COMMENTS ON THE GENERAL CIRCULAR ECONOMY LAW INITIATIVE IN MEXICO

Background

Since the end of the 19th century, it is clear that the production processes generated by human economic activities and the constant generation of waste have contributed to climate change in the world, therefore it is urgently required to adopt new models of industrial and consumer processes based in the principles of sustainability to reduce waste and the effects of climate change and pollution.

Sustainability consists in fulfilling the needs of current generations without compromising the needs of future gener ations, while ensuring a balance between economic growth, environmental care and social well-being.

In the sixties, philosophical currents emerged that proposed the implementation of circular economy models , the central axis of said ideology implies extending the useful life of a product to reduce generation of waste, these trends of thought continued in the decades of the seventies and eighties, until 1990 when David Pierce and Kerry Turner created the concept of “circular economy”, defined back then as taking

advantage of available resources in one or more circular processes to reduce their environmental impact and give up the lineal handling of waste scheme.

The Ellen MacArthur Foundation (created in 2010 with the aim of accelerating the tran sition to the circular economy and which has also issued strategic recommendations for its regulation in our country), defines circular economy as a regenerative industrial system that proposes to redesign of products, busi ness models and production patterns in such a way that all waste is systematically elimi nated (in other words zero-waste generation).

At the international level, many countries such as Holland, France, Italy and Germany have taken the lead and established defi nitions of this model, in this regard the French Agency for Energy and Environment Management (“ADEME”) defines the circular economy as an “economic system based on exchange and methods of production that, at each stage of life cycle of a product, increase the efficiency of the use of resources and decrease the environmental impact, while at the same time improves the well-being of individuals”.

Besides de above China and Europe are world leaders in in the transition to circular economy since their strategies impact the rest of the world through their Law for the Development of Circular Economy 2009 and implementation of policies of the European Green Deal, respectively.

Several States of Mexico such as Quintana Roo, Baja California, Queretaro and Nuevo Leon have already enacted Legislation regarding Circular Economy and other States such as Guanajuato are proposing said Legislation.

In this article we will analyze the circular economy model from the perspective of the General Circular Economy Law Initiative approved by the Chamber of Senators of the Mexican Government as of November 2021 and submitted to the Chamber of Deputies of the Mexican Government for review and comments, which application will be of general observance in the Country.

Definition

In a general basis, the meaning of the circular economy is directly related with the 3Rs principles (reduce, reuse and recycle)

under the new concept “from cradle to cradle”.

In Mexico, the definition of Circular Economy is found in the Decree of the General Circular Economy Law Initiative (hereinafter referred to as the “Law Initiative and/or General Law of Circular Economy”), which, as previously mentioned, was approved by the Plenary Session of the Senate of the Mexican Republic in November 2021, and submitted for approval and modification to the Chamber of Deputies of the Mexican Republic and will only be valid if it is approved by said Chamber of Deputies and by the president of Mexico and published in the Official Gazette of the Federation .

The following are definitions included in the Law Initiative, which we consider of importance, among others.

“Circular Economy” is defined in the Law Initiative, as a system whereby the production, distribution and consumption of goods and services shall be redesign, by reincorporating said goods or by-products back into cyclical production processes, the aforementioned in order to extend as long as possible the useful life of products, and the materials associated with them, and there fore prevented or minimized the generation of waste, in addition to promoting changes in production and consumption habits;

“Zero Waste” is defined as set of poli cies, instruments and programs aimed at promoting the recovery and use of waste in order to discourage materials from ending up in a landfill or in the environment.

“Circular Economy Standards” which consists of those standards to be issued by the Mexican Ministry of Environment and Natural Resources (hereinafter “SEMARNAT”) that will promote the reduction of carbon foot print, water footprint, optimization of the use of materials, through the efficient use of natural and economic resources, sustain able consumption and production strategies; applicable guidelines for the reuse, recycling, composting, co-processing or other type of recovery processes.

“Valorization” Principle of associated actions whose objective is to recover the remaining value of the materials that inte grate the waste by reincorporating them into production processes, under criteria of joint liability, integral handling and environmental, technological and economic efficiency, this definition was already included in the General Law for Integral Handling of Waste in effect as of October 8, 2003.

Objective

The main objectives of the Law Initiative are primarily the following; i) promote efficiency in the use of products, services, materials,

second used raw materials, by-products through recovery processes such as reuse, recycling, redesign of production process, energy recovery processes among others to comply with policies of zero land waste to landfill, ii) promote the observance of Circular Economy principles, (as same are described in the following section) within the development of economic activities, iii) collaborate in the creation of technological development and stimulate economic devel opment to migrate to recycling, reuse and redesign processes of products, based on the principles of sustainability, iv) encourage integration of value chains to incorporate Circular Economy Standards, v) instigate and spread a culture of environmental joint liability in the population regarding respon sible consumption of products and services, vii) help the transition towards sustainable cities and communities, viii) encourage the use, generation and access to clean and renewable energy sources towards a culture of greater sustainability.

Circular Economy Principles

According to the Ellen McArthur Foundation, the Circular Economy is based on three guiding principles, a) preserving and improving natural capital, b) optimizing the use of resources and c) promoting system efficiency, releasing negative externalities through the performance and practices of redesign, reprocessing, re -manufacturing, composting, reconditioning, repair, reuse, recycling, recovery, efficient use of energy, materials and water or any type of use or recovery processes.

The principles pursued by the Law Initiative are very similar to those previously described above and consist of i) preserving natural capital by controlling and balancing the flows of renewable resources, ii) opti mizing the use of resources in the life cycle of products, iii) promote the efficiency of the system, including clean production and responsible consumption, to reduce the externalities of the processes of using natural resources and iv) seek synergies between the different agents involved in the processes.

Distribution of Faculties to Federal, State and Municipal Authorities

For the compliance of the General Law of Circular Economy, diverse faculties will be granted to the three level of Authorities; (Federal, State and Municipal).

The Federal Authority was granted, among other faculties, with i) the power to carry out the development of Public Policy on Circular Economy and of a National Program for the Promotion of Circular Economy to be prepared and issued by SEMARNAT in

coordination with the Mexican Ministry of Economy (“SE”), ii) power to implement Fiscal Economic Incentives for individuals or legal entities that incorporate Circular Economy Standards in their economic activities, iii) exclusive faculty to regulate activities such as manufacture, transformation, maquila, trade, distribution, donation, transport, disposal or any other related economic activity, iv) establish transition periods for the gradual transition into the circular economy model and most importantly, v) the exclusive faculty to verify compliance of the General Law of Circular Economy, including the imposition of applicable sanctions.

The State Governments (33, including Mexico City), among other faculties, i) the power to draft Public Policies and Legislate on Circular Economy matters, in coordination with the Federation, ii) to promote the partic ipation of the private sector in the design and implementation of actions to encourage the Circular Economy, iii) manage within the scope of the competence in its territory the continuous Education and training of indi viduals, groups or organizations from all sectors of society to spread a culture of envi ronmental joint liability, iv) celebrate agree ments with industrial chambers to meet the objectives pursued by the General Law of Circular Economy, including the setting-up

of the corresponding infrastructure, v) the design and promotion of Fiscal and Financial Economic Instruments; vi) the creation of a Registry of Companies that require a Circular Economy Plan.

Municipal Authorities will be entitled to i) issue regulations within the territorial districts of their Municipalities, ii) provide information to the Registry of Companies that require a Circular Economy Plan governed by the State Governments, iii) establish local contributions to individuals or legal entities responsible of Final Disposal Sites/ Landfills, and iv) regulate and integrate a registry for the waste pickers.

Besides the above, the Law Initiative creates the Operation Organisms which can be private, public or mixed with the purpose to avoid the destruction of the value economic chains promotion of productive projects, decrease the environmental foot print, generate jobs among others and it considers a list of said organisms, such us material banks, composting and energy generation plants, educational centers, among others.

Regulated Parties

The Law Initiative establish that the Regulated Parties are those individuals or legal entities whose activity is the manufac ture, production, import or manufacture of containers and packaging (hereinafter identi fied as “Regulated Parties”) who shall submit before SEMARNAT a Circular Economy Plan (hereinafter identified as the “Plan”). Besides said Parties will be able to obtain Zero Waste certificates for those who comply with the Federal Regulations in matters of environ mental handling of waste under the scheme of circular economy.

It is worth mentioning that micro and small waste generators are exempt to submit said Plan pursuant to the General Law for the Prevention and Integral Handling of Waste.

It is established that in the event Regulated Parties have a Waste Handling Plan or international certifications including within same any Circular Economy Standard, said Waste Handling Plan will be sufficient to evidence compliance with the General Law of Circular Economy.

Raw Materials and Byproducts

In order to achieve compliance of the main objectives and principles pursued by the Law Initiative, as well as for the preparation and handling of a Circular Economy Plan, the defi nitions of “Raw Material”, “Second Used Raw Material” and “ Byproduct”, have to be taken into account. The Law Initiative defines:

Raw Materials: Material extracted from nature or from a previous process that is transformed to produce materials or products.

Second Used Raw Materials: All those materials that at the end of their useful life, become non-conforming products, or by-products, which are converted into second-use raw materials by being sepa rated, stockpiled and collected or recov ered, and are managed and/or selected for

Product Information

Measures will be established to guarantee that goods and products commercialized in the Country (for example electronic prod ucts) contain in its labeling, information regarding their proper handling at the end of their useful life. The aforementioned to be able to promote responsible consump tion patterns within the population. The competent Authority will publish the official list of specific products that will be subject to the labeling information described herein.

Circular Economy Plan

The Circular Economy Plan (CEP) addresses the issue of waste generation from a full life cycle approach, in other words, the CEP will consider strategies and new mechanisms from the product design stage to avoid waste generation and become a Second Used Raw Material or Byproduct. This practice is identified as “Ecodesign” and the purpose is that all manufactured products can be used for as long as possible and when their life use comes to an end, said products can be rein tegrated into the circular economy model through their recovery.

CEP must be integrated with the description of the activities carried out by individuals or legal entities, areas of oppor tunity and financing requirements to move towards the circular economy and the goals of the circular economy indicators.

By-product: Those materials that are generated unintentionally from production and that are likely to be reused, recycled or used either in the same production or in different processes.

Once reviewed said definitions, we can conclude that Second Use Raw Materials, can be used for the production of any good or product, attending to the requirements that apply to the final product as the case may be. The aforementioned with the intention that the manufacturer be liable from cradle to cradle for the handling of its products, by-products and second used raw materials avoiding generation of waste.

As a last option, the General Law of Circular Economy contemplates that those products or byproducts that are not suscep tible to undergoing into reuse, repair, composting, recycling, reincorporation into value chains may be used to be transformed into energy through recovery processes.

The CEP may also include different means of influencing the social sector, such as support for education, support for groups of collectors (waste pickers), reme diation of contaminated sites, generation of jobs, implementation of infrastructure and recovery of public spaces, among other requirements imposed by the State govern ments. Said Waste Pickers will be subject to specific Fiscal Regime.

Regarding goals and economic indica tors to migrate into the Circular Economy model, the Regulated Parties must comply with the national or international standards that are designed for the reincorporation of their waste or second-use materials into a value chain in order to access tax incentives contemplated in the Law Initiative.

Sanctions

The Law Initiative establishes fines the range from 20 to 60 thousand Units of Measurement (UMA), the temporary or definitive shut down, (total or partial) of the facility whereby the economic activity is performed, repair the damage, suspension and relocation of permits, the

aforementioned when the Regulated Party has violated the Law Initiative.

When does the Law Initiative comes into force?

The Law Initiative will be in force once it is published in the Official Gazette of the Federation, take into account that said Law Initiative as it stands may undergo additional modifications proposed by the Chamber of Deputies or the President prior its publication.

Said Law Initiative provides a transition period of approximately six months from the day following its publication to enter into force and to draft and issue the Regulations of said Law, including the National Program of Circular Economy.

Benefits to migrate to a circular economy scheme

Among the positive aspects to migrate into a circular economy scheme, the following stand out:

a) Direct impact on the fight against climate change and waste prevention. (According to data provided by the United Nations, changing the way we produce and use steel, cement, aluminum and plastic could reduce greenhouse gas emissions from these industries by up to 40% by 2050);

b) Generates income for industries through increased efficiency in the use of their resources and technologies, as well as the use and exchange of waste and by-prod ucts as raw materials;

c) Savings of raw material costs for industries by reducing the amount of mate rial consumed, it is possible to reduce the costs of processing Byproducts and organic waste and soil restoration;

d) Reduce the amount of waste destined for final disposal sites, emissions of pollut ants into the atmosphere and wastewater discharges into bodies of water;

e) Encourages innovation through the implementation of creative solutions, and the reduction of prices by consuming less raw materials, could result in significant savings of natural resources and energy through the implementation of eco-effi ciency measures and greater use of renew able energies.

Conclusions

From the analysis of the Law Initiative in our opinion, the attempt to develop a legal instrument of general application for the entire country in terms of circular economy is a progress and complies with the constitu tional human right of every person to have an adequate environment for their development and well-being, notwithstanding the fore going, the Law Initiative is silent about certain important matters, for example, establishing the procedure in which the different levels of Mexican Authorities (Federation, States and Municipalities) will coordinate for the development of their faculties, since some

powers are established exclusively for the Federation but other faculties were assigned in coordination or mutual cooperation with the Government of the States, such as the power to regulate on Circular Economy matters.

Another deficiency that we identified is that the Law Initiative encourages the devel opment of procedures for the recovery of products for energy production purposes, we consider this strategy is contradictory, since several energy production process generates pollutants into the atmosphere, therefore we believe that the recovery process should be aimed to prevent generation of waste, but at the same time prevent pollutant emissions into the atmosphere.

The Law Initiative does not emphasize the criteria for establishing the goals that must be achieved by the Regulated Parties subject to the compliance of Circular Economy Plan, so it is necessary that the Law establish specific goals and strategies as well as adequate periods to complete same.

David G. Mandelbaum represents clients facing problems under environmental laws that have no conventional solution, or for which the conven tional solution would yield an unacceptable result.
