WHAT IS BUYER REPRESENTATION
The Buyer Agency Agreement, whether it?s a Buyer Representation Agreement or an Exclusive Right to Buy Agreement, is a crucial document in real estate transactions. It must be signed by both the buyer and the agent or broker representing the purchaser. Once signed, the buyer?s agent represents the buyer?s best interests offering advisory services throughout the purchase process. This includes promoting and protecting the buyer?s interests while maintaining strict confidentiality. If you're working with Lenihan Sotheby's International Realty, we will guide you through this process.
WHAT IS BROKERAGE COMPENSATION
The Agency Agreement, similar to a Listing Agreement, establishes a professional relationship between buyers and the brokerage. It outlines the compensation for the buyer?s agent and the brokerage. Importantly, the commission amount is negotiable, and brokerages may set minimum rates for compensation. When entering into this agreement, buyers can expect dedicated representation and expert guidance throughout their real estate transaction. Remember, having a knowledgeable agent by your side ensures a smoother process.
Our AdvisoryFees
Lenihan Sotheby's International Realty and we, as agents, are compensated on a commission basis. Your Buyer Agency agreement details the advisory fees, which may vary depending on the property you purchase.
SELLER PAID BROKERAGE COMMISSION
- The seller has offered to pay a commission to the buyer's broker. - The seller offers only a portion of the commission you have agreed to in the Buyer Agency agreement. This would require you to pay any portion of our commission not paid by the seller unless you condition your purchase offer on the seller paying all of your commission obligation and the seller accepts such offer.
BUYER PAID BROKERAGE COMMISSION
- The seller has not offered to pay a commission to the buyer's broker, or is offering less commission than the fee agreed upon in your Buyer Agency agreement ? you will be responsible for the fees not covered by the seller at closing.
