One Year Guarantee! For the first time ever, Leachman Cattle of Colorado is offering a one year guarantee on all bulls that we sell. This guarantee will cover your purchased bull(s) against death, injury, infertility, and loss of use. If, during the first year from purchase, you lose the use of your Leachman bull for whatever reason, we will give you a full credit towards the purchase of a new bull. We only ask that your herd veterinarian provide a written statement describing the death, injury, or infertility. If the bull in question can be salvaged, we would like you to keep the salvage value, and a credit will be issued, less the salvage amount you receive for the bull. If the bull completes a full breeding season, then the credit will be given at 75% of the original purchase value (less any salvage value). All claims must be made within 1 year from the date of purchase. Example 1: Your $5,000 bull dies before you turn him out to breed. You receive a full credit of $5,000. (Purchase Price - $0 Salvage - $0 Use). Example 2: Your $5,000 bull injures his scrotum after you pull him from the cows. You sell him for $1000 in salvage. You receive a credit of $2,750 ($5000 purchase - $1000 salvage - $1250 usage). Requirements for claims: 1.
All claims must be made within 365 days of purchase.
2.
A veterinary statement regarding the circumstances is required.
3.
A Verbal agreement from Leachman Cattle of Colorado is required prior to a bull being sold for salvage. Documentation of the salvage value of the bull, including identification of the bull on the sale barn ticket, that corresponds to the bulls Leachman identifications (ear tag or metal clip) is also required.
This credit can be used for the purchase of bulls, females, semen, and/ or embryos from Leachman Cattle of Colorado. If the credit is not used within 24 months of the date of issuance, then it will expire.

How to read this catalog
1. Reg#: the registration number of the animal. NotReg
means the animal is not registered. Pending means that a registration number has been applied for, but was not issued at the time of catalog printing.
2. Brd: breed of the animal if two breeds or less are involved. If more than two breeds are in the animal, then the composition shows the percent British and the percent Continental, i.e. 58B 42C means 58% British and 42% Continental. 3. DOB: date of birth 4. Color: BLK = black, BWF = black white face, BBF = black brockle face, RED = red, RWF = red white face, WHT = white. 5. Mating type: E = embryo transplant, A = via artificial insemination, N = natural service 6. Sex: B = Bull, H = Female 7. P = polled. S = scurred. H = horned. 8. Cooperator herd where the bull was raised. 9. Pen where the bull is located.
10. Genetic Defect codes - a C appended to the end denotes carrier and an F denotes tested free and P denotes possible but untested. NH - Neuropathic Hydrocephalus AM - Arthrogryposis Multiplex CA - Contractural Arachnodactyly OS - Osteopetrosis DD -Developmental Duplication
20. Yearling EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale.
Phenotype Scores to Make Bull Buying Easier:
22. IMF is the ultrasound based EPD/ABC for marbling expressed on a breed scale. The Stabilizers are expressed on an Angus scale.
11. C. Ease: Calving Ease is the predicted calving ease if you use the bull on heifers. If there is a number in the brown box, this indicates the breed calculated calving ease direct EPD. In addition, we provide our Leachman estimated calving star system.
***** The easiest calving bulls in the industry. **** Use on smaller heifers with minimal assistance needed *** Use on larger heifers with some assistance expected.
12. Growth: This is a score from one star to five stars, where five stars means maximum growth. Even the one star bulls are as growthy as any bull in America 20 years ago. 13 . Maternal: This is an estimate of maternal efficiency, NOT milk. It includes cow size, milk, fertility, and growth. The bulls are scored from one star to five stars. Five star bulls will produce some of the most profitable cows in the industry if you sell calves at weaning. 14. Feedlot: This looks at all of the post weaning traits including gain, conversion, carcass weight, and carcass merit. Scored from one star to five stars, where five stars would produce maximum overall value in your feeder calves. 15. Phenotype: A combination of eye appeal and overall kind. Scored from one star to five stars. Five star bulls are the best phenotypic bulls in the sale (in our opinion)! Two star bulls are less attractive visually than average. 16. Disposition: Our traditional score of 1 – 5 on disposition. Score 5 bulls are bulls you can walk up to and touch. Score 3 is about average historically for Leachman bulls. However, we are making a concerted effort to improve disposition, so most bulls score 3 or higher. The bulls scored 2.5 or 2 are nervous and do not like to be in close quarters with people on foot – but they are great for big range operations. 17. Actual birth weight. This is not adjusted for age of the dam. EPDs/ABCs Breed Association EPDs (Expected Progeny Differences) are listed for all registered animals. Leachman ABCs (Across Breed Comparisons) are listed for all un-registered animals. All ABCs are on an Angus base and can be compared across breeds within this catalog. EPDs are appropriate association EPDs without any adjustments. 18. Birth weight EPD/ABC expressed on an Angus scale (or breed scale for Red Angus, Hereford, and Charolais). 19. Weaning weight EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. (970) 568-3983
21. Milk EPD/ABC expressed on a breed scale. The Stabilizers are expressed on an Angus scale. This is the best predictor of a bull’s daughter’s ability to milk. It measures the difference in weaning weight that will be produced between one bull’s daughters and another bull’s daughters due solely to milk.
23. REA is the ultrasound based EPD/ABC for ribeye area expressed on a breed scale. The Stabilizers are expressed on an Angus scale. 24. MWT is the predicted mature weight of daughters that you will get if you use the bull on a 1250 pound cow. If your cows weigh 1350, add 100 to this predicted weight. If your cows weigh only 1150, subtract 100 from this predicted weight. This EPD is the best indicator of daughter size -- far better than frame score or yearling height. 25. F:G is the pedigree estimated feed to gain EPD that predicts the feedlot efficiency of the bulls offspring. A negative number means that the bull’s progeny will feed more efficiently. Example: -0.50 means that the bulls progeny will require ½ pound less feed per pound of gain. 26. Intake: is an estimate of the amount of feed that the bull’s progeny will consume over a 112 day feeding period. It is expressed in pounds. Animals with higher intake will consume more throughout their life. Animals with lower intake will consume less. 27. FS is an EPD, expressed as frame score, predicting the yearling frame score of a sire’s progeny, compared to that of other sires. 28. SC is an EPD, expressed in centimeters, predicting the yearling scrotal circumference of a sire’s progeny, compared to that of other sires. 29. $Ranch EPD: This Leachman profit index that predicts weaning profitability based on calving ease, weaning weight, maternal milk, cow cost, and FERTILITY. Based on producing 100 calves. This EPD assumes a slide on calf prices of $10 / cwt. See page 12. 30. $Feeder: This number is expressed in terms of the bull’s added value to the sale price of your feeder calves. It is expressed in dollars per head. Thus when comparing a +100 bull vs. a +50 bull, we expect the first bull to sire calves worth $50 per head more at weaning (regardless of their weight). 31. $Profit™ EPD: One, simple, proven number that gives each trait a weight according to its impact on profit. See page 12 for additional information. 32. FT: Indicates the bull was individually measured for feed intake. Bulls without this notation, were not individually measured. Unmeasured bulls have EPD’s based on their parental average. Page 1
$PROFIT
TM
Are all small cows really efficient? There seems to be a big disconnect in today’s beef industry. On sale day we want heavy, high quality steers to pay the bills. The rest of the time we want efficient cows to keep our costs as low as possible. Simply selecting for smaller cows with no regard for feed efficiency is not the answer. Likewise, selecting for shear growth with disregard for cost is just as poor of a strategy. The best way to make your cowherd truly efficient, and your calf crop earn more, is to use Leachman $Profit™. This is the only index in the industry that works on both sides of the ledger (production AND cost). Cows that work! Steers that pay! How $Profit works:
What traits are included in $Profit:
Our simulation model then factors in all of the effects on both income and expense to come up with a net profit figure for each bull. $Profit allows you to compare any two bulls and calculate the difference in profit that they are expected to generate in your herd. Let’s compare a $10,000 $Profit bull to $6,000 $Profit bull (the average 2008 born Angus bull). The predicted difference between the bulls is $4,000 or about $40 per calf. $Profit works for us and it will work for you too.
Some traits are not so easily characterized for $Profit. Milk, for example, is a good thing until you get too much. When over +25, milk EPD has a more negative effect on fertility than it has a positive effect on weaning weight. There are a few traits not yet included in $Profit: longevity, structure, and disposition. These traits are important but difficult to express in dollars.
$Profit assumes that the average commercial bull will have 100 progeny over its lifetime. The model assumes that you keep 30% of your heifers as replacements and that you retain ownership on the remainder of the calves through finishing and sell on a grid. We realize that many don’t retain ownership, but doesn’t it make the most sense to select from birth all the way to slaughter? Feedlots have already proven their willingness to pay premiums for superior Leachman sired calves.
$Profit includes nearly every trait that impacts profitability. The effect of most traits on profit is fairly simple to understand. Here is the list of what is included and its effect: Revenue Traits ▪▪ Calving ease = more calves ▪▪ Weaning and yearling EPD = more weight ▪▪ Fertility (days to conception) = more weight and more calves ▪▪ Carcass weight = worth more up to 1050 lbs. ▪▪ Marbling = valued based on grid premiums ▪▪ Ribeye area = value as impacts yield grade ▪▪ % Retail Product = more yield is more meat Cost Traits ▪▪ Cow mature size = in general bigger eats more ▪▪ Cow intake = more intake costs more ▪▪ Feedlot feed efficiency = cost of gain
Star System Explained:
Accuracy: The sire’s level of accuracy is determined by the number of progeny that have been evaluated in the Leachman System. Several progeny recorded, use with confidence (over 90% accurate). Pedigree and individual data only (about 30% accurate). Calving Ease: The predicted calving ease if you use the bull on heifers. The easiest calving bulls in the industry. Use on smaller heifers with minimal assistance needed. Use on larger heifers with some assistance expected. (If no stars are shown, the animal is recommended for use on cows only.)

Growth: A formula combines WW and YW to predict how much performance the sire will pass on to their progeny. Most growth. Maternal: An estimate of the maternal efficiency of the daughters this sire will produce. It includes cow size, milk, fertility and growth. Keep these heifers! They will make the most profitable females in the business. Feed/Carc: A formula that combines: gain, conversion, carcass weight and carcass merit to predict post weaning performance. Maximum overall value in your feeder calves. Disposition: An observation of the sires disposition. You can walk up to and touch. Average - respects flight zones and handles well, but is not a pet. Across Breed Comparisons
Dare to compare: You cannot afford to make mistakes in your breeding program! Choosing to use sires with incomplete or low value data can unknowingly make your herd less profitable – same work, same cost, poor results - unacceptable. Leachman ABC’s are the most reliable and comprehensive EPD’s in the industry. They are backed by a large (nearly a million), long-standing (over 30 years), multi-breed (over 15 breeds) database. Using this system assures you of making sound breeding decisions with minimal risk of failure.

What is the best strategy to stay profitable? Use Leachman High $Profit Stabilizer Bulls! Composite Advantages: • • • • •
You get the advantages of crossbreeding, with the simplicity of straight breeding. Hybrid vigor increases pounds weaned per cow exposed by 23%. Composite bulls are the easiest way to keep a high percentage of F1 hybrid vigor. Composite cows live longer and have higher pregnancy rates. You produce one kind of calves for ease of management and marketing.
Stabilizer Advantages:
• Built using all-star sires from the Angus, Red Angus, Gelbvieh, Simmental, and South Devon breeds. • Flesh as easily as an F1 Hereford x Angus (from MARC data). • Keep over 65% of F1 hybrid vigor, because of their multiple breed mix. • Produce uniform, Angus type calves that are highly marketable. • Marble better than average Angus and far above Continental crosses. • Yield more and reach heavier carcass weights than do straight British cattle. • Produce moderate sized, low feed intake, high productivity females.
Lee Leachman answers FAQ’s about $Profit WHAT IS $PROFIT? $Profit tells you which bulls’ calves make you the most profit, from birth to slaughter if you retain ownership and keep replacements. It includes the cow traits, fertility, growth, carcass, and feed intake. Isn’t that really what you want to know? It’s for sure what you need to know. If you sell your calves at weaning, instead of retaining ownership, you can use our $Ranch.
WHAT DOES THE SINGLE NUMBER, $PROFIT, DO FOR ME? $Profit helps you compare what different bulls are worth so you can find the best bull to improve your herd. None of us are smart enough to look at 20+ EPDs and figure out which bull will help us the most. $Profit and $Ranch do that for you. Why would anyone buy something for a business unless you know how much money it will generate in profit for the company? You don’t want to guess. You spend a lot on bulls. You want to buy a bull that will reduce your costs and increase your revenues. The $Profit single number estimates what a bull’s 100 calves (4 years @ 25 calves per year) will generate in net profit compared to an industry average bull. $Ranch does the same thing from birth to weaning. Literally, we run partial budgets and look at how all of the genetic effects impact your bottom line.
New generation breeders using $Profit Share: Ryan Ludvigson, Donnell Brown, Seth Leachman, and Park Ludvigson.
Here is how you can use it. Say the cost of the average industry bull this year is $4,500. That industry average bull has a $Profit of around $7,500. If you buy a $12,500 $Profit bull for the same price, then you are ahead $5000!
HOW DOES $PROFIT DIFFER FROM OTHER MAJOR INDEXES? First, like most indexes, $Profit takes into consideration output and revenue, but we also include the cost side of the equation. Other indexes ignore the cost and just help you find the cattle with the highest output and revenue. Unfortunately, growth and output always have a cost. I don’t know of a single index that directly includes cow feed intake in the equation like we do. Years ago, farmers learned that you couldn’t just chase more and more output, but that you had to control the inputs and costs. The important goal is more net income or profit, not maximized revenue. Our index helps us and helps our customers raise cattle that cost less… and produce more profit. Second, $Profit recognizes that many traits have ideal levels – more and more or less and less is not what you want. Seedstock breeders like to chase big numbers because it helps them sell cattle. However, our program knows you make more profit when you are at optimum levels for traits like birth weight, milk, and cow size. As an example, more milk is good up to a point. However, too much milk hurts your fertility. Almost all traits are like that. Other industry indexes are linear, and do not find the optimums. Instead they often encourage breeders to chase maximums. Third, our $Profit takes into account hybrid vigor because our customers want and need to crossbreed. Fertility and longevity are huge drivers of cow herd profitability. Many herds are struggling with fertility because they have become too straight bred. A crossbred cow breeds up sooner, is open less often, and lives longer. Crossbreeding can increase pounds weaned per cow exposed by 23% and that drives profit. Our index includes the economics of heterosis.
HOW GOOD IS THE DATA BEHIND $PROFIT? We have the largest breeder owned data base in the industry with over 750,000 records. Plus, our data is all from top notch, “professional breeders.” We almost always receive complete, whole herd reporting data. Other systems contain data that is partially reported or substantially unreported. Plus, many herds do a very poor job at establishing contemporary groups. If we see problems, we work hard to correct or remove them from the database. Poor and partial reporting makes for biased data and inaccurate EPD’s. Our own cooperators reported over 9,000 calves in the last year. These calves all come from structured, mostly AI, matings with reference sires and breeds so that all animals, breeds, and producers can be compared. It is like a huge, structured progeny test. This data is heavily AI driven. It also contains thousands of breed comparisons as we use purebred, hybrid, and composite bulls from each of our breeds. Clay Center compares 200 animals of each breed against one another in a single environment with limited use of proven AI sires to derive their breed differences. We compare thousands of animals of each breed and we have heavy use of proven sires in hundreds of different environments. We believe that we have the most accurate across breed comparisons available in the industry. Finally, we do more feedlot and harvest verification than any other seed stock program. We have a number of commercial test herds that breed AI so that we can feed and harvest the progeny. We feed large sire groups to confirm that our feed efficiency EPD’s accurately predict the performance in the feedlot and on the rail. We also collect carcass data to make sure that our ultrasound based predictions are accurate. In all, we harvest several thousand sire identified carcasses per year. We also collect conversion, gain, and carcass weight on over eight thousand Leachman sired calves from customer herds each year. Page 6
HOW GOOD IS THE $PROFIT SYSTEM? If there was a better index than $Profit, we would use it! Each year, we have new seed stock herds that sign up to use $Profit. When we run their herd, they are shocked – shocked by how well we find the best cattle and shocked by the number of bulls they are using that will not improve their herds. Inevitably, $Profit helps them make more rapid genetic improvement and that is why they join our system. I tell people that all indexes run the risk of quickly taking you to the scene of the accident. That is to say, a bad index quickly creates unexpected and unwanted consequences. Pig producers made pigs too lean. Dairy producers made dairy cows too infertile. As further examples, selection for Angus’ $Beef has produced some very large, inefficient cows in the Angus breed. Selection for Simmental’s API likes some cattle that are not competitive on growth and ribeye area. Ultimately, associations are reluctant to tweak and improve their indexes because breeders have vested interests to keep promoting their high-ranking genetics. We don’t care about any of that – we just want to get the right answer as quickly as possible. Most indexes are designed by scientists who have very little practical experience raising and breeding cattle. Further, the designers of the indexes have no real-world feedback system to see what is happening with the cattle. Our system is driven by master breeders. I eat, sleep, and drink $Profit making sure that it is working properly. Plus, we have dozens of cooperators and master breeders watching the results to make sure that $Profit is taking us in the right direction. We use $Profit for all our breeding decisions. We cannot afford to use a breed or sire that has low $Profit. In our continuous quest for outlier bulls and cows to bring in from the industry, we convert their data into $Profit before we decide to buy or use a bull or female. We use $Profit to select our replacement females and to help make cow culling decisions. You can use $Profit to share in our genetic progress!
$PROFIT SEEMS TO BE GOING UP AND UP. IS THAT REAL AND WILL IT CONTINUE? We are making more rapid genetic progress than nearly any other program in the industry. We know this because we actively compare ourselves. Each year, our cooperators keep the highest heifers as replacements and AI to the highest bulls. So long as we can continue to find higher and higher sires, this trend will continue. There is no doubt that the genetic change is real. Our cows are getting smaller. Our weaning weights are going up. Our feedlot conversion is improving. Our cattle max out the carcass weight range. Plus, they have increasingly high percentages of upper 2/3 choice and prime. Our future depends on $Profit. It is adding profit to our herd and to our customers’ herds. You don’t have to guess whether or not we believe in $Profit – just watch the bulls we use and you will know where we are placing our bets! (970) 568-3983

Leachman Stabilizers – 30 years in the making! • Built on Science: First designed in the 1970’s by USDA ARS scientists at the Meat Animal Research Center as the Marc II composite: ¼ Red Angus, ¼ Hereford, ¼ Simmental, ¼ Gelbvieh. • Privatized: A private herd was developed by Pat Vinton, Gordon, NE and later sold to the Tessari family in Babb, MT – thus becoming the foundation for the Leachman Stabilizer herd. • Modernized: From 1988 – 2003, Leachman modernized the Stabilizer composite: ▪ Reduced the birth weight. ▪ Made the cattle solid colored and polled.
▪ Increased the post weaning gain. ▪ Improved convenience traits including disposition and udder quality. ▪ Introduced black lines in addition to the original red lines. ▪ Injected top hybrid and purebred sires form the Angus, Simmental, and Gelbvieh breeds. • Moved to Colorado: In 2003, Leachman Cattle of Colorado was formed with a nucleus of cooperators that included the Tessari herd and several other Stabilizer cooperators. • Selected with $Profit: LCoC began selecting the Stabilizer using $Profit with significant results: ▪ Dramatic further reduction in birth weight while increasing yearling growth. ▪ Significant improvement on marbling to now exceed average marbling Angus cattle. ▪ Substantial selection for reduced feed intake and improved feed efficiency. ▪ All of which coincided with a huge annual progress on $Profit. • Expanded Internationally: In 2016, Leachman offered genetic analysis services to Stabilizer breeders in the UK, New Zealand, and Australia. This expansion increased the total Stabilizer herd being selected for $Profit to over 20,000 breeding females. Genetics are now flowing to and from each of these herds – increasing the rate of global selection improvement.
Excerpts from a 2001 letter written by Dr. Keith Gregory, Research Geneticist at U.S. Meat Animal Research Center (MARC) to Jim Leachman: “Your contributions to beef cattle breeding are unmatched in the history of beef cattle breeding. No one has had a greater impact on beef cattle breeding on a global basis. I have stated on several occasions that no one is implementing more of the available beef cattle breeding technology than Leachman Cattle Company.” Page 10

ALL ANIMALS OFFERED ARE SUBJECT TO PRIOR SALE AND PRICE CHANGES. EXCEPT FOR THOSE STATED IN THE BELOW TERMS AND CONDITIONS, THERE ARE NO WARRANTIES, EITHER EXPRESSED OR IMPLIED, AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE CATTLE BEING SOLD IN THIS OFFERING. THE WARRANTIES AND GUARANTEES SET FORTH IN THESE “TERMS AND CONDITIONS” ARE IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, AND THE REMEDIES PROVIDED THEREIN SHALL BE THE SOLE AND EXCLUSIVE REMEDY OF THE BUYER, OR ANY PARTY CLAIMING THROUGH BUYER, FOR ANY BREACH OF WARRANTY OR GUARANTEE THEREIN PROVIDED, AND ALL OTHER OBLIGATIONS OR LIABILITIES.
SALE TERMS AND CONDITIONS
TERMS: Terms of sale are cash unless satisfactory credit arrangements have been made with the Seller prior to the sale. PURCHASER’S RISK: Each animal becomes the risk of the Purchaser as soon as sold. It shall be the obligation of the Seller to see that animals are fed and cared for, free of charge to Purchaser, until loaded for shipment. CERTIFICATE OF REGISTRY: A transferred certificate of registry will be furnished to the Buyer for each animal unless said animal is unregistered as denoted in the catalog. HEALTH: All animals are eligible for interstate shipment; except as otherwise announced. Interstate health papers will be furnished for each animal requiring T.B., Bang’s, and other health testing in accordance with State and Federal Regulations. ARTIFICIAL INSEMINATION SERVICE CERTIFICATES A.I. Service Certificates shall be furnished by the Seller, at no cost to the Buyer, for all females sold in the sale that are bred artificially to bulls not owned by the Seller. ANNOUNCEMENTS: Changes of information, of any kind, in this catalog will be announced from the auction block. Such announcements shall take precedence. BREEDING GUARANTEE 1. All animals are guaranteed breeders, with the exception of: a) calves under twelve months of age; b) animals shown by Purchaser after sale (in cases of animals shown after purchase, the breeding guarantee, if any, shall be such as agreed upon between Seller and Buyer; or c) gross negligence or willful misconduct on the part of the Purchaser. 2. Bulls are guaranteed breeders if not allowed to run with the herd until at least 14 months of age. Any bull which either: 1) settles 1/3 or more of the healthy cows he serves; 2) is the sire of 20 or more animals; or 3) settles cows by natural service and passes a fertility test made by a competent veterinarian during any 6 month period of trial (provided for in paragraph 2 of the section of these sale terms and conditions entitled “Options and Privileges of Return or Adjustment”) shall be considered a breeder. Any guarantees with respect to the ability to freeze semen shall be by separate agreement between Buyer and Seller. “Safe in Calf” Females have been examined by a competent veterinarian and are so guaranteed. Pasture-bred Females have been exposed, but are not guaranteed to be in calf. Serviced females are believed to be in calf but are not so guaranteed. Open females have not been served and are so guaranteed. IDENTIFICATION: Seller offers each animal with a readable tattoo corresponding to its catalog designation and registration when applicable. OPTIONS AND PRIVILEGES OF RETURN OR ADJUSTMENT 1. All claims for adjustment or refund must be made in writing either within six months of the sale date or no later than six months after the animal reaches 18 months of age, with the exception of claims involving defects or parentage. 2. In the event an animal is claimed to be a non-breeder, the animal may be returned to the farm of the Seller, if in good condition and in compliance with the health requirements of the Seller’s state. The Seller shall be entitled to six months trial following the return of the animal in which to prove that the animal is a breeder. If at the end of six months the Seller is unable to prove the animal is a breeder, the Seller shall, at the option of the Buyer, replace the animal with another of equal value or grant the Buyer a credit for use on any products marketed by the Seller. Such credit of the full purchase price shall, in any case, be deemed full satisfaction and settlement. Any expense incurred for transporting an animal claimed to be a non-breeder shall be the responsibility of the Purchaser, except that the Seller shall be responsible for transportation costs in excess of the distance between the Purchaser’s farm and the location where the sale took place. If the Seller proves the animal to be a breeder, it shall be the obligation of the Purchaser to take delivery of the animal and pay all expenses incurred for transportation. 3. If a female sold as “safe in calf” proves not to be in calf, the Purchaser may receive service from the bull previously used, if available, or if the bull is not available, the Seller shall be obligated to make a satisfactory adjustment on the
purchase price upon return of the animal to the farm of the Seller. Any adjustment provided for herein shall absolve the Seller from further liability, except in case such female proves to be a non-breeder. If a female represented as “safe in calf” at time of sale to a certain bull proves to have been bred to a different bull, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the Seller (adjustments shall not be considered to be a breeding fee or an allocation of the purchase price to any unborn calf). Any expenses incurred for transportation shall be the responsibility of the Purchaser, except that the Seller shall be responsible for transportation costs in excess of the distance between the Purchaser’s farm and the location where the sale took place. 4. If a female sold as “served” proves not to be in calf, or if a female sold as “pasture-bred” proves not to be in calf, the Seller only guarantees such female to be a breeder. 5. If a female sold as “open” proves to be with calf, the Purchaser may return the animal to the farm of the Seller prior to calving for a credit of the full purchase price or for another animal of equal value, whichever is acceptable to the Purchaser. It shall be the obligation of the Seller to bear any expense incurred for transportation. GENETIC DEFECT AND PARENTAGE GUARANTEE 1. All animals are guaranteed not to produce a calf with the following defects: Dwarfism, Double-muscling, Parrot Mouth, Osteopetrosis (marble bone disease), and Syndactylism (mule foot), and Arthrogryposis Multiplex (curly calf). The parentage of all animals bred by the Seller is guaranteed to the extent that the animal is by the Sire and out of the Dam indicated on its registration paper. These guarantees are effective for a period of two years from date of sale only under the following conditions. a) The Buyer shall notify the Seller in writing immediately upon the birth of a calf suspected of being defective or immediately after determination is made that such calf is defective, or if parentage is suspected or found to be in error. b) The Seller, at his expense shall be permitted and provided, with reasonable opportunity, to obtain blood samples of an alleged defective calf and its sire and dam for the purpose of blood type/DNA analysis to establish parenthood. In the case of suspect parentage, the Buyer at his expense, shall be permitted and provided, with reasonable opportunity, to obtain blood samples of the animal in question and its sire and dam for the purpose of blood type/DNA analysis to establish parenthood. If sire or dam, as indicated on the animal’s registration paper, is proven to be in error by such analysis, the Seller shall reimburse Buyer for cost of such analysis. c) The animals will be returned by the Buyer to the Seller at the Buyer’s expense; provided the animal meets the health requirements for the Seller’s state. d) The replacement of an animal with another of equal value or the refund of the purchase price, in connection with a defect producing animal or an animal whose parentage is in error, shall be deemed full satisfaction and settlement. 2. In the event there is a dispute as to whether or not a calf is defective, or parentage is in error, “determination” referred to in Paragraph 1a above shall be made by a person or persons acceptable to both the Buyer and Seller. In the event that Buyer and Seller cannot agree on the selection of such person or persons, then each of them shall appoint a representative to make the determination. In the event that such representatives fail to agree, a third person selected by the representatives of the Buyer and Seller shall make the determination. RIGHTS AND OBLIGATIONS The above terms and conditions of sale shall constitute a contract between the Buyer and Seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. Neither the sale manager, nor any other person connected with the management of the sale, assumes any liability, legal or otherwise.
