All around me I have noticed a certain sense of optimism across our fair land as businesses in all sectors are taking on more and more employees. Companies are expanding, order books are filing and to be honest, generally all round the feeling is good... as the shoots of recovery feel defiantly rooted in moving forward. Now, while the potential recovery is cautiously welcomed, we all seem to be optimistic about our sector growth. We do have a crazy twelve months ahead that indicates that Life has never been more interesting or challenging.

2014/2015 within the compliance industry sees some huge changes to the regulations used to govern how we both carry out our services and how you, the end user, protects your properties. We will, of course, cover many of these in future editions of Compliance News and we hope you find these topics interesting and informative. With our core services being electrical bias, the biggest change for Lantei will come from the latest release of Amendments 3 to the electrical wiring regulations BS7671 and how they will change and affect the installations we design, install, inspect, test and look after. With Lantei’s commitment to compliance safety, I will be hosting the first of many tech talks relating to the electrical amendments and their impact. Starting September 15th at Preston North Ends Football ground to small and medium size contractors, before launching on a series of industry specific Duty Holder seminars across the UK over the coming twelve months.

Engaging in local community causes The aim of these magazines are, I hope, to show you a little about the people behind the company, to bring a humanistic approach to our business and while there are informative areas within the content of each edition, there is also lots of information to share and celebrate. INDUSTRYNEWS... improvement notes Your insurance company wants you to have a report carried out on your electrical installation. So you contact three companies to get competitive

As mentioned, the electrical installation condition report is the first step to a continued program of maintenance that ensures safety, not the final stage, but the first step. While this is done by periodically testing and inspecting the property, it is the production of the report, its contents and subsequent actions which are important.

quotes, you accept one & the work is carried out report submitted and invoice paid... DONE!... not quite! Six months later you get a knock on the door by the HSE and now you find that you are being prosecuted. What went wrong? Your insurance company is happy, you have had your electrical report carried out So why are you being handed improvement notices to action? The reason for this is that with many people having these services carried out, once the report has been completed, they simply file it away at the bottom of a draw and never act upon the recommendations inside. The report could have a thousand observations on it but you could probably put money on them never being touched. The faults highlighted stay put until the next time the building is tested and the report never sees the light of day. I say, time and time again, a report does not make you compliant, it is what you do with it afterwards that matters the most. With all reporting services, they are the first step to ensuring a safe working environment, not the final stage.

What is a condition report? Once the inspection has been completed the real work begins. It is good at this stage of the article to highlight what an electrical condition report is not. It is not a certificate. It never has been. It does not certify that the installation is safe for continued use; it does not absolve you of all sin, and is not the answer to all your prayers. I have had countless people over the years ask that when the corrective works have been completed after the initial condition report was carried out, if they would like me to re issue a satisfactory certificate? My answer is no, it is not a certificate. It is a report.

All corrective works that are carried out are supported with the relevant certificate or work sheets. With the initial report and the supplementary minor works documentation, this is more than sufficient to highlight to the HSE that you are fulfilling your duty in ensuring a safe working environment.

Bogged down in testing data While many get bogged down in testing specifications, testing percentages, rolling programs and so on, just remember that the percentage of the installation inspected and tested is not as important as the report itself. Guidance note three of the Wiring Regulations 3.8.4 states “that the inspector must be familiar with setting sample sizes as carrying out 100% inspection and testing in installations is unrealistic, uneconomical and unachievable� Failure to address these issues will result in prosecution, as was the case with Keighley Lighting, a West Yorkshire firm prosecuted over unacceptable working conditions by the HSE http://www.hse.gov.uk/press/2012/ rnn-yh-13612.htm#!

should be actioned, or expect a call from HSE! In this instance, the HSE found that during their inspection, an electrical report had been left to one side for a considerable amount of time and, on investigation, it was determined that there were over 70 items highlighted which had not been dealt with.

It is pretty simple, whoever you have dealing with your inspection...

Protect yourself and raise awareness

a) A quotation to correct the works highlighted.

Keylighting Ltd, of North Brook Works, Alincote Street, Keighley, was prosecuted by HSE for breaching the Health and Safety at Work Act 1974 between 25 May 2010 and 25 January 2011. The company pleaded guilty and was fined £8,000 with £20,000 to pay in costs. This, and other examples of work place negligence, go a long way in helping raise awareness and creating safer working environments for all. Section 2(1) of the Health and Safety at Work Act 1974 states: ‘It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees’. And, while electrical inspection and testing is not a statutory requirement, the statement above is and is quite frequently enforced. So how can you protect yourself?

Condition reporting is a two stage process 1.You have your report carried out. This will require a test engineer to inspect and test a percentage of your installation in order to provide you with a report including any recommendations found at the time of test. 2. All corrective works that are carried out are supported with the relevant certificate or work sheets.

Ask them for two things b) A proposed program to highlight when and how the work is to be done. This will show that you have been inspected and there is evidence to prove that you are serious in keeping your work place safe. There has been a great deal of conversation regarding having different companies carry out corrective works and testing. In short, that is a decision for you to take; while it be advantageous for a company to maintain an element of commercial impartiality, it is not vital. As long as the work carried out is certified at the end, that should be enough. We have come across testing companies who insist that work should be carried out by another company; you must have the initial testers return to certify their work. Let me assure you that this is completely false. No matter how big or small the works are, the contractor is required to certify their work with the production of the appropriate certification. Claiming that their report will be void should anyone else touch your site is just plain incorrect and should be dismissed outright.

Blank cheques for additional work! One of the main problems encountered with periodic inspections were that they became blank cheques for contractors to drum up additional work in the form of remedial actions. The new reporting format was designed to eradicate that and bring a sense of trust and honesty back into the market. Multiple circuits protected by one device, untraced circuits and screws missing, was to be removed from the condition reports as while they may not comply with regulations, they do not in many cases impair the integrity and safety of the installation. Having a good understanding of both the client’s requirements, and that of the wiring regulations, is essential in order to approach an installation in a much more measured fashion.

How did Lantei come about? I blame my wife for that. Leona had a successful career in sales upon completing an honours degree in Business and always wanted to create something successful. I wasn’t really to eager to go into business as I have seen many companies try and fail, especially with the recession in full effect. Leona got me to take a week’s holiday in May 2010, thinking it was a bit of quiet time for the pair of us as we had been working so hard. Little did I realise that it was a ploy to show me what she could do with sales. That week Leona brought in over £13,000 of work and that was me sold. If she could do that in a week, what could she do full time? I had responsibilities at work with my team as CLM was going through a buyout by PHS, but once the deal was done and everyone’s job in my department was safe it was time for me to go. With nothing more than a four thousand pound credit card and a great deal of belief we set out as Lantei and have never looked back. 10

HSENEWS... comply with notices! A Hertfordshire tool supply company has been told to pay £27,000 for endangering workers after neglecting to maintain electrical systems and equipment.

Firms urged to pull the plug on £30m of wasted electrical safety tests.

Watford Magistrates’ Court heard that tools, including power hammers and grinding machines, as well as fixed electrical systems, were so poorly maintained at Arrow Tools in Waltham Abbey that they presented immediate and potentially fatal risks to employees.

Misleading advice and advertising, often by companies who offer the testing, is contributing to low-risk businesses such as offices, shops and hotels paying unnecessarily for over-the-top maintenance regimes. The law simply requires an employer to ensure that electrical equipment is maintained in order to prevent danger - it does not state that every item has to be tested or how often testing needs to be carried out.

The failings were identified by the Health and Safety Executive (HSE) during an inspection on 19 November 2009. HSE served four Improvement Notices on the company, including one to improve management arrangements, over an 18 month period. However, despite two extensions being granted to comply with the terms of the notices, subsequent investigations in 12 Nov 2010 and 7 April 2011, found there were still insufficient arrangements to properly manage risks.

Unnecessary electrical safety tests cost office-based businesses an estimated £30 million a year. It’s a myth that every portable electrical appliance in the workplace needs to be tested once a year - and what’s more it’s a costly one.

HSE’s revised guidance Testing appliances to ensure that they are safe to use can contribute to an effective maintenance regime, but in a low-risk environment most dangerous defects can be found simply by checking the appliances for obvious signs of damage such as frayed cables.

Recognise the risks Arrow Tools (UK) Limited, of Gordon Road, Waltham Abbey, was fined a total of £24,000 and ordered to pay £3,000 in costs after admitting a breach of the Electricity at Work Regulations 1989 and for ignoring the management improvement notice. After the hearing, HSE inspector Peter Burns said “It is important that companies recognise and acknowledge the risks posed by poorly maintained electrical systems, which could ultimately result in death – and this was the real danger here. The best way to ensure that these and other risks are controlled is to have effective management systems in place.” Peter continued, “Arrow Tools were served several Improvement Notices, including one in relation to their management arrangements, and were given ample time to comply. Yet they failed to do so and put their employees at risk for an extended period of time in the process.” Companies have a legal duty to protect the health and safety of their employees and other around them and this includes complying with improvement notices. Launching HSE’s revised guidance on portable appliance testing (PAT), HSE Chair Judith Hackitt said: “We know that low-risk companies are being mis-led over what the law requires when it comes to maintaining portable electrical appliances, and many are paying for testing that is not needed. “Businesses are responsible for protecting their employees, but they shouldn’t be wasting their money on unnecessary checks that have no real benefit. HSE has always advocated a proportionate, risk-based approach to maintenance. This new guidance is simple and clear to follow.” Nick Starling, Director of General Insurance at the Association of British Insurers, said: “Insurers have never required policyholders to undertake unnecessary portable electrical appliance tests which are not proportionate to the risk. “We welcome HSE’s guidance, which will help businesses focus on what they do best, free from worries about health and safety myths.”

Part of Bjorn’s task will be to change the face of outbound calls from the dreaded cold calling approach to direct sales to a more engaged added value approach to customer service. The Cricket Club can trace its origins back to 1875, making it the oldest of the local sporting Clubs. Hearing of Lantei’s commitment to community projects, they approached Lantei for support. We have over the last year taken part, supported or sponsored some amazing charity events, helping to raise over £20,000 for various charities. This ranged from cycling 500kms through Rajasthan for Save the Children right down to charity baking events which raised £10,000 for the suffering of Syria and more. LANTEINEWS... our proud team awards Winning the ECA national business awards A Preston electrical firm is celebrating after netting a major prize at top industry awards night. Lantei Compliance Services triumphed at the Electrical Contractors Association gala dinner and awards in Birmingham. The firm was crowned Small Contractor of the Year, which is awarded to a contractor with a turnover of less than £5 million who shows exceptional growth and development within the industry.

Established in 2010 Lantei, against all odds have grown to become one of the UK’s main provider of specialist electrical and work place testing services with offices in Preston, Newcastle and London. Without loans, external finance or in fact any debt of any kind. Lantei has seen some tremendous success over the last twelve months culminating in being awarded the silver award from Investors in People at the end of May and now this converted national business award. Directors Anthony and Leona Smith interrupted their two week family holiday to fly back to England for the awards for a couple of days on hearing of their nomination, while their parents holidaying with them looked after their children in Turkey. After winning the award Anthony mentions that “It’s still a little surreal, to be recognised for all you hard work is one thing, but to win a national award is more than we ever dreamed of. When up against companies who have been around for a lot longer, a commendation would have been tremendous, but to win, well it’s not quite sunken in yet.

Given that this weekend is also our wedding anniversary, it’s more than either Leona or I dreamed of. Again I thank the boys and girls of Lantei for their hard work and look forward to celebrating with them properly when we return from holiday” The Electrical Contractors Association is the largest electrical association of its kind in the United Kingdom and for us two Preston companies to have beaten off such stiff competition is remarkable. This year’s event will be hosted on the 29th 30th of May and will feature speakers such Clare Baldings with the awards being hosted by presenter and journalist Gyles Brandeth.

Winning Best Newcomer at Lancashire’s Prestige Business awards After three great initial years of trading Lantei found themselves fittingly awarded with best newcomer to the Lancashire business market in last night’s Lancashire Business awards 2013. With the glitz and glamour one can expect from Stanley House in Mellor, Downtown in Business’s seventh annual business awards was bigger and better, playing host to many of the region’s largest and brightest companies in a celebration of business achievement. Lantei Compliance Services found themselves up against some tough competition to pick up best newcomer to the Lancashire business market. Anthony Smith MD of Lantei mentions that “To pick up an award is great recognition for the hard work everybody at Lantei puts in. To be placed against such good competition and to win makes everone’s hard work worthwhile, I feel really proud.
