Home sales up as first-timers hit five-year high The number of first-time buyers in the property market has reached a five-year high, according to the Council of Mortgage Lenders (CML). Following this encouraging news, housing market sentiment has been lifted further by the Chancellor’s launch of a two-pronged ‘Help to Buy’ scheme in his Budget on 20 March.

scheme, designed to aid both the housing market and the wider economy, will have two elements. One takes the form of a shared-equity loan to provide finance of up to 20% for many new-build purchases. The other will be a mortgage guarantee scheme to help those with small deposits to qualify for a mortgage.

The CML figures showed that there were 216,200 first-time buyers in 2012. That was the first time the annual total exceeded 200,000 since 2007. It was also a 12% increase on the 2011 figure of 193,000. Another notable feature of the UK mortgage market in 2012 was a rise in buy-to-let lending which, at £16.4 billion gross, was up 19% on the previous year.

Under the shared-equity loan element, government funding of up to £3.5 billion will be made available for qualifying purchases where the purchaser can provide a 5% deposit to buy a brand-new house costing up to £600,000 with a capital repayment mortgage. The loan of up to £120,000 will be interest-free for five years. ‘Help to Buy: equity loan’ becomes available from April 2013.

In further good news for the housing market, the Royal Institution of Chartered Surveyors (RICS) reported that the number of sales continued to grow in January for the fourth month in a row. Although the growth was quite small, RICS spokesman Peter Bolton King said it was a sign that the worst might be over for the property market. Although some reports suggest that its positive impact has fallen short of expectations, a number of property market experts believe that the Funding for Lending scheme, which was introduced by the Bank of England to encourage banks and building societies to expand lending, has helped mortgage approvals and home sales. Mr Bolton King said: “Price falls across the UK have gradually stemmed in recent months and it is interesting to see that the amount of completed transactions are on the rise, as confidence returns to the marketplace. While it is still very early days to talk about a comprehensive market recovery, activity levels are still encouraging and there is some optimism out there that things could continue to improve.” After Mr Bolton King commented, homebuyers and housebuilders alike were given further grounds for optimism by Chancellor George Osborne’s Budget Day announcement about a ‘Help to Buy’ scheme. The new

The mortgage guarantee element of the ‘Help to Buy’ scheme could, over a three-year period, see the government provide guarantees to cover up to £130 billion of loans to enable mortgage providers to offer a higher ‘loan to value’ than would normally apply. ‘Help to Buy: mortgage guarantee’ will be available from January 2014. These new schemes, not available for buy-to-let, are in addition to Funding for Lending and NewBuy, so there are clear signs that getting the housing market fully back on its feet is a major government priority, not just to help individuals’ personal lives but also to support businesses that depend on a vibrant construction sector. Chancel Repair Liability There are few better examples of how apparently outdated and bizarre laws can continue to affect homeowners across England and Wales than the historic ‘chancel repair’ liability.

In short this is a liability placed in law upon ‘lay rectors’ to pay the cost of repairing the chancel of the parish church. For those of you who are not regular churchgoers, the chancel is the part of the church over the altar where the service is conducted. Without wishing to scare you unnecessarily this ancient law allows your local parish church, or rather your local parochial church council (PCC), to demand from you many thousands of pounds if your house has been built on land that was once ‘rectoral glebe.’ Historically when the parish churches were built responsibility for their maintenance was divided between the parishioners and the rector. Whilst the parishioners were liable to maintain the western end of the church, where they sat, the rector was liable to maintain the chancel at the eastern end of the church.

The tithes have since been phased out. Unfortunately for landowners, however, the liability to pay towards chancel repairs has not. It is estimated that chancel repair liability benefits more than half the pre-Reformation churches of the Church of England and the Church of Wales – some 5,200 in all – covering 3.7 million acres of land. There is therefore a very real possibility that, if you are a homeowner, your property may be subject to chancel repair liability.

The landowner who originally built and endowed the parish church gave land, known as ‘rectoral glebe’, to help fund the chancel repairs and granted the right to receive tithes (a tenthpart of the product of land or livestock) which were paid as a kind of tax by the parishioners. This was then known as the ‘rectory’.

Until recently, chancel repair liability appeared to have been almost forgotten about. However, the 2001 case of Aston Cantlow -v- Wallbank confirmed the position that chancel repair liability does indeed still exist, notwithstanding the arguments put forward that it contravenes human rights. Mr. and Mrs. Wallbank were given some land in blissful ignorance of the fact that it was subject to chancel repair liability and had to pay a chancel repair bill of over £210,000.

In the 13th to 15th centuries many such rectories were acquired by monasteries but, upon the dissolution of the monasteries in the reign of Henry VIII, the property of the monasteries was disposed of by the Crown in favour of both individuals and institutions, such as the Oxford and Cambridge colleges.
