The African Methodist Episcopal Church today seeks to set the record straight on a statement that is misinformation at best and a lie at worst. A July 1, 2012 story posted on the “Charisma News” website and Facebook page reported that the AME Church was threatening to withdraw support from President Barack Obama because of his stance on same sex marriage and that the AME Church was partnering with an organization called The Coalition of African American Pastors. According to Bishop Samuel L. Green, Sr., President of the AME Church Council of Bishops, “As a denomination, we do not endorse candidates for any political office. As such, we cannot ‘withdraw’ support from President Obama because we cannot endorse any candidate for political office and did not endorse the President. No organization has been authorized to speak for the AME Church.” Bishop Carolyn Tyler Guidry, Chairperson of the AME Church’s Commission on Social Action said, “Contrary to the report, neither the AME Church nor its leadership is involved with or partnering with the Coalition of AfricanAmerican Pastors.” We also condemn those who attached the good name of the African Methodist Episcopal Church to an effort to sow discord and misinforma-
tion. The story in Charisma News bore a sad and striking resemblance to other stories that either stretch or totally abandon the truth in an effort to divide and conquer the African American community. As a denomination born in the struggle for equality, we condemn any effort to discourage voters or to lead voters astray through misinformation. The AME Church Social Action Commission will instead continue to encourage all citizens, and especially those touched by our churches, to register and exercise their right to vote. “We call upon Charisma News and those who furnished this erroneous story to their website to immediately rescind the story. Should that not be done, we will immediately seek possible remedies to correct the situation,” said Bishop T. Larry Kirkland, Sr., President of the General Board of the AME Church. In the Episcopal Address to the worldwide church, the Bishops of the Church said, “We call upon each of our congregants to become registered and vote on election day...and urge all of our churches to conduct voter registration drives”. Bishop John R. Bryant, Senior Bishop of the AME Church, said, “We shall continue to advocate for the well being of all humankind, so that they can freely hear the liberating Gospel of Jesus the Christ.”

LOS ANGELES (AP) — Rodney King was remembered in Los Angeles on Saturday as a forgiving man who bore the scars of his infamous beating with dignity. The Rev. Al Sharpton, who delivered the eulogy at Forest Lawn Hollywood Hills, said before the funeral that King never showed bitterness to the officers who beat him. “People should not be judged by the mistakes that they make, but by how they rise above them,” Sharpton said outside the Hall of Freedom at the sprawling cemetery grounds. “Rodney had risen above his mistakes. He never mocked anyone — not the police, not the justice system, not anyone.” “He became a symbol of forgiveness,” Sharpton said. The funeral came nearly two weeks after King was found dead at the bottom of the swimming pool at his Rialto, Calif. home on June 17. He was 47. Family members held a private service early in the day, followed by a public memorial and burial. Mourners signed a guest book and surveyed newspaper clippings from the days when King dominated headlines in 1991 and 1992. A large photograph of a smiling King was set on an easel. Daughter Laura Dene King, 28, said she was proud to have had her father in her life for as long as she did, especially considering she almost lost him when she was six years old. “I will remember his smile, his unconditional love,” she said. Several donors helped pay for the funeral, the reception afterwards, and other arrangements. Television producer Anthony Zuiker donated $10,000, and said he was at the funeral to show support for King’s family. “We lost a symbol, but they lost a loved one,” said Zuiker, creator of the CSI: series. Lawrence Spagnola, who coauthored King’s 2012 book “The Riot Within: My Journey from Rebellion to Redemption,” sat with family members at both services. The family can be proud of the “amazing degree of grace and wisdom” with which King carried himself after being violently thrust into the media spotlight, Spagnola said. King’s death is being treated as an accidental drowning but authorities are awaiting autopsy results to determine the official cause of death. He became famous after his beating by Los Angeles police in 1991 was captured on videotape and broadcast worldwide, as were photos of his bloodied and bruised face. The images of the grainy video became a national symbol of police brutality. It was played over and over for the following year, inflaming racial tensions across the country. More than a year later, four officers charged with felony assault in the beating were acquitted by a jury with no black members. The verdict sparked one of the most costly and deadly race riots in U.S. history. During the unrest, which left more than 50 people dead and caused more than $1 billion in property damage, King famously pleaded for peace by asking, “Can we all get along?” See RODNEY KING, page 10

BY LARRY MARGASAK AND PETE YOST | ASSOCIATED PRESS WASHINGTON (AP) — The Justice Department declared Friday that Attorney General Eric Holder’s decision to withhold information about a bungled gun-tracking operation from Congress does not constitute a crime and he won’t be prosecuted for contempt of Congress. The House voted Thursday afternoon to find Holder in criminal and civil contempt for refusing to turn over the documents. President Barack Obama invoked his executive privilege authority and ordered Holder not to turn over materials about executive branch deliberations and internal recommendations. In a letter to House Speaker John Boehner, the department said that it will not bring the congressional contempt citation against Holder to a federal grand jury and that it will take no other action to prosecute the attorney general. Dated Thursday, the letter was released Friday. Deputy Attorney General James Cole said the decision is in line with long-standing Justice Department practice across administrations of both political parties. “We will not prosecute an executive branch official under the contempt of Congress statute for withholding subpoenaed documents pursuant to a presidential assertion of executive privilege,” Cole wrote. In its letter, the department relied
in large part on a Justice Department legal opinion crafted during Republican Ronald Reagan’s presidency. Frederick Hill, the spokesman for Rep. Darrell Issa, said it is regrettable that “the political leadership of the Justice Department” is taking that position. Issa, the House Oversight and Government Reform Committee chairman, is leading the effort to get the material related to Operation Fast and Furious. Although the House voted Thursday to find Holder in criminal and civil contempt, Republicans probably are still a long way from obtaining documents they want for their inquiry into Operation Fast and Furious, a flawed gun-tracking investigation focused on Phoenix-area gun shops by Justice's Bureau of Alcohol, Tobacco, Firearms and Explosives. The criminal path is now closed and the civil route through the courts would not be resolved anytime soon. “This is pure politics,” White House spokesman Jay Carney said. “Remarkably the chairman of the committee involved here has asserted that he has no evidence that the attorney general knew of Operation Fast and Furious or did anything but take the right action when he learned of it. “No evidence, so if you have no evidence as he has stated now about the White House and the attorney general, what else could this be but politics?” More than 100 Democrats See ERIC HOLDER, page 15

The bills, which provide first of their kind protections for homeowners and reforms to the mortgage and foreclosure process, will now be sent to the desk of Governor Jerry Brown for consideration. The bills were approved 53 to 25 in the Assembly and 25 to 13 in the Senate. “Passing these key elements of

SACRAMENTO, Calif. (AP) — California Gov. Jerry Brown’s ambitious plan to start building the nation’s first dedicated high-speed rail line is set for a pivotal vote by the Legislature this week with some state lawmakers still skeptical about spending billions in the Central Valley. The Democratic governor is pushing lawmakers to authorize $2.7 billion in voter-approved state bonds for construction on the first 130-mile stretch of high-speed rail from Madera to Bakersfield. Brown has made the massive infrastructure project one of his priorities for the year and says the state has to act fast in order to capture billions of dollars in additional federal support. “Suck it in,” Brown told an audience gathered last month for the 75th anniversary of the Golden Gate Bridge. “We got to build, we got to do it right.” While Democratic leaders who control both houses of the Legislature support the bullet train, they concede that a legislative vote to authorize state bonds faces a tight vote, particularly in the Senate. Because Republicans oppose the project, at least 21 Democratic senators are needed to pass legislation on a simple majority vote. The project also faces GOP opposition in Congress. “We’ll see where it goes,” Senate President Pro Tem Darrell Steinberg of Sacramento said last week. Critics of high-speed rail say it's not clear where most of the construction funding will come from. They call the project too expensive and unnecessary. Recent polls show tepid support for a bullet train even though California voters authorized a total of $9 billion in what was intended to be the first round of bond financing back in 2008.

Thousands in Los Angeles unite in largest ever rally to stop “Walmartization” of L.A. jobs In the largest-ever protest against Walmart, thousands of Southland residents marched through L.A.’s Chinatown to call for an end to the “Walmartization” of L.A. Chinatown residents, community organizations, faith and labor leaders, musicians Tom Morello and Ben Harper, civil rights leader Dolores Huerta, US Congresswoman Judy Chu, L.A. Leader Maria Elena Durazo , L.A. LABOR LEADER MARIA ELENA DURAZO and union workers stood with Walmart associates and warehouse workers to call on the retailer to change the way it treats workers and communities. “Our demands are clear. Walmart must provide a living wage, quality health care, demonstrate respect for local communities, and uphold workers’ rights here and around the world,” said Joe Hansen, president of the United Food and Commercial Workers international union. Marchers passed through the streets of Chinatown as they made their way from Los Angeles State Historic Park (the Cornfield) to the intersection of
Broadway and Cesar Chavez Blvd. – the proposed site of a controversial new Walmart store. Speakers called on Walmart to stop its cycle of impoverishing communities and on city officials to reject Walmart’s proposal for a store in Chinatown. "We don’t want Walmart to destroy Chinatown and unique neighborhoods across L.A. and the United States just to make a few executives in the Walton family richer," said Tom Morello, guitarist with Rage Against the Machine. Morello, performing under his folk rock moniker The Nightwatchman, sang his popular “Union Song” and what he called the “uncensored version” of Woody Guthrie’s “This Land Is Your Land.” Fellow Grammy winner and singersongwriter Ben Harper showed up between touring gigs to play “We Can’t End this Way.” Harper, a downtown Los Angeles resident, spoke powerfully about how Walmart would negatively affect his community. In the run-up to the massive rally, local and national momentum continued

to build as thousands united to call on Walmart to improve its treatment of workers and communities. Grammy winner Steve Earle released a song urging Angelenos to come to today’s rally and all three major Los Angeles mayoral candidates – City Controller Wendy Greuel, City Councilmember Eric Garcetti and City Councilmember Jan
Perry – pledged their support for the rally and promised not to take money from Walmart. "For far too long corporations like Walmart have been getting special treatment, while middle-class families have been struggling in this tough economy and bearing the brunt of the tax burden. Let’s send a message that our city needs responsible development that builds our middle class and encourages the growth of a thriving small business sector,” said Greuel. New energy has been building for months as Walmart associates, warehouse workers and community supporters have denounced the retailer’s alleged Mexican bribery scandal and cover-up, labor violations at warehouses that move Walmart goods in Southern California and the company’s aggressive efforts to open a Chinatown store against the wishes of local residents. Controversy continues to swirl in Los Angeles around the proposed Chinatown Walmart and questions are growing about how the company may have manipulated the building approval process. Permits were approved with little oversight and public input in the dead of night—before the L.A. City Council
could vote on an ordinance that would have potentially impacted the chain’s ability to build a store in Chinatown. Poet laureate Natasha Trethewey working on memoir NEW YORK (AP) — The nation’s new poet laureate will be telling her own story, in prose. Natasha Trethewey is working on a memoir, currently untitled, that has been acquired by Ecco. The publisher, an imprint of HarperCollins, announced Monday that the book is scheduled to come out in 2014. The 46-year-old Trethewey is the daughter of a white father and black mother. The memoir will tell of her childhood in the American South in the 1970s and ’80s. Trethewey won the Pulitzer Prize in 2007 for her collection “Native Guard.” This fall, she begins a one-year term as U.S. poet laureate.

(AP) — Golden State Warriors coach Mark Jackson said Thursday that he and his family were the targets of an extortion
attempt related to an extramarital affair he had six years ago. The Smoking Gun reported that a 28-year-old former stripper, Alexis Adams, possessed nude photographs of Jackson and wanted money to keep the photos from becoming public. Adams and an alleged co-conspirator, 40-year-old Marcus Shaw, were named in felony criminal complaints for their alleged roles in an extortion scheme, according to online records filed with the U.S. District Court in Oakland. The documents don’t identify the victim but The Smoking Gun said “V1,” as the victim is referred to in documents, is Jackson. Adams was released on $25,000 bail but Shaw remained behind bars because he has a prior conviction for aggravated robbery in Tennessee in 1996, for which he was sentenced to 12 years in prison, according to court records. He also was arrested in Georgia in 2005 for investigation of murder, armed robbery, aggravated assault and kidnapping, “though the case was ultimately dismissed,” according to an affidavit filed in the case by FBI Special Agent Beth F. Alvarez. The public defender listed for both didn’t immediately respond to a voicemail or email seeking comment. In a statement released by the team, Jackson said the extramarital affair occurred when he was still working as an ESPN/ABC broadcaster. He called the affair “embarrassing” and apologized for the affair. Jackson said a man approached him this past April 3 at the team hotel

Jackson said he “regrettably” paid the man, calling it “a terrible lapse in judgment and a course of action I would not recommend to anyone.” Court documents show he handed over $5,000. After the man emailed him two weeks later and called his wife asking for more money, Jackson said, he informed the team about the situation. The Warriors said they immediately contacted the FBI. Jackson didn’t respond to an email from The Associated Press seeking further comment. In an email from Shaw dated May 3, he told Jackson he could get $185,000 “from another resource” if the coach didn’t pay, according to the court documents. Jackson worked with the FBI to record several phone calls and monitor emails. In response to Shaw’s second demand, according to the documents, “V1” wrote: “If I had known that was amount I would have offered to pay more the first time. I will give you $200,000 to keep this quiet. We can still work this out. I have the money. I do not want these pictures getting out.” The court documents also note several text messages between Shaw and Adams that outline the alleged extortion attempt. On the afternoon of April 3 before Jackson said he handed over money, Adams sent a text message to Shaw that read: “Concentrate and (expletive) him up. He is a Fake (expletive) man of god,” according to court documents. Jackson said he made his wife, Desiree, aware of the affair years ago and the two reconciled. Jackson, coming off a 23-43 record in his first season as a head coach, is also an ordained minister. He leads a non-denominational congregation with his wife in the Los Angeles suburb of Van Nuys. The couple has four children. “I recognize the extremely poor judgment that I used both in having an affair six years ago — including the embarrassing communication I exhibited during that time — and in attempting to deal with the extortion scheme at first by myself,” Jackson said in the statement. “I made some egregious errors. I apologize for any embarrassment I may have caused my family, friends and, of course, the Warriors. “At that time in my life, I was not pastoring. Three years ago, my wife and I established a ministry. With deepest regret, I want to apologize to my Church Family. I was wrong. We must live Holy.” The team also released a statement supporting Jackson but not condoning his affair. Jackson included a quote from the Bible in his written statement and asked for forgiveness for his actions. “What goes on in the dark,” it reads, “will come out in the light.”

ATHENS, Ga. (AP) — Georgia tailback Isaiah Crowell was dismissed from the team Friday by coach Mark Richt after the sophomore was arrested on felony weapons charges. Police found a gun in Crowell’s vehicle early Friday morning. Georgia announced the dismissal Friday afternoon. Richt’s short statement in the announcement did not mention Crowell. “We have a dedicated and committed group of men who are working hard to prepare for the coming season,” Richt said. “Our total focus will be directed toward the team and this effort.” Crowell was arrested at a vehicle checkpoint on the Georgia campus at around 2:20 a.m., according to AthensClarke Police Department spokeswoman Hilda Sorrow. Among the charges he faces are carrying a concealed weapon and possession of a weapon on school property. Crowell consented to a search after officers smelled marijuana in the vehicle. Police found a 9-millimeter Luger pistol under the driver’s seat with an altered serial number. Crowell was released on bond Friday afternoon. As a freshman in 2011, Crowell led Georgia with 850 yards rushing. Crowell, 19, came to UGA in 2011 as the top-rated running back prospect in the country out of Carver High School in Columbus, Ga. He announced he would attend Georgia by pulling out a bulldog puppy at signing day news conference.
He went on to win Southeastern Conference Freshman of the Year honors from The Associated Press. Crowell rushed for a career high 147 yards on 30 carries to help the Georgia beat Ole Miss 27-13 last season. He eclipsed the 100-yard rushing mark on four occasions, and scored six touchdowns. Despite his success, Crowell’s freshman season also included setbacks on the field and off. He and two of his teammates were suspended for one game and missed Georgia’s game against New Mexico State after they failed a drug test. In the SEC championship game, he struggled with 10 carries for 15 yards in a 42-10 loss to LSU. Richt said in March that he was impressed by Crowell’s work ethic in the offseason. Richt said at that time the running back is “definitely growing up.” Crowell’s exit will open the path for two highly rated newcomers to the team to play as freshmen. Tailbacks Keith Marshall of Raleigh, N.C. and Todd Gurley of Tarboro, N.C., were two of the top players in Richt’s 2012 signing class. Ken Malcome, Brandon Harton and fullback/tailback Richard Samuel are left as the top returning rushers. Marshall was third, behind Malcome and Crowell, on Georgia's tailback depth chart released after spring practice.

William’s agent, Mark Bartelstein, initially told The Associated Press the deal was finalized about 3:45 p.m. MDT Friday, and the Jazz and Clippers officially announced it in releases three hours later. The deal initially was believed to involve only three teams, but a fourth, the Houston Rockets, got involved after Thursday's draft. The Rockets received the rights to the Clippers' 53rd overall pick, Furkan Aldemir, and the Jazz sent the team’s trade exception to Dallas. The Mavs also received cash considerations from Houston. Williams must pass a physical but is expected to hold a news conference in Salt Lake City on Monday or Tuesday. The Jazz drafted Williams in 2003 but allowed him to leave after one season, a decision that general manager Kevin O’Connor said was the worst he ever made. Dallas faced a Friday deadline on a $2.4 million buyout of Odom’s $8.2 million option for next season. Williams’ decision to exercise his
$8.5 million player option cleared the way for the deal. “He’s really excited,” Bartelstein said. “This is where his career started. They’ve got a terrific young team. He thinks he can come in and bring real leadership. He’s excited about that. They made it clear how much they wanted him. They did a good job of recruiting him.” Williams played in 57 games as a rookie before going to Milwaukee. He eventually became a starter and was an All-Star as recently as 2009. Asked to recall the amount he let Williams leave Utah for, O’Connor on Thursday night shook his head and said, “It wasn’t that much.” Bartelstein, who has several other players on the team, found it hard to fault the Jazz. “Mo was a really young player at that time,” he said. “Kevin has wanted him back for a long time. EUGENE, Ore. (AP) — Jeneba Tarmoh conceded the final Olympic spot in the 100 meters rather than race against training partner Allyson Felix. Tarmoh notified USA Track and Field on Monday of her intention to withdraw. Her agent, Kimberly Holland, already made it known that Tarmoh would not participate in a runoff Monday night to settle a thirdplace tie at the U.S. track trials. In an email sent through her agent to USATF, Tarmoh said: “I understand that with this decision I am no longer running the 100m dash in the Olympic Games and will be an alternate for the event.” Tarmoh, who felt all along she had won the race on June 23, did not specify in her statement why she was giving up a chance to possibly run the 100 in London. USATF President Stephanie Hightower said the organization was "disappointed" Tarmoh had a change of heart. The runoff was scheduled to be shown in prime time on NBC in conjunction with the network’s coverage of the swimming trials. It would’ve been a boon for track. Now, it’s another blow for a sport that’s taken its fair share of late. The controversy in the 100 overshadowed the entire trials because USATF had no protocol in place to deal with a dead heat. And while top officials scrambled to draft a tiebreaking procedure, the athletes didn’t want to talk about it until after the conclusion of the 200 — nearly a week later. The tiebreak also didn’t exactly address this particular situation — an athlete commits to racing and decides not to at the last minute. The matter, however, was resolved once Tarmoh stepped aside.
Felix will now race in both the 100 and 200 in London. Tarmoh didn't qualify in the 200, but is eligible to run in the Olympic 400-meter relay. “The situation has been difficult for everyone involved,” Felix said in a statement. “I had accepted the USATF decision and was prepared to run at 5 p.m. I wanted to earn my spot on this team and not have it conceded to me so I share in everyone’s disappointment that this runoff will not happen. All I can do now is turn my focus to London.” Tarmoh only reluctantly agreed to the runoff. She believed she won on the track fair and square nine days ago. “In my heart of hearts, I just feel like I earned the third spot,” she said Sunday. “I almost feel like I was kind of robbed.” Tarmoh leaned across the finish line and looked up to see her name on the scoreboard in the third spot behind winner Carmelita Jeter and runner-up
Tianna Madison. The 22-year-old Tarmoh even took a celebratory lap around the track, waving an American flag. She received a medal and held a news conference. Then, she found out about the dead heat from reporters. The situation has been a debacle since Felix and Tarmoh crossed the line in 11.068 seconds. The options USATF presented to settle the tie were a runoff, coin flip or one athlete conceding the spot to the other. The athletes and their agents met with USATF representatives Sunday, and Felix and Tarmoh chose to settle matters on the track. Tarmoh, however, was clearly unhappy with the choice. “This decision was really hard for me to make,” Tarmoh said. “I was pushed into a corner. They said if you don’t make a decision, you give your spot up. I work too hard to just give my spot up. I had to say it was a runoff.”

If we don’t put an end to the Walmart model of making a few people rich and keeping the rest of us struggling, we are going to live in a country with no middle class at all. For my kids and for my community, I’m speaking out for change at Walmart.” Walmart has had a recent string of setbacks in its efforts to build new stores in urban areas as communities push back against the company. Walmart recently abandoned plans to develop two stores in the Boston metro area after local residents voiced strong opposition to the planned stores. The company’s New York efforts have been stalled as the New York City Comptroller filed a lawsuit in connection with the recent bribery scandal.

Mariah Carey opened the tribute, and her voice wavered as she told stories about Houston. She recalled the last time she saw Houston last year, and how the two laughed and gossiped together. “I miss my friend,” Carey said. “I miss hearing her voice and laughter.” R&B singer Monica was vocally top-notch as she sang “I Love the Lord,” a gospel song once sang by Houston; Brandy sang two upbeat Houston hits, “I Wanna Dance With Somebody” and “I’m Your Baby Tonight.” Chaka Khan blazed the stage with “I’m Every Woman,” which Houston remade. The censor police also worked overtime when Rick Ross performed with his Maybach Music Group and during Minaj’s performance and acceptance speech for best female hip-hop artist. Minaj’s win was her third consecutive time taking the prize. “I really, really appreciate BET for keeping this category alive, and I appreciate all the female rappers doing their thing, past, present and future,” she said, before uttering an obscenity. Best gospel winner Yolanda Adams, who also performed, gently took some of her peers to task, urging them to act mature and use their fame wisely. “We need all of y’all,” she said onstage. “I’m saying the world needs everyone in this room. Please make sure that you use your gift responsibly, ‘cause we’re watching. Our babies are watching, and they want to be like us.” West, the most nominated act of the night with seven, and Jay-Z won the ceremony’s top prize, earning video of the year for “Otis.” They also won best group. An internal report by prosecutors says that after a three-year investigation, they didn’t have enough evidence to show celebrity news website TMZ paid the accused officers for the photo, and that became an obstacle in charging them. The Associated Press report obtained a copy of the March 28 report on Thursday after its contents were first reported by the Los Angeles Times. Officers Blanca Lopez and Rebecca Reyes may still get fired. They are slated to appear before disciplinary panels in August. Brown, who was Rihanna’s boyfriend at the time, was arrested on suspicion of beating the Grammy winner on Feb. 8, 2009, leaving her bloody and bruised. Joe Simitian, D-Palo Alto, another skeptic. “But frankly the High-Speed Rail Authority has struggled to deliver a project that fits that description.” Lawmakers are under pressure from labor groups that say the project is sorely needed because it will bring jobs, particularly to the Central Valley region that has higher-than-average unemployment. The Obama administration has threatened to rescind $3.3 billion in federal grants if the Legislature doesn’t appropriate its share of funding. The governor is counting on those federal funds and the $2.7 billion in state bonds for a total of $6 billion to build the first segment. California was able to secure more than expected after Florida, Ohio and Wisconsin turned down federal money. Transportation Secretary Ray LaHood met with legislative leaders in Sacramento last month and told them not to delay the decision. The Federal Railway Administration has said the money must be used for the Central Valley segment. Steinberg, the Senate leader, said the Legislature will vote this week to authorize the state bond. Another $800 million or so will be dedicated for upgrades in Northern and Southern California. “I get the argument that to start in the Central Valley creates a risk because there’s no guarantee of future

Dan Richard, chairman of the authority, said the vote not only starts construction on high-speed rail in California but also authorizes financing to help electrify Caltrain, a San JoseSan Francisco commuter line, and upgrade Metrolink’s lines in Southern California. “I’m absolutely convinced that the plan that we’ve put forth is the best plan given the resource limitations that we have,” Richard said. “And it will move us forward towards an integrated intercity rail system with early investments in the bookends in the urban areas. It’s a balanced plan.” Legislative leaders have suggested that additional funding would next go toward extending high-speed rail from Bakersfield to Palmdale, which could link with regional rail systems into Los Angeles. Supporters say the project will bring roughly 20,000 jobs for the next five years. “This isn’t just any vote,” said Jim Earp, executive director of the California Alliance for Jobs, which represents union construction workers. “This is a watershed vote. It’s the kind of vote that you remember what people do because a lot of folks’ livelihoods depend upon what happens in Sacramento on this vote.”

I applaud my colleagues for their hard work to protect consumers through this reasoned compromise.” “The package approved by the Legislature today is a major victory for California’s consumers,” said Assembly Speaker John A. Pérez. “We impose tough new regulations on banks and lenders to stop the abusive practices we’ve seen since the collapse of the housing market, and this package will bring relief to hundreds of thousands of California homeowners.” The California Homeowner Bill of Rights consists of a series of related bills, including two that were passed on June 26 by a two-house conference committee: AB 278 (Eng, Feuer, Pérez, Mitchell) and SB 900 (Leno, Evans, Corbett, DeSaulnier, Pavley, Steinberg). The two identical bills passed by the conference committee contain key elements of the legislative package and provide protections for borrowers and struggling homeowners, including a restriction on dual-track foreclosures, where a lender forecloses on a borrower despite being in discussions over a loan modification to save the home. The bills also guarantee struggling homeowners a single point of contact at their lender with knowledge of their loan and direct access to decision makers. For the first time, the Homeowner Bill of Rights imposes civil penalties, of up to $7,500, on the repeated filing of foreclosure documents without verifying their accuracy, a practice commonly known as “robo-signing.” In addition, homeowners may require loan servicers to document their right to foreclose. Homeowners will also have a clearly-defined right to access the
courts to protect themselves from violations of these protections. The Homeowner Bill of Rights also consists of four bills outside of the conference committee process. These will enhance law enforcement responses to mortgage and foreclosure-related crime, in part by empowering the Attorney General to call a grand jury in response to financial crimes spanning multiple jurisdictions. Additional elements will help communities fight blight related to foreclosure, and the crime that results, and provide enhanced protections for tenants in foreclosed homes. Please see the attached fact sheet for the status of these bills. The California Homeowner Bill of Rights was introduced February 29, 2012 at a press conference featuring Assembly Speaker John A. Pérez and Senate President pro Tem Darrell Steinberg and bill authors from the Assembly and Senate. The Homeowner Bill of Rights codifies many of the core protections from the recent national mortgage settlement. The California Homeowner Bill of Rights extends Attorney General Harris’ response to the state’s foreclosure and mortgage crisis. Attorney General Harris created a Mortgage Fraud Strike Force in March, 2011 to investigate and prosecute misconduct related to mortgages and foreclosures. In February 2012 Attorney General Harris extracted a commitment from the nation’s five largest banks to dedicate an estimated $18 billion to mitigate financial harm to California borrowers caused by bank misconduct in the foreclosure process. George H.W. Bush, who nominated him to the Supreme Court, chose Thomas at least partly because he is black. Race is a central fact of his meteoric rise, and Thomas has alternately denied it and resented it – all the way to the top.” To characterize Thomas’ behavior as resentment is an understatement. The late U.S. Appeals Court Judge Leon Higginbotham observed, “I have often pondered how is it that Justice Thomas, an African-American, could be so insensitive to the plight of the powerless. Why is he no different, or probably worse, than many of the most conservative Supreme Court justices of the century? I can only think of one Supreme Court justice during the century who was worse than Justice Clarence Thomas: James McReynolds, a white supremacist who referred to blacks as ‘niggers.’” Though arguably the worst, Thomas is by no means the only African American who votes against the interests of his community. Alabama Congressman Artur Davis was soundly defeated two years ago in his bid to win statewide office. Under the delusion that he could become the first Black governor of Alabama, Davis fervently attacked local Black leaders and was the only member of the
Congressional Black Caucus to vote against the Affordable Care Act. Longtime Alabama State Senator Hank Sanders challenged Davis tactics. “Some Whites use race to consolidate White voters during election and some Blacks use race to consolidate Black voters,” Sanders wrote in his newsletter, Senate Sketches. “But this time, there is a new context: a technically well qualified Black person is running for Governor of Alabama in the Democratic Primary against a technically well qualified White. There is also a new twist: a Black person is attempting to use the race of other Blacks to consolidate Whites behind him. It’s a new context with new twists in an age old saga.” The saga did not end well for Davis, who has since joined the Republican Party. In his primary contest against Agriculture Commissioner Ron Sparks, who is White, Davis lost 10 of the 12 counties that made up his congressional district, some by as much as 70 percent. He even lost his own polling place in Birmingham. And let’s not forget Edolphus Towns, the Democratic Congressman from Brooklyn. Though Towns did not vote for a civil contempt citation against Attorney General Eric Holder, he took a more cowardly approach by voting present. We should not be surprised. This is the same person who supported Hillary Clinton over Barack Obama in 2008. Before that, he backed Republican Rudy Giuliani for mayor over Manhattan Borough President Ruth Messenger. Fortunately, Towns is not seeking re-election. When I look at Clarence Thomas, Artur Davis, Edolphus Towns and others we should hold in contempt, I think back to what Thurgood Marshall said about Clarence Thomas: “There’s no difference between a white snake and a black snake. They’ll both bite.” George E. BY GEORGE E. CURRY NNPA COLUMNIST As the nation eagerly awaited the Supreme Court’s decision on the constitutionality of the Affordable Care Act, all eyes were focused on Anthony M. Kennedy, a staunch conservative who occasionally supplies the lone swing vote that tilts the court’s narrow 5-4 rulings in one direction or the other. But this time, to the surprise of arch-conservatives who had championed his cause, Chief Justice John G. Roberts, Jr. sided with the liberal bloc on the Supreme Court, giving President Obama an unexpected clear victory in his signature legislative accomplishment. What was not surprising was that Clarence Thomas would not step into the role filled by Roberts. He is widely regarded as the most conservative member of a conservative-dominated Supreme Court. Thomas is far more conservative that Hugo Black, a former member of the Ku Klux Klan who served on the court from 1937-1971. Black, a former U.S. Senator from Alabama (he once filibustered an antilynching bill) joined the KKK in the early 1920s. In fact, during the 1926 election, he gave speeches at KKK meetings throughout the state. Black later acknowledged that joining the Klan was a mistake and became one of the most liberal members of the Supreme Court, strongly backing the principle of “one man, one vote” and using the equal protection clause of the 14th Amendment to forbid racial discrimination. No such luck with Clarence Thomas. In every major case involving affirmative action – including Texas v. Hopwood, Adarand v. Pena and Grutter v. Bollinger – Thomas voted against the interests of African Americans. What makes that so strange is that Thomas has benefited from affirmative action throughout his adult life. In their excellent book, Supreme Discomfort: The Divided Soul of Clarence Thomas, Kevin Merida and Michael A. Fletcher, two colleagues at the Washington Post, write: “Every Thomas employer, from [Former Missouri Sen. John] Danforth, who gave him his first job, to President

Prosecutors say Reyes later emailed the image from her LAPD email address to her personal email address. Reyes and Lopez were roommates at the time, and phone records showed that they made multiple phone calls to Fox Television and TMZ in February. The photo shocked fans and prompted a national conversation about domestic violence after it spread through the media. But despite a search of Reyes’ and Lopez's bank accounts, a money trail was not discovered tying the leak to them, prosecutors said. In order to prove the officers broke the law, prosecutors said in the report they “must prove beyond a reasonable doubt that Reyes and Lopez disclosed the image of Robyn F. (Rihanna) to TMZ and obtained money in exchange for this disclosure.” The prosecutors’ report noted that other LAPD personnel had access to the photos.

statement backing the Republicans. “The Terry family takes no pleasure in the contempt vote against Attorney General Eric Holder. Such a vote should not have been necessary. The Justice Department should have released the documents related to Fast and Furious months ago,” the statement said. The contempt votes happened on the day that Obama’s health care law survived in the Supreme Court, prompting some Democrats to speculate that the votes were scheduled to be overwhelmed by news stories about the ruling. About five hours after the court ruled, with news sites flooded with information about the health care ruling, the House voted 255-67 to declare Holder in criminal contempt. A second vote of 258-95 held Holder in civil contempt and authorized the House to file a lawsuit. In past cases, courts have been reluctant to settle disputes between the executive and legislative branches of government. The issue became more complicated when Obama invoked a broad form of executive privilege, a legal doctrine designed to keep private certain communications of executive branch agencies. The documents were written after Fast and Furious was shut down. The subpoena covered a 10-month period from February 2011, as the Justice Department expressed growing con-
cern that the Fast and Furious operation had employed a risky investigative tactic known as “gun-walking.” In early December 2011, the department finally acknowledged that the initial denial of gun-walking was in error. Republicans said the contempt citations were necessary because Holder refused to hand over documents that could explain why the Obama administration took 10 months to acknowledge the gun-walking. In Fast and Furious, ATF agents abandoned the agency’s usual practice of intercepting all weapons they believed to be illicitly purchased, often as soon as they were taken out of gun shops. Instead, the goal of the tactic known as “gun-walking” was to track such weapons to high-level arms traffickers, who had long eluded prosecution, and to dismantle their networks. Gun-walking long has been barred by Justice Department policy, but federal agents in Arizona experimented with it in at least two investigations during the George W. Bush administration before Operation Fast and Furious. These experiments came as the department was under widespread criticism that the old policy of arresting every suspected low-level “straw purchaser” was failing to stop tens of thousands of guns from reaching Mexico, more than 68,000 in the last five years. A straw purchaser conceals that he is buying guns for others. Fast and Furious identified more than 2,000 weapons suspected of being illicitly purchased. But agents lost track of many of the guns. Some 1,400 of them have yet to be recovered.

Hill admitted she didn’t pay taxes on about $818,000 earned in 2005, $222,000 in 2006 and $761,000 in 2007. The money was earned by four corporations she owned. The 37-year-old South Orange resident got her start with The Fugees and began her solo career in 1998 with the critically acclaimed album “The Miseducation of Lauryn Hill.” She then largely disappeared from public view to raise her six children, five of whom she had with Rohan Marley, the
son of famed reggae singer Bob Marley. After the charges were brought, Hill posted a long statement on her Tumblr page that decried pop culture’s “climate of hostility, false entitlement, manipulation, racial prejudice, sexism and ageism.” She explained that she hasn’t paid taxes since she withdrew from society to guarantee the safety and wellbeing of herself and her family. Hill hinted Friday that she might expand on those comments at her sentencing. When Shipp asked her if anyone had directly or indirectly influenced her decision to plead guilty, she replied, “Indirectly, I’ve been advised my ability to speak out directly is for another time, at sentencing.”
