By Jane Harrison Georgia has filed a federal court motion requesting dismissal of the Florida lawsuit for equitable apportionment of water in the Apalachicola-ChattahoocheeFlint river system. Georgia argued in the 30-page motion filed Feb. 16 that without federal government’s direct participation in the case, the U.S. Corps of Engineers could not be bound by a court order addressing water apportionment in the river system where federal dams control water flow. Any court resolution of the case, therefore would not solve the decades-long water conflict, nor would it offer the relief Florida seeks in the lawsuit filed against Georgia in Oct. 2013. Georgia attorneys’ call for dismissal followed a request by U.S. Solicitor General Donald Verrilli that the federal government act basically as an observer but not an active participant in the case. In a U.S. Statement of Participation, filed with Special Master Ralph Lancaster Feb. 9, Verrilli asked that the federal branch be allowed to take part as amicus curae, which means it would not be a formal participant, but would monitor the course of litigation.

The U.S. enjoys sovereign immunity and is not required to participate in the lawsuit; nor could it be compelled to action by the court in an amicus position. Verrilli requested the U.S. be granted access to evidence submitted during discovery and depositions, but not be required to submit evidence. He also asked that the U.S. states be given an opportunity to broker a deal between the states, asserting the Department of Justice has “considerable experience in facilitating settlement of complex water disputes through direct participation in negotiations and through alternative dispute resolution.” Georgia’s dismissal motion contends that the U.S. is an indispensable party in the legal case because of its authority over water release from federal dams on the river system. Writing for the attorney general’s office, Georgia attorney Craig Primis described a limited U.S. position as a “fatal stumbling block to proceeding with this case (because) Florida can only get relief through an order that is binding on the United States, and yet the United States has refused to sub-

ject itself to an order entered in this case.” He added the U.S. participation as amicus with requested access to discovery evidence and dispositions “is tantamount to a concession that the United States requires intimate and routine involvement in this litigation to protect its interests and fulfill its statutorily prescribed responsibilities. The only way the United

States can have the rights of a full party is if it assumes the burdens of a full party – including most significantly the burden of being bound by a final order or decree.” The major thrust of Georgia’s dismissal motion is that the lawsuit would not dictate how the federal government allocates water on the river system. Thus, even if Florida prevailed, it would See Lawsuit, page 11

Lightning facts: Which boats are most likely to be struck If you are a member of BoatUS and have your vessel insured by them, you may have seen the article on “Striking Lightning Facts” that appeared in the January 2015 issue of Seaworthy, their insurance publication. Their insurance division keeps tabs on lightning strike claims, and have accumulated quite a few facts we boaters may want to review. On average, one in a million people gets struck by lightning in any given year, but an analysis of 10 years of lightning claims data from the Boat US Marine Insurance files have found that about one in a thousand boats has a lightning claim each year. Now that should get the attention of us mariners who love to be out on the water between the months of June through September, the top months for fast moving and violent thunderstorms. We’ve all been there and know

Any boat can be hit, even personal watercraft, but boats with a high metal pole reaching up to the sky is vastly more likely to be a target. Consider the following data based on claims data

Holiday Marina will begin 2015 season with new restaurant, floating store By Pamela A. Keene Change is coming to Holiday Marina for the 2015 boating season. By early May, the marina will open its new floating store near the current gas dock. Additionally, a new restaurant will open before summer. The Twisted Oar will offer onthe-water dining when the season begins. Owner Cary Eubank plans major renovations of the existing restaurant, including moving the

bar to the deck side of the restaurant. “We’ll offer bar service from a two-sided bar, because the lake is what we want our customers to see,” he said. “As far as the food goes, we’re going to mix it up a bit. I love doing things outdoors, like Cajun boils, oysters and smoking pigs, so we plan to do something every weekend as far as food.” The décor will have more of a lake-beach theme. “The menu

will include basic entrees, lots of appetizers, wings and fingers, and pizza,” Eubank said. “We’re also planning to start delivery to boats in the marina after Memorial Day.” The Twisted Oar will include a full bar and offer catering services. The Twisted Oar will also have an NFL and football package. “It will be a touch of a sports bar wrapped around the lake,” Eubank said.

The new floating ship’s store will be located adjacent to the existing gas docks. “It will offer more convenience for our customers, with a convenience-store feel,” said Alex Laidlaw with Westrec Marinas, which owns both Holiday and Sunrise Cove on Lanier. “We’ll offer a broader range of beverages and food, plus a nice refreshed look.” Plans are to build an all-new floating concrete gas dock in the

fall to replace the existing dock. “Our gas dock is one of the largest on the lake and this is an upgrade we’ve needed for a long time,” Laidlaw said. The 1,500-square-foot store will be attached to the existing gas dock until the new floating gas dock is complete in the fall. The two construction projects have been timed to minimize inconvenience during the boating season.

The motion posits that the lawsuit cannot satisfy Florida because it cannot compel the U.S. to act, but that the Corps’ manual might “result in flow regime in the Apalachicola River that satisfies Florida’s asserted water needs – and thus remedies the very harms Florida asserts in this case.” It adds that if Florida still claims harm after the water control manual is completed, it can seek relief through the APA. Lancaster, appointed by the Supreme Court as Special Master

in November, has repeatedly urged the states to aggressively pursue a settlement to avoid costly litigation and a ruling that neither state wants. In a teleconference with states attorneys and a U.S. attorney Feb. 10, he reiterated: “I am not very good at predicting things; but at the risk of prognosticating wrong, let me say that I think that when this matter is concluded – and I hope I live long enough to see it happen – when this matter is concluded, at least one and probably both of the parties will be unhappy with the court’s order … . But I can tell

you that I can see an order which requires Georgia to produce a certain volume of water or an order that says that Florida has to get along with what it’s got … . I, again, urge you to consider the fact that before this case is over – if it continues in its present order, both states will have spent millions and perhaps even billions of dollars to obtain a result which neither one wants.” He further advised the states to take seriously the U.S. Solicitor General’s offer to help mediate a settlement. Georgia responded with the motion for dismissal.

ACFS drawn into ‘water war’ legal battle By Jane Harrison The private non-profit organization whose goal was to amicably solve the water wars outside of court is being sucked into litigation. The Apalachicola-Chattahoochee-Flint Stakeholders has been subpoenaed by the state of Florida in its federal lawsuit against Georgia over water in the river system. The group whose motto is “working together to share a common resource” has basically shut down since late October, when it last met at Lake Lanier Islands Resort. No face-to-face governing board meetings have been scheduled since that tension-filled session in Buford. Their major project, a science-based water sharing plan supported by $1.5 million in private donations, remains unfinished. ACFS Chairman Jim McClatchey would not say what information Florida seeks in the subpoena filed in late January. He indicated ACFS was “trying to figure out” how to react to the request, but that they have an attorney working on a response and would meet the court’s deadline, amended to May 2015. ACFS was one of three nongovernment entities in a flood of subpoenas served by Florida from the Chattahoochee River’s northern headwaters in Habersham County to its merger with the Flint River at Lake Seminole at Georgia’s southwest corner. (See related story).The organization is composed of individuals from Georgia, Florida and Alabama with connections to the river systems tapped by the three states. It includes representatives from city and county governments, industries, businesses, fishermen, farmers, historic/cultural, environmental, conservation and recreation groups. Their major project, the Sustainable Water Management Plan (SWMP), originally scheduled for completion in June 2014, remains in the works, McClatchey said. He would not comment about whether Florida wants access to thousands of pages of data collected by university researchers preparing the tri-state water sharing model. ACFS governing board members at the October session indicated they had not even seen the data presented only to executive committee members. McClatchey said the lawsuit “has made our job harder” but has not halted SWMP research. Florida filed suit in Oct. 2013 despite ACFS urging to delay legal

action until it could present a science-driven plan to share the resource. Florida’s suit accuses Georgia of hoarding water and drying up the oyster-based economy and natural environment in the Apalachicola region. S. Gordon Rogers, ACFS vicechairman of the technical committee, offered a different version of how the lawsuit was affecting its major project. The SWMP “is not ready. The Supreme Court situation has brought it to a screeching halt,” he said. He said he did not know what was going to happen to the high minded plan. “I’ve put five years of my life into this thing. None of us is happy,” he added. He indicated various ACFS groups are clamming up behind protective shields guarding their respective interests. “I hope we

can get past all this,” he said. “It’s important work. I would like to see it crank back up.” The 56-member group, formed in 2009, has plied through difficult waters before in its efforts to make peace between the states. The governing board and various committees have made hundreds of critical decisions by consensus and function under the rule that any action could be stopped by just one member saying “I can’t live with this decision.” ACFS officials have held up their organization as an example to the warring states that tri-state entities can work together. Chairman McClatchey commented on the irony of getting drawn into the legal fight through the Florida subpoena. “Our whole thing was to avoid litigation,” he said.

Florida opens floodgates with subpoenas By Jane Harrison Subpoenas sent by Florida to cities and counties that tap water from the Chattahoochee and Flint river system have public utility employees digging into boxes and scanning electronic archives. Florida is seeking what could amount to millions of pages of water-related documents from Georgia municipal and county water departments to submit to as potential evidence in a federal lawsuit against Georgia. The Sunshine State also wants records from at least three private groups in its attempt to prove the lawsuit’s allegation that Georgia is selfishly draining the water supply and harming Florida’s interests downstream. The cities of Gainesville, Cumming and Buford are among subpoena recipients extending from Habersham County in the Georgia mountains to Bainbridge at the southwest corner. Copies of subpoenas obtained by Lakeside News shows the broad scope of information Florida seeks. In short, within 90 days of subpoena delivery it wants all documents – past, present, and future – that have anything to do with water. Cumming Director of Utilities Jon Heard said Florida’s request, as is, would require the city to “go through every single record at city hall … something we don’t want to wade through.” He reported the city attorney has contacted Florida lawyers about finetuning their request to at least a more focused time period. Gainesville Public Utilities Director Kelly Randall said his department “will cooperate in whatever way we can” to produce documents that basically “contain anything relative to water supply from the last couple of decades.” The subpoena sent employees of some water departments scrambling to city hall basements to sift through boxes containing decades-old paper records. Overwhelmed with the mountain of documents they were asked to produce, representatives from Cherokee County, Americus and Albany requested and got a 30day deadline extension from the special master presiding over pretrial proceedings. Georgia has also requested voluminous records from Floridians, delivering subpoenas to county governments, seafood and oyster businesses, environmental/conservation groups and two universities. In a Feb. 10 teleconference with Special Master Ralph Lancaster, attorneys representing both states discussed the tremendous task of assembling hard copy and electronic data and sorting through it. Georgia attorney Craig Primis said the state will be contracting additional attorneys to review the massive files compiled by consulting firms. Lancaster commented on the expense both states will endure if the case continues on its current course. He again urged the states to pursue settlement to avoid spending potentially billions of dollars in litigation.

LAKE LANIER OLYMPIC VENUE Hunter Regatta opens spring rowing season By Jane Harrison About 1,500 rowers from an estimated 40 teams from around the Southeast will dip oars in Lake Lanier March 28 in the John Hunter Regatta. After a long winter of sweating indoors on ergs, college and high school athletes will show their stuff in the early spring regatta at the Lake Lanier Olympic Venue. Some crews will stay over the next day to compete in the smaller Lanier Sprints Regatta. The 29th annual regatta known as “The Hunter,” organized by the Georgia Tech Crew and Saint Andrew Rowing Club, from Roswell, is comparable to the college grid iron opener for crews around the region. The early spring rite on Lake Lanier draws thousands of spectators who traditionally fill area hotels and restaurants in Gainesville. Some visitors come back the next day for the Lanier Sprints Regatta, a smaller competition run by the Lake Lanier Rowing Club that offers some events not scheduled in the Saturday regatta. The two regattas mean double duty for many LLRC members who assist with The Hunter and run the club event the day after. Hunter director Nils Thompson expects fewer crews than in previous years due to competing regat-

tas elsewhere. Several women’s teams from North Carolina, Tennessee, Florida and Texas are on the entry list for the San Diego Crew Classic, also March 28. Other crews from those states will join rowers from Louisiana and Georgia at the Lake Lanier regatta. Thompson said regatta officials had “had no discussion” about bringing the regatta back to LLOV. “It is by far the best venue in the Southeast,” said the long-time rowing supporter who helped with 1996 Olympic rowing at the venue. He added that he has kept up with reports about improvements at the venue and looks forward to seeing them first hand. Rowers will put their feet down on two new docks purchased by GainesvilleHall ’96 last fall. “I haven’t been up there yet to see them, but I’m sure they’re very good,” Thompson said. The sturdy docks of Brazilian hardwood pose a stark contrast to the sagging, splintered original docks left over from the Olympics The double regatta weekend will close the Clarks Bridge Park boat ramp and cause heavy traffic on Clarks Bridge Road, especially on Saturday. Admission is free, but there is a parking fee.

GH ’96 hopes to get funding for LLOV improvements By Jane Harrison A tower bridge, enlarged concession area, additional restrooms, and reception rooms are among more than $600,000 in improvements on the drawing board for the Lake Lanier Olympic Venue. The venue’s governing board studied architectural plans for enhancing the facility at its meeting last month in preparation for an international regatta in May 2016. The Gainesville-Hall ’96 board has several funding hurdles to clear before money for the proposed facelift is secured. With less than a third of the projected renovation cost in the bank, the board is looking to potential city, county and state money to help pay the bill. The board is striving to ready the ’96 Olympic rowing and canoe/kayak site for the Pan American Championships, a 2016 canoe/kayak Olympic qualifier. Additionally, it hopes the proposed renovations will roll out the welcome mat for more community events. Whether the money will come depends what local governments and voters decide in the coming weeks. Gainesville Mayor Danny Dunagan told board members that if voters approve the Special Local Option Sales Tax in the March 17 referendum, $250,000 would be available in July. Another $150,000 is possible, pending the city council’s approval of a GH ’96 funding request submitted last month. The county could potentially match the city’s input depending on how commissioners regard the GH ’96 funding request. Both governments contributed $150,000 each to operate the venue in 2014 and 2015. Hall commissioners narrowly approved funding for this year in a 3-2 vote. Dunagan also mentioned $300,000 in possible state funding. GH ’96 Director Mimi Collins said in January she sent letters to the Governor’s office and local legislators informing them of progress at the venue and the high profile regatta, but not specifically requesting state funds. If the money is secured, another barrier must be cleared before new construction can begin. Nick

Baggett, U.S. Army Corps of Engineers Resource Manager for Lake Lanier, told board members that any work on Corps property not already “in the footprint” of existing infrastructure would need Corps approval. The evaluation process, including an environmental impact assessment, could take 612 months. Collins then suggested the board focus on renovating the service building on the Olympic plaza and the tower interior. The planned bridge to the tower’s second floor would be subject to Corps’ approval. Architectural plans for the venue remake also depict big changes on the boathouse side, across Clarks Bridge Road from the tower. A drivethrough entrance crowned with a peak resembling the tower is shown fronting the boathouse, where interior renovations would accommodate business meetings, receptions and athletic training. Sketches also show a full length balcony facing the lake, an exercise trail, and re-configured parking area. Collins indicated the board plans to implement the master plan in phases, prioritizing what needs to be done first for the Pan Am Championship. In other GH ’96 business: • A smaller version of a MasterCraft professional wakeboarding event than originally proposed in December is being considered. Venue Manager Morgan House disclosed that he told a local MasterCraft dealer involved with the pro wakeboard tour that he was unsure if the venue could seat an expected 10,000 spectators. Discussion had previously centered on setting up temporary bleachers to add to the grandstand’s 2,000-seat capacity. No decision was made by late February. The event would also need Corps’ approval. • House estimated the venue generated more than $3 million in local economic impact is fiscal year 2014-15 with events that brought in 15,000 people. ‘Who Owns Water’ takes Gainesville crowd down the rivers By Jane Harrison A Lake Lanier area audience joined numerous environmental group members from around Georgia last month to view Who Owns Water, a documentary filmed by two brothers who canoed from the lake’s northern headwaters to the Gulf of Mexico in spring 2013. The screening at the University of North Georgia Gainesville Campus is one of many that filmmakers David and Michael Hanson staged in communities along the 500 mile river system that was their home for about five weeks. The movie attracted a diverse crowd of about 150, some of

whom expected to see exactly who owns the water in an embattled watershed coveted by three states. The message may not have been what they anticipated. Gorgeous waterscape videography, fluid poetic screen writing, and the colorful vernacular of river people in the film transform the water wars into a 50-minute artistic flow. Self-made scenes of Michael Hanson working the paddle with lightning cutting across dark clouds over his shoulder, orange and peach sunrises over a ribbon of silver, and an acoustic track of river songs and roots music illustrate David’s lyrical narration and the culture of the

Those stories show the personal connection people feel with the rivers far from the bullish rhetoric of lawsuits. Local paddler Gary Gaines, who met the filmmakers near his get-away on the upper Chattahoochee, tells about the river becoming more shallow outside his cabin door. An eight-boat of rowers demonstrates unity, grace and strength stroking near the Lake Lanier Olympic Venue. The turbulent action on a full and stormy Lake Lanier settles south of Buford Dam with trout anglers, a bagpiper, and folks peering down from private docks. After the brothers separate, with David paddling onto the Flint River south of the Atlanta airport and Michael continuing on the Chattahoochee, the people and environment of “the other Georgia” come into focus. Their relationship with the river is different from that of metropolitan residents with landscaped yards. David describes it as a raw, complex physical intimacy with the

water that irrigates their crops, puts food on their tables, and chills their beer. Camouflaged coveralls, slow Southern drawls, rebel flags, kettles frying catfish and whiskey on the porch form the backdrop and sound track as the brothers interview farmers, outfitters, and hand-made shack owners en route to their rendezvous on the Apalachicola River at the Florida line. There the flow turns to blackwater snaking south to the gulf, where they meet fourth generation oysterman “TJ” working his tongs near Apalachicola. So, who owns water? That’s what University of North Georgia student Martin Durand expected to find out before he saw the movie. Actually, he said he already knew. “Georgia does … the Chattahoochee is mostly in Georgia,” said the college junior who also came for the free Sweetwater beer at the reception and extra credit in biology class. After the movie, the brothers and Chattahoochee Riverkeeper Jason Ulseth fielded questions that reflected attendees’ particular interests. “Why didn’t you interview the Corps of Engineers,

they’re the ones who control the river system?” asked one. Others inquired, “What do you think of Glades Reservoir?” “What about raising Lake Lanier to 1,073 feet?” “Do you really think conservation can provide 2.7 million more gallons?” The question-answer session sparked conversation, which is what the brothers hoped the movie would generate. When asked about the message they wanted to convey to their Georgia audience, Michael responded, “We want to connect people who live along the whole basin, above and below, and to start a conversation” about conservation. He indicated that after hanging out with an oysterman, supping with a catfish angler on a houseboat, and flipping a canoe on whitewater at a river’s source, you get a bigger picture of who owns water. The movie’s final narrative surmises: From the fly fishing shop to the oyster bed, we own the whole thing. Maybe one day they’ll say the people who own this water saved it for us. Boat show stories and news about new toys With the completion of the Miami Beach Boat Show in the middle of February, the boat show season is mostly over. Most builders featured larger yachts than years past with more electronics and equipment than most yacht owners have seen in recent years. Joy sticks and side, forward scanning fathometers are now mostly standard and connect with your iPhone. Coupe is now the description on a lot of cruisers in the 30’ to 45’ class. Several smaller boats in the 18’ to 25’ class have new models powered with jet drives. Georgia builder Chaparral has two or three jet drive boats that offer comfortable cruising and are equipped for water sports. Boat shows always have some stories that you will remember. The Atlanta Boat Show had one of those several years ago. I’m sure some visitors will remember when the wakeboarding pond broke and water went cascading down the aisles. A lot of things got wet but nobody was hurt. Everyone hopes that’s the last time that happens. My story was when I sold the Queen of the Miami Boat Show – one of the first 46’ Bertrams. A client wanted a 46’ Bertram. I had just sold his 36’ Trojan flybridge so he and a friend met me in Miami. We toured the Bertram facilities and went to the show. After he checked out the boat he said “I’ll take it,” so I went to the Bertram desk to get the sales agreement together. I went to find my client and his friend and couldn’t find him. After some time had passed the Bertram man said he needed a deposit and signature. So I made arrangements and signed. I got back to Clearwater, and no client. His wife called and wanted to know where he was. About 10 days later I was advised the boat was in St. Petersburg and ready to be delivered. I was sweating. I didn’t have that kind of money. About that time he called and said he was ready to close and take delivery. He told me that he and his friend went to the Bahamas to go to the casinos. I felt much better after piloting the yacht to his slip after closing. There are a lot of good stories heard at boat shows about boats and the characters that own and pilot them. This month ushers in severe store season As I said in last month’s column, I thought February would be the coldest month of the winter. As it turned out, it indeed was. We even set a record low on February 20th of 16 degrees in Atlanta. On that same night, Blairsville, up in the northeast Georgia mountains, dropped to -2 degrees. The biggest story from last month was the devastating ice storm centered around Lake Lanier and to the north. The set up included a strong area of arctic high pressure that brought in a very shallow later of cold air (below 1800 feet). This cold air wedged itself down the east side of the mountains and “pooled” across northeast Georgia. Temperatures remained just below freezing and never moved. Above ground, at an altitude of 5,000 feet, the temperature was in the mid-40s. When I saw this setting up, I just cringed. As the snow from the higher clouds fell into the warm layer, the snow melted into rain drops. The rain then fell on to the sub-freezing ground, where it formed a layer of ice on roads and trees. Between a quarter to half inch of ice accumulation was very common. The sheer weight of the ice was just too much for the trees to handle and one by one, they came crashing down on homes and power lines. Many residents were without power for nearly a week.

So now we head into my least favorite season of the year. Aside from Glenn the pollen, it’s severe Burns storm season. I do expect a very active seaLanier son. All winter long we Outlook have been dealing with two jet streams over the United States. The cold polar branch has been bringing us the cold arctic air. The southern branch, which has been cruising over the Pacific Ocean, and Mexico, brought us the moisture and our ice storm. It is this southern branch I am most concerned about. When spring storms erupt, these strong upper level winds over the top of the storm bring the storms a tremendous amount of energy. As winds increase from the surface to the top of the storm, this wind shear can cause the air to begin to rotate horizontally. As storm updrafts become stronger, they will tilt that rotating wind into the horizontal. This is the beginning of a tornado. I don’t see much change in this upper level wind pattern so let’s get ready this month. From useless coupons to free cruises, we get them all Bob and Carolyn Wilson, aboard Sea Island Girl, continue Lakeside's long running series of cruising adventures which began in the mid-1990s. To date we've had the Johnston family, Jean and Bill Bayman, and Mechelle and Bill Cooksey all contribute to the series. Bob and Carolyn boated on Lake Lanier until leaving for their adventure in 2002. Being at home this winter cruising season has opened our eyes. Never would we have imagined that we would receive so many Robocalls and useless coupons or solicitations by mail! These are daily occurrences that do nothing more than clog up the answer machine and mailbox. While traveling, the unsolicited mail is not so much a problem as our trusty mailman never forwards third-class mail, or our mail forwarding service on the other end has been requested to simply discard it. The phone calls cannot be stopped despite the Federal No Call List and we usually find 60 or more messages on our answer machine that need to be sorted through when we return home. In any given week, there will be cruisers, runabouts, wakeboard boats and bass boats in the shop. He balances his restoration and repair work between boats and motorcycles, with an occasional automobile thrown in. we love going to concerts at the Tabernacle.” Chris is helping Crystal launch a business making customized

etched glassware, bottles and shadow boxes. Within a couple of hours of launching a Facebook page for Crystal Life Designs, she had landed her first order to make two dozen etched glasses. “I’m so amazed by the power of Facebook,” he said. He attended his first Atlanta Boat Show five years ago and goes back every year. “It was such an eye-opener for me that first year,” he said. “I met more than 300 people that I never would have before and it was just amazing.” Garrison shows no signs of slowing down. “I have my hand in so much stuff, and I really like it that way,” he said. “It keeps me thinking a lot and it keeps me from being bored.” His experimenting with painting continues to keep him on his toes. “I really do love the painting, but, like I said, I’ll never let go of the fiberglass,” he said. “Boats rule the nest around here.” Garrison's handiwork can be seen with motorcycles, boats and cars.

Abandoned houseboat finally leaves Lanier By Pamela A. Keene Another eyesore on Lake Lanier’s shoreline is finally gone. After more than two years of legal research, soliciting funding and lining up sponsors and skilled suppliers, the Lake Lanier Association has bid adieu to a massive abandoned houseboat on the north end of the lake. “This has been a long time coming and we’re glad to finally have the houseboat off the lake,” said Joanna Cloud, executive director of the Lake Lanier Association, who spearheaded the removal. “Part of the challenge is that the houseboat needed to be moved into a more land-accessible area before we could actually get it out of the lake. It had been abandoned in a remote part of the lake near marker 28C and any access was difficult.” Late in 2014, the association initiated moving the boat to a construction site near Latham Creek where Marine Specialties Inc. was completing a rip-rap job. “Tom Child and his staff are always so

willing to step up and help us,” Cloud said. “They were able to pull the abandoned boat for us so that we could move on to the next step.” Then Cloud set about finding additional sponsors and suppliers who could dissemble the boat and haul it away by land. Several companies stepped forward, including Ryan Bennett, of Lanier Dock Systems, and Chris Jones, who owns a salvage company. “It was a happy coincidence to meet them both at the Atlanta Boat Show in January,” she said. “It turned out we needed additional assistance and worked with Greg Mason of Lakeside Transport, who had a large trailer to help us haul the boat away. Once he was in the mix and we found out that he had the equipment we needed, I knew we were golden.” The boat was finally removed in midFebruary; it was taken to a salvage yard for scrap. “Granted, it sat at Latham Creek longer than we – and I’m sure the area residents – wanted it to, but we are so thankful that it’s finally off the lake.” Volunteers prepare the abandoned houseboat for its trip to the salvage yard near Gainesville.

All Georgia trout waters may open year round By Jane Harrison After the Georgia trout season opens on March 29, it may never close. The overwhelming majority of trout anglers at a Georgia Department of Natural Resources hearing in Gainesville last month expressed enthusiasm about a proposal that opens all Georgia trout water to year-round fishing. But, a couple mourned the potential loss of opening day traditions passed down for generations. The hearing was the first of two in North Georgia to gauge anglers’ opinions about removing the “mountain” trout season. That season runs from late March through October on 40 percent of Georgia trout waters. The potential regulation change could put anglers on Lake Lanier’s high elevation headwaters in the solitude of winter, long before the mayflies hatch. Hearing attendees hailed the proposal as progressive and long in coming. Alex Watson, a past Trout Unlimited chapter conservation chairman, said he trusted the DNR’s judgment and scien-

tific basis for the proposed change. He said members would enjoy fishing for wild trout in the small streams of the upper Chattahoochee above Helen. He added hardcore anglers will be out there in winter, especially on mild days such as the first February weekend this year when temperatures reached near 60. Fishing buddies Mike Pentecost and Terry Raber agreed. “There won’t be as many fish the rest of the year, but there will be a group of guys and girls who will go,” Pentecost said. He looks forward to possibly hitting Bogg’s Creek, Sarah’s Creek and the upper Chattahoochee when the weather’s right in winter. Raber said he’s out on year round streams even when ice cycles spike the water. “Gotta wear waders,” he said. He added opening up mountain streams year round gives him more places to get outdoors and fish. However, Lee and Jonathan Sisson denounced the possible end of an era. Opening day “is a tradition we’ve got here in Geor-

gia and it’s a tradition that means a lot,” Jonathan Sisson said. “My dad took me and I remember the excitement of opening season when I took my son. I’d like to take my grandson,” he said. Having 60 percent of Georgia trout streams open year round is enough, he added. Some anglers suggested traditionalists put a new twist on opening day by centering their annual ritual on the first March delivery of fish from DNR hatcheries. The Georgia DNR Board will consider responses at the hearings and written comments before voting on the proposal March 25, according to Jeff Durniak, DNR North Georgia Region Fisheries Coordinator. Approval would mean the season would not close as originally scheduled Oct. 31. It would never close. Durniak, who conducted the Gainesville meeting before about 20 attendees, said preliminary polling from about 7,000 respondents last fall showed a three-to-one margin in favor of the change. DNR estimates 100,000 anglers fish for

trout in Georgia. Forty percent of Georgia’s 4,000 miles of trout water designated as seasonal and can be legally fished from the last Saturday in March through Oct. 31. “Some of the best wild trout streams are in the higher elevations” and are classified as seasonal, Durniak said. These include the upstream watersheds and tributaries of the Chestatee River in Lumpkin County and the Chattahoochee River in White County. The upper reaches of Amicalola Creek in Dawson and Lumpkin and the left and right forks of the Soque River in Habersham have also been offlimits for winter anglers. Asked why the state imposed seasonal restrictions in the first place and what prompted the idea to remove them, Durniak said both scientific progress and social aspects figured in. “As a conservation agency, it is our mission to protect wildlife resources,” he said. The DNR originally limited fishing on designated streams to inhibit human interference with

trout reproduction and growth, he said. However, scientific studies have concluded that “most angling regulations have no significant impact on wild trout populations,” he said. Water quality (including floods and droughts), food, and geology primarily influence Georgia trout population and growth, he said. He cited trout population and size records from Charlie’s Creek in Towns County dating back to 1984 and data gleaned from studies in the Great Smoky Mountains National Park in North Carolina that found no decline in trout count or size after streams transitioned from seasonal to year round. Durniak said public demand for year round fishing on all Georgia trout streams has increased. “We’ve gotten more requests … this is the right time to bring it up” for DNR consideration, he said. Yard chores in March make for a better spring season By Pamela A. Keene Friday, March 20, can’t come soon enough. As the first official day of spring, it signals that warm weather is not far behind. By now, most of us are getting restless for warmer weather – either to work in the yard or to get back out on the lake. And while we’ve had a winter with vastly fluctuating temperatures, March should provide more consistent – and maybe a little warmer – opportunities to set the stage for your spring gardening – or boating. Will you pass the test? March is the perfect time to get your flower beds and vegetable gardens ready for the April arrival of plants at area nurseries and box retailers. The very first step is to have your soil tested. For less than 10 bucks through your local University of Georgia Cooperative Extension Office, you can find out your soil’s acidity or alkalinity, which influence how well plants absorb nutrients; evaluate its fertility and composition; and receive recommendations for the correct amendments needed to improve the soil for the particular kind of plants you’ll be installing. After you’ve collected the samples, take them to your local UGA Extension Office to be sent to the University of Georgia to be analyzed. In a couple of weeks, you’ll receive a detailed report about your current soil conditions and how you should enhance the soil to maximize your gardening success. Once you’ve found out what your soil needs, go ahead and do the amendments several weeks

before planting to allow for better integration of the amendments in the soil. Any nice “not cold” day in March is a great time to get those beds ready. Anytime is good for mulching The benefits of mulching far outweigh the work involved. Helping plants and soil retain moisture, protecting roots from the heat or cold and adding some nutrients to the soil offset the time and energy it takes to spread bales of pine straw or wheelbarrows and bags full of wood chips. Popular materials for mulching include pine bark, aged wood chips, shredded cypress or pine straw. You can buy it in bags at a local retailer or in bulk from a nursery or garden supplier. You can also make your own mulch by collecting leaves in the fall and shredding them, piling them with chipped wood branches, if you have a good chipper. However, allow “homemade mulch” to season over the winter or it will rob your plants of crucial nutrients, such as nitrogen. If you use fresh wood chips, the nitrogen in the soil will first go to break down the chips, robbing your plants of crucial nitrogen.

Mulching and pruning the woody stems of butterfly bushes this month will promote plenty of colorful blooms.

The proper depth for mulch is usually between two and three inches, but make sure you’re not covering the base stem of the plant. Leave about a two-inch space between the plant and the mulch. Mulching will save you money and time this spring and summer, because it helps hold moisture in the soil and it can reduce the

growth of weeds. It will also provide a finished look to your flower beds, shrub plantings and vegetable gardens. By the way, if you get your gardening chores done now, you’ll have more time to enjoy the lake as the weather warms up. Pamela A. Families enjoy fun, educational visit to Buford Trout Hatchery By Jane Harrison Foot-long trout attack a bait fish and snap it up. Six-inchers nearly fly out of the water to catch a bite to eat. Fingerlings churn the water in a feeding frenzy. Lucky anglers might occasionally see action like this on Georgia trout streams. But one does not have to be a fly fisherman in the wilderness to watch hungry trout grab a meal like piranhas. About half a million trout of all sizes swim the raceways of the Buford Trout Hatchery where

they put on a regular show. Several families toured the hatchery on the Chattahoochee River downstream from Buford Dam on a February Saturday, about a month before truck loads of hatchery-raised trout were delivered to seasonal streams opening March 29. The regular 1 p.m. Saturday “matinee” offers the public a chance to learn about Georgia’s trout rearing and stocking program. The hatchery is also open daily for self guided tours, angling at a kids’ fishing pond,

and walks on a nature/birding trail. Georgia Department of Natural Resources Wildlife Technician Travis Taylor entertained onlookers last month with the fishy antics of more than half a million browns and rainbows growing in the raceways. Security awareness is vital for mariners Everything in the maritime world, including numerous other elements of our society, revolve around adequate security. The process is taken for granted and sometimes easier said than done if recent news of events is any example. Effective and clearly delivered training in the skill of recognizing a threat equals improved awareness and most of all, increased safety. It is the foundation for the course of instruction mandated by the new National and International 2016 Standards of Training and Watch-Keeping (STCW) laws that govern all certified mariners and licensed officers. Its roots are derived from US Navy and US Coast Guard security requirements for ships and cutters, professionally designed for a more thorough understanding concerning situations that demand quick, concise action if needed. Program organization is the principle focus and the delivery of that information needs to be a basic – simple to apply – set of instructions and procedures to follow. This is not a concern for lake boaters but if you decide to travel offshore, near coastal, even inland waters, there would be a tremendous benefit from an increase in security awareness. This general type of training can also be helpful in terms of your own

personal safety when taking a cruise to a foreign port of call. The more you know the actual process of how to assess risk then the safer you will be. It all begins with an increase of awareness and knowing what to look for compared to an unprepared and often ineffective reaction to an incident. Prior to mid-patrol break and foreign port visits on USCG and Navy ships we would be briefed on local conditions, real time information, something that would be of great value in all regards, especially personal safety both ashore and onboard the ship while moored. Everything should be considered including sights to see, places to dine, emergency services, and of course, areas where not to venture into. We even deployed a maritime form of law enforcement called Shore Patrol to provide extra protection to crew members and to work with

local authorities if needed. All these procedures would greatly benefit everyone, increasing all aspects of vessel security awareness. Each port presented different characteristics for consideration in security, all of which was effectively handled utilizing a straightforward, easy to operate system. Our world is rapidly changing and the security measures to counter threats is ever expanding. The two most important objectives: risk management and enhanced situational awareness are the fundamental parts. One half day, STCW approved course of instruction on Vessel Security Awareness, delivered by retired U.S. Coast Guard professionals with years of experience in this arena, is now available here in the Atlanta area beginning this spring. More and more abandoned vessels and docks have started to appear at Lake Sidney Lanier over the past few years. After receiving several reports of abandoned vessels and docks around the lake, the U.S. Army Corps of Engineers decided to initiate a concerted effort to remove these eyesores. As managers of the lake and its shoreline, the Corps is working very hard to protect Lake Lanier. But, we do have limitations on our manpower and resources in addressing abandoned property issues. Because the Corps does not have the appropriated funds to remove abandoned vessels and docks from the lake, we reached out to some of our partners, particularly the Lake Lanier Association and the Georgia Department of Natural Resources, in the spring of 2014 to discuss partnering to address this issue. Abandoned vessels and docks in disrepair violate the 2004 Shoreline Management Plan on Lanier. Once a vessel or dock is identified as an issue, the Corps attempts to contact the owner and require him or her to remove the property from the lake and/or repair the vessel or dock so that it is safe and useable. Depending on the situation, the Corps has different tools that can be used to address violations, such as imposing fines on owners of the abandoned/unauthorized property, impounding the abandoned/unauthorized property in place, revoking dock permits associated with the owners of the property, and/or issuing citations to appear in federal magistrate court. If the owner is known, the Corps will first notify the owner verbally, and then send a written notice and/or a warning citation, allowing 30 days to make the nec-

essary repairs and/or remove the vessel or dock from the public property. If corrective actions are not completed by the deadline, the next step is issuing a citation requiring that the owner appear in court. Pending the outcome of the court case, the judge may require compliance and assign a deadline to have the issues corrected. However, sometimes the Corps cannot determine who owns an abandoned vessel or boat dock. These are the cases that challenge the Corps and its partners. In response to this challenge, the Lake Lanier Association has developed a spreadsheet to assist in tracking abandoned vessels and docks. Since the beginning of this partnership, the association has been very instrumental in removing two vessels from Lanier – one houseboat and one sailboat. The Corps has also been working with local, county, state and federal agencies in the removal of various abandoned vessels and boat docks around the lake. The Georgia DNR is also assisting this effort by locating registered owners of the vessels and the reporting of abandoned vessels. There is still much more that can be done. Walter Mitty Race brings historic sports car racing to Road Atlanta When I stepped out of a race car in 1971 as a professional driver, I assumed that I would never return to my dangerous occupation of the previous 10 years in Europe. I simply walked away without looking back and stepped into a life of raising children, being a fishing guide and writing articles about the outdoors and traveling to interesting places. It was one of those writing assignments in 2003 about Panoz racing cars and Road Atlanta that brought me back in touch with my past. It only took a few laps driving the 2.56 mile course at Road Atlanta and a day reliving memories on the historic concrete of Sebring in Florida in a real racing car to make the old juices flow again! As I parked the Panoz GTS behind the pit wall at Sebring after an exhilarating day on the track, my heart was racing from the rampant adrenaline rush, and I knew that the racing bug had bitten me for the second time in my life. Though I had no idea of how or when I would ever strap on a helmet again, the wheels in my head were turning fast. Since I drove a Mazda Miata every day and had owned several of them since 1991, I toyed with the idea of renting one for a driver’s school. Knowing, however, that just the school experience would never be enough to satisfy my new “need for speed,” I began investigating the current Club Racing classes and stumbled upon Spec Miata. I knew this would be the path for me to follow for fun racing. To make a long story short, that beginning led me to another 10 wonderful years of very competitive road racing during my 60s that I could have never imagined. I even won the Southeastern Championship in 2004, had a number of podium finishes and

But, as I eased in to my 70s, I knew it was time for a new direction that would allow me to drive a few more years in a calmer atmosphere. That’s when I discovered HSR (Historic Sportscar Racing), who happen to host one of the most prestigious vintage car racing events in the world at Road Atlanta every spring. HSR began during the 1970s at Road Atlanta with the idea of highlighting the race cars from the past ... many of which I had driven in Europe during the 1960s. HSR’s efforts have provided a venue for competitors and spectators alike to share in the wonderful history and excitement created by the cars that competed at race tracks around the world. This includes many race cars and motorcycles that date back to the early 1900s, but includes early Miatas like mine that are now more than 25 years old. Though I didn’t finish any higher than 4th at the 2014 Walter Mitty at Road Atlanta, I plan to do better this year. Nevertheless, if you want a fun weekend with lots of car lovers, great food, fabulous old cars everywhere and some of the best vintage racing seen anywhere in the world, plan to be at Road Atlanta for the

They plunge the small fry into a cold rectangular pool where they get fed by hand until they graduate to bins for bigger fish. Taylor demonstrated how the ravenous fingerlings “beg like puppy dogs” for pea-sized feed pellets made of reconstituted fish. The tiny fish boiled up the water at the wave of an arm and snatched up the sprinkles released from Taylor’s hand. Children giggled with glee. They rejoiced even more when Taylor let everyone get hands full of pellets to throw in and dipped his net in to bring up writhing trout for close inspection. The hatchery’s occupants get room and board, albeit in crowded quarters, before they are released into Georgia’s year round, delayed harvest and seasonal trout streams. They thrive in the concrete bins filled with cold fresh water pumped from the river flowing from the bottom of Buford Dam. They consume about 1,000 pounds of feed per

day and get liquid oxygen piped in. Fish raised at the Buford hatchery have metropolitan or rural destinations, south on the Chattahoochee River, west as far as Cherokee County, and north into Dawson County. Taylor said fisheries workers regularly turn loose 12-plus inchers on the Chattahoochee River near I-75/I-285 and in Amicalola Creek at Steele Bridge Road in Dawson County in the delayed harvest program. This is a management strategy for catch and release Nov. 1-May 14, allowing the big fish to be caught more than once. From mid-May to the end of October, anglers can catch and keep the lunkers that may end up on dinner plates or attached to a trophy wall. Fish travel by special truck from the hatchery in a half-ton of water and get piped or scooped out by net. Taylor said he’ll walk along a stream bank with a net full of trout and “throw ‘em in the water right over people’s heads … I haven’t hit anyone yet,” he quipped. Several of the dozen or so people on Taylor’s tour had pulled in 12 to 14 inch browns on the Chat-

tahoochee or Amicalola Creek. Cobb County resident David Watkins brought his 15-year-oldson Matthew and a friend to see the where their catch grows up. They planned to cast on the Chattahoochee upriver from the hatchery after the tour. Four-year-old Sophia Richards was excited about seeing so many fish. “She loves fish,” said her mom, Leah Richards, who with husband, Josh, brought the little girl to the hatchery on a Valentine’s Day family outing. Another preschool-age child, a rambunctious boy with a miniature tackle box, did not want to wait for the tour. His dad headed him straight to the kids’ fishing pond to try his luck.
