If the bull completes a full breeding season, then the credit will be given at 75% of the original purchase value (less any salvage value). All claims must be made within 1 year from the date of purchase.

How To View Sale Videos and Access the Auction:
The bull videos will be posted online at both www.superiorlivestock.com and www.Leachman.com prior to the auction opening. The Auction itself will be conducted racehorse style and will open by Noon CST on Tuesday, February 7th and will begin closing at 5:00 pm CST on Thursday, February 9th. To access the auction and the videos from a traditional computer go to www.superiorlivestock.com and click on the Production Auctions “Schedule” tab at the top of the homepage and then locate the auction on February 9th from the sale calendar and click the appropriate link. You may also access the auction from www.Leachman.com or www.smartauctions.auction. SmartAuctions is also built for a mobile platform to accommodate today’s busy world. To access the auction from a smart phone text “Leachman” to 52182 and follow the prompts. To place a bid on a lot you must register for the auction. When you click on an individual lot it will initially show “Want to place a bid?” with a “REGISTER NOW” tab right below it. Click on the “REGISTER NOW” tab and input your correct information with a valid address, mobile phone number and e-mail address. It will also eventually ask for a credit/debit card. You must provide a valid credit or debit card to verify your identity, but you will not be charged for any purchases on your credit card unless you specifically request that after the sale is completed. If you do not wish to pay with a credit card then do not choose to do so and you will receive an invoice in the mail and/or by e-mail to pay by check. Once you have registered you will have a username and password and will not have to register for this auction again. Once you have placed a bid you will receive confirmation via a text message regardless of whether you bid over a traditional computer, a tablet or a smart phone. You should also receive a text message the moment you have been outbid provided you have good cell service. This will save you from having to watch the entire auction if you do not wish to.
Additional Helpful Information Regarding The Auction:
What is a racehorse style auction? A racehorse style auction is a timed auction that has no sale order and closes every lot at the same time. Once the auction hits 5:00 pm CST on Thursday, February 9th there will be 5 minutes left on the clock. If nobody bids in this time frame the auction closes and each lot sells to the highest bidder for that particular lot. If somebody does bid in this time frame then the clock resets to 5 minutes and counts down again. This process will continue until no other bids are placed and the clock reaches zero. This approach eliminates the need for a sale order and allows customers the opportunity to select another lot once the lot they have been bidding on is beyond their limit. Should I wait until the last second to bid? No!! Your countdown timer is an estimate and may not match exactly with the auction server. If you wait until the last second to bid you run the risk of your countdown clock being off by a few seconds and the auction closing before you place your bid. Will the sale refresh automatically? Yes. If you are watching the auction on a smart phone and leave your web browser you may need to refresh when you first return to the webpage. If ever in doubt go ahead and refresh. Can I make this to where I only see/follow the lots I’m interested in? Yes, once you click on an individual lot there will be a tab with a star next to it that says “Watch This Item”. Click on it and then when you return to the All Items page you will see a tab at the top that says “My Activity”. Click on this and you will only see the lots you have starred. You can also un-watch a lot by clicking “Stop Watching” on the individual lot. If you have any questions or need help registering and/or bidding call (866) 419-6279. SmartAuctions will send invoices following the conclusion of the sale.

$PROFIT Why $Profit helps:
Today, ranchers have too much data to study. With over 20 EPD traits and so many measurements, buying the best bull has become really confusing. Every bull is good on some traits and weak on others. The challenge is figuring out how each of those traits is going to impact your bottom line. We wish we knew which bull would make the most money from birth to slaughter, but most of the time, we end up guessing. Back in 2005, we decided that we didn’t want to guess any more. Dallas Horton asked Lee Leachman to come up with one number that sorted the bulls on their bottom line impact – so we did. Since then, we have provided $Profit on all bulls we sell. Furthermore, we are basing almost all of our own selection decisions on $Profit. Literally, we are putting our money where our mouth is. Let me tell you a story about two bulls that we bought a few years ago from the same sale. Both bulls had complete performance data, ratios, ultrasound, and even feed efficiency data. They were both the same breed. After the sale, we added their herd’s data into our database to calculate EPD’s and $Profit. One bull came out at $8,374 and the other came out at $14,258. That is a huge difference – one bull was a great buy and the other was an expensive mistake.
How $Profit works:
$Profit assumes that the average commercial bull will have 100 progeny over its lifetime. The model assumes that you keep 30% of your heifers as replacements and that you retain ownership on the remainder of the calves through finishing and sale on a grid. We realize that many don’t retain ownership, but doesn’t it make the most sense to select from birth all the way to slaughter? Feedlots have already proven their willingness to pay premiums for superior Leachman sired calves. Our simulation model then factors in all of the effects on both income and expense to come up with a net profit figure for each bull. $Profit allows you to compare any two bulls and calculate the difference in profit that they are expected to generate in your herd. Let’s compare a $10,000 $Profit bull to $6,000 $Profit bull (the average 2008 born Angus bull). The predicted difference between the bulls is $4,000 or about $40 per calf. $Profit works for us and it will work for you too.
On the Ranch, In the Feedlot, & On the Rail, ™ $Profit simply works!

What traits are included in $Profit:
$Profit includes nearly every trait that impacts profitability. The effect of most traits on profit is fairly simple to understand. Here is the list of what is included and its effect: Revenue Traits ▪▪ Calving ease = more calves ▪▪ Weaning & yearling EPD = more weight ▪▪ Fertility (days to conception) = more weight and more calves ▪▪ Carcass weight = worth more up to 1050 lbs. ▪▪ Marbling = valued based on grid premiums ▪▪ Ribeye area = value as impacts yield grade ▪▪ % Retail Product = more yield is more meat Cost Traits ▪▪ Cow mature size = bigger eats more ▪▪ Cow intake = more intake costs more ▪▪ Feedlot feed efficiency = cost of gain Some traits are not so easily characterized for $Profit. Milk, for example, is a good thing until you get too much. When over +25, milk EPD has a more negative effect on fertility than it has a positive effect on weaning weight. There are a few traits not yet included in $Profit: longevity, structure, and disposition. These traits are important but difficult to express in dollars.
Feed Efficiency Explained: Feed:Gain: Difference in the amount of feed a bull's progeny will consume to produce one pound of gain.
Example: A -0.50 F:G EPD means this animal's progeny will consume 1/2 pound less feed per pound of gain than would progeny of a 0.00 F:G EPD sire.
Feed Intake: Difference in feed con-
sumption of each of a bull's progeny in a 112 day feeding period. Example: A steer whose sire has a -100 Intake EPD will eat 100 pounds less feed in 112 days than one whose sire had a zero Intake EPD.

Leachman Cattle of Colorado is committed to helping ranchers reduce the losses from brisket disease. We know from our own cowherds that losing calves to brisket at any time from birth through yearling stage can have significant financial cost. We are convinced that pulmonary artery pressure (PAP) scores are very strong predictors of whether or not animals will have the disease. For this reason, we have collected over 2,432 PAP scores on cattle in our program. Unfortunately, taking measurements will not solve the problem. Most ranchers know that buying PAP tested bulls reduces the problems with brisket, but most still report losing 3% - 8% of their calves to brisket depending on the year. This level of calf loss is still unacceptable! We believe that the best strategy to reduce brisket disease is to use expected progeny differences (EPDs) for PAP. Think of selecting for low birth weight. Just buying bulls under 80 pounds would help calving ease, but using low birth weight EPD bulls is a much more effective strategy. This is true, because an EPD takes into account much more information. For example, buying a 75 lb. BW bull out of a sire that generally sires very heavy calves is far less likely to be easy calving than is a similar BW bull out of a sire that generally sires light calves. The same is the case with PAP. Our PAP EPD closely relates to the actual PAP score of the bulls as shown in the graph below. The correlation between the PAP scores and the PAP EPDs are 80%. This is typical in a trait like PAP that is 30% heritable. However, as with all EPDs, you can see that some bulls score better or worse on the EPDs than on the actual score. Ranchers concerned with PAP scores should use the EPDs – not the actual PAP scores. It is clear to us that sires with PAP EPD’s over +3 have tremendous death loss on their calves. Sires with +1 or less on PAP EPD are typically considered sires that are “good at altitude.” The sixty-six sale bulls that are under -0.7 on PAP should be used to dramatically reduce brisket disease in herds that suffer from significant high altitude disease problems.
Key points to regarding PAP and PAP EPDs: • • •
•
We have taken 2,432 PAP scores (all by Dr. Tim Holt). PAP is 30% heritable. The PAP EPDs reported were calculated by Colorado State University. Selecting bulls using the PAP EPD is FAR more accurate than simply using the PAP scores. Herds that have significant brisket disease should use the lowest PAP EPD bulls.

Birth weight EPD/ABC expressed on an Angus scale (or breed scale for Red Angus, Hereford, and Charolais). 19. Weaning weight EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 20. Yearling EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 21. Milk EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. This is the best predictor of a bull’s daughter’s ability to milk. It measures the difference in weaning weight that will be produced between one bull’s daughters and another bull’s daughters due solely to milk. 22. IMF is the ultrasound based EPD/ABC for marbling expressed on a breed scale. The Stabilizers are expressed on an Angus scale.
30. $Feeder: This number is expressed in terms of the bull’s added value to the sale price of your feeder calves. It is expressed in dollars per head. Thus when comparing a +100 bull vs. a +50 bull, we expect the first bull to sire calves worth $50 per head more at weaning (regardless of their weight). 31. $Profit™ EPD: One, simple, proven number that gives each trait a weight according to its impact on profit. 32. FT: Indicates the bull was individually measured for feed intake. Bulls without this notation, were not individually measured. Unmeasured bulls have EPD’s based on their parental average. 33. PAP: New PAP EPD. See page 4 for mor information. Key to bull comments: • Any reference to % rank is the percentile rank within that bull’s breed. Top 1% means the animal ranks better than 99% of the population on that trait.
23. REA is the ultrasound based EPD/ABC for ribeye area expressed on a breed scale. The Stabilizers are expressed on an Angus scale.
• Reference to the number rank (i.e. #2 $Profit) is the bulls rank within his breed within the sale bulls for that trait. So, #4 F:G ST means the 4th best Feed:Gain Stabilizer bull in the sale.
24. MWT is the predicted mature weight of daughters that you will get if you use the bull on a 1250 pound cow. If your cows weigh 1350, add 100 to this predicted weight. If your cows weigh only 1150, subtract 100 from this predicted weight. This EPD is the best indicator of daughter size -- far better than frame score or yearling height.
• All bulls are evaluated for foot soundness. Bulls below a 3 score are deemed to have less than desirable hooves. 2.5 Feet = flatter heal and/or slightly longer toe. 2.0 Feet = flatter heal and much longer toe. 1.5 Feet = evidence of toes curling in on front or hind feet. All such bulls’ feet have been trimmed and sell with our complete guarantee.
25. F:G is the pedigree estimated feed to gain EPD that predicts the feedlot efficiency of the bulls offspring. A negative number means that the bull’s progeny will feed more efficiently. Example: -0.50 means that the bulls progeny will require ½ pound less feed per pound of gain.
• Other abbreviations used in the comments include:
26. Intake: is an estimate of the amount of feed that the bull’s progeny will consume over a 112 day feeding period. It is expressed in pounds. Animals with higher intake will consume more throughout their life. Animals with lower intake will consume less. 27. FS is an EPD, expressed as frame score, predicting the yearling frame score of a sire’s progeny, compared to that of other sires. 28. SC is an EPD, expressed in centimeters, predicting the yearling scrotal circumference of a sire’s progeny, compared to that of other sires. 29. $Ranch EPD: This Leachman profit index that predicts weaning profitability based on calving ease, weaning weight, maternal milk, cow cost, and FERTILITY. Based on producing 100 calves. This EPD assumes a slide on calf prices of $10 / cwt. (970) 568-3983
• Dam 5@101 NR – indicates that the bull’s dam has five calves with an average weaning ratio of 101 • WR & NR = weaning or nursing ratio. How the calf ranked within herd on their adjusted weaning weight. • YR = yearling ratio. How the calf ranked within herd on adjusted yearling weight. • AWW = adjusted 205 day weaning weight. AYW = adjusted 365 day yearling weight. • REA & IMF = either adjusted data or ratios for ultrasound ribeye area and inter-muscular fat (marbling). • ADG = average daily gain on test. WDA = weight per day of age at a year. • Stay = the Red Angus EPD for Stayability. This predicts the likelihood that a bull’s daughters stay in the herd. +14 means that 14% more of this bull’s daughters will be in the herd at age 6. Page 7
Sweetwater Ranch is using high $Profit Stabilizers to build great replacements AND great feedlot cattle. Chad Williams, Manager and Bob Schmidt, Owner of Sweetwater Ranch
“Bob wants low cost, moderate cows; but I also want steers that hit it out of the park.“
~ Chad Williams Sweetwater Ranch, Hays, KS
For Bob, this means keeping cow size moderate. Nonetheless, Chad wants steers that have growth and carcass merit that will rank high in the industry. By measuring all traits and balancing them with $Profit, the Sweetwater Ranch is hitting both goals. The Sweetwater replacement females, pictured below, will check all of the boxes. They fit the environment, are easy fleshing, calve without difficulty, and raise good calves.

High $Ranch Stabilizers are building a better cowherd for the IX Ranch “I am definitely happy with our 2016 production report. We’re a large outfit and run on big country with under 14” of total precipitation. Our goal is to have an efficient cow that will have high fertility and high pounds weaned per cow exposed in our environment. We are raising 600 pound steer calves out of 1,200 pound cows. We are almost up to 550 pounds weaned per cow bred! Using Leachman Stabilizer bulls, we have our cowherd profit traits moving in the right direction. Our cows’ mature weight and frame are moderating, milk is not too high or too low, and our preg rates are up. So far this year, our mid-aged cows are 94% pregnant.”
~ Rich Roth, Manager IX Ranch, Big Sandy, MT
Rich Roth, Steve Roth, and Lee Leachman sort through the yearling Stabilizers bulls each Spring to select the ideal set for the IX Ranch. Heavy selection pressure is placed on $Ranch, disposition, and optimal cow traits. Plus, the average $Profit is going up each year.

High $Profit Stabilizers are moving these young herds to the top! Brock & Brett Christensen Ruskin NE
“Our goal is to move our average, put-together herd of generic cows to as high a level of performance as genetically possible as fast and as economically as we can. We are doing it with Leachman Stabilizer genetics. Our first 71 head of steers converted 5.85 to one and reached a payweight of 1,436 pounds. They dressed 66% to produce an average carcass weight of 914 pounds. We are going to continue to use high $Profit Stabilizers in our AI program and we will continue to retain ownership.” ~ Brett Christensen, Partner
This modern day, Stabilizer baldy graded Choice, gained 4.43 pounds per day, and maxed out the carcass weight at 1050 pounds.
“The Christensen cattle have above average quality grade and performance, but where they really excel is their overall muscle dimension. The cattle averaged a dressing percentage of 66%, yet only had 10% 4’s and higher. That allowed them to bank an extra $100 per head over market average. Now, with their investment in Leachman 18 Karat – it will be really fun to watch the strides that their program will make.” ~ Steve Scholz, Lincoln County Feed Yard North Platte, NE

Using high $Profit Stabilizers– their cow size is going down and their calf weights are going up! “My goal has been to make my herd as efficient as possible – I want the cattle to adapt to the environment, not the other way around. We are threading the needle by lowering inputs and overhead while increasing output and profits. We focus on getting retained heterosis and feed efficiency from Leachman. We started 10 years ago and our cattle took off like a rocket. The Stabilizers lowered our cowherd mature wights and frame scores without lowering our weaning weights – in fact our calf weights are going up! Our Stabilizer sired heifers’ progeny outgrow our mature cow’s calves off grass…”

The Nelson’s have reduced their supplemental feeding from 90 days down to just 30 by calving later. Their goal is to get to zero days of feeding!

“We are deep into the Leachman program. We want it all! We are using two tools: $Profit bulls and DNA testing. Our goals are to have quiet temperaments, wean a high percentage of good, healthy calves at an early age and produce feed lot cattle that really put on the weight with high daily gain and feed efficiency. We want to harvest the calves at 12 – 13 months of age and earn as many carcass premiums as possible.”

“Our cows winter graze and range calve on high, semi-arid ranges from 5000’ to 8500’. We do not feed hay, but do supplement with protein tubs. Our total carrying capacity is limited by our public range carrying capacity limits. Year in and year out we are around 1400 cows. We keep very close track of what the cows are doing: ●
●
●
90% pregnant on our yearling heifers in a short, 30 day season with timed AI and natural service cleanup. 96%+ pregnancy on the cowherd. We then sell any bred cow that will not calve in the first 45 days. 92% - 95% weaned calves/pregnant cows depending on Spring storms.
These numbers have all improved over the last 15 years as the cows were increasingly the result of high $Profit Leachman Stabilizer bulls.”

The Stabilizer Breed The Stabilizer breed is a multi-breed composite developed by Leachman Cattle Company. The breed is based on research done by the United States Department of Agriculture (USDA) at their Animal Research Service (ARS) at the MARC, Clay Center, Nebraska. The Stabilizer breed is a blend of Stabilizers at the Tessari Ranch British and Continental inputs. The original formation was 25% of four breeds each – Red Angus, Hereford, Simmental, and Gelbvieh. The Stabilizer combines the fleshing ability, marbling, and moderate size of the British breeds with the muscle, milk, and growth of the Continental breeds. As a four breed composite, the Stabilizer retains 75% of the F1 hybrid vigor and thus allows producers to crossbreed with simplicity. The MARC (Meat Animal Research Center) started a project in 1973 called the Germ Plasm Utilization (GPU) project. Stabilizers at the Reiger Ranch The research project was led by Dr. Larry Cundiff and Dr. Kieth Gregory – two scientists widely regarded as world-wide leaders in crossbreeding research. The goal of the GPU project was to study the impact of hybrid vigor or heterosis on all production traits. As part of this project, the government station developed three different multi-breed composites populations to see how hybrid vigor was retained in multiple generations of composite x composite crossbreeding. The composites where named Marc I (¾ Continental, ¼ British), Marc II (½ Continental,

½ British), and the Marc III (¼ Continental, ¾ British). The research at the MARC showed several advantages that come from crossbreeding. Most importantly they showed
Highly productive Tessari Stabilizers
that hybrid vigor has a large impact on beef cattle production. The research demonstrated an 8% improvement in weaning weight when a purebred cow is mated to a bull of a different breed. The research also showed that crossbred cows are far more productive than purebred cows. The benefits came in multiple areas including more milk production, better body Typical mature Stabilizer bull at the Grubl Ranch condition, faster re-breeding, and a longer productive lifetime. In total, the crossbred cows weaned 23% more weight than did purebred cows. Historically, crossbreeding requires the use of complicated mating systems to keep the hybrid vigor effect. Scientists designed rotational systems using three breeds. However, such systems were too complicated. Furthermore, they resulted in wide swings in breed composition, and prevented breeders from having a uniform, well adapted herd. As an alternative, the researchers at MARC developed multi-breed composites. Their study confirmed that such composite breeds retain hybrid vigor in proportion to the number of breeds used – using more breeds generates more retention of hybrid vigor. The Marc II composite, with four breeds, retains 75% of the see video at www.leachman.com
F1 hybrid vigor. Thus, breeders can breed composite bulls to composite females and keep most of the available hybrid vigor. As scientists developed the composites at Clay Center, Dr. Gregory was asked to help a private commercial cattlemen, named Pat Vinton, build a composite program in central Nebraska. Based on research work, Dr. Gregory recommended that Mr. Vinton develop a composite patterned after the Marc II. Thus, Pat started with two different herds of females where he crossed Red Angus with Simmental and Gelbvieh with Hereford. He then used the resulting F1 bulls over the females in reciprocal matings to build the mix of 25% from each breed. In 1988, Lee Leachman visited the Vinton herd in Nebraska to inspect the cattle. Lee was so impressed with the herd that he convinced Mr. Vinton to send bulls to Leachman Cattle Company for sale in their World’s Largest Bull Sale in Billings, MT. Unfortunately, Mr. Vinton passed away unexpect-
Despite the merit of the Stabilizer’s original breed mix, at Leachman’s decided to open the mix of the composite to allow for the use of the best possible bloodlines. In the late 90’s, this meant the absorption of the Leachman Rangemaker line that included Angus, South Devon, Tarentaise, and Salers into the Stabilizer herd. In more recent years, top crossing using purebred Angus, Gelbvieh, and Simmental herd sires has been used to rapidly incorporate the most advanced Stabilizers yearling heifers are easy to purebred lines. raise and breed. Currently, Leachman is working to incorporate South Devon lines to take the place of the original Hereford breed inputs. Today, the Leachman Stabilizer population ranges from 3/8 British – 5/8 Continental to ¾ British – ¼ Continental. The three primary breed inputs continue to be Angus, Simmental, and Gelbvieh. Any bull which either: 1) settles 1/3 or more of the healthy cows he serves; 2) is the sire of 20 or more animals; or 3) settles cows by natural service and passes a fertility test made by a competent veterinarian during any 6 month period of trial (provided for in paragraph 2 of the section of these sale terms and conditions entitled “Options and Privileges of Return or Adjustment”) shall be considered a breeder. Any guarantees with respect to the ability to freeze semen shall be by separate agreement between Buyer and Seller. “Safe in Calf” Females have been examined by a competent veterinarian and are so guaranteed. Pasture-bred Females have been exposed, but are not guaranteed to be in calf. Serviced females are believed to be in calf but are not so guaranteed. Open females have not been served and are so guaranteed. IDENTIFICATION: Seller offers each animal with a readable tattoo corresponding to its catalog designation and registration when applicable. OPTIONS AND PRIVILEGES OF RETURN OR ADJUSTMENT 1. All claims for adjustment or refund must be made in writing either within six months of the sale date or no later than six months after the animal reaches 18 months of age, with the exception of claims involving defects or parentage. 2. In the event an animal is claimed to be a non-breeder, the animal may be returned to the farm of the Seller, if in good condition and in compliance with the health requirements of the Seller’s state. The Seller shall be entitled to six months trial following the return of the animal in which to prove that the animal is a breeder. If at the end of six months the Seller is unable to prove the animal is a breeder, the Seller shall, at the option of the Buyer, replace the animal with another of equal value or grant the Buyer a credit for use on any products marketed by the Seller. Such credit of the full purchase price shall, in any case, be deemed full satisfaction and settlement. Any expense incurred for transporting an animal claimed to be a non-breeder shall be the responsibility of the Purchaser, except that the Seller shall be responsible for transportation costs in excess of the distance between the Purchaser’s farm and the location where the sale took place. If the Seller proves the animal to be a breeder, it shall be the obligation of the Purchaser to take delivery of the animal and pay all expenses incurred for transportation.

3. If a female sold as “safe in calf” proves not to be in calf, the Purchaser may receive service from the bull previously used, if available, or if the bull is not available, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the Seller. Any adjustment provided for herein shall absolve the Seller from further liability, except in case such female proves to be a non-breeder. If a female represented as “safe in calf” at time of sale to a certain bull proves to have been bred to a different bull, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the Seller (adjustments shall not be considered to be a breeding fee or an allocation of the purchase price to any unborn calf). Any expenses incurred for transportation shall be the responsibility of the Purchaser, except that the Seller shall be responsible for transportation costs in excess of the distance between the Purchaser’s farm and the location where the sale took place. 4. If a female sold as “served” proves not to be in calf, or if a female sold as “pasture-bred” proves not to be in calf, the Seller only guarantees such female to be a breeder. 5. If a female sold as “open” proves to be with calf, the Purchaser may return the animal to the farm of the Seller prior to calving for a credit of the full purchase price or for another animal of equal value, whichever is acceptable to the Purchaser. It shall be the obligation of the Seller to bear any expense incurred for transportation. GENETIC DEFECT AND PARENTAGE GUARANTEE 1. All animals are guaranteed not to produce a calf with the following defects: Dwarfism, Double-muscling, Parrot Mouth, Osteopetrosis (marble bone disease), and Syndactylism (mule foot), and Arthrogryposis Multiplex (curly calf). The parentage of all animals bred by the Seller is guaranteed to the extent that the animal is by the Sire and out of the Dam indicated on its registration paper. These guarantees are effective for a period of two years from date of sale only under the following conditions. a) The Buyer shall notify the Seller in writing immediately upon the birth of a calf suspected of being defective or immediately after determination is made that such calf is defective, or if parentage is suspected or found to be in error. b) The Seller, at his expense shall be permitted and provided, with reasonable opportunity, to obtain blood samples of an alleged defective calf and its sire and dam for the purpose of blood type/DNA analysis to establish parenthood. In the case of suspect parentage, the Buyer at his expense, shall be permitted and provided, with reasonable opportunity, to obtain blood samples of the animal in question and its sire and dam for the purpose of blood type/DNA analysis to establish parenthood. If sire or dam, as indicated on the animal’s registration paper, is proven to be in error by such analysis, the Seller shall reimburse Buyer for cost of such analysis. c) The animals will be returned by the Buyer to the Seller at the Buyer’s expense; provided the animal meets the health requirements for the Seller’s state. d) The replacement of an animal with another of equal value or the refund of the purchase price, in connection with a defect producing animal or an animal whose parentage is in error, shall be deemed full satisfaction and settlement. 2. In the event there is a dispute as to whether or not a calf is defective, or parentage is in error, “determination” referred to in Paragraph 1a above shall be made by a person or persons acceptable to both the Buyer and Seller. In the event that Buyer and Seller cannot agree on the selection of such person or persons, then each of them shall appoint a representative to make the determination. In the event that such representatives fail to agree, a third person selected by the representatives of the Buyer and Seller shall make the determination. RIGHTS AND OBLIGATIONS The above terms and conditions of sale shall constitute a contract between the Buyer and Seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. Neither the sale manager, nor any other person connected with the management of the sale, assumes any liability, legal or otherwise.
