LEMMON DROPS: What’s happening to local restaurant owners is patently unfair

Beach man filed against The Pelican Diner. Hepler, owner of the popular Sebastian restaurant, hired a $350-an-hour attorney to help guide him through the process. It’s not like he has an extra $5,000 or $6,000 around to spend on attorney fees. But that’s what he’s going to have to pay (and that’s probably on the low side) to defend himself in the lawsuit filed Oct. 11 by Santiago Abreu, who alleges violations of the Americans with Disabilities Act. Never mind The Pelican Diner counts several disabled customers as regulars. On a typical day, Hepler said, the restaurant has two or three wheelchair-bound customers and four or five customers with walkers. “I’ve never had one person complain,” he said.
Hepler has plenty of company, both inside the county and out of state. He was targeted in what’s called “drive-by” lawsuits. Abreu has filed more than 100 ADArelated lawsuits against restaurants in Arizona, Colorado and Florida. A few months ago, two individuals Russ Lemmon filed a rash of ADA-related lawsuits against a dozen Indian River County businesses. The Lemon Tree, Bobby’s and Mr. Manatee’s were among the restaurants targeted. One local restaurant owner, who didn’t want to be identified, says he paid $28,000 in attorney fees to defend himself in the “drive-by” lawsuit. His advice to Hepler? Settle, and settle now. “You get nowhere fighting it,” he said. “It’s nothing more than a scam by attorneys.” Ya think? These type of lawsuits give attorneys a bad name. To

expect every restaurant to be in total compliance of the ADA is unrealistic. “They can nitpick me to death,” Hepler said. Now that he knows about the violations, he can correct them. But he still has to pay an attorney $350 an hour to make Abreu’s lawsuit go away. It’s patently unfair what these serial plaintiffs did to restaurants in Indian River County. Given how much this county caters to handicapped people, it’s hard to imagine there are any egregious ADA violations. Unless I’m missing something, things are “good enough.” As regular readers know, Miller’s Neighborhood Market (the corner of U.S. 1 and 17th Street) was fighting for survival because the new Cumberland Farms, which opened June 30, has been selling gas for the lowest price in the county. Well, the fight is over. Miller’s closed its doors on Oct. 31. The closing of Miller’s Neighborhood Market wasn’t the only jolting news last week. Florida Veggies & More decided to

close its Farm Store and plans to shut down the entire operation at the end of the year. Florida Veggies, founded by Dan and Lisa Brenneman, opened in November 2012. The farm had monthly expenses of $4,000 to $5,000. He said the property will be put up for sale. Some downtown Vero Beach restaurant news: What was once (for a very short time) Swine & Co. is now Southern Social. According to one population forecast, we’re supposed to go from the current 143,000 to 202,000 in 2040. That’s still manageable, right? It’s been a month since Hurricane Matthew hit here, and the piles of debris at the old Dodgertown Golf Course continue to give me pause. Hate to see it end up in the landfill, but … Speaking of Hurricane Matthew, I loved Peggy Fisher’s perspective: “That last-minute jog when it was still a powerfully dangerous (Category) 4 was a miracle, Thanksgiving came early to all of us privileged to call our Treasure Coast home.”
