All About Guardianship

Guardianship over a loved one may be necessary when either a disabled minor is six months from turning eighteen or an adult family member is suffering from mental health issues, serious illness or condition, impairment, or some other disability that prevents a person from managing their own affairs or make or communicate important decisions about the person’s self. In order to become guardian over an individual, you must file a petition with the Clerk of Superior Court and participate in a hearing. The Clerk must find by clear, cogent, and convincing evidence that the individual is incompetent and that a guardian should be appointed. There are three main types of guardianships in North Carolina: 1. Guardian of the Person – power to manage the care and custody of an individual. 2. Guardian of the Estate – power to manage a person’s finances and other business matters. 3. General Guardian – has the powers of both guardian of the person and guardian of the estate. Each case is different and it will depend on the specific facts and circumstances as to what type of guardianship is needed. The guardian appointed will depend on the specific facts as well. It may be an individual, a corporation, or a disinterested public agency. Making the decision to have a loved one declared incompetent can be a very overwhelming. Most people feel a sense of guilt when having a loved one declared incompetent. Additionally, families may disagree as to who should be guardian over a loved one.
