SUPREME COURT SAYS ACA IS LEGAL: HERE’S WHAT YOU NEED TO KNOW

Here it is, yet another article on Obamacare. The bottom line is we think the Affordable Care Act is here to stay regardless of the next election’s outcome. Changes will likely occur, but aspects will likely continue forever. So let’s talk about the history of the ACA, about important rules yet to go into full effect, and about where the ACA is headed. The ACA has faced many challenges, with two advancing all the way to the Supreme Court. Both times, the Court upheld the act. The first case, National Federation of Independent Business v. Sebelius, questioned the constitutionality of the “individual mandate” requiring Americans to purchase insurance. The court ruled it was a valid exercise of Congress’ power under the Constitution’s Taxing Clause. The recent King v. Burwell case challenged whether premium tax credits could be given for individuals purchasing coverage from the Federally Facilitated Marketplace in states without a state-run exchange. The Court upheld the tax credits. It seems the ACA is here to stay. In fact, there are many provisions that have yet even to go into full effect. IMPACT OF SMALL GROUP MARKET RULES Let’s start with small businesses. While the rules, which include a new rating structure, went into effect in 2014, many employers have transitional policies allowed to delay compliance until as late as 2017. That number actually will grow because in 2016 more employers will be included in the federal government’s definition of “small” (up to 100 employees), as opposed to 2014-15, when states have defined sizes and most have used 50 employees as the threshold between small and large. And as more employers move into the “small” group category and as transitional policies expire, many employers will see much higher health insurance premiums. PLAY OR PAY Other soon-to-be-felt provisions include penalties for failing to offer qualified, affordable coverage to employees. Originally scheduled to be in force in 2014, these were delayed until 2015 and then delayed again until 2016 for employers with less than 100 full-time equivalent employees. But they’re coming. Also in 2016, applicable large employers for the first time will be required to report to the IRS and to their employees regarding their offer of coverage for the prior calendar year. THE INDIVIDUAL MANDATE AND THE CADILLAC TAX Changes are coming for individuals as well. For example, penalties for failing to comply with the individual mandate are increasing. In

2014, these totaled $95 per adult and $47.50 per child up to $285 per household, or 1 percent of household income, whichever is greater. In 2015, these increase to $325 per adult and $162.50 per child up to $975 per household, or 2 percent of annual household income, whichever is greater. In 2016, they increase again to $695 per adult and $347.50 per child, up to $2,085 per household, or 2.5 percent of annual household income – again, whichever is greater. Also, in 2018, a 40 percent excise tax – the so-called “Cadillac tax” – kicks in on health insurance premiums that exceed $10,200 for individual coverage and $27,500 for family coverage. Finally, there’s the Transitional Reinsurance Program, which collects contributions from health insurance issuers and self-insured group plans and makes payments to individual health insurance issuers that cover higher cost individuals. It was designed to stabilize premiums in the individual marketplace through 2014 - 2016. After 2016, it ends. WHAT’S AHEAD? While the Affordable Care Act is more embedded than ever in the health care system, it still can be amended through the legislative process. Of note are two bills, H.R. 879 and H.R. 2050, that would repeal the Cadillac tax, and two bills, S. 1099 and H.R. 1624, that would change the federal definition of small employer to those with up to 50 employees while giving states the option to increase to 100 if they choose. by Mary Elizabeth Bradford Many of my clients I am retained to design executive resumes for also have questions about the job search portion of their transition. They want information on strategies depending on their particular situation. Some clients have been affected by a reorganization or acquisition; they have taken a package and are in between executive positions. The good part about this is that it gives them plenty of time to focus on what they want next! The other part involves deciding if they want or need to create some form of additional income stream to supplement them and their families during their career transition. I was just reading this article on part-time jobs that pay really well. What I especially love about this article is the fluidity of the opportunities and the instant income they can bring in! Although a couple of these positions (dog walking) wouldn’t appeal to the C level executive, the bigger picture about this is how easy it is to turn a hobby or enjoyable activity that aligns with an executive’s natural capabilities into a verifiable income stream. It also has added benefits: retaining that feeling of leadership and control (so critical in an executive job search) and the benefit of choosing one’s own hours and how much effort goes into the part-time role. Some of my clients have found their bridge activities so enjoyable they made them permanent—on either a part-time or full-time basis. Here are some additional suggestions. FOR ENTREPRENEURS Did you know that 6-figure incomes can be made by offering local services—giving you part-time income without a lot of stress? Consider a Coffee Kiosk by a busy office building or even services for cleaning up dog poop in people’s yards. Are you chuckling? Well, others have already proven this is an easy, fast, and profitable business to start! Along those same lines I have even heard of people making a lot of money by offering to stencil glow-in-the-dark addresses on curbs so that in an emergency, first responders can easily find your house within your neighborhood. WEB BASED BUSINESSES There are many successful online businesses now. Coaching, niches such as Web site development, SEO, and yes, resume writing too—are just a very few examples of the hundreds of online businesses that technology makes it possible to offer the world now. And what about ebooks? Ebook sales now make up 30% of Amazon’s total book sales: a $5 billion dollar division. There are many good business coaches to get you started doing this. My personal favorite is Ali Brown. You can run these ventures part-time or full-time. SOLO CONSULTING Many of my clients take part-time gigs in management consulting. The ones who are most successful really define their niche, so it is crystal clear what problem they solve. For example, they don’t just focus on team building; they focus on team building for technology companies whose sales teams focus on conceptual selling and channel partnerships. This also makes it much easier to market their expertise since their target market is so well defined. THE TAKEAWAY There are a wide variety of businesses you can start on your own— both online and offline—and you have many choices, from your own back yard, to around the world. NEW FINANCE LEADER NAMED AT BISD

Latisha Grill has been named assistant superintendent for budget and finance at Boerne ISD, according to superintendent David Stelmazewski. Grill is taking the place of Bruce Revell, who has announced his retirement. Prior to joining Boerne ISD, Grill served in a similar capacity for Bandera ISD beginning in 2000. Previously, she served the Burnet Consolidated ISD. “We are so pleased to welcome Tish to the Boerne ISD team in this critical role,” said Stelmazewski. “She has great experience, impeccable credentials and excellent endorsements from those who have worked with her. “With Mr. Revell and Mrs. Grill actively transitioning between now and the end of 2015, our finance, accounting and budgeting processes will continue on a smooth course. Just as I am pleased that Tish has joined us, I am grateful to Bruce for his years of dedicated service to this district and to Texas public schools.” Under Grill’s leadership, Bandera ISD earned the Superior Achievement recognition through the Financial Integrity Rating System of Texas for 13 straight years. The district was also a Gold Star recipient in the Texas Comptroller’s Leadership Circle for the past three years. Grill holds a number of professional certifications, including the Certified Texas School Business credential. She earned her Masters of Business Administration degree from Texas A&M-San Antonio. Revell, who will retire in December, joined Boerne ISD in 2007. Under his leadership, the district consistently received top ratings from the Texas Education Agency’s FIRST program. In 2014, he was named one of the region’s top CFOs by the San Antonio Business Journal. Prior to his arrival in Boerne, Revell served as CFO for the Ector County ISD in Odessa. BBM

Many people look for the “secrets” to investment success. Is it timing the market just right? Is it finding those hot stocks or getting in on the “ground floor” of the next big thing? Actually, these types of moves have little relevance to the vast majority of investors — even the most successful ones. So let’s take a look at some steps you can take that can be effective in helping you work toward your financial goals. IT’S TIME IN THE MARKET…NOT MARKET TIMING. Some investors think they can succeed at “market timing” — buying when the price is low and selling when the price is high. And this would indeed be a good strategy if they could predict highs and lows. No one can accurately forecast these peaks and valleys, though. So, instead of ducking in and out of the market in a vain attempt to catch the highs and lows, simply stay invested. The more time you spend in the market, the lesser the impact you’re likely to feel from short-term price swings. And if you’re always invested, you’ll always be in a position to benefit from the next market rally. IT’S “BUY AND HOLD” — NOT
“BUY AND SELL.” Even if you aren’t trying to time the market, you may be tempted to buy and sell frequently as you look for new and better opportunities. Yet, this constant buying and selling can be costly. Frequent trading, with all the additions and subtractions from your portfolio, can make it hard for you to follow a consistent, unified investment strategy. You’re better off purchasing quality investments and holding them for the long term, until either your needs change or the investments themselves no longer possess the same attributes they did when you purchased them. IT’S BUILDING A STRONG FOUNDATION — NOT GETTING IN ON THE “GROUND FLOOR.” Many people regret not being one of the initial investors of a company that has done spectacularly well. But most new companies don’t achieve anywhere near that level of success. So, instead of looking for the next big thing on the “ground floor,” try to build a strong “foundation” consisting of a mix of quality investments suitable for your risk tolerance, goals and time horizon. This type of investing may not sound glamorous, but
a strong foundation is better equipped than a possibly shaky ground floor to withstand the shifting winds of market forces. IT’S COOL-HEADED THINKING – NOT CHASING “HOT STOCKS.” If you browse the internet or watch one of the investment shows on cable television, you are bound to read or hear about “hot” stocks. But by the time the news reaches you, these stocks may already be cooling off. Even more importantly, they might not be right for your needs in the first place. Instead of chasing after hot stocks, which, by their nature, carry a strong emotional component (namely, the desire for quick, big gains), try to coolly and dispassionately analyze your situation to determine which investments are really most appropriate for your goals. There really aren’t any shortcuts to reaching your desired financial destination. But by taking the slow and steady path, you can work toward getting there. TO POOL, OR NOT TO POOL?

I have had clients ask me if adding a pool to their backyard or even buying a home with an existing pool will help increase the value of their home down the road. This is a great question! Rather than quoting studies and statistics easily found on the Internet, I will take this on with my personal opinion (so for the record, if you are contemplating adding a pool, please conduct your own independent research and come to your own conclusion). In short, here is my take on this ever-debatable question: My personal feeling is yes, a pool does add "value" to a home. However, that does not mean a home owner with a pool will recover the initial cost to build the pool, the repairs, the maintenance, the cost of all of the chemicals, etc. in the form of increased equity when he/she goes to sell the home someday. Let me be more specific. In my opinion, a pool is a nice feature, especially here in Texas when our summers and even late springs and early falls can be hot. After all, what's not to like about coming home from work and jumping into your pool to cool down or watching your children enjoy themselves swimming with their friends throughout the summer? For example purposes only, let's assume a pool costs you $40,000 to have built. Let's say over a five year period you spend another $5,000 in the form of repairs, supplies, maintenance, electricity, etc. After five years, you decide it is time to sell and downsize or upgrade your home. You're into the pool for roughly $45,000. You might be thinking, "I am going to price my home $45,000 more than what the exact same home would sell for without a pool." Although a reasonable and fair thought, this is not usually how it works. Although I would argue a home owner with a pool can increase the price of his/her home, there is a very strong likely-hood that most buyers will not agree with this $45,000 increase in price. A pool may make a home more attractive and desirable than similar homes without a pool (I realize there are people who do not like or want pools) and may cause a home to sell faster than similar homes without pools, but a seller should be prepared to not recover that $45,000 he/she put into the pool over the past five years. In my experience, a seller with a pool, assuming the home has other attractive features,

will recoup a percentage of the pool costs, but most likely not more than 50% of the initial cost. In conclusion, adding a pool is not what I would consider an "investment" into a home, as most good investments increase in value over time. A new kitchen, a remodeled master bath, an increase in square footage, etc. are usually considered solid "investments" back into a house. However, a pool may expedite the time it takes to sell a home because many buyers have a pool on their wish/must have list. Lastly, in the defense of a pool, it is difficult to place a "value" on all of the wonderful memories that a family has made in it over the years! Some additions are still priceless. And yes, we recently added a pool to our home. Thanks for reading,

The latest Multiple Listing Service (MLS) housing market data show Texas home sales had a 7 percent year-over-year increase last month while the median price was up 8 percent. Although the rise in both sales and prices might suggest housing affordability is not a problem yet in Texas, Real Estate Center Research Economist Dr. Jim Gaines said that depends on the price category potential buyers are looking at. “If you’re a low-tomedium-income household, you’re probably having difficulty finding a home in the price range you’re looking for,” Gaines said. “You’re also probably not finding many new houses because few are being built at that price level. Most builders are building on the high-end scale.” Also, affordability is a relative term,
Gaines said. “Compared with communities around the country, most Texas communities remain a housing bargain in terms of general price levels and availability,” he said. “But compared with where home prices in Texas have been the last 20 or 25 years, yes, things are getting pricey.” According to June 2015 Texas MLS data (as of July 27), 31,524 homes were sold last month, about 2,100 more than a year ago but more than 4,200 more than in May of this year. The median price was $209,500 compared with $193,500 a year ago and $205,300 in May. The statewide months' inventory stood at 3.6 months, well below the 6.5 months Center economists consider a balanced market.
