SAN DIEGO (CNS) - A motorist who was on drugs when he got into a head-on freeway crash that killed a Poway High School graduate in Rancho Penasquitos was sentenced Friday to six years in state prison. Timothy Theodore Barnette, 19, pleaded guilty in October to gross vehicular manslaughter while intoxicated and DUI causing injur y for triggering the May 16 crash that killed 22-year-old Nick Hart, a 2009 PHS graduate who had been on his way to a funeral. At the sentencing, a tearful Barnette apologized to Hart’s family, asking them to forgive him. “I know that will probably never happen,’’ Barnette said. But Hart’s father, George Hart, told the defendant to “do the right thing.” “We will forgive you,” the victim’s father told the defendant. Har t’s grandmother, Joan Reynolds, told Barnette that his actions killed her grandson. “You had no right to that car in the condition you were in,” she said. “We hope you suffer much.” SEE PRISON, Page A12

The $7.38 million sale of a 10.8-acre surplus lot in Rancho Bernardo to a company wanting to build a new retirement community was unanimously approved Monday night by the Poway Unified School District board. AmeriCare Health and Retirement, Inc submitted the highest of three proposals to buy the so-called “water tower” site at 6061 Avenida Venusto. The property is now in escrow, said Supt. John Collins. The proceeds from the sale, after payment of fees, will be added to the district’s general fund for a one-time usage. AmeriCare’s offer beat two other offers: $7.3 million from SheaHomes AND $6.65 million form Nierman Perlman Properties, Inc. The company plans to build a senior retirement community on the property, similar to their other Silvergate Retirement Residence communities, located in Fallbrook and San Marcos. The property has been a point of contention between the school district and the City of San Diego. Many Rancho Bernardo residents wished for the city to purchase the property and develop it into a park with sports fields, but the city was unable to come up with the minimum $6.6 million the district was asking for the property. Though the board was in agreement over the sale, Poway resident Tom Moore disagreed. Through public comment on the issue, Moore stated that he believed that the board’s lack of a marketing plan for selling the property meant they were settling for a lower price. “Less time [selling the property] always means less money,” said Moore. Moore also expressed concern over the district selling the property without entitlement, which would have raised the worth of the property to $11 million, not the $6.6 million of the current as-is property. Real estate entitlement is a right that dictates what is allowed to be developed on a certain property and its uses. The water tower site will need to be rezoned to allow for AmeriCare to build its senior retirement community. The entitleSEE SALE, Page A12

One hundred low- and moderate-income children received the chance to shop with Marine Corps and Navy heroes for Christmas presents for their families Thursday, Dec. 12 thanks to the “Holiday with the Heroes” program. The annual event is put on by The Summit for Children Worldwide, with assistance from the Poway Kiwanis Club. It was held at the Poway Walmart, in the newly built garden center expansion, with about 400 total attendees. They included the children, heroes, family members and volunteers from The Summit, the Kiwanis Club, Poway High School Key Club, and K-Kids from Painted Rock Elementary School. Children from schools in the Poway Unified School District, including Pomerado and Valley Elementary, were given $100 gift cards for Walmart, and, accompanied by a hero, were able to shop for presents for their families. The kids were also given a handmade blanket and were able to choose a couple of books to take home, as well as participate in arts and crafts, and get a picture with Santa.

An estimated 95 Marines from the 1st Light Armored Reconnaissance Battalion at Camp Pendleton were on hand to help the kids shop for their families, as well as two naval officers. The 1st LAR, known as “The Highlanders,” was “adopted” by the City of Poway several years ago. This is the fourth year Holidays with the Heroes has been held in Poway. “It’s definitely the best turnout we’ve had,” said Cody Trotter from Summit for the Children. Normally Holidays with the Heroes sponsors 50 children to shop for their families, but a generous donation from the WestconGroup allowed them to expand to 100 children this year. Trotter said that The Summit for Children Worldwide hopes to expand even further next year, outside of

the Poway Unified School District. “We want to grow by as much as we can,” said Trotter. Each child is sponsored by a donation of $100, so every $100 donation will add another child to the event, said Trotter. The children selected to participate in Holiday with the Heroes were picked by their teachers and student-teacher liaisons, and must be good students to be chosen. The children are told to purchase gifts for their families and not for themselves. “It encourages the kids to learn how good it is to give,” said Trotter. “They bring a list [of wanted gifts] for their families, and talk to Santa.” After the gifts are purchased, they are gift-wrapped by volunteers. The rapidly expanding Pizza Studio chain is coming to Poway’s Creekside Plaza and should be open by spring. The Los Angeles-based company has leased 1,316 square feet at 13483 Poway Road that had been occupied by BGR The Burger Joint, said John Jennings, senior director of Cushman & Wakefield Retail Advisors. The former tenant closed several months ago after operating for about one year. The new owners are Brian Mesic and his wife, Gianni Nguyen, who recently moved into the area with their three children and are building a home in Santaluz. Nguyen said the Poway restaurant is the first of five they plan to open along the I-15 corridor. Another 15 restaurants are planned by others for San Diego County, plus more than 100 others across the country, she said. The Pizza Studio’s concept allows customers to design their own pizzas from a large number of ingredients, according to its website. The company also supports local artists, allowing them display space in each restaurant. Nguyen said she hopes to begin construction in February and be open by spring. The restaurant will employ about 35 people, she said. The new lease brings the retail center back up to 100 percent occupancy, Jennings said.

PUSD's interim budget has positive and negative news BY EMILY SORENSEN The results were both better and worse than expected for the first interim budget of the Poway Unified School District for the 2013-14 school year, which was presented to the school board at the Monday, Dec. 16 board meeting. While the first interim budget did have a reduction in expenditures of nearly $4 million less than projected in the October budget, it also saw a decrease in revenue of $865,061, from the California Department of Education’s Local Control Funding Formula (LCFF). The LCFF provides nearly 75 percent of the district’s revenue, with local, state and federal revenues making up most of the other 25 percent. Despite the loss in revenue, the proceeds of the water tower site, which have been figured into the budget under Other Financing/Sources, will help leave the district with a much rosier ending balance than previously expected, an extra $11 million in the ending balance. The projected budgets for the 2014-15 and 2015-16 school years were still bleak, requiring $11.5 million in cuts during 2014-15 and $16 million in cuts in 2015-16. The budget will be no longer in deficit after the combined $27.5 million in cuts, however. The board was also presented with an update on the funding plan for the Design 29 Campus, the new K-8 school which is planned to open next year. Due to some missing bond insurance information in the legal documents, the board will not be voting on the funding plan until the January meeting. The funding plan has been updated to include the bond insurance, provided by Build America Mutual,

who have worked with the district for bond insurance previously. The board voted to add bond insurance to the funding plan to increase the bond’s security credit rating. Without insurance and without using the district’s general fund as assurance, the funding plan’s credit rating would be BBB-. With bond insurance, however, the rating will be increased to AA, which will increase the likelihood of success in selling the bond. The addition of bond insurance will also provide a financial benefit as well, decreasing the program repayment term to a projected 28 years instead of 30, and reducing the district’s total net payments from $81.6 million without bond insurance, to $76.8 million. The board will review and vote on the funding plan at the January board meeting. Other happenings at the board meeting included: • The board voted on a new president, vice president and clerk. Board vice president Todd Gutschow took over the role of board president from Marc Davis, while board clerk Penny Ranftle accepted the nomination to board vice president. Andy Patapow was voted into the role of board clerk. They will serve in these roles until next December. • The board congratulated three PUSD students for earning top composite scores of 36 on the ACT College Admission and Placement Exam, Kevin Jiang from Mt. Carmel High School, Jacob Basinger from Poway High School, and Amanda Tjitro from Westview High School. • Los Penasquitos Elementary School was honored as a Golden Bell recipient by the California School Boards Association. Golden Bells are awarded to select California schools demonstrating outstanding educational programs.

This is why she takes it upon herself each year to organize a Toys for Tots collection, working closely with Marines of the 4th Tank Battalion stationed at the Naval Marine Corps Reserve Center. “We collect 124,000 new, unwrapped toys annually and provide holiday cheer to around 52,000 children from our base alone,” said Capt. Evita MosquedaChapman. “Every child receives one or two toys, but we’d like to be able to do more to make everyone’s holidays even happier.” Last year the toys collected were dis-

Need gift list help? Now there's an app for that BY ELIZABETH MARIE HIMCHAK Selecting the perfect gift for the holidays or any other time of year is a little easier with a new free app created by a Santaluz resident. Marcela Smith said she came up with the idea for the “Gift Share Love” app after realizing in May she would soon face another holiday season with no easy way to buy wanted presents. “I can’t tell you how much time I’ve spent trying to buy my friends and family gifts that they’ll actually use,” Smith said. “After doing an extensive search on the App Store for an app to help but coming up empty, I decided to create an app that would solve this problem for everyone.” Available for free through iTunes, the “Gift Share Love” app is only available for iPhone, iPad and iPod touch with iOS 6.1 or later. A stand-alone website version for those without smart phones is set for release in January and an Android version might be ready in the first quarter of 2014, Smith said. She went with the Apple version first because “I have everything Apple,” she said. There are many options with the app. Wish lists — dubbed “faves” — can be made public or private and sent to noniPhone users via email. Those who wish can also share their lists via Facebook and Twitter. Users can also have multiple lists with different viewing and privacy settings.

Notes can be added, such as size, color, what one likes about it and price. Smith said even if gift givers do not select something from the “faves” list they can get ideas about what to or not to buy. For example, her list mentions she is allergic to the fragrance of lavender since those unaware of her allergy have given her items with that scent in the past. “They would spend time looking for something and then I don’t use it,” she said. Not long after the app was released on Nov. 25, one user wrote online that she was using the app for a use Smith said she had not considered. “I can keep the things (makeup, lo-

tions, clothing and shoes) I use in a well organized list,” wrote the person going by the screen name SD-shopper. “This way I won’t be caught at the store without the name of my foundation makeup or the size I wear in a particular shoe.” Smith said the app also lets one save and share their favorite recipes, wines, clothing, perfumes, sports equipment, books, charity events, hiking trails and restaurants. Through the app one can connect with more than 50 major retailers, including Amazon, Best Buy and Nordstrom, since it has relationships with these businesses, Smith said. Those not on the list can be added. The self-described “non-techie” said the process to create an app was easier than she expected. This summer she hired a Florida-based company to turn her flowcharts, features and screen page designs into computer code. Smith, who worked in the escrow industry, said she was up to the challenge because she frequently had the company’s software engineers modify programs to fit the office’s needs. “My mind works that way,” she said. “I have spent my own savings to invest in this app because I believe in its potential for long-term growth,” Smith said. Whether that investment proves profitable depends on number of users, she said. If she gets hundreds of thousands, Smith said she would be able to get the investment paid back through the affiliated merchants.

Poway woman receives gift of hearing for the holidays BY ELIZABETH MARIE HIMCHAK A life-long Poway resident with hearing loss since childhood now has new career possibilities thanks to her father and a local audiologist. Poway resident John Wismont Jr. nominated his daughter, Shawn Wismont, for the ninth annual Hear for the Holidays contest. The prize is a top-of-the-line hearing device valued at around $6,600 plus a lifetime of follow-up visits with David Illich, Palomar Health’s chief audiologist. Illich started the contest in 2005 to thank the community for helping his relatives in the aftermath of Hurricane Katrina. SDN Chamber plans name change BY ELIZABETH MARIE HIMCHAK San Diego North Chamber of Commerce will have a new name by next May that likely eliminates a geographical boundary reference, according to its leader. President and CEO Debra Rosen made the announcement during the chamber’s Regional Connect networking event on Dec. 11 at the Rancho Bernardo Inn. (Photos of the event can be found on Page B6) Rosen told attendees the change is due to a number of factors including many organizations in this area using the word “north” in their names and several of the chamber’s 600 current and active members not being located in the North County. She said they extend from state Route 52 — and some even further south — to Temecula. With the North County boundary defined differently by various entities, Rosen said the chamber’s board of directors decided a name change is in order as well as a “rebranding” of the chamber. Bottom Line Marketing has been retained to survey members and come up with several name suggestions for the board by February. Rosen said the endeavor’s cost will not be paid with members’ dues, but how the money will be raised has yet to be determined. “We want chamber members involved in the process,” Rosen said. Based on responses to the upcoming survey going out to members, she said the board will likely select a name by March, a new logo in April and officially launch the name during a party in May. To encourage participation, members who complete the survey will be entered into a drawing for the three Sony Xperia Tablet Zs that will be given away at the launch party. “Our organization is growing — growing fast and our name needs to keep up with that growth,” she said. San Diego North Chamber of Commerce, based in Rancho Bernardo, took on a regional focus after the Rancho Bernardo and Diamond Gateway chambers merged in 2005. Since then its membership has increasingly expanded beyond businesses located within the Inland Corridor communities. In November 2011, SDNCC became the only United

States Chamber of Commerce accredited organization in the county, one of 13 in the state and among 3 percent of chambers nationwide. That designation, according to SDNCC’s website, means the accreditation program has validated the chamber for having strong standards of programming, demonstrating clear organizational procedures and being a catalyst for positive action in the community. Requirements for selection include meeting minimum operations

and programming standards in areas such as governance, government affairs and technology. In addition to holding several small-scale events throughout the year that include workshops and monthly mixers, SDNCC organizes several large-scale annual events. These include the State of the Region luncheon, San Diego Women’s Week, Celebration of Business dinner, RB Alive! street fair and Business Salute to Police and Public Safety.

Volunteers sought to help count region's homeless Help count the homeless living in our area during the We All Count annual homeless census Friday, Jan. 24. The homeless census is conducted by the Regional Task Force on the Homeless in cooperation with the Department of Veterans Affairs. We All Count needs 800 enumerators from 4 to 7 a.m. Jan. 24 to count homeless people throughout the county, and 200 surveyors on Jan. 24, 25 and 26 to help interview homeless people. Enumerators and surveyors will work in teams of two or three. The Regional Task Force will provide training. During February, 50 people are needed to help enter data from the count. The purpose of the count is to fully understand homelessness in the region in order to help families, veterans and individuals leave the streets. October 12, 1961, in Bronx, NY. He was raised in New York and was a devoted Yankees fan. Chris was a New Yorker at heart but Poway was his home. He never met a stranger, and saw the good in everyone, always with a smile and boundless energy. Working in the Auto and Real Estate industries and recently as an owner of Edible Arrangements, Chris never forgot anyone and always left an impression on those that he met. He leaves us too soon, but was loved by all, and will be greatly missed. LA Fitness was his second home where he enjoyed racquetball and playing league matches. He was a member of San Rafael Catholic Church. He is survived by father, James Shean of Poway; sister, Sandra Shean of Sabre Springs; and niece, Danielle Figg of Sabre Springs. He was preceded in death by his mother, Patricia Shean in 2006. Hart’s mother, Jennifer Wood, said the pain her family is going through is “immeasurable.” Wood said her son was a “beautiful person, both inside and out.” Hart’s sister, Kaitlyn, said her brother “was going to change the world.” The defendant’s mother, Georgia Barnette, told her son, “Today is such a sad day. You have a heavy burden on your young shoulders.” Ann Almryde testified during a preliminary hearing in July that she and her husband were traveling west on Ted Williams Parkway near Pomerado Road around 9:30 a.m. when she noticed a Land Rover parked with two wheels up on the sidewalk. Moments later, the same Land Rover sped past the couple, with the man behind the wheel changing lanes and driving erratically, prompting Almryde to call 911. Another witness, Rex Dolendo, said he was stopped at a red light on the same road — which becomes state Route 56 near the Interstate 15 interchange — when the Land Rover’s driver cut him off and narrowly missed hitting his car. David Brenner said he tried to pass the Land Rover and got a good look at the driver, who he identified as Barnette. The witness said Barnette smiled at him, swerved to the left, crossed a center median and crashed into Hart’s vehicle on the other side of the freeway. Hart, who loved to surf and rock-climbing, was pronounced dead at the scene. California Highway Patrol Officer Brad Clinkscales testified that after the crash, at a hospital, Barnette told him that he had left Abraxas High School in Poway to get something to eat. He said Barnette said he had taken two Xanax pills and smoked marijuana two days before the accident, and had inhaled computer keyboard cleaner two months earlier. Officers found two cans of the cleaner in the defendant’s car and one was empty, Clinkscales testified. Authorities found marijuana, Xanax and inhalants in Barnette’s blood.

Blue Sky Ecological Reser ve is bringing back its popular free hiking series, “Hiking for Fun and Fitness: Six Weeks to Ramona Dam,” for a fourth year, beginning 9:30 a.m. Monday, Jan. 6, for six weeks. Hikers should meet at the south end of the Blue Sky parking lot, 16275 Espola Road. The series will

be led by docents Gillian Pinsky and Mike Green. The hikes, which begin easy, will increase distance and fitness level weekly, eventually culminating in a five-mile round-trip hike up to Ramona Dam on Feb. 17, a hike that has an 800-foot elevation gain in the last mile up to the dam. “It’s definitely moderate to difficult at the end,” said interpretive services coordinator Annie Ransom.

The hiking series is definitely suitable for beginners, Ransom said, or experienced hikers wanting a change. “It’s a great de-stressor,” said Ransom, “and a great way to meet new people. Board member Kimberley Beatty expressed concern over the option, which would, if the properties were chosen to be sold, be done through a process known as “request for proposals” (RFP), rather than a public bidding process. “We owe it to the public to be open and transparent,” said Beatty. “There were questions with the process of the water tower property, doing this would be a mistake.” Beatty referred to the RFP process as a “backroom deal.” Newly elected board President Todd Gutschow disagreed, saying that the RFP process would allow for a marketing plan to be developed. “This would allow us to do what Mr. Moore suggested,” said Gutschow. He added that it didn’t sound like it would be a backroom deal, as there would be a public marketing plan.

Collins said that the district was in no rush to sell the properties, despite a looming January 2016 deadline for allowing the proceeds of property sales to be used for one-time general funds. “Nothing will happen until the reviews [of the properties’ values and best uses] come back,” said Collins. Collins also added that the RFP process is very public. “We’re trying to maximize our assets while making the best school district possible for the kids,” said Collins. The next step in the process will be a public hearing at the next board meeting, which will be held at 6 p.m. Tuesday, Jan. 21 at the district office, 15250 Avenue of Science in Carmel Mountain Ranch. Following the public hearing, the applications for the waivers will be submitted to the California Department of Education board.

Supervisor recaps life, year on board BY ELIZABETH MARIE HIMCHAK County Supervisor Dave Roberts said his dealings with San Diego’s adoption/foster system inspired him to run for the board. While speaking at the Dec. 10 Conservative Order for Good Government meeting in Rancho Bernardo, Roberts also shared some family history dating back to 1629 and professional background before talking about what San Diego County Board of Supervisors accomplished during his first 11 months in office. The father of five adopted children said he and his spouse sued the county to keep their third child, a foster child in their care for 18 months and slated to reROBERTS turn to an unsafe home with his biological mother. They won and adopted him. Later the mother lost custody of her younger two children, whom they also adopted. That experience sparked his desire to run for county office in order to “fix the foster/ adoption system,” he said. Roberts and Board Chairman Greg Cox created the exceptional families program to get 50 “very hard to place” foster children in permanent homes. To date, Roberts said, “50 percent have been adopted into loving, forever homes.” The former Solana Beach mayor and twoterm city councilman said his first goal on the board was to “bring the county back to the people.” One way he has done this is by holding office hours in the Rancho Bernardo Library from 10 a.m. to noon on the third Thursday, which

includes today, Dec. 19. He also opened an office in Escondido to save District 3 constituents from having to drive to downtown San Diego. The board’s first new supervisor in two decades — and only Democrat — said he likes COGG’s name since the words represent his political philosophy. “Fiscal responsibility is my number one priority,” Roberts said. “The federal and state government doesn’t get it, but here at the county we get it. We are strong fiscal stewards.” For examples of conservatism, he mentioned the county’s AAA bond rating and new Registrar of Voters office that the county paid for with cash. “We do not build until we have the money,” he said. Roberts said because many programs the county operates are funded through the federal and state governments that set the laws, the supervisors cannot change the laws, but can make sure they are carried out locally as efficiently as possible. He said the county hired more than 600 people this year to work on Affordable Care Act — “Obamacare” — issues. As for good government, he said the board has done much to improve the safety and wellbeing of residents. For example, $19 million per year is spent on fire prevention and lessons learned from the county’s 2003 and 2007 wildfires were implemented. Among topics the supervisors are pursuing, Roberts mentioned reforming the mental health system through the use of in-home outreach teams that can help families dealing with a loved one’s mental health issues by identifying resources to help them.

She wore hearing aids for a while during childhood, but stopped wearing them because of her classmates’ teasing. As an adult, financial limitations prevented her from obtaining hearing aids for her hearing loss of 60 to 70 percent. John Wismont said his daughter was born with highrange hearing limitations and

her hearing loss progressively increased as she got older. By high school she learned to read lips “really well” and understand sign language since many of her friends were deaf. “I hear sounds I’ve never heard before, like when driving I hear the pebbles on the ground,” she said. “I hear sounds I do not need to hear too.” Illich said when someone has not worn hearing aids for years — or in Wismont’s case, for decades — the devices have to be adjusted gradually in order to give the wearer

time to adapt to sound. “The greater the loss, the greater the adaptation,” Illich said. “She’s doing amazing.” Many factors were considered by the judges when choosing the winner. Among them was the degree of hearing loss and financial need. Wismont’s father explained that need in the essay he wrote after reading about the contest in the Poway News Chieftain last month. “Shawn has four children, two grown and the two youngest in middle and elementary school,” he wrote. “Shawn’s

tears to her eyes. “The letter made me sad,” she said, adding she was trying to get Medi-Cal to cover a hearing aid, but had yet to learn if it was approved. “Hopefully, I will find a job where I want to work and not just get any job,” she said, explaining she is trained as a medical assistant but because of her hearing loss could not work in that field. Instead, she has been employed as a caregiver. Until she finds new employment, Wismont said those she works for will no longer think

she is ignoring them since now she can hear what they are saying. Illich said not only will Wismont have a chance to see her financial opportunities improve, but many aspects of her life. He said those with hearing loss often become introverts because they have difficulty communicating with friends and family members. He called the new ability to easily communicate “priceless.” He also said there are physical ramifications, including a 30 times higher chance of memory loss as they age.

Make the giving season a year-round tradition

I

t always seems that the further we get into the December holiday season, the larger our hearts grow. In recent weeks countless numbers of volunteer groups, churches, families and individuals have stepped up to help the less-fortunate in our region. Some have purchased toys for low- and moderateincome children. Others have provided donations of cash and gift cards for families to whom the holidays would otherwise mean only disappointment (there are more of them than you might think.) Our growing senior population is remembered and celebrated with special programs, meals and related activities. While the holiday donations are sincerely appreciated, a question lingering in the

minds of many recipients, and those who look after them, is “What about next month?” Hunger returns every day. Rent is due every month. Children outgrow their clothes and shoes. Yet the holiday contribution barrels and the little red kettles will be put away in storage toward the end of next week. The media will move on to other topics. Helping people in need is a basic tenet of being a compassionate human being. We give when we’re asked to, when we’re reminded of the need. But what about when we’re not? Let us all remember that ever y day is an opportunity to help others in any way we can, and not just during the holiday season.

Year-end reflections by assemblymember By Brian Maienschein State Assemblymember

F

or everyone, this year has had its moments of joy and sadness, successes and setbacks, love and loss. Fortunately, the end of the year always gives us an opportunity to take a step back from it all and reflect, while we spend time with family and friends. Personally, I am thankful to represent such a great community in the state Assembly. I am thankful for the hardworking members of my staff, who are dedicated to helping me effectively serve my constituents. And most importantly, I am thankful for the health and well-being of my family and friends. This time of year is also the season of giving, not only of presents and gifts, but also of our time. All throughout San Diego, there are charitable organizations, food banks, and toy drives where you can volunteer or donate money. I encourage you to give back in any way you can to help spread the joy of the holiday season to

those in our community who are less fortunate. In the upcoming year, I will continue to focus on the areas that matter most to our district; safer communities, a strong economy, addressing mental health and homelessness, protecting our children, and providing them with a better education. My Assembly Bill 1335 will strengthen justice for physically and mentally disabled victims of sexual abuse and their families. These crimes are often harder to prosecute, because in many cases the victims cannot effectively communicate what has happened to them. My legislation will ensure that these predators serve sentences that match the nature of their heinous crimes. My Assembly Bill 230 builds on the work I began last year to help make youth sports a safer experience for our children. AB 230 will require youth sports leagues to publicly disclose whether or not they conduct background checks on their coaches. Parents See REFLECTIONS, Page A20

Moved by column about dog I was so touched by Amy Roost’s Dec. 12 column “Tiki’s Last Second Wind.” You see on May 8 of this year, I had to make the painful decision to have my beautiful 13-year-old schnauzer put down after a long bout with diabetes. I did choose home euthanasia, which for me and my husband was comforting, but am very familiar with Dr. Singh, a wonderful vet. Little did I know that in June, my husband, Pedro Gonzalez, would become seriously ill and pass away on Aug. 19, 2013. I lost two wonderful parts of my life, and it was Gretchen who brought my husband some of his greatest joy. It has not been easy to breathe since losing two of my best friends, but I find comfort believing they have found each other in heaven, along with other furry friends, loved and lost along the way. I only knew my husband two weeks before we got married in Kansas City, Kansas, and God granted me 51 wonderful years with him. My thoughts go out to Amy and her family in such a sad loss, and I thank you for sharing this story. In a way, Amy, maybe we did get our Christmas miracle, we got to love our special furry friends and I got to love my husband for many years and they loved us back! That to me is a true miracle. How about a little credit? Further to the Dec. 5 letter written by Marcella Myers, “Why not cite the Bible?” whereby the Bible is not cited as the source of the biblical passages on John F. Kennedy’s memorial, the Kennedys were not particularly known for giving credit where credit was due. In JFK’s inaugural speech (1961), the former president has often been highly praised for his legendary quote: “Ask not what your country can do for you, but what you can do for your country.” JFK plagiarized this quote from Kahlil Gibran’s “The Prophet,” (1923) but did not bother to cite Gibran.

Likewise, Robert Kennedy in a speech on the assassination of Martin Luther King (1963), said, “I see things that are not and say, ‘Why not?’”. This quote was lifted from George Bernard Shaw’s “Back to Methuselah” (1921). Robert Kennedy did not cite Shaw for this quote.

Thanks for the star Every year a Christmas star appears over Espola Road reminding us of the miracle of Christmas that occurred in a stable over 2,000 years ago and transformed the world forever. I do not know who faithfully erects this seasonal display every year reminding us of our Savior’s birth. What I do know is that it is enjoyed by many in Poway who travel north on Espola Road after sunset. The effort is appreciated by many of us who look forward to its appearance each year.

The latest cannabis craze

drug popular back in the ‘70s is making a big comeback and teens are taking notice. Kids we see tell us “it is the best way to get seriously stoned.” One news report compared it to cruising around in a Tesla while making every other car look like a stagecoach. What is this latest craze? Butane Hash Oil (BHO) — often referred to as dabs, wax, earwax, honey, honey oil, weed oil or shatter. This concentrated form of marijuana, referred to as “wax” due to its sticky, amber-colored appearance, provides a stronger, faster, and arguably more dangerous THC high. It contains more than 70 to 80 percent pure THC, the active ingredient in marijuana, compared to the average leaf with 20 to 30 percent TCH, making it possibly the most powerful marijuana concentrate on the market. Because of its potency, you don’t need a large amount to get high. The other advantage is that it doesn’t give off a noticeable odor in either its solid or vaporized form. BHO can be used in various ways — smoking, vaporization or consumed. Using a “rig” (small water pipe design for this use), users take a hand-held blowtorch and heat a metal surface. This is followed by placing a drop of hash oil (“dab”) onto the hot surface until it melts, boils and vaporizes through the water pipe and into the user’s lungs. It can also be smoked by placing in a rolled cigarette or in a pipe as well as

Officials report an increase in fires and explosions related to the highly flammable process of THC extraction as “how to” videos fill the Internet. Often these processes can be misidentified as a pipe bomb or meth labs. BHO gets its name from the process from which it’s made — by placing marijuana in some type of holding container and pushing butane through the container in such a manner that doesn’t allow the plant material to escape (only the butane). The butane extracts the THC from the leaves and out flows a liquid that looks like honey, wax, etc. Once cooled, small amounts are chipped off and used. Looking online you can find everything you need to know about this dangerous trend. It’s amazing how potent this concentrate is. While the marijuana debate continues on with some feeling that it’s a relatively harmless drug, who knows what the long-term consequences of such

will have another resource which allows them to make safer decisions on programs for their kids. Finally, as we ring in a new year, many of us make resolutions — creating or renewing a commitment to achieve certain goals. The bills from the ambulance, surgeon, hospital and other providers went to the insurance company which paid everything except a bit over $1,200. This is clearly fraud in my opinion. In order to get his part down to the contracted $200, he had to hire an advocate. There is a local health care provider who does separate billing for multiple labs as a result of a single blood test. As a result, the patients receive bills for more than one copay, even though there was only one blood test. Looks like fraud to me. The new health care law has specific provisions for out-of-pocket maximums for the insured for the year. By each of us keeping good records (shoe boxes are great) and asking our elected assemblyman and state senator to stop their attempts to defraud, we can make a difference. For almost 20 years I’ve dealt with teens and their denial that marijuana is a drug. The number one thing I’m always told is that it’s a plant and natural so how can it be bad? Let’s really look at how natural a genetically engineered hybrid plant that is processed through a series of chemical additives for the sole reason of extracting the mind-altering chemical is in anyway natural. Education continues to be the key not only for teens but us as a society.

he state Legislature reached an agreement with Gov. Brown to try to get the federal judges to extend for three years the time to reduce the prison population below the capacity of the prisons. The three-judge panel has delayed a final decision. If they do get such judicial dispensation, the state will try to get psychological help for the prisoners — and if that appeal fails, Gov. Brown can try to transfer prisoners to other states. In ancient Rome, there were no prisons, so committing a crime entailed the primary means of execution (crucifixion). In one case during the term of Augustus, a slave executed his owner, and all of the owner’s other slaves (on the theory that they should have dissuaded the culprit) — more than 400 were crucified. The record number of crucifixions of general miscreants in Rome at one time was more than 600 (When the Romans put down the Jewish uprising in 73 or 74 BC, they killed more than one million people, then in Judea they crucified the remainder at a rate of 500 per day until they ran out of wood for crosses.) Murder was not common in Rome, at least among the elite — and that is all that history covered — although theft was common, particularly at night because Rome had neither streetlights nor police. It was particularly dangerous in the countryside throughout Europe for the next several thousand years. Murder at sea by pirates was common. (It should be noted that the head of a Roman household had life and death authority over his wife and slaves, and killing either was not “murder.”) If a criminal was not crucified, he might be fed to animals, forced to fight to the death at the circus, garroted, impaled (a par-

My conclusion is that criminality is a natural part of the social (dis)order, and criminals are not dissuaded from their acts even by the harshest punishment. I conclude that criminal brains are simply differently wired, and that if even the most vicious Roman punishment is not a deterrent, then certainly seeing a friendly psychiatrist will not work. I am always surprised that the very same people who claim that homosexuality is natural (with which I agree), and that those groups who claim they can “retrain” the homosexual into a heterosexual, are frauds (with which I also agree). They seem to think that groups can retrain criminal minds into being non-criminals. No, I believe that anti-social behavior is ingrained, as is socially compliant behavior. The solution is to isolate the non-compliant from the compliant until age makes social non-compliance too difficult for the criminal mind to act upon. New Poway-based group strives for sax appeal BY EMILY SORENSEN The Saxations, an all-women saxophone quartet based in Poway, are blazing new trails for female saxophonists with their skill, style and marketing plans. “[The Saxations] are fairly new, we’ve been together since March,” said LeiLani Vidal, a Poway resident and director of the Better Health and Wellness Center in Poway. “We’ve been pleasantly taking off since then.” Vidal was inspired to put together an all-female saxophone group after attending a marketing talk at the Sax Summit in Orange County earlier this year. One of the talks held at the event was about how to market yourself in the music industr y, and how to set yourself apart. “It felt like he was speaking my language,” said Vidal. “I always wanted an all-female saxophone quartet.” The hardest part of put-

Vidal found one, who introduced her to another talented saxophonist she knew, and before long, The Saxations were born. “We didn’t know each other,” said Vidal. “I didn’t know if we’d work.” Vidal’s fellow sax players

are Kyrie Lombard, a baritone saxophonist, Allison Boles, who plays tenor and alto saxophone and new member Michelle Maynard, who recently replaced former Saxation Shannon Bates. “We’re not your traditional grandmother’s sax quartet,” said Vidal. She described their sound as “pop instrumental,” that is sometimes compared

to smooth jazz. The Saxations have performed instrumental versions of Destiny’s Child song “Bootylicious,” as well as Michael Jackson songs. One of the things that have set them apart from other groups is their music arrangements, said Vidal. “We’ve hired the best arrangers, who have written arrangements for us,” said Vidal. “The level of quality is very high.” Vidal began playing saxophone at age 11, and played professionally with her parents’ band, “Cam Vidal and the Blue Notes,” which she played with through high school, before putting the sax aside to focus on college. She began playing again a few years ago, and has been working on improving her skills ever since. “My skills have improved quite a bit since being part of [The Saxations],” said Vidal. Though they’ve been together less than a year, Vidal said the group is doing

very well, performing locally as well as in Hollywood, at a birthday party for noted percussionist and arranger Victor Orlando. The group also recently performed at the Christmas in the Park event in Old Poway Park, and at Tango del Rey in San Diego, which was a sold-out show. “There’s a lot of hype out there [about us],” said Vidal. “A lot of interest in women playing sax.” Vidal said The Saxations have received an endorsement deal with Dakota Saxophones, and are in discussion for further endorsement deals. The Saxations will be per forming in Januar y at the National Association for Music Manufacturers, representing Dakota Saxophones. “That’s a big deal [in the music industry],” said Vidal. Just because it’s winter, it doesn’t mean the fun has to stop at Moonlight Stage Productions. Moonlight is putting on three shows in its 24th winter season, two musicals and a classic comedy, at the AVO Playhouse, 303 Main St. in Vista. The season begins Thursday, Jan. 16 with the musical comedy “Nunsense,” which runs through Sunday, Feb. 9. Carlos Mendoza will direct and choreograph “Nunsense,” which tells the stor y of the Little Sisters of Hoboken, who must stage a musical fundraiser to bury their fellow nuns who were accidentally poisoned. The show will feature Sue Boland as Reverend Mother, Brenda Oen as Sister Mary Hubert, Rae Henderson as Sister Robert Anne, Sarah Errington as Sister Mary Amnesia and Aubrey Elson as Sister Mary Leo. The second show of Moonlight’s winter season is Noel Coward’s supernatural comedy “Blithe Spirit,” opening

his past Saturday night, for at least the 18th year, I “officiated” over the tree lighting ceremony at the opening of Poway’s “Christmas in the Park.” As I have said before, this annual event in Old Poway Park is a wonder to behold with its booths, hay and pony rides, carolers and dancers. The tree lighting and subsequent arrival of Santa on old “Engine No. 3” stir memories of Christmases past and elsewhere. The kids really believe that is Old Saint Nick being escorted by the desperados of the “Shadow River Regulators.” This is by far Poway’s most successful and popular event and is attended by literally thousands of people from Poway and surrounding communities. A “well done” to city staff and the dozens of volunteers who make the event a huge success. ***** It is incredible that such a joyous season also marks the first anniversary of the massacre of 26 people, mostly 7- and 8-year-olds, at Sandy Hook Elementary School in Newtown, Conn. It is unbelievable that just 365 days ago, a deranged youth walked into a school, armed to the teeth with weapons purchased by his equally deranged mother, and proceeded to shoot his way through rooms of terrified children and their teachers. All this after blowing away his mother at home. I can’t imagine the horror of a parent being told that their 8-year-old child had just been murdered at school. School, where children should be the safest and fear nothing but tests and report cards. The most disturbing outcome of this horror is that there has been no outcome at all. Absolutely nothing has been done since Sandy Hook, Columbine, Aurora, the Washington Navy Yard, etc., to cur-

tail the proliferation of guns and ease of access to anyone, deranged or not. There have been 23 mass shootings (four or more dead) since Sandy Hook. Now there is a statistic Americans can be proud of.

***** ‘Tis soon to be the “silly season” to quote retired City Manager Jim Bowersox, referring to the years when City Council elections are held. The coming year may be silly and then some, as two council seats and the mayor’s seat are up for grabs. Having participated in more than one “silly season,” I can attest to the fact that things do get silly and worse. Mayor Don Higginson’s term is up and he seems to be running again for an eighth time as either councilmember or mayor, though I haven’t heard anything official. Councilmember Steve Vaus, who is not up for re-election, appears to be running for something as I just received a glossy, two-sided mailer extolling Steve’s “Poway Secret Service,” his website, and his newsletter. Vaus has the advantage of running for mayor from a “safe seat” so if he loses, he is still on the council. Council members John Mullin and Dave Grosch apparently will just run for re-election to their seats. Councilmember Jim Cunningham said he’ll sit this one out. The next 11 months until November will certainly be interesting, if not silly. Emery is a former member of the Poway City Council.

The Poway Kiwanis Club cooked dinner for the attendees, as well as providing 100 handmade fleece blankets to the kids. The blankets, which don’t require sewing, are made from fabric purchased at a big discount from Joann’s Fabrics, then tied and finished by members of the Poway High School Key Club, Twin Peaks Middle School Builders Club and K-Kids from Painted Rock Elementary School. There is a real chance for Poway High, Rancho Bernardo and Del Norte to all be crowned CIF San Diego Section champions at the end of the year. The Titans are in the toughest division of them all — the Open — but have one of the most prolific offenses in the county. The Broncos are in Division II and have already proven they can play with the upper-tier teams, beating defending Division II champion La Costa Canyon 1-0. The Nighthawks lost their top two goal scorers, but playing in Division IV gives them a

chance to compete for a crown. Here is a closer look at the local teams:

ԎԎ Outlook: The Titans were supposed to finish in the middle of the pack last year, but stunned everyone by taking the Palomar League crown for the first time since 2011. This season, it wouldn’t be a shock at all if Poway takes the title. The Titans have a roster full of goal scorers, but will have to fill voids left on defense and in the net. All-Palomar League goalkeeper Spencer Orr graduated, and two inexperienced sophomores are battling it out for the starting job. “We are loaded offensively and unloaded defensively and goalkeeping,” said Morris, who has led the Titans to the Division I semifinals four years in a row. “We have two sophomores See BOYS, Page B3

Erb leading all over for PHS BY MICHAEL BOWER Tom Erb put on the curly, green-haired wig, the bulgingmuscles suit and held the fake green and white trident for just about every Poway High football game in the fall. The senior often paced in front of the Titans’ student section or stood right in the middle of the pack, raising his trident and shouting out spirited cheers. The student section would respond to the man they call “ To m m y T i tan” by going nuts, creating

an energetic and fun-filled atmosphere. That combined with the football program’s recent success and handful of young stars had students and members of the community buzzing about Friday nights. That type of pulse has been non-existent for the boys basketball program for several years now. Erb is hoping this is the season it will come back.

The 5-foot, 10-inch point guard changed out of his Friday night gear and into a basketball jersey for the winter. The new outfit brings just as much charisma, but instead of a wig and trident it is his steals and flashy passing bringing the student section to its feet. “This is a football school right now,” Erb said. “People have always been excited about the football team ... but coach (Scott Fisher) came in and made it a priority for us to bring Poway basketball back and get the community See ERB, Page B4

BY MICHAEL BOWER A trip to Cuba is extremely tough to come by for any American due to a longstanding U.S. trade embargo against the nation. But Connor Jones’ left arm earned him an airplane ticket. The Poway High senior pitcher was selected to play for Team MVP — the lone squad representing the United States — in the 2013 Cuba International Friendship Games, which begins Dec. 27 and concludes Dec. 31 in Havana. “It is kind of a big shocker because anybody could have made the team and I was really surprised it was me,” said Jones, who carried a 2.34 ERA and posted 29 strikeouts over 21 innings pitched for Poway last season. “I always give 110 percent in everything and it is finally paying off and showing.” The wood bat tournament will feature teams from several different countries from around the world, including Venezuela, Cuba, China, Japan and the Dominican Republic. Team MVP is an 18-and-under squad, which will feature 10 players from California in the games. Only 12 parents will be allowed to accompany the team to Cuba. Jones’ parents will not be making the trip. out slow for the Titans last season. It will be a tough act to follow, especially with nine seniors having graduated including the top two goal scorers. The Titans will be young, with only three seniors, but not lacking in talent. “It is going to be how quickly can we go from an immature team to an experienced team,” Lalor-Nielsen said. “And that is going to take a little time competing against high level teams.” Shoemaker and Taylor are the team captains, while freshmen Hess and Richards are the up-and-comers to watch. Hess entered the week leading the team in goals with five.

Godfrey is the returning leading goal scorer. The speedy midfielder had three scores last year. It would have been senior Allie Boehmer, who had four goals last season, but a torn ACL will keep her out the entire year. “That is a huge loss for the team,” LalorNielsen said. “That is why we have three freshmen playing forward.” Westview and Torrey Pines are the favorites in the Palomar League. Freshman and sophomore players are being thrown into the mix this season for each of the local teams. How quickly they mature will likely be the deciding factor in just how far each team goes. Poway has only three seniors on the roster and will lean on three freshmen forwards to bolster the offense. at goalkeeper and they have been thrown into it because we need them to be ready. We can score three or four goals a game, but we are still trying to figure out our defense.” This could end up being one of the most explosive offenses Poway has ever had under Morris. Center midfielder Flores, who did not play high school last year, is one of the top players in the county. He leads an allstar cast of midfielders, including returners Gallagher, Reyes, Peranteau, Berr y, Bedoya, Cedillo and Hayne. “Flores makes ever yone else around him better,” Morris said. “He is incredibly quick and even though is 5-foot-7 he can out jump a 6-3 guy for a header. He is a really gifted player.” Flores and Reyes are committed to San Diego State, while Peranteau is a Chico State commit. He is out with an injury, but should be back by early January. A big question mark on offense will be how all these talented players handle playing time. “I can’t get enough guys on the field,” Morris said. “I can’t play them all. We are just going to have to sub a lot and they are not selfish as far as who scores the goal. This won’t be a team where one guy is scoring all the goals. We don’t need that. We can have five or six guys score 10-12 goals. And they are all friends and we have a lot of seniors so we have maturity. Those things help.” The Titans are in the newly created Open Division with Torrey Pines, Westview, San Pasqual, La Costa Canyon, Carlsbad, Hilltop and Chula Vista. “I like it,” Morris said of the new division, which aims to group the top eight teams in the county in one playoff bracket. “Putting us in a group like that is awesome.

That struggle could be coming to an end, as Rancho Bernardo appears to have the talent in place to be competitive in the Palomar League and get back to the postseason. “I think this year we have a pretty solid team,” Trecker said. “It certainly is not the team I had three years ago

when we basically were an all-star team and won it all, but our returners are very solid players and I think we will make the playoffs this year.” Dixon will be a huge part of any success the Broncos have this year. He is one of the top strikers in the area. He led Rancho Bernardo with six goals last year. Broton and Baggs will also be offensive threats for the Broncos, as the two scored three times each for the Broncos last season. “We have moved Kenzie into an attacking role this season,” Trecker said. “Last year he played defense for us, but we are going to rely on the combination of Eric and Kenzie. We think that will be a good part of our attack. Kenzie had a few goals last year. Hopefully, he can get some more this year.” There are still a few question marks in the midfield, but Trecker said he will figure that out as the season rolls along. The Broncos figure to be in the middle of the pack in

The Nighthawks finished in third place in league last year behind Ramona and Orange Glen. The Bulldogs and Patriots are once again the favorites in the Valley League. Del Norte was placed in Division IV for the playoffs, where it should have a shot to win it all. “I think it is there for us to take as long as we work hard and have the right attitude,” O’Rielly said.

We have been reaching out to people to come to the games, but the best way to do it is to win.” The Titans have not only been winning, they have been beating some of the top-ranked teams in the San Diego Section. Poway entered this week with a 3-2 record, including victories over Foothills Christian, El Camino and Vista — all top-10 ranked teams in the preseason. The only two losses the Titans have suffered are to No. 1 La Costa Canyon (56-46) and No. 3 Hoover (57-54). And Poway played right with both the entire way. Erb, who prides himself on being a traditionalstyle, pass-first point guard, has played a key role in the promising start. He delivered 12 assists and five steals in a 57-54 loss to Hoover last week. He followed that performance with a 13-assist, four-steal night in Poway’s 58-28 rout of Vista. For his efforts, Erb is the Toyota of Poway Athlete of the Week. “Any time you have someone that is good at and willing to pass, your team is going to be better for that,” first-year Titans’ coach Fisher said. “We are hoping he shoots the ball better, too, but even when he is not shooting well he is still a major contributor to our offense by giving the ball to people in spots they can do something with it.” Erb says his love of passing goes back to what his dad taught him as a youngster. “It all stems back to my dad,” said Erb, who entered this week with a section-leading 50 assists. “He is the one that always taught me to be a pass-first point guard. I just love it because when you are a scoring point guard you are the first guy that has the ball and nobody wants to watch you go down and take the first shot. If you are a passing point guard, everyone is involved

and everyone enjoys playing with you.” The floor general has a ton going for him off the court, too. He always has put academics first, carrying well over a 4.0 GPA and staying involved as president of the Environmental Club at Poway. It all paid off recently, when he committed to the prestigious Pomona College. Forbes ranks Pomona No. 2 in the nation on the list of top colleges, behind only Stanford and one spot ahead of Princeton University. “I chose Pomona because, first of all, they have the program that I want to do (Environmental Policy),” Erb said. “And coach Charles Katsiaficas seems like the kind of coach that is a relationship first guy. That’s what I want to have and I think he will be able to build me into the player and individual I want to be.” But right now Erb, along with his teammates, are concentrating on building the Poway boys basketball program where they want it to be. They want packed crowds, an energetic atmosphere and the community to be excited about going to a game. They want the buzz the football program has had over the past three years. But there has been little to buzz about when it comes to the Titans’ boys basketball program. Poway has not won a league title for 15 years and the last time it won a section title was 1992. These Titans believe they can make one or the other or maybe even both happen this year. “We have not won a league title since 1998 and we are reminded of that every time we step foot in the gym because of the banner on the wall,” Erb said. “Winning a league title would be huge. That would be something that would bring the community and Poway basketball back.” And that would be one more thing “Tommy Titan” could leave Poway feeling proud about.

He features a fastball, changeup, curveball and

slider. He said he has started to gain interest from colleges, including Sonoma State, Texas A&M, Michigan State, Texas Christian University and Ohio State. “He can definitely help out a college,” Williams said. “He has the ability to pitch at the Division I level. He needs somebody to overlook that he hasn’t had that many opportunities at other places and see what he is actually physically capable of.”
