A MESSAGE FROM OUR EXECUTIVE DIRECTOR We often say that 2013 will be remembered as the year our nation woke up to the gravity of America’s gun violence epidemic. Following the tragic events in Newtown, new attention and effort brought significant momentum to the fight to end gun violence. With over 20 years of experience advocating for smart gun laws, the Law Center to Prevent Gun Violence offered leadership and trusted insight in 2013, helping craft and support solutions to prevent the unacceptable levels of death and injury from guns in America. Thanks to the generosity of our supporters, 2013 was a watershed year for the Law Center, and for enacting sensible gun laws across America. We are incredibly proud to be a national leader in this movement, and to provide an unparalleled and unique set of services that helps save lives. It is only with loyal friends and partners like you that we can continue to create lasting change to our nation’s gun laws.

A Year of Success for Smart Gun Laws The nation was shocked and horrified when 20 children and six adults were tragically gunned down at Sandy Hook Elementary School in December 2012. As 2013 began, Americans’ grief and outrage transformed into earnest demands for change to our nation’s gun laws, from the federal to the state to the local level. As the year progressed, momentum built, largely generated by the creation of new gun-safety organizations across the country. As an established and respected resource on America’s gun laws, the Law Center played a pivotal role in supporting both new groups and existing gun-violence prevention organizations, sharing our expertise and analysis and helping fuel the fight to end gun violence. Our legal team educated activists, leaders, and legislators from across the country on the best policy solutions to promote gun safety and prevent future tragedies. Initially, the nation urged Washington to respond at the federal level, and the Law Center delivered critical assistance

to the Gun Violence Prevention Task Force chaired by Congressman Mike Thompson. When Congress failed to act on the federal background check bill in April 2013, much of the movement’s focus shifted to work at the state and local levels, and our legal team was there to provide in-depth tracking, analysis, and policy recommendations unavailable elsewhere. By the end of 2013, we had worked with 30 states to promote smart gun laws. In all, the results of our legislative efforts in 2013 were astounding. We achieved unprecedented success at the state level with the introduction of dozens of smart gun laws across the country. More than 50 new laws passed in over 20 states, with eight of those states making major changes to strengthen firearms laws. 2013 was a year full of victories in the courts as well, with the Supreme Court refusing to rehear any of the federal decisions rejecting Second Amendment claims and courts across the country

upholding common-sense laws that limit the carrying of firearms in public. By providing support via our Brief Bank and by filing amicus briefs, the Law Center was uniquely positioned to help defend the good laws already on the books. In June 2013, we celebrated the Law Center’s 20th Anniversary with a gala event in San Francisco that honored our achievements and paid respect to the tragic circumstances that led to our founding. A Historic Year in Gun Violence Prevention

Since the Law Center began tracking state firearms legislation in 2009, we have become widely recognized as the top source for comprehensive information on firearms legislation pending in state houses across the country. National, state, and local gun-violence prevention groups, researchers, and elected officials—as well as national and local media—all turn to us to identify and track the progress of gun bills and to identify trends in state legislation. In 2013, we tracked and analyzed 1,531 gun bills nationwide and worked to produce a state scorecard ranking all 50 states on their gun laws. Our state legislative tracking work was more critical than ever as the gun violence epidemic took center stage in the media and the public discourse in 2013. State legislators across the country responded to the overwhelming demand for action following the Newtown tragedy by introducing exponentially more gun-related legislation than in the past. In the first two months of the year,

the total number of bills to strengthen firearms restrictions went up 231 percent compared to the same two-month period in 2012. In contrast, the number of bills introduced by the gun lobby increased by only 67 percent during this time period. Many of the new gun laws in 2013 made changes in critical policy areas. Four states strengthened existing assault weapons bans, five added or strengthened existing bans on large capacity ammunition magazines, and five added new laws requiring background checks for private sales of firearms. Four states added a requirement that owners report lost or stolen firearms to police and three enacted laws imposing record-keeping and/or background-check requirements for ammunition sales. These kinds of major laws have substantial capacity to reduce gun violence in meaningful ways. We are incredibly honored to have worked with 30 states across the country, providing free legal support to 38 legislators,

more states also made CHANGES TO ENHANCE gun safety

assistance to advocates, and education to communities looking to strengthen—and smarten—their gun laws. Our legal team also stayed on top of legislative efforts to weaken firearms laws. Our state tracking is critical to monitoring these dangerous trends, many of which expand where guns may be carried in public and other sensitive places like K–12 schools, college campuses, bars, and houses of worship. Overall, states made great strides toward stronger regulation of firearms in 2013. The progress achieved this year will greatly impact public safety in the states where new laws were enacted and will undoubtedly contribute to the momentum for smart gun laws that continues to grow across the country. We are proud of the central role the Law Center has played in that effort and grateful for the ongoing support of the members who make our work possible.

Leading the Way for the Rest of the Nation The Law Center to Prevent Gun Violence is very pleased with the exceptional progress California made in improving its already strong firearms safety laws in 2013. In response to the shooting at Sandy Hook Elementary School and other incidents of gun violence that devastate our communities every day, California legislators passed a historic number of bills to help prevent gun-related deaths and injuries in the state, and Governor Brown signed 10 of those bills into law. This progress was due in no small part to the tireless advocacy and support of the Law Center and its members throughout the legislative session. The bills signed into law in 2013 strengthened regulations with respect to safe storage of firearms in the home, disarming prohibited persons known to possess firearms, improving the reporting of serious threats of violence to law enforcement, and more. The Law Center also supported cities and counties across California, continuing to deepen our longstanding commitment to provide legal expertise and assistance in local areas across the country. In 2013, we worked with a host of local jurisdictions in California, including Sunnyvale, Pleasant Hill, and Los Gatos, as they considered adopting new ordinances to reduce gun violence in their communities. The free, comprehensive support we provided—unavailable elsewhere—served as an invaluable resource to these municipalities.

EDUCATION & MEDIA HIGHLIGHTS

Sharing Expertise with Diverse Audiences A key aspect of the Law Center’s mission is to provide invaluable information on gun legislation to a wide range of legislators, advocates, the media, other gun policy organizations, and the general public in a variety of ways. What makes us unique in the movement to prevent gun violence is our expertise on the legal aspects of guns in America and our ability to break this complex information down in ways that everyone can understand. The cornerstone of our educational work is our website, smartgunlaws.org. Relied upon for in-depth information, research, and analysis unavailable elsewhere, it grew to become more highly trafficked than ever in 2013. In fact, our website traffic increased by more than 300% during the year and was visited over a million times.

In the wake of the tragedy at Newtown and throughout 2013, the media also increasingly turned to the Law Center as a source of reliable information on gun laws. Media requests came from national and local newspapers, talk radio, and television. We responded to all relevant requests and enjoyed an increased media presence and recognition as a result. In 2013 we responded to 150% more media requests than in 2012, and were quoted 52% more times than the previous year in articles and media outlets. In 2013 our attorneys were quoted 1,802 times and cited 3,456 times in media sources around the world. The more focus the media takes on this issue and our recommendations for smart gun laws, the more likely lasting, impactful change on this issue becomes.

With new organizations forming and others ramping up their efforts throughout the year, the demand for the legal expertise the Law Center provides grew an enormous amount. We strengthened our partnerships with other groups in the movement and educated more activists and legislators on gun laws than ever before. We also shared our policy recommendations more widely and responded to a greater number of requests for legal assistance. Thanks to the generosity of our donors, we had the resources to supply the fight for smart gun laws with the intellectual capital it needs as at builds into a movement that can’t be ignored.

The Battle in the Courts The country has been faced with an astonishing amount of Second Amendment litigation since the Supreme Court’s landmark District of Columbia v. Heller decision in 2008. One of the gun lobby’s frequent tactics is to attempt to pressure legislators into believing that smart gun laws violate the Constitution, and despite the fact that the courts are proving those challenges wrong, 2013 was still awash in Second Amendment challenges. Thankfully, the Law Center has been able to counter the gun lobby and help defend smart gun laws in the courts. These cases require significant resources to enable our legal team to fight back and help protect the safety of our communities. The Law Center’s Brief Bank Project, our innovative system for tracking Second Amendment litigation that provides government attorneys with resources to defend state and local gun laws, entered its fourth year in 2013. In addition to tracking existing lawsuits, we followed the development of dozens of new cases filed across the country challenging existing gun regulations.

The depth of analysis and information shared on the panels and insights I gain help give me with the tools I need to be even more effective in litigating challenging Second Amendment cases.”

Through 2013, we tracked and analyzed over 700 Second Amendment cases and provided our post-Heller litigation tracking summary regularly to city, county, and state’s attorneys. We are truly the only resource of this kind. The Brief Bank Project, along with our assistance, means that litigators defending these cases are well-equipped to ensure sensible gun laws stay on the books. Throughout the year, we continued our vigorous support of jurisdictions across America forced to defend their common-sense gun regulations from

Second Amendment challenges. Our legal team coordinates the filing of amicus curiae (“friend of the court”) briefs in which interested parties such as cities, counties, law enforcement agencies, and community organizations take a position on crucial legal issues affecting state and local gun regulation. In 2013, we filed five amicus briefs, including one with the U.S. Supreme Court making the case that federal law should prohibit those convicted of any domestic violence crime from possessing a firearm. We also filed amicus briefs with federal courts in New York and Connecticut in support of restrictions on assault weapons and large capacity magazine bans enacted following the tragedy in Newtown.

In addition, the Law Center hosted our second annual Second Amendment Litigation and Jurisprudence Conference in Chicago for over 60 attorneys from across the country, bringing legal experts together to discuss relevant pending cases and recent decisions. This conference, the only one of its kind, allows litigators to share best practices for approaching Second Amendment cases and to gain insight into new developments in the fight for smart gun laws in the courts.

EVENTS & PUBLICATIONS

Educating the Public Law Center staff participated in close to 50 events in 2013. Our attorneys traveled throughout California and to 11 states across the country to attend educational summits and share their expertise with organizations such as the American Bar Association, Children’s Defense Fund, National Physicians Alliance, the Poynter Institute, and many more. On November 14, 2013, the Law Center held its own educational event, “What Can the Gun Policy Debate Learn from Cigarettes, Seatbelts, and Climate Change?” at the Public Policy Institute of California in San Francisco. We gathered a diverse panel of experts on motor-vehicle safety, tobacco regulations, and climate change and asked them to share how each movement has achieved success in the face of big business, politics, and other policy challenges. The stimulating conversation culminated in a thought-provoking discussion on how the gun violence prevention movement can learn from the approaches of advocates in these other realms of public health and safety. A Time to Honor, Reflect, and Recommit Every year, the Law Center to Prevent Gun Violence and our supporters gather to mark the anniversary of our organization’s founding with a gala dinner commemorating the lives taken on July 1, 1993, as well as the unacceptable toll of lives taken by gunfire every day. By bringing our community together, we strive to look to the future and develop lasting solutions to the plague of gun violence in America. The Law Center’s 20th Anniversary Dinner was held on June 28, 2013, at The Fairmont Hotel in San Francisco, and was like none other. The confluence of our milestone 20th anniversary and the newfound energy within the gun violence prevention movement resulted in our biggest and most successful event ever. Over 800 of our strongest supporters joined us for an engaging and inspiring evening.

We are so fortunate to have had such a remarkable display of loyal support from Bay Area law firms and individuals, as well as many new sponsors from across the country, all of whom helped us exceed our fundraising goal. Beyond its fundraising success, the Anniversary Dinner was an ideal opportunity to come together to recommit our efforts to end gun violence and hear from leaders in the movement. The extraordinary program included remarks from Senator Dianne Feinstein, House Leader Nancy Pelosi, Congressman Mike Thompson, San Francisco Mayor Ed Lee, Pastor Michael McBride, and Law Center Executive Director Robyn Thomas. Awards were given to Senator Feinstein, Congressman Thompson, and Pastor McBride for their outstanding and courageous leadership on preventing gun

violence. Each year, we also recogize a Pro Bono Partner that provided exceptional volunteer support to the Law Center’s efforts. In 2013, we honored Kirkland & Ellis LLP as our Outstanding Pro Bono Partner of the Year. Finally, we also inducted three new members into the Law Center’s Founders’ Circle: Elizabeth Cabraser, Carol Kingsley, and Michelle Scully Hobus. The San Francisco Giants and the Law Center Play Ball To commemorate the 20th anniversary of the tragic shooting at 101 California Street in 1993 that devastated the San Francisco community, the San Francisco Giants chose the Law Center to Prevent Gun Violence as their community partner for the June 22, 2013, game.

The Giants honored members of the Law Center on the field for the Home Plate Ceremony before the game and aired a public service announcement about our work. We are incredibly grateful to the Giants for helping raise awareness for the work we do to prevent the loss of lives caused by gun violence.
