During a trial in which Mae West was accused of indecency on stage the Judge asked, “Miss West, are you trying to show contempt for this court?” to which she replied “On the contrary Your Honour, I was doing my best to conceal it”.

whilst doing so they were not breaking the law. And it was amazing how many squatters came across properties where the windows were already broken!

Why is this relevant? Well you may have read recently in the press the comments of Judge Peter Bowers who is reported to have said “It takes a huge amount of courage, as far as I can see, for someone to burgle somebody’s house. I wouldn’t have the nerve.”

Although you can actually see a squatter, the person you probably need to worry more about is the conman who claims to own your house. The con - called property title theft - involves criminals taking out mortgages on properties they don’t own, pocketing the money and leaving the real owner thousands of pounds in debt.

Now you don’t have to be a subscriber to the Daily Mail to feel outraged by the Judge’s comments. But the law is not always an ass and occasionally common sense does prevail.

Since 2006 the Land Registry has paid out more than £26 million in compensating victims of recurring property fraud. And beware, it can happen even to the most astute buyers.

A step in the right direction must be the decision by the Crown Prosecution Service not to prosecute Andy and Tracey Ferrie, who were confronted in the bedroom of their house in Melton Mowbray by several men who had smashed their way into their home. Having been the victims of three previous break-ins the Ferries shot the intruders using a legally-held shotgun, leaving two of the culprits with minor wounds. The CPS agreed that the Ferries had acted within the law, which allows people to use reasonable force to protect themselves, their family or their property.

In 2004 Nick and Christian Candy, the luxury developers, paid £6.5million to four pensioners for a 47 acre estate known as King’s Beeches in Sunninghill. In fact the land belonged to a billionaire Saudi Sheikh but forged paperwork lodged with the Land Registry showed the pensioners as the legal owners.

On the subject of protecting your home you may not be aware that the law has recently changed. As from 1st September squatting in a residential building as a trespasser has become a criminal offence. Section 144 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 is the statutory authority you might wish to quote when dialling 999.

One of the problems is that until 2003 the Land Registry used watermarked certificates to prove a person owned a property. These were abolished as the records went paperless and then titles became available online to the public in 2006. In theory all that is needed to sell or remortgage a property is a forged identity and a great deal of nerve. No doubt Judge Peter Bowers would be quick to praise their bravery and ingenuity! So what can you do to protect yourself against such scams? Well I’m glad you’ve asked. Voluntarily register your title at the Land Registry

This change in the law will be particularly welcomed by people who own second homes as they were not covered by the old law. Before 1st September if someone entered an empty property without causing damage

Make sure your contact details are up-to-date Did you know that if your land is registered at the Land Registry you can provide up to three different contact addresses, including an email address and an address abroad? When the Land Registry receives an application regarding your property it will write to you about it. So if your details are not up-to-date you might not receive their letter or email. You can download a form from the Land Registry website to add an address or update your existing contact details.

restriction and ensures that the Land Registry will not register a sale or mortgage unless a solicitor or conveyancer has certified that the person who signed the deed is a registered owner. This would certainly deter a fraudster from trying to forge your signature or copy your identity. There is a fee of £50 payable to the Land Registry for this service. Finally, without wishing to sound like that chap off Crimewatch, please don’t lose too much sleep worrying about these matters. Instead I suggest you discuss your fears with one of the solicitors in our Property Department at Foskett Marr Gadsby & Head LLP. Being an architect is a passion, not a job. Well it is for me, Melanie Clear, founder of clear. (formerly cleardesigns). Those who study architecture need such passion to help them through the tough, very long days of study. 7 years, equivalent to a lawyer or doctor for those of you who don’t know. Studying for 7 years and finally being able to call yourself an ‘architect’ is no mean feat and when you can call yourself an architect it’s a privilege. Architecture has been implanted within me since I was a fourteen-year-old schoolgirl in South London. Having forged my career in commercial and design-led practices in Central London, in 2005 I set up clear. based in Loughton. The driving force behind this move was that I felt that there were no other practices that appeared to encompass my passion and thought for the ‘design’ combination of architecture and interiors. My philosophy is that architects are designers, so who better to carry out the interior of a building as well as the exterior? Many architects tend to be ‘traditional’ in their approach of simply providing a set of drawings for the builder to work from. Yet the great architects of the past, Sir Christopher Wren and Antonio Gaudi, were masters of design. They lived and breathed a building. Every detail, every material and every thought carefully considered, creating beautiful buildings that have stood the test of time and become iconic. To me an architect should experience the building on behalf of their client, be personable so that clients can converse with them and, most importantly, be able to guide clients in creating a building that is the best it can be. That’s not just pure design, it’s design within a budget or design that will comply with the vast plethora of planning and building regulations alike.

To me an architect creates buildings which in turn create the environment we live in. It is my belief that, to be truly successful, you must have passion for architecture. Every project my team and I work on is carefully considered from its inception to realisation. Every project has its own distinctive location, client brief and should therefore be unique in its own right. Architecture is far more than lines on a piece of paper, anyone can do that. Architecture is a thought process, a vision, a creation. With our personal service we believe we have ‘a different approach’ to design and ultimately create buildings that are unique.
