Who is responsible for repairs during a home sale? Many questions arise during the home-buying process. Buyers looking at homes that require a good deal of TLC may wonder who is responsible for the home’s repairs, particularly if such repairs are needed to secure a certificate of occupancy. Depending on the situation, there is no clear-cut answer. There is no perfect home, and things that are acceptable to the current owner may not be acceptable to the buyer who is looking to become the next owner. The home-buying process is typically a careful cooperation between buyer and seller to find a middle ground. The buyer may have to make some concessions, as will the seller. Ultimately, it is this cooperation that often determines if the sale goes through or is terminated. Before any negotiations can begin regarding repairs, it is adviseable for a buyer to have an independent inspector come out and look over the home and property. Most real estate agents will suggest this be done as a first priority — even before a contract is entered on the home. An inspection will unveil any potential problems in a home and indicate things that the buyer may not be aware of, including items that do not meet with code or could be unsafe. An inspector also may point out problems that could cause a mortgage lender to give pause. This may mean the lender will deem problems unsafe and refuse to fund the mortgage until repairs are made.

Home buyers may be able to negotiate that sellers repair major structural issues, such as a leaky roof. If not, negotiate a lower sale price. A copy of this inspection report should be sent to the home seller to review with his or her attorney and real estate agent. The buyer working with his own real estate attorney and agent can petition for certain repairs to be made. Many sellers will make such repairs to ensure the purchase goes through, or they will accept a lower purchase price to compensate for the needed repairs, which the buyer will then make. Buyers might want to hire a good real estate attorney to write clauses into the contract to protect their interests. This allows the buyer to forfeit the sale and walk away from the contract should an issue arise.
Buyers should know that, for a home that is not in foreclosure, there are some repairs that should ultimately be the responsibility of the seller. If these repairs are not made, a buyer should think strongly about walking away from the deal, according to Why6Percent.com, a real estate marketing site. The rules often change when buying a home that is a short sale or in foreclosure. A home that is in distress is typically in this situation because the current owners cannot afford to pay their mortgage, and thusly, are not able to afford repairs. According to Think Glink, a money-management Web site, buyers may try to negotiate repairs with the seller, but they shouldn’t assume that sellers (or lenders in the event of a bank-owned home) are responsible for the repairs. Generally speaking, most short sales and foreclosures are sold “as is” and may even specify that repairs and requirements for the certificate of occupancy are the buyer’s responsibility. A buyer also can ask to have the home price reduced to cover the repairs. But foreclosures are often already deeply discounted.

Closing costs and points explained One of the great mysteries of home buying, at least to those who have never been through the process, is closing costs. While nearly everyone has heard of them, few who haven’t had to pay them really understand them. Even some people who have paid them aren’t sure what they spent all that money on. Closing costs are the various fees that a homebuyer must pay before the mortgage lender will finalize the mortgage. Generally speaking, these costs are about 3 to 6 percent of the amount borrowed. That is in addition to your down payment. Following are some of the components of your total closing costs. The
lender will charge an application fee to cover the costs of completing your mortgage application. This may or may not include the fee for your credit report. They will also charge a loan origination fee, also known as points. This covers the administrative costs of processing your mortgage. One point is equal to 1 percent of the total amount loaned. Many lenders offer the option to purchase without points, but keep in mind that this will result in a higher interest rate. There are also lenders who will let you pay additional points to lower the interest on your loan. Title insurance will be required by your lender. This protects you and the mortgage company in case the seller does not have the legal right to sell it. There could be unknown co-owners of the property, or it could have an unpaid lien against it that would prevent the seller from legally selling it.
Taxes associated with the transfer are usually the buyer’s responsibility, unless other arrangements are agreed upon. You may also have to pay for a survey of the property. You will likely be required to pay the interest accrued between the time your mortgage was originated and the due date of your first payment. Attorney and notary fees may also be a part of your closing costs. Closing costs are comprised of all of the expenses that must be paid before the purchase of your new home is finalized. Points are a fee charged by your lender that may be somewhat flexible and directly affect your interest rate. An appraisal is also required by lenders. This is to ensure that the home is worth the amount loaned to you to purchase it. A home inspection is not usually required, but it’s a good idea to have one. The cost of the inspection could also be considered part of closing costs. Homeowners insurance is a standard requirement of mortgage lenders. They will require proof of it and may require you to pay the first year’s premium before closing. Private mortgage insurance may also be required depending on the amount of your down payment, and part of the fee will be included in your closing costs.

Time your move right to save money Buying a new home is the most expensive purchase a person is likely to make in his or her lifetime. It also can be one of the more stressful. The Employee Relocation Council states that moving is the third most stressful event in life, following death and divorce. But a well-timed move can reduce stress and save money. Moving during certain times of the year can result in considerable savings. Moving during the summer, when children are out of school and the weather is nice, can make a move more manageable. Keep in mind that because late spring and summer are the peak moving seasons, they also tend to be more expensive. Many moving companies and truck rental agencies will charge a premium if you use their services during the summer. Furthermore, crews may change in the summer when students on vacation could fill in for regular, more experienced movers. High prices are not only reserved for those who buy a new house during the spring and summer. Renters may find spring and summer is also the peak season for rentals. Many apartment managers can attest that the dates between June 2 and August 30 are quite busy in terms of apartment turnover. College students are more likely to move as soon as the academic year ends, and many landlords plan leases to expire in the summer months to ensure that re-renting places will be easier thanks to a flooded apartment market. According to Apartment Wiz, a Houstonbased apartment locating service, although there might be greater apartment availability during the warm-weather months, it also means greater competition between prospective tenants. The important thing is only to spend as much as you can comfortably afford. What do you need to know about home loans? Most people bxorrow money to buy a home. If you take out a home loan, then you will have a monthly mortgage payment. This payment has several components. These parts of a mortgage payment are called PITI — principal, interest, tax and insurance.

Can from previous page your future housing expenses. For example, what is your utility bill now and will it increase if you buy a new home? Consider changes in the cost of your insurance, taxes, commute, tools, and fees such as condo fees. You may want a “reserve fund” to cover initial new home expenses such as decorating, window coverings, furniture, lawn care equipment, and unanticipated repairs. Try not to do any major remodeling during the first year. If you stretch yourself too far and you can’t pay your monthly mortgage payments, you may lose your home. Don’t forget to keep in mind your non-housing expenses. Nonhousing expenses include food, clothing, entertainment, education, car expenses, medical expenses, childcare, savings, etc. These expenses are important to consider as you look at the mortgage payment figures. Can you comfortably afford the monthly mortgage payment if one of your other expenses (such as medical or childcare) increases? How much money can you borrow? The lender sets a limit on how much you can borrow. Lenders want to know how much of your gross income (your total income before taxes or any deductions) will go towards your mortgage payment. You must qualify to get a mortgage loan. You may want to pre-qualify for a loan so that you can shop for homes in your price range. To qualify you for a loan, a lender will look at two major factors: your earnings and your existing debt. To decide if you make enough money for a mortgage payment, most lenders use the housing-expense ratio. Typically lenders will allow you to spend up to 28 percent of your gross income for a mortgage payment. For example, a family earning $50,000 gross annual income earns $4,167 per month gross income ($50,000 divided by 12 = $4,167). This family would qualify for a loan with a $1,167
monthly mortgage payment ($4,167 multiplied by .28). However, keep in mind this ratio uses gross income not take-home income. You must decide if you can comfortably afford this high of a monthly payment plus your other expenses. Lenders also use the debt-to-income ratio. This method calculates how much of your gross monthly income is used to pay debt. Payments for the mortgage, car loans, credit card debt, student loan payments and other debt are all considered. Lenders often use a 36 percent debt-to-income ratio. However, taking on such a large payment obligation isn’t wise unless you feel confident you can live on what remains of your income. Lenders consider other factors too. A poor credit history, unstable income source, or inadequate cash reserves can disqualify you as a borrower. The lender also must approve the house you want to purchase. Usually this approval requires an appraisal of the property. What are your options? Don’t be discouraged if at first it seems you can’t qualify for the loan you would like. There are many programs to help first-time buyers. These programs usually offer loans at low interest rates or with a low down payment. Be sure to check on the availability of these first-time buyer loans and also FHA (Federal Housing Administration) and VA (Veterans Administration) loans. You may want to reevaluate the home price you thought you wanted. Perhaps you could qualify for a less expensive home. It may be that it’s important to pay down your current debt or save some cash before you buy a home. Set yourself a goal to save or reduce debt by a certain date. When you’ve met your goal, apply for a loan again. By carefully considering all the costs of home ownership, you can choose a home that you can comfortably afford.

How to get approved for a mortgage Real estate professionals say the market is rebounding, and many would-be home buyers are eagerly awaiting their opportunities to purchase their own homes. Fresh data indicates that the inventory of properties is quickly drying up and soon the market is poised to point in the sellers’ favor. According to Allen & Associates, a real estate appraisal, consultant and research firm based in Colorado, properties in the area listed for sale are below the six-month supply of inventory. Now could be the time to get a good deal on a home, provided buyers are able to secure mortgages. No matter how many affordable homes are available, if a buyer cannot get approved for a mortgage, then his or her chances of owning a home are slim. In the wake of a tumultuous economy, many lenders tightened restrictions on mortgage lending. And even though the economy has rebounded, many lenders have continued to follow strict guidelines before lending money. In order to secure a mortgage with a good interest rate, buyers must take control of their financial situations and fix problems that could lead to loan rejection. Many things can impact a mortgage application. Here are the ways to overcome liabilities and improve your standing with prospective lenders. • Know your credit rating. Your credit rating is a score that lenders rely on when deciding whether or not to approve your mortgage application. The higher the credit rating, the more attractive you look to prospective lenders. But the lower your score is, the more difficulty you will have getting a loan. Should you get a loan with a low score, you may have to pay a higher
interest rate than someone with better credit. Prior to making any big financial decisions, such as applying for a mortgage, it is vital to find out your credit score. You can request a free copy of your credit report, which includes your credit score, once a year from the three major credit reporting agencies in the United States and Canada: TransUnion, Experian and Equifax. You also can pay for your credit report. • Address any issues on your report. Once you know your score, you can take steps to address any issues on the report. Pay down revolving consumer debts, such as credit card balances and auto loans. Report any errors on your credit report so they can be adjusted. Pay bills on time and address any notices of collections before they make it onto your permanent record. If you will be applying for a loan soon, avoid opening any other credit accounts for the time being.

• Maintain steady employment. Having a job is often vital to getting a mortgage. Lenders tend to look for long-term financial stability, which is best illustrated by maintaining steady employment. Jumping from job to job may be a red flag to lenders, so it’s better to make a switch after you have been approved for a loan. • Save, save, save. Having more money in the bank lowers your loan-to-value ratio, or LTV. This will make you appear less risky to lenders. Individuals who have saved for a considerable down payment on a home are also seen in a better light. • Make sure you have a credit history. Some people are too cautious with their credit and think closing accounts or avoiding credit entirely will make them more attractive to lenders. But
