apply for a state economic development designation for the airport within the next month. The 425 agreements will allow the city and township to split tax revenue from airport property and undeveloped land that surrounds it. Because the airport is located in Clinton County’s DeWitt Township, none of that revenue is presently shared with Lansing. Ingham County taxpayers are the only ones in the tri-county area to subsidize Lansing airport operations.

Don Jenks’ home went into foreclosure because a blood clot broke loose from his lung and traveled to his brain. This was in July of last year. Jenks was in the hospital, recovering from open heart surgery. The clot caused a stroke that damaged his eyesight and partially paralyzed his right side. He had a job selling carpet. After the stroke he couldn’t work. He couldn’t afford to pay the mortgage on his condominium in Haslett, the one he bought after the divorce so his daughters could stay in the Haslett schools. His long stay in the hospital and longer stay at his sister’s house during his recovery meant he missed notices from the bank. He was trying to negotiate a mortgage modification with Flagstar Bank, but it was a real estate agent who came by to offer him cash for his house keys, essentially a payment to walk

LEGAL AID FOR RESIDENTS In June, the Ingham County Board of Commissioners approved a one-year, $60,000 contract with Legal Services of South Central Michigan to provide representation to county residents who have lost their homes or stand to lose them. The firm is representing Don Jenks in his foreclosure case. At the time, Board Chairman Mark Grebner called the contract “almost a no-brainer.” “We’re dependent on tax revenues, and every foreclosure that goes through hits us for hundreds and hundreds of dollars,” he said. “The property gets written down. It damages the property values of other houses. It’s just a mess for everybody.

away, who told him the property had been sold. He decided to fight the process “Because it’s my house. It’s my home. That’s the bottom line.” And his attorney, Perry Thompson of Legal Services of South Central Michigan, the organization retained by Ingham County earlier this year to represent people who have lost their homes or stand to lose them, has found a few reasons why Jenks might be able to prevail. Among the reasons is the signature on the document that transferred ownership of the mortgage on Jenks’ home to Flagstar Bank. It’s signed by a man named Robert Stoudemire, who is signing as a vice-president of Mortgage Electronic Registration Systems (MERS), but also is a VP at Flagstar. Careful examination of other documents signed by Stoudemire “reveals at least two distinct signatures,” Thompson wrote in a document in the case, which is underway in Ingham County 55th District Court. If at least two people were signing documents as Robert Stoudemire, the filing reads, “there is no reason to believe that any of these documents actually contains the signature of the real Robert Stoudemire.” The response from the opposing counsel was that Jenks simply doesn’t have the legal standing to make that sort of challenge, forged signature or no. The mortgage assignment was between MERS and Flagstar, wrote Tricia Nelson, an attorney with Schneiderman & Sherman in Farmington Hills, and so “The only party that may object to the language of the assignment is MERS or Flagstar Bank.” “Because the defendant is not a party to the assignment, the defendant cannot challenge the assignment.” The logic seems to be that, if MERS wants Flagstar to have the mortgage and Flagstar wants to take it, no third party should be able to question the transaction. Nelson cited an unpublished federal appellate court decision from Livonia Properties Holdings, LLC v. Farmington Road Holdings, LLC, in which the judges ruled the borrower couldn’t question a mortgage transaction between two other parties, although there were questions about the timing. But as the foreclosure crisis has unfolded, it’s become clear many of the country’s major lender were hardly faultless in their record keeping and sometimes willing to resort to questionable, and possibly illegal, methods to try to cover their sins. In that context, Thompson said, the argument is disquieting. “Michigan courts have very clearly

said that the person foreclosing has to actually own the mortgage and the note,” he said, “and if we can’t point out that they don’t, then (the courts’) holding is meaningless.” Neither Nelson nor Neil Sherman, the managing attorney at her firm, responded to messages left Oct. 24. But James Allen, an attorney with Miller Canfield in Troy who represented the lender in the Livonia Properties Holdings case, said the practical risk of accepting a mortgage assignment at face value didn’t seem particularly great. “I’ve actually never read of somebody suing for foreclosure and somebody else coming in and saying ‘I’m the true lender,’” he said. “The sheer number of cases coming through Michigan’s courts has turned the field of foreclosure law into something like an arms race,” Thompson said. “We’re constantly trying to come up with a new argument to save somebody’s house, and the banks’ attorneys are constantly trying to come up with ways of shooting that down.” Lorray Brown, managing attorney with the Michigan Poverty Law Program, said many of the practices now being questioned went on largely uncontested for years because Michigan is a non-judicial foreclosure state, meaning most cases never cross a judge’s desk. “The only reason these things started being revealed is because of the whole crisis, more foreclosures and more litigation,” she said. Jenks’ case still is a long way from the Court of Appeals, where it might set some sort of broader precedent. But Ingham County Register of Deeds Curtis Hertel, Jr., found Fannie Mae’s argument “preposterous” enough that he felt compelled to weigh in on Jenks’ behalf. “What it would mean is that two parties can agree to commit a fraud,” he said, “and nobody can challenge it.” For Jenks, it’s a matter of maybe being able to keep his home. He filed for disability last fall. With it, he said, he could pay what he owes. Only he hasn’t been approved yet.

Lansing would assume police and fire coverage responsibilities, although the airport has its own security system and DeWitt Township officials said the airport does not generate many calls for its police and fire services. City, township and airport leaders want the agreements to bolster their application for recognition as a Next Michigan Development zone, or “aerotropolis,” which offers tax incentives to businesses in hopes of attracting them there.

A new networking hub and resource for black business owners became official Monday with the launch of the Lansing Black Chamber of Commerce. “We are going to advocate for black businesses,” said chamber President Angela Pruitt, who owns Mid Michigan Business Solutions. “We’re another resource targeted towards a community that’s been somewhat ignored.” Pruitt said plans for the local chamber has been in the works since about March. Elementary school music programs cut in June will be restored in the Lansing School District, including introductory strings and band classes for fifthgraders. The district also will immediately buy 10 new school buses to replace the oldest vehicles in its fleet of 71. The Lansing school board approved up to about $300,000 for music and about $788,000 for the buses at its meeting Oct. 20. The district will use a portion of the $7.9 million surplus funds discovered in preparation for an audit of the 2010-11 budget to pay for music programs at the elementary level and

boost music programs at its middle and high schools. It would cost about $300,000 to hire three teachers, said Diana Rouse, director of elementary education and student services. But the district might not spend that much. Rouse said she hopes to have a recommendation to the board and get the jobs posted within the next few weeks. Board Secretary Myra Ford asked that the music program be brought back to the table. Her concern: Failing to teach kids the basics in elementary school could affect the quality of middle and high school music programs. On the transportation issue, Chief Operations Officer Brian Ralph told the board the district has 58 bus

routes and 59 reliable buses. Nine of its buses are 13 to 16 years old with excessive mileage. Three others require major repairs or overhauls. Ralph said it is not costeffective, efficient or safe to try to keep old buses on the road. The money for the school bus purchase comes from what is known as the Durant fund, proceeds from a class-action lawsuit about school funding filed in 1980 and resolved by the Michigan Supreme Court in 1997. That $1.6 million is earmarked for technology and capital purchases but cannot be used for instruction or operating expenses. Ralph said the buses can be delivered within two to three weeks of purchase.
