Battle of Lake Erie Congressional Presentation Sword with Commodore Oliver Hazard Perry Autograph Letter Signed

A Fine And Extremely Rare War of 1812 Presentation Sword, Commissioned By Congress And Posthumously Awarded To Midshipman John Clark, Killed In Action In The Battle Of Lake Erie, 10 September 1813 with Autograph Letter Signed from Commodore Oliver Hazard Perry. Previously unknown and consigned by direct descendants of Midshipman Clark. This sword, together with approximately 27 others, was commissioned from the legendary Philadelphia sword maker William Rose, Sr. (1783-1856) and possibly etched by master artist William Meer for presentation to junior warrant officers who took part at the Battle of Lake Erie under the command of Commodore Oliver Hazard Perry. The hilt and scabbard fittings are of cast, chased, and mercury-gilded brass, now black with tarnish and untouched, as-found. An unusual combination of classical and 8

naval motifs, the cast-in-the-round bust-form pommel wears a Roman-style helmet with the rectangular grip adorned with a mermaid holding an urn in high relief. The shell guard features an eagle in relief standing on a cannon barrel before crossed flags and anchors. The reverse of the shell guard is decorated with a laurel wreath flanked by large letters “U.S.” The knuckle guard (section missing) consists of pierced acanthus branches above and below a medallion with low relief bust portrait. The straight, double-edged blade is frost etched with four rectangular panels with stylized blossoms, trophies of arms, and the inscription: “JOHN CLARK MIDSHIPMAN / Lake Erie 10th September 1813.” The other side is etched with a framed naval engagement vignette and the inscription: “Altius ibunt qui ad / summa nituntur” (He who aims highest rises highest). The maker’s name “W. ROSE” is etched at

the forte. The blade retains considerable original polish with some staining and the frost etching and inscriptions are clearly visible. The black leather scabbard is in two pieces but otherwise complete with both chape and locket. The locket with a trident motif and the chape with an anchor entwined by a sea creature. A similar sword, presented to Midshipman Peleg K. Dunham is in the collection of the Metropolitan Museum of Art (2013.622a, b). Midshipman John Clark (1793-1813) served aboard the USS Scorpion, a sloop launched during the spring of 1813 for service in the upper Great Lakes, commanded by Sailing Master Stephen Champlin and operating in Commodore Oliver Hazard Perry’s squadron on Lake Erie. She saw action during the Battle of Lake Erie with the distinction of firing both the first and last shots. Midshipman Clark was one of only two men lost from the Scorpion during the battle. John Clark’s father, Sanford Clark, wrote to his son’s commanding officer, Commodore Perry regarding his son’s entitled prize money. Commodore Perry’s letter in response to Sanford Clark is included here: PERRY, Oliver Hazard (1785-1819). Autograph letter signed (“O.H. Perry”) to Sanford Clark. Newport, RI, 14 March 1814. 1 page, 4to, framed with postmarked envelope, toned, minor losses at edges, not examined out of frame. Perry addresses the practicalities regarding the money owed: “I have received your letter of the 6th last. In reply to your enquiries respecting your late son Midshipman John Clark’s share of prize money, wages etc. I beg leave to refer you to the purser, Samuel Hambleton Esq. now in Washington, who is the agent also for paying the prize money.” He continues, providing details of Clark’s burial and praise for his military conduct to the grieving father: “Your son was buried on Edward’s Island, his grave is with those of the other officers, who fell in the action of the 10th of Sept. Your son behaved as became a brave officer and fell at his post supporting his country’s

honor, I sympathize with you in his loss, he, no doubt had he lived would have been an honor to his friends and to his country.” Sanford Clark also wrote to President Madison on 9 June 1814, requesting information on payment. A note for reply indicates that John Clark’s share was $811.35. Sanford wrote again to the President on 1 January 1817, stating: “Permit me to remind your Excellancy [sic] that it is now well nigh three years since the above resolution passed the National Legislature and the same has not been carried into effect,” and he notes at the top of the letter the resolution of the “Senate & House of Representatives of the United States of America in Congress assembled, that the President of the United States be requested to present a Sword to the nearest male relation of Midshipman John Clark who was slain gallantly combating the enemy in the glorious battle gained on Lake-Erie under the command of Captain Perry.” (Both letters held by the National Archives, DNA: RG 45, Misc. Letters Received). Clark’s persistence was gratified as the family received both their owed payment and this fine sword. (Lot 6) $12,000 - 15,000

38.375” (97.5cm) hatchet tipped, tapered single-edged blade. 1.375” wide at ricasso with two wide fullers running nearly the full length of the blade. 44.875” in overall length. Spine engraved in a single line Manufre Rle de Kinglenthal Nbre 1814. Reverse ricasso with illegible inspection mark, obverse blade marked in upper fuller with Klingenthal inspections of a “{* over B in an oval}” for Bourson, an «{L in a circle}” for Lobstein and a “{partially wreathed B}” for Bick. All are correct inspection marks for the production date on the spine. Another “{* over B in an oval}” inspection is found on the top of the inner face of the brass guard, with the inspection letters “V, F and B” on the face of the guard. 6.5” hilt with heavy brass guard with three branches and a knuckle bow with the reverse of the knuckle bow stamped “VERSAILLES” and the upper rear of the bow, where it meets the pommel cap stamped “BELGIUM”. An “{asterisk}” and the letter «V” are stamped on the interior of the guard where the three outer branches come together. Leather covered wood grip

with cord wrap and 13 rows of twisted brass wire. Saber is accompanied by a metal scabbard with two suspension rings that has as a symmetrical lyre-shaped drag and a riveted throat. Top of throat inspected with a small asterisk and with a small “{r in a circle}” on the upper mount. Scabbard measures 39.625” in overall length. This Versailles hilted, Klingenthal bladed French AN XIII Heavy Cavalry Saber was produced in the winter 1814, roughly four months prior to the 100 Days and is a rare example of an unmodified AN XIII saber that retains its original hatchet tip and has not been altered to spear point as was done with most AN XIII sabers in inventory circa 1816. As such, the saber is almost certainly a Waterloo trophy, as swords that were still in French service after that battle were almost universally modified. The “Belgium” mark on the guard suggests that the saber remained in Beligum after the battle and was later exported to another country at a time when the “country of origin” of an item had to be applied to it for importation. A wonderful opportunity to own a correct Waterloo period French Cuirassier Saber. (Lot 7) $2,500 - 3,500

Cased Early Production Model 1854 Beaumont Adams Percussion Revolver

54-Bore (.442). 6” octagonal barrel length. SN: 16813R / B812. Blued finish, color casehardened 5-chambered cylinder, checkered one-piece walnut grip. Top strap and top flat of barrel engraved in a single line: “Deane, Adams & Deane No 30 King William Street London Bridge” with lower right side of frame engraved in two lines: “B. 812 / Adams’ Patent No 16,813R”. Cylinder with matching “16,813R” serial number engraved as well. The “B” number indicates this is the 812th revolver produced under the Beaumont patent improvements. Barrel and cylinder with London commercial proof marks. The assembly number “2497” if found on the reverse of the loading lever, rear face of cylinder and inside triggerguard. Frame engraved with tight foliate scrolls, with butt cap engraved en-suite as well as forcing cone area of the barrel. A very interesting transitional Beaumont-Adams revolver that includes uncommon features for a Model 1854 revolver. Despite using the “Beaumont” lock improvements with the hammer spur, the revolver remains a double-action only gun with the older Model 1851 patent spring safety on the left side of the frame which is engaged to achieve the “half-cock” position. However the cylinder arbor pin is retained by the newer M1854 patent thumb screw, and the M1854 patent sliding safety that blocks cylinder rotation is found on the right side of the frame as well. The grip incorporates a concealed cap box in the butt, a feature typical of the M1851 revolvers but not normally found on the M1854 guns and also has the flared base of the M1851 guns, but with the M1854 grip angle. The revolver also incorporates the relatively scarce Rigby patent ramrod that is stored by folding it into the grip area. This rammer was used prior to adopting the more common Kerr patent design and is typically associated with the early M1854 Beaumont-Adams revolvers produced at London Armoury Company when Adams went to work there in 1857. While Adams revolvers cannot be easily dated based upon serial number, the presence of the post-1854 patent features, the Deane, Adams & Deane markings, very low Beaumont patent tracking number and the fact that Adams had moved to the London Armoury Company by early 1857 suggest this

transitional revolver was produced circa 1855. Revolver is contained in a typical compartmentalized English oak casing with recessed lock and brass Bible hinges with a dark green baize lining and a reproduction Adams retailer label. Accessories include a correctly marked Adams Patent dual conical cavity 54-Bore bullet mold, a James Dixon & Sons marked copper bag shaped pistol flask, a rosewood cleaning rod with removable brass jag and concealed ball puller, an unmarked pewter oiler, an embossed japanned tin Eley brother tin of caps, a reproduction ebony handled cone wrench with cone prick in bottom and a rosewood handled turnscrew. A fine and interesting transitional Beaumont Adams revolver produced towards the end of Robert Adams’ tenure at Deane, Adams & Deane. Fine Pair of Scottish Steel Flintlock Ram’s Butt Pistols by John Campbell Attributed to Kenneth McKenzie Leader of Clan McKenzie

.52 caliber. 6.5” barrel lengths. SN: NSN. Polished steel construction with silver highlights. Locks singed “John Campbell” in script. Pistols of traditional Scottish form with “scroll” or “ram’s horn” butt profiles, flush-fit locks, ball shaped triggers and multistage tapered round barrels with fluted breeches and slightly flared octagonal muzzles. Flint locks with rounded and fenced, un-bridled pans and flat faceted swan neck cocks. Locks remain in original flint with original top jaws and screws intact. Pistols with nearly full coverage engraving showing neatly executed flowing foliate scrolls over most of the surfaces, as well as traditional Scottish geometric woven rope motifs, and reeding on the first stage of the barrel near the breech. Pistols are further embellished with three engraved silver bands on the bottoms of the frames. Pistols retain their original 3.625” steel belt hooks on the reverse, which are lightly engraved with traditional motifs. Tapered, metal button-head ramrods with baluster turned rings are secured by single pipes and vent picks with ball finials are threaded into the pistol’s butts. Obverse grips mounted with silver ovals engraved with the Clan McKenzie crest of a stag’s head within a shield, with stars and dots around the periphery and surrounded by an oval with the Latin motto “Fide Parta, Fide Aucta” (By Faith Obtained, By Faith Increased), the motto of Kenneth McKenzie who was the hereditary clan chieftain from 1761-1781. John Campbell was one of three generations of Scottish gunmakers who worked in Doune, Scotland (located near both Stirling & Falkirk) during the 18th century from roughly 1710 to 1798. These pistols were likely produced by either the first or second Campbell of that line, as the first worked until circa 1750, with second active for at least a decade before and after that time. Additional research by the consignor suggests that these pistols were mostly likely owned by clan leader Kenneth McKenzie (b1744-d1781) 1st Earl of Seaforth (recreated), as this version of the clan motto in conjunction with the crest were used by him. During the Jacobite uprising of 1715, Kenneth’s grandfather William, the attainted 5th Earl of Seaforth, supported the claim of the pretender James Stuart against George I of England. At the conclusion of the conflict, when the war was lost by the Jacobites, William and his descendants were stripped of their hereditary lands and titles. The hereditary lands were subsequently repurchased by the family as both Kenneth and his father (also Kenneth, Lord Fortrose) were supporters of the English crown. Kenneth (Viscount Fortrose) was made Baron Ardelve, a peerage in Ireland in 1766 and in 1771 was also made The Earl of Seaforth, a newly created (or recreated) peerage, in Ireland. He served as a Member of Parliament for Caithness (Scotland) from 1768-1774 and in 1772 he was elected a Fellow of the prestigious Royal Society. With the opening of hostilities in the American colonies and the need to replace garrison troops from around the British Empire that had been sent to the conflict in North America, the British government pressed those with titles that had been supported by the crown to raise regiments to help with the military manpower crisis. McKenzie subsequently raised the 78th Seaforth (Highland) Regiment in December of 1779, which he led as its Lieutenant Colonel. The regiment was dispatched to service in India in June of 1781 and during the journey McKenzie fell ill and died in August. His body was consigned to the deep, and leadership of the regiment and the clan was passed to his cousin Thomas Frederick McKenzie Humberston. A lovely and historic pair of mid-18th century Irish pistols with direct association with the Clan McKenzie that were likely the personal arms of Kenneth McKenzie who led the clan for two decades, from the time of his father’s death in 1761 until his own death in 1781. (Lot 1) $25,000 - 40,000

Rare Etched Panel Colt Model 1878 Double Action Sheriff’s Model

.44-40. 4” barrel length. SN: 1865 (mfg, ca1879). Nickel finish, fire blued small parts, checkered Rampant Colt logo hard rubber grips. Short barreled “Sheriff’s Model” or “Storekeeper” variant produced without an ejector rod. Two-line barrel address as is appropriate for these shorter barrel lengths. Although the .44-40 caliber variant of the Model 1878 was the most popular civilian chambering for these revolvers, with some 18,819 produced, some combinations of barrel lengths and finishes are quite rare. Only 539 of the .44-40 Model 1878s were produced with the 4” barrel, of which 3 were “soft” and sent out to another retailer for embellishments like engraving, 247 were blued and 289 were nickel. All of the 4” guns were produced without ejector rods. This is a very scarce and desirable example of a “Sheriff’s Model” Colt Model 1878 Revolver that would be a wonderful addition to any advanced collection of Old West firearms. (Lot 52) $3,000 - 5,000

The M3 sub machine gun was adopted into service in 1942 as a lightweight low-cost alternative to the cumbersome Thompson M1928A1, or “Tommy Gun.” Popularly referred to as the “Grease Gun” because of it’s resemblance to the mechanic’s tool, the M3 could fire at a rate of 400 rounds per minute. The slow rate of fire compared to German and Russian SMG’s allowed skilled shooters to have better control and fire single shot bursts. This specimen shows signs of use and likely saw combat as it is marked with a serial number that dates it to mid-1944 manufacture. The M3 was later updated with improved features and renamed the M3A1. Reliable and easy to maintain, the M3/M3A1 SMG was used by U.S. troops during several conflicts including WWII, the Korean war, Early Vietnam War, and even some parts of the Gulf War. Lot comes with an M3-9mm bolt and barrel conversion kit. According to Frank Iannamico’s text studying the M3, these conversion kits were issued to OSS (Office of Strategic Services) and partisan troops who only had British or captured German ammunition. The M3’s simplified design allowed for an easy conversion from .45 ACP to 9mm. The original goal was to produce 25,000 of these conversion kits, but only 500 are believed to have been made during late 1943 and early 1944. Conversion kit features a 9mm magazine filler, two tension springs, a 9mm bolt, and 9mm barrel. This lot also includes an additional .45 ACP barrel and two additional magazines (one extended magazine, one 30-shot magazine). Canvas M1/M3 olive drab sling is attached. (Lot 93A) $10,000 - 15,000

Spangenberg & Consortium Wall Gun

.72 caliber. 39.5” wedge retained octagon to round barrel. SN: 78. Browned finish, iron furniture, European hardwood stock. Military style percussion lock with adjustable double-set triggers is marked S&C for Spangenberg & Consortium of Suhl, Prussia. Top flat of barrel marked at breech “SUHL” and dated 1854. Left angled flat of breech marked with Prussian inspection marks and the number “78”. Oversized military rifled musket style barrel is secured to the stock by three wedges and has a hooked breech. Bore rifled with five lands and grooves of roughly equivalent width, barrel equipped with fixed notch rear sight and dovetailed base for what was likely a globe front sight that is now missing. Breech tang with hole for removable peep sight that is now missing. Triggerguard with extended skeleton “pistol grip” to rear, sling swivels in toe of stock and through forend between the middle and entry pipes. Brass tipped wood ramrod secured by two iron thimbles and an iron entry pipe. Counterpane of stock with illegible name carved into it that has been mostly obliterated. Military style iron buttplate. Rifle has been modified and folk art decorated at some point in time by enhancing it with simple folk art carvings on the reverse butt, with mother of pearl inlays and with similar decoration on the obverse and by the addition of a sliding wood patchbox whose lid is decorated with a raised carved flower. The right edge of the middle of the buttplate has been cut to accommodate the added matchbox lid. The wrist was also checkered as part of the added embellishments. The overall style and pattern of the rifle is essentially a Germanic version of the French Model 1840 Rampart (Wall) Gun, and apparently at some point during its working life the rifle was altered for use as a heavy barrel civilian target rifle. The rifle weighs in at roughly 18.5 pounds and is a very impressive and interesting piece for any collection of mid-19th century European percussion arms. (Lot 137) $3,000 - 5,000

Tiffany Style Gripped and Engraved Colt Model 1862 Police Percussion Revolver

.36 caliber. 6.5” round barrel. SN: 28930 (mfg. ca 1864). Blued barrel and cylinder with inlaid gold decorations, color casehardened frame, hammer and loading lever, gold gilt brass triggerguard and backstrap, gilt trigger, gilt cast bronze Tiffany style grip. Five-shot fluted percussion cylinder, all visible numbers match. One-line New York barrel address, two-line “COLT’S /PATENT” mark on lower left side of frame. Frame profusely engraved in the New York style, possibly being the work of L.D. Nimschke’s shop with flowing foliate Arabesque scrolls and some punch-dot background shading. Frame with nearly complete engraving coverage, with the round rear portion of the cylinder, the hammer and rear web of the loading lever engraved en-suite. Additional engraved details with the same motif are present on the edge of the wedge, rear of the triggerguard as well as on the triggerguard’s web. Screw heads in frame engraved with simple sunburst lines with the wedge screw engraved in the same fashion and gold gilt. Barrel inlaid with flowing gold vine motifs from the barrel web to the muzzle, with gold inlaid figural foxes on each side of the web and the muzzle encircled with gold vines. The cylinder features gold decorative motifs between the flutes that terminate in arrows pointing towards the muzzle. The revolver is mounted with a fine set of highly detailed gilt Tiffany style grips decorated with flowing foliate Arabesque scrolls, a beaded border around the lower edge of the grip and a spreadwinged Mexican “Eagle & Snake” motif on the backstrap. It is generally believed that what collectors refer to as “Tiffany Gripped Colts” were produced and retailed by Schuyler, Hartley & Graham of New York with the cast grips provided by the Ames Sword Company, essentially creating a “presentation sword” style revolver. Both Colt factory engraved guns and guns that were engraved by contract engravers for Schuyler, Hartley & Graham are known with these grips. The reprint of the 1864 Schuyler, Hartley & Graham catalog shows similarly decorated guns with cast grips and profuse engraving as figures #422, #423 and #425. Figure #422 is of a 5.5” Colt Model 1862 “Police” Revolver and is listed in the catalog as “Colt’s New Model, 5 1/2 inch, Engraved Bronzed Handle, Plated and Gilt.” A similarly decorated Colt Model 1862 Police (#38549 - circa 1868) is in the collection of the Metropolitan Museum of Art with the same style of frame engraving and gilt decorations, but with a different pattern of Tiffany style grips, the figural depiction of “Christianity & Justice”. Additionally, a similarly decorated pair of Colt Model 1862 Police Revolvers were presented to the governor of Adrianople by Abraham Lincoln in 1864 with solid silver Tiffany made grips (#25513E & #25514E). This is a very attractive example of a highly embellished Colt Pocket Police revolver with Tiffany style grips that appears to be one of Schuyler, Hartley & Graham decorated revolvers with the engraving work possibly from Nimschke’s shop, as he did much of the engraving for the firm during this period. (Lot 158) $25,000 - 35,000

** Winchester Model 1886 Deluxe Lightweight Take Down Rifle

.45-70. 22” round barrel. SN: 126914 (mfg. ca1902). Blued finish, color casehardened lever and hammer, checkered pistol-gripped stock with shotgun butt, checkered hard rubber buttplate and hard rubber grip cap, checkered forend. Take down frame, plain trigger. Barrel with two-line Winchester roll die applied barrel address and patent information, additionally marked “45-70” forward of the chamber and «NICKEL STEEL” on the left side of the barrel. Two-line patent marking on rear of trigger plate. Sporting style sling swivels, folding rear sight, Lyman dovetailed white bead front sight blade and added Lyman adjustable receiver mounted rear sight. A Winchester serial number email query confirms the gun as a takedown frame Model 1886 Rifle in .45-70 with an “extra light” 22” barrel, plain grain checkered pistol grip, shotgun butt with hard rubber buttplate and a full magazine. There are no comments regarding sights. The query notes that the gun was received in the warehouse on June 11, 1903 and shipped the following day as order #187649. The query additionally notes a “Repair and Return” on 8 October 1906 on order #8982 but no further information is provided. It is not clear if this was for refinishing, additional sights, or exactly why the rifle went back to Winchester. A copy of this email query data sheet can be provided to the buyer. (Lot 195) $7,000 - 9,000

Winchester 3rd Model 1866 Rifle

.44RF. 24” octagonal barrel length. SN: 39066 (mfg. ca1870). Blued finish, color case hardened hammer and lever, brass frame and furniture. Smooth walnut stock with crescent butt and smooth forend. Barrel is marked in two lines “WINCHESTER REPEATING ARMS. NEW HAVEN. CT. / KING’SIMPROVEMENT-PATENTED-MARCH 29, 1866. OCTOBER 16, 1860”. Rear sight is an old, fixed block replacement with a dove-tailed front sight blade. Rifle is equipped with factory sling swivels and a three-piece cleaning rod in butt. One of the most iconic Winchester-made guns, the Model 1866 “Yellowboy” improved upon the venerable Henry rifle by adding a loading gate in the frame, a forend, and a sealed magazine tube. All issues with the operation of its direct predecessor. The Model 1866 was the first product of the newly established Winchester Repeating Arms Company, which had superseded the New Haven Arms Company. A very nice example with a substantial amount of blue on the barrel that is far above the average 1866 on the market, and that only needs a set of original sights to be correct. (Lot 54A) $8,000 - 12,000 26
