How to read this catalog 1. Reg#: the registration number of the animal. NotReg means
the animal is not registered. Pending means that a registration number has been applied for, but was not issued at the time of catalog printing.
2. Brd: breed of the animal if two breeds or less are involved. If more than two breeds are in the animal, then the composition shows the percent British and the percent Continental, i.e. 58B 42C means 58% British and 42% Continental. 3. DOB: date of birth 4. Color: BLK = black, BWF = black white face, BBF = black brockle face, RED = red, RWF = red white face, WHT = white.
10. Genetic Defect codes - a C appended to the end denotes carrier and an F denotes tested free and P denotes possible but untested. NH - Neuropathic Hydrocephalus AM - Arthrogryposis Multiplex CA - Contractural Arachnodactyly OS - Osteopetrosis DD -Developmental Duplication Phenotype Scores to Make Bull Buying Easier: 11. C. Ease: Calving Ease is the predicted calving ease if you use the bull on heifers. If there is a number in the brown box, this indicates the breed calculated calving ease direct EPD. In addition, we provide our Leachman estimated calving star system.
***** The easiest calving bulls in the industry. **** Use on smaller heifers with minimal assistance needed *** Use on larger heifers with some assistance expected.
12. Growth: This is a score from one star to five stars, where five stars means maximum growth. Even the one star bulls are as growthy as any bull in America 20 years ago. 13 . Maternal: This is an estimate of maternal efficiency, NOT milk. It includes cow size, milk, fertility, and growth. The bulls are scored from one star to five stars. Five star bulls will produce some of the most profitable cows in the industry if you sell calves at weaning. 14. Feedlot: This looks at all of the post weaning traits including gain, conversion, carcass weight, and carcass merit. Scored
from one star to five stars, where five stars would produce maximum overall value in your feeder calves. 15. Phenotype: A combination of eye appeal and overall kind. Scored from one star to five stars. Five star bulls are the best phenotypic bulls in the sale (in our opinion)! Two star bulls are less attractive visually than average. 16. Disposition: Our traditional score of 1 – 5 on disposition. Score 5 bulls are bulls you can walk up to and touch. Score 3 is about average historically for Leachman bulls. However, we are making a concerted effort to improve disposition, so most bulls score 3 or higher. The bulls scored 2.5 or 2 are nervous and do not like to be in close quarters with people on foot – but they are great for big range operations. 17. Actual birth weight. This is not adjusted for age of the dam.
EPDs/ABCs Breed Association EPDs (Expected Progeny Differences) are listed for all registered animals. Leachman ABCs (Across Breed Comparisons) are listed for all un-registered animals. All ABCs are on an Angus base and can be compared across breeds within this catalog. EPDs are appropriate association EPDs without any adjustments. 18. Birth weight EPD/ABC expressed on an Angus scale (or breed scale for Red Angus, Hereford, and Charolais). 19. Weaning weight EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 20. Yearling EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 21. Milk EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. This is the best predictor of a bull’s daughter’s ability to milk. It measures the difference in weaning weight that will be produced between one bull’s daughters and another bull’s daughters due solely to milk. 22. IMF is the ultrasound based EPD/ABC for marbling expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 23. REA is the ultrasound based EPD/ABC for ribeye area expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 24. MWT is the predicted mature weight of daughters that you will get if you use the bull on a 1250 pound cow. If your cows weigh 1350, add 100 to this predicted weight. If your cows weigh only 1150, subtract 100 from this predicted weight. This EPD is the best indicator of daughter size -- far better than frame score or yearling height. 25. F:G is the pedigree estimated feed to gain EPD that predicts the feedlot efficiency of the bulls offspring. A negative number means that the bull’s progeny will feed more efficiently. Example: -0.50 means that the bulls progeny will require ½ pound less feed per pound of gain. 26. Intake: is an estimate of the amount of feed that the bull’s progeny will consume over a 112 day feeding period. It is expressed in pounds. Animals with higher intake will consume more throughout their life. Animals with lower intake will consume less. 27. FS is an EPD, expressed as frame score, predicting the yearling frame score of a sire’s progeny, compared to that of other sires. (970) 568-3983
28. SC is an EPD, expressed in centimeters, predicting the yearling scrotal circumference of a sire’s progeny, compared to that of other sires. 29. $Ranch EPD: This Leachman profit index that predicts weaning profitability based on calving ease, weaning weight, maternal milk, cow cost, and FERTILITY. Based on producing 100 calves. This EPD assumes a slide on calf prices of $10 / cwt. 30. $Feeder: This number is expressed in terms of the bull’s added value to the sale price of your feeder calves. It is expressed in dollars per head. Thus when comparing a +100 bull vs. a +50 bull, we expect the first bull to sire calves worth $50 per head more at weaning (regardless of their weight). 31. $Profit™ EPD: One, simple, proven number that gives each trait a weight according to its impact on profit. 32. FT: Indicates the bull was individually measured for feed intake. Bulls without this notation, were not individually measured. Unmeasured bulls have EPD’s based on their parental average.
New, One Year Guarantee!
For the first time ever, Leachman Cattle of Colorado is offering a one year guarantee on all bulls that we sell. This guarantee will cover your purchased bull(s) against death, injury, infertility, and loss of use. If, during the first year from purchase, you lose the use of your Leachman bull for whatever reason, we will give you a full credit towards the purchase of a new bull. We only ask that your herd veterinarian provide a written statement describing the death, injury, or infertility. If the bull in question can be salvaged, we would like you to keep the salvage value, and a credit will be issued, less the salvage amount you receive for the bull. If the bull completes a full breeding season, then the credit will be given at 75% of the original purchase value (less any salvage value). All claims must be made within 1 year from the date of purchase. Example 1: Your $5,000 bull dies before you turn him out to breed. You receive a full credit of $5,000. (Purchase Price - $0 Salvage - $0 Use). Example 2: Your $5,000 bull injures his scrotum after you pull him from the cows. You sell him for $1000 in salvage. You receive a credit of $2,750 ($5000 purchase - $1000 salvage - $1250 usage). Requirements for claims: 1. All claims must be made within 365 days of purchase. 2. A veterinary statement regarding the circumstances is required. 3. A Verbal agreement from Leachman Cattle of Colorado is required prior to a bull being sold for salvage. Documentation of the salvage value of the bull, including identification of the bull on the sale barn ticket, that corresponds to the bulls Leachman identifications (ear tag or metal clip) is also required. This credit can be used for the purchase of bulls, females, semen, and/or embryos from Leachman Cattle of Colorado. If the credit is not used within 24 months of the date of issuance, then it will expire.

$PROFIT Why $Profit helps:
Today, ranchers have too much data to study. With over 20 EPD traits and so many measurements, buying the best bull has become really confusing. Every bull is good on some traits and weak on others. The challenge is figuring out how each of those traits is going to impact your bottom line. We wish we knew which bull would make the most money from birth to slaughter, but most of the time, we end up guessing. Back in 2005, we decided that we didn’t want to guess any more. Dallas Horton asked Lee Leachman to come up with one number that sorted the bulls on their bottom line impact – so we did. Since then, we have provided $Profit on all bulls we sell. Furthermore, we are basing almost all of our own selection decisions on $Profit. Literally, we are putting our money where our mouth is. Let me tell you a story about two bulls that we bought a few years ago from the same sale. Both bulls had complete performance data, ratios, ultrasound, and even feed efficiency data. They were both the same breed. After the sale, we added their herd’s data into our database to calculate EPD’s and $Profit. One bull came out at $8,374 and the other came out at $14,258. That is a huge difference – one bull was a great buy and the other was an expensive mistake.
How $Profit works:
$Profit assumes that the average commercial bull will have 100 progeny over its lifetime. The model assumes that you keep 30% of your heifers as replacements and that you retain ownership on the remainder of the calves through finishing and sale on a grid. We realize that many don’t retain ownership, but doesn’t it make the most sense to select from birth all the way to slaughter? Feedlots have already proven their willingness to pay premiums for superior Leachman sired calves. Our simulation model then factors in all of the effects on both income and expense to come up with a net profit figure for each bull. $Profit allows you to compare any two bulls and calculate the difference in profit that they are expected to generate in your herd. Let’s compare a $10,000 $Profit bull to $6,000 $Profit bull (the average 2008 born Angus bull). The predicted difference between the bulls is $4,000 or about $40 per calf. $Profit works for us and it will work for you too.

What traits are included in $Profit:
$Profit includes nearly every trait that impacts profitability. The effect of most traits on profit is fairly simple to understand. Here is the list of what is included and its effect: Revenue Traits ▪▪ Calving ease = more calves ▪▪ Weaning & yearling EPD = more weight ▪▪ Fertility (days to conception) = more weight and more calves ▪▪ Carcass weight = worth more up to 1050 lbs. ▪▪ Marbling = valued based on grid premiums ▪▪ Ribeye area = value as impacts yield grade ▪▪ % Retail Product = more yield is more meat Cost Traits ▪▪ Cow mature size = bigger eats more ▪▪ Cow intake = more intake costs more ▪▪ Feedlot feed efficiency = cost of gain Some traits are not so easily characterized for $Profit. Milk, for example, is a good thing until you get too much. When over +25, milk EPD has a more negative effect on fertility than it has a positive effect on weaning weight. There are a few traits not yet included in $Profit: longevity, structure, and disposition. These traits are important but difficult to express in dollars.
Feed Efficiency Explained: Feed:Gain: Difference in the amount
of feed a bull's progeny will consume to produce one pound of gain. Example: A -0.50 F:G EPD means this animal's progeny will consume 1/2 pound less feed per pound of gain than would progeny of a 0.00 F:G EPD sire.
Feed Intake: Difference in feed con-
sumption of each of a bull's progeny in a 112 day feeding period.
Example: A steer whose sire has a -100 Intake EPD will eat 100 pounds less feed in 112 days than one whose sire had a zero Intake EPD.
Leachman’s Cutting Edge Financial Indexes Include Tested Feed Efficiency Values! At Leachman Cattle, we have collected feed intake records on over 13,000 animals. These records allow us to estimate feed intake and feed conversion EPDs. These values are then incorporated into our overall selection indexes.

These bulls don’t melt!
“We bought our first Leachman bulls in 2004. We used the Leachman bulls on our British x Brahman crossbred cowherd. We liked our first calf crops – heavier and more acceptable type. We’re extremely happy with the cows they made. In fact, we like their daughters as well as our F1 cows. The Leachman bulls were better than anything else we had used before. Their confirmation, with more muscle, did not melt off in our rugged country. And they worked really hard! Today, all our bulls are Leachman/TopLine bulls. We buy only $10,000 $Profit and higher bulls with good ribeye, marbling, and feed efficiency….”

High $Ranch Stabilizers are building a better cowherd for the IX Ranch “I am definitely happy with our 2016 production report. We’re a large outfit and run on big country with under 14” of total precipitation. Our goal is to have an efficient cow that will have high fertility and high pounds weaned per cow exposed in our environment. We are raising 600 pound steer calves out of 1,200 pound cows. We are almost up to 550 pounds weaned per cow bred! Using Leachman Stabilizer bulls, we have our cowherd profit traits moving in the right direction. Our cows’ mature weight and frame are moderating, milk is not too high or too low, and our preg rates are up. So far this year, our mid-aged cows are 94% pregnant.”

Sweetwater Ranch is using high $Profit Stabilizers to build great replacements AND great feedlot cattle. Chad Williams, Manager and Bob Schmidt, Owner of Sweetwater Ranch
“Bob wants low cost, moderate cows; but I also want steers that hit it out of the park.“
~ Chad Williams Sweetwater Ranch, Hays, KS
For Bob, this means keeping cow size moderate. Nonetheless, Chad wants steers that have growth and carcass merit that will rank high in the industry. By measuring all traits and balancing them with $Profit, the Sweetwater Ranch is hitting both goals. The Sweetwater replacement females, pictured below, will check all of the boxes. They fit the environment, are easy fleshing, calve without difficulty, and raise good calves.

101 Livestock Market Report August 23, 2016
Last week we started to talk about buying bulls for this fall and why Leachman Topline bulls are some of the best bulls on the market. Being able to buy bulls with a real value on them is a relatively new tool in bull selection, and we have been attempting to explain this new process. $Profit Gives you One Number This new method of bull selection combines all the EPD’s in a computer program and allows everyone to select bulls without all the confusion associated with trying to get the best of all those EPD’s. The computer process kicks out one number called $PROFIT. If you want to produce calves in the top 1/2 of all calves produced in 2017, then you will need to select bulls with a $9,000 PROFIT and up. Make Sure You Get What You Pay For Keep in mind the $PROFIT number is the real value of the bull you purchase servicing 25 cows for the next 4 years. The higher the number, the better the calves you are going to produce. It’s a number you can go to the bank on. If you buy bulls elsewhere and they don’t give you the $PROFIT number, then you won’t know if he is worth $4,000 or $12,000.
$PROFIT is a number everyone is going to need to be competitive in the calf market…. ~ Jim Warren 101 Livestock, Aromas, CA

“We are deep into the Leachman program. We want it all! We are using two tools: $Profit bulls and DNA testing. Our goals are to have quiet temperaments, wean a high percentage of good, healthy calves at an early age and produce feed lot cattle that really put on the weight with high daily gain and feed efficiency. We want to harvest the calves at 12 – 13 months of age and earn as many carcass premiums as possible.”

“Our cows winter graze and range calve on high, semi-arid ranges from 5000’ to 8500’. We do not feed hay, but do supplement with protein tubs. Our total carrying capacity is limited by our public range carrying capacity limits. Year in and year out we are around 1400 cows. We keep very close track of what the cows are doing: ●

90% pregnant on our yearling heifers in a short, 30 day season with timed AI and natural service cleanup. 96%+ pregnancy on the cowherd. We then sell any bred cow that will not calve in the first 45 days. 92% - 95% weaned calves/pregnant cows depending on Spring storms.
These numbers have all improved over the last 15 years as the cows were increasingly the result of high $Profit Leachman Stabilizer bulls.”

The Stabilizer Breed The Stabilizer breed is a multi-breed composite developed by Leachman Cattle Company. The breed is based on research done by the United States Department of Agriculture (USDA) at their Animal Research Service (ARS) at the MARC, Clay Center, Nebraska. The Stabilizer breed is a blend of Stabilizers at the Tessari Ranch British and Continental inputs. The original formation was 25% of four breeds each – Red Angus, Hereford, Simmental, and Gelbvieh. The Stabilizer combines the fleshing ability, marbling, and moderate size of the British breeds with the muscle, milk, and growth of the Continental breeds. As a four breed composite, the Stabilizer retains 75% of the F1 hybrid vigor and thus allows producers to crossbreed with simplicity. The MARC (Meat Animal Research Center) started a project in 1973 called the Germ Plasm Utilization (GPU) project. Stabilizers at the Reiger Ranch The research project was led by Dr. Larry Cundiff and Dr. Kieth Gregory – two scientists widely regarded as world-wide leaders in crossbreeding research. The goal of the GPU project was to study the impact of hybrid vigor or heterosis on all production traits. As part of this project, the government station developed three different multi-breed composites populations to see how hybrid vigor was retained in multiple generations of composite x composite crossbreeding. The composites where named Marc I (¾ Continental, ¼ British), Marc II (½ Continental,
Stabilizers are bred to be maternally efficient - they wean a high percentage of calf weight to cow weight.
Page 18
½ British), and the Marc III (¼ Continental, ¾ British). The research at the MARC showed several advantages that come from crossbreeding. Most importantly they showed
Highly productive Tessari Stabilizers
that hybrid vigor has a large impact on beef cattle production. The research demonstrated an 8% improvement in weaning weight when a purebred cow is mated to a bull of a different breed. The research also showed that crossbred cows are far more productive than purebred cows. The benefits came in multiple areas including more milk production, better body Typical mature Stabilizer bull at the Grubl Ranch condition, faster re-breeding, and a longer productive lifetime. In total, the crossbred cows weaned 23% more weight than did purebred cows. Historically, crossbreeding requires the use of complicated mating systems to keep the hybrid vigor effect. Scientists designed rotational systems using three breeds. However, such systems were too complicated. Furthermore, they resulted in wide swings in breed composition, and prevented breeders from having a uniform, well adapted herd. As an alternative, the researchers at MARC developed multi-breed composites. Their study confirmed that such composite breeds retain hybrid vigor in proportion to the number of breeds used – using more breeds generates more retention of hybrid vigor. The Marc II composite, with four breeds, retains 75% of the
F1 hybrid vigor. Thus, breeders can breed composite bulls to composite females and keep most of the available hybrid vigor. As scientists developed the composites at Clay Center, Dr. Gregory was asked to help a private commercial cattlemen, named Pat Vinton, build a composite program in central Nebraska. Based on research work, Dr. Gregory recommended that Mr. Vinton develop a composite patterned after the Marc II. Thus, Pat started with two different herds of females where he crossed Red Angus with Simmental and Gelbvieh with Hereford. He then used the resulting F1 bulls over the females in reciprocal matings to build the mix of 25% from each breed. In 1988, Lee Leachman visited the Vinton herd in Nebraska to inspect the cattle. Lee was so impressed with the herd that he convinced Mr. Vinton to send bulls to Leachman Cattle Company for sale in their World’s Largest Bull Sale in Billings, MT. Unfortunately, Mr. Vinton passed away unexpect-
Despite the merit of the Stabilizer’s original breed mix, at Leachman’s decided to open the mix of the composite to allow for the use of the best possible bloodlines. In the late 90’s, this meant the absorption of the Leachman Rangemaker line that included Angus, South Devon, Tarentaise, and Salers into the Stabilizer herd. In more recent years, top crossing using purebred Angus, Gelbvieh, and Simmental herd sires has been used to rapidly incorporate the most advanced Stabilizers yearling heifers are easy to purebred lines. raise and breed. Currently, Leachman is working to incorporate South Devon lines to take the place of the original Hereford breed inputs. Today, the Leachman Stabilizer population ranges from 3/8 British – 5/8 Continental to ¾ British – ¼ Continental. The three primary breed inputs continue to be Angus, Simmental, and Gelbvieh. ALL ANIMALS OFFERED ARE SUBJECT TO PRIOR SALE AND PRICE CHANGES. EXCEPT FOR THOSE STATED IN THE BELOW TERMS AND CONDITIONS, THERE ARE NO WARRANTIES, EITHER EXPRESSED OR IMPLIED, AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE CATTLE BEING SOLD IN THIS OFFERING. THE WARRANTIES AND GUARANTEES SET FORTH IN THESE “TERMS AND CONDITIONS” ARE IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, AND THE REMEDIES PROVIDED THEREIN SHALL BE THE SOLE AND EXCLUSIVE REMEDY OF THE BUYER, OR ANY PARTY CLAIMING THROUGH BUYER, FOR ANY BREACH OF WARRANTY OR GUARANTEE THEREIN PROVIDED, AND ALL OTHER OBLIGATIONS OR LIABILITIES.
SALE TERMS AND CONDITIONS
TERMS: Terms of sale are cash unless satisfactory credit arrangements have been made with the Seller prior to the sale. PURCHASER’S RISK: Each animal becomes the risk of the Purchaser as soon as sold. It shall be the obligation of the Seller to see that animals are fed and cared for, free of charge to Purchaser, until loaded for shipment. CERTIFICATE OF REGISTRY: A transferred certificate of registry will be furnished to the Buyer for each animal unless said animal is unregistered as denoted in the catalog. HEALTH: All animals are eligible for interstate shipment; except as otherwise announced. Interstate health papers will be furnished for each animal requiring T.B., Bang’s, and other health testing in accordance with State and Federal Regulations. ARTIFICIAL INSEMINATION SERVICE CERTIFICATES A.I. Service Certificates shall be furnished by the Seller, at no cost to the Buyer, for all females sold in the sale that are bred artificially to bulls not owned by the Seller. ANNOUNCEMENTS: Changes of information, of any kind, in this catalog will be announced from the auction block. Such announcements shall take precedence. BREEDING GUARANTEE 1. All animals are guaranteed breeders, with the exception of: a) calves under twelve months of age; b) animals shown by Purchaser after sale (in cases of animals shown after purchase, the breeding guarantee, if any, shall be such as agreed upon between Seller and Buyer; or c) gross negligence or willful misconduct on the part of the Purchaser. 2. Bulls are guaranteed breeders if not allowed to run with the herd until at least 14 months of age. Any bull which either: 1) settles 1/3 or more of the healthy cows he serves; 2) is the sire of 20 or more animals; or 3) settles cows by natural service and passes a fertility test made by a competent veterinarian during any 6 month period of trial (provided for in paragraph 2 of the section of these sale terms and conditions entitled “Options and Privileges of Return or Adjustment”) shall be considered a breeder. Any guarantees with respect to the ability to freeze semen shall be by separate agreement between Buyer and Seller. “Safe in Calf” Females have been examined by a competent veterinarian and are so guaranteed. Pasture-bred Females have been exposed, but are not guaranteed to be in calf. Serviced females are believed to be in calf but are not so guaranteed. Open females have not been served and are so guaranteed. IDENTIFICATION: Seller offers each animal with a readable tattoo corresponding to its catalog designation and registration when applicable. OPTIONS AND PRIVILEGES OF RETURN OR ADJUSTMENT 1. All claims for adjustment or refund must be made in writing either within six months of the sale date or no later than six months after the animal reaches 18 months of age, with the exception of claims involving defects or parentage. 2. In the event an animal is claimed to be a non-breeder, the animal may be returned to the farm of the Seller, if in good condition and in compliance with the health requirements of the Seller’s state. The Seller shall be entitled to six months trial following the return of the animal in which to prove that the animal is a breeder. If at the end of six months the Seller is unable to prove the animal is a breeder, the Seller shall, at the option of the Buyer, replace the animal with another of equal value or grant the Buyer a credit for use on any products marketed by the Seller. Such credit of the full purchase price shall, in any case, be deemed full satisfaction and settlement. Any expense incurred for transporting an animal claimed to be a non-breeder shall be the responsibility of the Purchaser, except that the Seller shall be responsible for transportation costs in excess of the distance between the Purchaser’s farm and the location where the sale took place. If the Seller proves the animal to be a breeder, it shall be the obligation of the Purchaser to take delivery of the animal and pay all expenses incurred for transportation.
Page 32
3. If a female sold as “safe in calf” proves not to be in calf, the Purchaser may receive service from the bull previously used, if available, or if the bull is not available, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the Seller. Any adjustment provided for herein shall absolve the Seller from further liability, except in case such female proves to be a non-breeder. If a female represented as “safe in calf” at time of sale to a certain bull proves to have been bred to a different bull, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the Seller (adjustments shall not be considered to be a breeding fee or an allocation of the purchase price to any unborn calf). Any expenses incurred for transportation shall be the responsibility of the Purchaser, except that the Seller shall be responsible for transportation costs in excess of the distance between the Purchaser’s farm and the location where the sale took place. 4. If a female sold as “served” proves not to be in calf, or if a female sold as “pasture-bred” proves not to be in calf, the Seller only guarantees such female to be a breeder. 5. If a female sold as “open” proves to be with calf, the Purchaser may return the animal to the farm of the Seller prior to calving for a credit of the full purchase price or for another animal of equal value, whichever is acceptable to the Purchaser. It shall be the obligation of the Seller to bear any expense incurred for transportation. GENETIC DEFECT AND PARENTAGE GUARANTEE 1. All animals are guaranteed not to produce a calf with the following defects: Dwarfism, Double-muscling, Parrot Mouth, Osteopetrosis (marble bone disease), and Syndactylism (mule foot), and Arthrogryposis Multiplex (curly calf). The parentage of all animals bred by the Seller is guaranteed to the extent that the animal is by the Sire and out of the Dam indicated on its registration paper. These guarantees are effective for a period of two years from date of sale only under the following conditions. a) The Buyer shall notify the Seller in writing immediately upon the birth of a calf suspected of being defective or immediately after determination is made that such calf is defective, or if parentage is suspected or found to be in error. b) The Seller, at his expense shall be permitted and provided, with reasonable opportunity, to obtain blood samples of an alleged defective calf and its sire and dam for the purpose of blood type/DNA analysis to establish parenthood. In the case of suspect parentage, the Buyer at his expense, shall be permitted and provided, with reasonable opportunity, to obtain blood samples of the animal in question and its sire and dam for the purpose of blood type/DNA analysis to establish parenthood. If sire or dam, as indicated on the animal’s registration paper, is proven to be in error by such analysis, the Seller shall reimburse Buyer for cost of such analysis. c) The animals will be returned by the Buyer to the Seller at the Buyer’s expense; provided the animal meets the health requirements for the Seller’s state. d) The replacement of an animal with another of equal value or the refund of the purchase price, in connection with a defect producing animal or an animal whose parentage is in error, shall be deemed full satisfaction and settlement. 2. In the event there is a dispute as to whether or not a calf is defective, or parentage is in error, “determination” referred to in Paragraph 1a above shall be made by a person or persons acceptable to both the Buyer and Seller. In the event that Buyer and Seller cannot agree on the selection of such person or persons, then each of them shall appoint a representative to make the determination. In the event that such representatives fail to agree, a third person selected by the representatives of the Buyer and Seller shall make the determination. RIGHTS AND OBLIGATIONS The above terms and conditions of sale shall constitute a contract between the Buyer and Seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. Neither the sale manager, nor any other person connected with the management of the sale, assumes any liability, legal or otherwise.
