from the end of this year. Once the Act comes fully into force there will be one year’s grace period to become compliant with the requirements for processing of personal information and it will have a very wide impact on people and entities such as sectional title schemes. The Act will affect the access to and processing of information in sectional title schemes. The body corporate, trustees and managing agent have the responsibility in terms of various provisions in the Sectional Titles Act to lawfully process owners’ personal information, thus making them the “responsible party/ies” and the owners, tenants, employees, contractors and so on to whom the personal information will relate, will be the “data subject/s.” “Personal information” including ” special personal information” arebroadly defined in section 1 of the Act and include information relating to race, gender, pregnancy, marital status, sexual orientation, age, physical or mental health, religion, language, education, financial history, e-mail address, physical address, telephone number, location information, online identifiers of any sort , personal opinions, views or preferences, confidential correspondence, views or opinions of another individual about the person, and the name of the person if it appears with other personal information.
This imposes significant information management and control burdens on bodies corporateand also those they contract with or employ so any of those persons or organisations will also need to have service level agreements with the body corporate to ensure personal information is correctly managed and is not shared with others not entitled to access it.
Any person providing personal information must know why the personal information is obtained and kept and must also be able to amend or correct it if necessary. Once the Act comes into force trustees, on behalf of bodies corporate, will have continually to consider what data they keep, how it is stored, secured, used and made available to others as well as take sensible precautions against it being used or accessed by unauthorised persons or organisations. Section 32 of the Constitution of the Republic of South Africa, 1996 (subsequently supplemented by the Promotion of Access of Information Act 2 of 2000) guarantees the making available of information and the Information Regulator will also administer and regulate the Promotion of Access to Information Act (“PAIA”) . The general principle of PAIA is that a person is entitled to be furnished with all available information that affects his,her or its interests in a specific situation so it will also be important for sectional title schemes to have an Information Manual which classifies information held and its accessibility or otherwise to any others aa well as a specific Information Officer who will deal with such matters. It is not possible to be prescriptive about the various possible areas in which the Protection of Personal Information Act will affect schemes but it is necessary for trustees and managing
agents for all schemes to immediately educate themselves, employees and owners about the enhanced duty of safeguarding personal information that will now potentially attract serious penalties if it is breached. At the least, breaches of personal information security will have serious reputational damage issues and it will also be obligatory to report any such breaches which is a very great change from the current position so complacency is not an option. The processes involved in the acquisition ,retention and disposal of personal information need to be carefully reviewed to be sure they comply with the eight PPI principles and all involved in the processes must be aware of their responsibilities so there will need to be an education process. Any information gathered must be necessary and not superfluous so it will be necessary, amongst other things, to review any existing collection of number plate and licence details at gates and to be very sure that such details can be justifiably collected as well as how and by whom they are collected and also accessed at any time. This will extend to control of the retention and further use of any records by security companies and others so service level agreements will also need to be reviewed or possibly even implemented for the first time. It is not possible to give an exhaustive list of information that needs to be reviewedand protected for every scheme but trustees should also at least look at protection of information such as owners’ notices of absence on vacation ,leases and lessees’ details , sale agreements submitted ,owners’ tax and banking details as well as levy account details and should prevent unprotected access to details such as e mail addresses and cell phone numbers which are literally gold dust for spammers and sales people as well as those with criminal intent . The protection of personal information extends throughout its lifetime so secure and definite destruction of such information is also necessary so “dumpster diving” of discarded or obsolete records must not be possible at any time.
