Also with Turnberry, she worked in Las Vegas as director of tourism for Town Square Las Vegas, a lifestyle and entertainment project. She entered the mall management and marketing profession in 1999, working as assistant director of marketing and business development for Simon Property Group in Las Vegas. Costanza received a bachelor’s degree in business management and marketing from the University of Nevada, Las Vegas, in 1998. She is married and has one child. Former pharmacy now camera exchange The old Yarbrough’s Pharmacy building still stands, but it now has a new paint job and a new sign. The building, located at 117 Piner St., now houses Denton Camera Exchange, a shop dedicated to new, used and antique cameras, lenses and equipment, as well as vinyl records and restored vintage furniture. The business is owned by Armand Kohandani, 28. Yarbrough’s Pharmacy, on Piner between Hickory and Oak streets, closed in 2012, and owner Julia Gibson held an estate sale. Her father, pharmacist Lonnie Yarbrough, opened the business in 1950. Yarbrough died in 2009. I

Venture combines two different businesses Owners Jeremy and Denise Speight combined two very different businesses when they opened the North Texas Vapor Shop & Aquarium Lounge. Their establishment, which opened Feb. 1, sells electronic cigarette devices, accessories and liquid as well as tropical saltwater aquariums. Electronic cigarettes are used by more than 3.5 million people, according to the Tobacco Vapor Electronic Cigarette Association’s website. Is the bond bubble bursting? “Instead of looking for outstanding values, many babyboomers are today piling into over-valued bonds and bond funds. n several articles in this column over the past three years, we have warned readers about the dangerous bond bubble forming in the financial markets. With their ultra-low interest rate policies, the Federal Reserve and other global central banks have waged a “war on savers” to fund bailouts of over-indebted borrowers. Starved of yield,

Jonathon FITE | savers have been taking excessive risks in bonds and bond funds with their hard-earned savings, often without even realizing it. The 30-year long bull market in bonds became a bubble. During the past few weeks, complacent bond investors have been rudely jolted out of their slumber. Fed Chairman Ben Bernanke pronounced that the central bank might curtail its “quantitative easing” program —

printing trillions of dollars to buy bonds — as the U.S. economy recovered. Bond markets, addicted to the cocaine of easy money, freaked out. Bond funds of all types have experienced their biggest value declines in years, with many funds down double digits. Tens of billions of dollars have been yanked from bond funds in the past month. So, has the bond bubble finally popped? First let’s show that a bubble — defined as severe overvaluation — actually exists. It is actually quite straightforward, once you think carefully about what a bond is: a type of loan. Would you personally consider making a loan at a 5 percent interest rate to a highly risky company with very little earnings or assets? We would hope

not. Yet, in early 2013, investors were pouring tens of billions of dollars of their hard-earned savings into junk bond funds (politely known as “high-yield”) containing these risky loans. That’s not to say that junk bonds are inherently bad. During the 2008 credit crisis, junk bonds were wonderful bargains, yielding above 20 percent. They provided great returns for our investment partnership. But at puny 5 percent yields in early 2013, junk bonds were a terrible deal. This was also true of other risky bonds, such as developing country sovereign bonds. Countries with shaky financial histories such as Zambia, Mongolia and Bolivia, were able to borrow below 5 percent in late 2012. Even Rwanda, once torn by civil war and still largely dependent on foreign aid, was

able to borrow hundreds of millions of dollars below 7 percent! So there’s a bubble in junk bonds and emerging market bonds. What about the “safe havens,” such as state municipal bonds and treasury bonds? Unfortunately, these, too, have been in bubble territory. Yields on the highest-quality municipal bonds hover under 3 percent. If you compare these microscopic yields with the true inflation rate of 5 percent — if you properly factor in rising costs of healthcare, college tuition and taxes — the real, inflation-adjusted return of government bonds such as munis and treasuries is actually negative. A bubble indeed. We have focused thus far on the overvaluation of bonds. Bond funds — mutual funds that invest in bonds — tend to further aggravate the risk of bonds in two ways.

WHAT IS PARENTAL ALIENATION?

Dr. Richard A. Warshak, Ph. D. is one of the most recognized experts in the country on parental alienation. He is located in Dallas, Texas and has testified in hundreds of custody cases. As a White House consultant, and through his writing, speeches, legislative and courtroom testimony, videos, and workshops, Dr. Warshak has had a profound impact on the law and well-being of families where parents live apart from each other. His book “Divorce Poison: How To Protect Your Family From Bad-mouthing and Brainwashing” is the classic and best-selling parental alienation resource in the world. The video “Welcome Back, Pluto: Understanding, Preventing, and Overcoming Parental Alienation” is the leading resource for families whose children struggle to stay out of the middle of parental conflicts. I have had the distinct pleasure of working with Dr. Warshak in cases and in continuing legal education. Full credit is given to him for this article. Most children whose parents live apart from each other long for a good relationship with both parents and want to be raised by both. The majority of children want contact with both parents on a regular basis, and the most common preference among children, and among adults looking back on their parents’ divorce, is for parenting plans that more evenly balance their time between homes.

from a parent differ from mild and moderate cases by the extent of the child’s rejection of a parent and the degree of negativity in the attitudes and behavior toward the rejected parent. Severely alienated children express extreme opposite views of their parents. They have little if anything positive to say about the rejected parent and often rewrite the history of their relationship with the rejected parent to erase positive and pleasant elements. Yet they often deliver beaming reports about the favored parent, which have little believability. Alienated children seem content to avoid all contact with the rejected parent, may reject the rejected parent’s extended family, and often threaten to defy court orders for time with the rejected parent. Severe alienation includes behavioral, emotional, and mental dimensions. Behavioral Impairments Severely alienated children treat the rejected parent with extreme hostility, disobedience, defiance, and withdrawal. They may resist or refuse contact, vandalize and steal property, threaten and perpetrate violence, and say mean and hurtful things. They may even allege abuse and often threaten to report the rejected parent for things the rejected parent has never done. Children who are severely alienated

typically display such venom. Often these children behave well with all other adults except the rejected parent and people associated with that parent.

Emotional Impairments When not treating the alienated parent with open dislike, severely alienated children remain distant and express no genuine love, affection, or appreciation. They fail to give Mother’s and Father’s Day cards to the rejected parent. They fail to return “I love you.” Alienated children show no apparent shame or guilt for mistreating the rejected parent. Severe alienation is not a situation where children merely love one parent a lot more than the other parent. These children harbor strong and irrational dislike toward the rejected parent with whom they formerly enjoyed a close relationship. Mental Impairments The child’s thoughts and statements about the rejected parent usually reflect trivial, shallow, and false complaints, often in words that echo the favored parent despite the child’s claim that the words are his own. In some cases, when trivial complaints fail to accomplish the goal of severing contact with the rejected parent, favored parents

and children lodge accusations of abuse. In the author’s family law litigation experience, the courts are very aware of this behavior by the favored parent and will often change custody of the child to the rejected parent. This is to lessen the time with the favored parent to lessen the impact of the emotional harm alienation causes. Alienated children’s thoughts about their parents become unbelievably opposite. They seem unable to come up with positive memories or perceptions about the rejected parent and have difficulty reporting negative aspects or experiences with the favored parent. Alienated children support the favored parent’s position in any situation where the parents disagree. Some children ask to testify against a parent in court, or to speak with the judge to lobby for their favored parent’s position in the litigation; however, this rarely works to the favored parent’s advantage as the judges can see right through it. One of the most evil signs of unreasonable alienation is what Dr. Warshak calls “hatred by association—the spread of hatred to people and even objects associated with the rejected parent, such as members of the rejected parent’s family, likes of the rejected parent, and pets.”

Some children, though, do not crave more time with an absent parent. Instead, these children reject one parent, resist contact, or show extreme reluctance to be with the parent. These children are alienated. Children who reject a parent with whom they previously had a good relationship are alienated and they often act out the favored parent’s negative attitudes. The alienated child’s treatment of the rejected parent is not in line with the rejected parent’s behavior and inconsistent with the prior history of the rejected parent’s relationship with the child. Because it is virtually impossible to prove the favored parent’s actions with the alienated child, alienation is proven by the child’s actions toward the rejected parent. Characteristics Of Severely Alienated Children Severe cases of parental alienation

Children in these situations learn to gain favor with the favored parent by echoing that parent’s complaints about the rejected parent. They learn that it displeases the favored parent when they show signs of connection and affection with the other parent. Often they refer to the rejected parent by first name or with a term of disrespect, rather than as Mom or Dad. Although others see clearly that a child’s negative attitude toward the rejected parent developed in the shadow of the other parent’s hostility, the alienated child denies any such influence. Instead the child blames the rejected parent for provoking the child’s hatred, when the source of the hatred stems from the favored parent and usually the favored parent’s friends and family. Chamber luncheon format revised

he format of the regular September membership luncheon has been revised slightly to not only allow for an expanded program on recently passed state legislation, but also to include the participation of several other chambers from around Denton County. The luncheon is scheduled for 11:30 a.m. Thursday, Sept. 19, in The Club at Apogee Stadium on the campus of the University of North Texas. The entire six-person state legislative delegation from Denton County has been invited to give presentations on the results of the 83rd session of the Texas Legislature. Coordinated as a joint project of the Denton, Flower Mound,

First, to juice their yields, bond fund managers often use leverage in the form of borrowed money — at near-zero short-term rates — or derivatives. In stable environments, this magnifies yields. That’s why many bond funds report yields higher than the bonds they own. But because of this leverage effect, bond funds have fallen more than 10 percent in recent weeks, more than the decline in their underlying bonds. Second, many bond funds trade in the stock market with their own ticker symbols — these are known as closed-end funds. Amid the thirst for yield, many bond funds, especially those associated with name brands such as Pimco, traded at premiums to their net asset value (NAV). Such bond funds can be especially risky since they are vulnerable to a triple

whammy — they own overvalued bonds, on leverage, and are priced above the price of the assets they contain! Interestingly, some bond funds have been slammed so hard this past month by investors rushing for the exits that today some of them have lost their NAV premiums and actually trade at significant discounts to NAV. This is especially true of funds focused on mortgage bonds. This is the lone orbit in the bond universe that intrigues us today — the rest of the space is still ripe for supernova flameouts. In recent days, Federal Reserve officials have been coming out of the woodwork to assure market participants the Fed will continue to coddle the “infant recovery� — now almost 5 years in the making — in hopes these verbal assurances will help stem the bond market tumult and stabilize bond prices. In the short term, many

bond funds may rally as the panic subsides and NAV discounts close. Longer-term, however, we expect bonds and bond funds to be a bad bet. Rising inflation and interest rates will surely burst the bond bubble.

Changes to Texas justice courts I

n response to legislation adopted in 2011, the Supreme Court of Texas has issued new rules governing civil cases filed in justice courts. These new rules go into effect Aug. 31 and will govern the filing, pre-trial procedures, trial and appeal of all civil cases filed in a justice court. Historically, cases in justice courts were divided into smallclaims cases and justice court cases. Small-claims cases typically involved civil disputes of $10,000 or less. However, these same cases could also be heard as a justice court case. The Texas Rules of Evidence applied to justice court cases, but not to small-claims cases. Certain types of civil disputes can only be initiated in justice

Scott ALAGOOD | courts, such as evictions, tenant lockouts and disconnection of a residential tenant’s utilities by a landlord. To some extent, the new rules simplify practice in justice courts. Under the current rules, multiple and seemingly conflicting statutes could apply, while certain procedural topics are loosely addressed. Texas Rules of Civil Procedure 523-591 set

forth the general rules of practice in justice and small-claims courts, while rules 737-755 deal with particular cases such as evictions and enforcing a landlord’s duty to repair or remedy residential rental property. Starting Aug. 31, these rules will be repealed and replaced with new rules 500-510 of the Texas Rules of Civil Procedure. The new rules will divide justice court civil cases into four distinct categories: n small-claims cases (rules 500-507); n debt claim cases (rules 500507 and 508); n repair and remedy cases (rules 500-507 and 509); and n eviction cases (rules 500507 and 510). The general rules governing

all cases will be found in rules 500-507. These rules will apply to all small-claims cases, and any other case not covered by rules 508, 509, and 510 which may be filed in a justice court. Small-claims cases will continue to apply to any disputes over monetary sums of $10,000 or less. In computing the $10,000 amount, attorney’s fees incurred will continue to be included, while statutory interest and court costs will not. To the extent the general rules are not in conflict with rules 508, 509 and 510, they will also apply to debt claims, repair and remedy claims, and eviction claims. To the extent that rules 508, 509 or 510 conflict with the general rules, the specific rules shall control.

Debt claims cases will be primarily governed by rule 508 and will apply to any lawsuits brought to recover a debt by an assignee of a claim, a debt collector or collection agency, a financial institution or a person primarily engaged in the business of lending money at interest. These cases will typically involve unpaid credit card claims involving no more than $10,000 — as calculated in small-claims cases. Repair and remedy cases will be primarily governed by rule 509 and will apply to lawsuits filed by a residential tenant under Subchapter B of Chapter 92 of the Texas Property Code to enforce a landlord’s duty to repair or remedy a condition which materially affects the physical health and safety of an ordinary tenant. Nationally and regionally, sellers and buyers are seeing a more vibrant housing market than the past few years, with numbers increasing across the board for sales and prices, while the amount of time spent on the market and foreclosures continues to drop. Marti Kay, a realtor with Remax North Associates in Denton said for many years it was a buyer’s market, but that stopped around three months ago. “Now it has turned around,” she said. “It is a seller’s market.” Kay said many people have been waiting for the right time to

get into homes, especially new homes. Some of them waited to get interest rates as low as they could. “They are thinking the interest rates were going to go down more, but they do not remember when it was 18 percent,” Kay said. Jayne Howell, a real estate broker with Scott Brown Properties

in Denton, said since interest rates have started to trickle back up, more potential buyers have locked down mortgage rates after debating whether it was the right time to buy. “Interest rates have remained historically low, but they’re climbing upward slightly and that’s alerting the people that have

been sitting on the fence to buy that the time is now,” she said. Part of the problem affecting home ownership right now is that houses are not staying on the market for very long. Home inventory as of May 2013 was 2.4, according to the Texas Real Estate Center. Just two years ago in May 2011, the home inventory was 7.1. Clients desire either new homes or homes in good condition, said Karin Seligmann, a realtor in Denton. Older homes are also selling fast, as long as they are in good areas and in good condition. “I feel a greater sense of

urgency in the buyers this year because, frankly, we don’t have enough homes that are in good condition on the market,” she said. This is partially because of the growing popularity of home sale and improvement shows on networks like HGTV, raising clients’ expectation for a property. Since the economic downturn, she has been staging homes for sales to make them look more desirable, and coaching the sellers more to make their properties more lucrative. Many of Kay’s clients have relocated from other areas to Denton, Lewisville and Flower

Mound. The majority of her clients have been first time homebuyers during the past three months, while other clients are downsizing. Howell said Scott Brown Properties continues to see variety in its clients with a lot of first-time homebuyers, people buying larger homes, and people relocating to the area. “It is a good time to sell, since prices are still reasonable that it might be a good time for them to move up [a home size],” Kay said. “They are finding Texas is a good place to live. We don’t have a state income tax, but our property taxes are high. They are still happy.”

In May, the number of properties that received a foreclosure filing in Denton County was 37 percent lower than the previous month and 62 percent lower than the same time last year, according to the foreclosure listing firm, RealtyTrac Inc. Erica Sullivan, an economic development analyst with the City of Denton, said banks have been more willing to complete the foreclosure process more quickly because housing values are rising and inventory was low. Locally, homes are sometimes selling before they are even placed on the market, she noted. The median sales price of a

NEW HOMES The number of people interested in buying a new home has increased in the past couple of months. As of May 2013, 972 new homes were sold in Denton County, according to the Texas Real Estate Center. Denton County had 2.4 months of inventory with the average price of home listed at around $225,000, according to the center’s website. Home sales for April 2013 were up 38 percent compared with the previous month, and up 35 percent compared with a year ago, RealtyTrac.com reported.

Some consumers instead have opted to build their own homes. Hallye Fletcher of Ponder said she and her husband found a lot they liked in the area at the end of January and began building their home in February after little success in the existing market. “We originally looked into preowned homes and even put an offer in only to be turned down to a lower offer as the buyers were worried about the house not appraising for what would have been our sale price,” Fletcher said in an e-mail. “There weren’t many options in Ponder that met our criteria, so we found a lot we liked and went from there.” RENTING The average median rent in the city of Denton is $821; the

county, $879. Both are higher than the statewide median rent of $813, according to the U.S. Census Bureau 2011 American Community Survey one-year estimates. Don Manning, chief operating officer for Scott Brown Properties in Denton, said the rental business has been strong in their office, even with an increase in new construction of apartments. About 75 percent of the company’s rental listings are apartments and about 25 percent are houses. In Denton, he said the rentals continue to cater to college students and the rest of the customer base remains diverse. properties for September as early as March and April. The period historically began in May and June and stayed steady through August. “People were looking to be a little more proactive,” Manning said. “I think they’re realizing it’s harder to qualify for a mortgage and, therefore, are scared the leasing market might be a little bit tighter than normal.” He said the leasing environment remains strong and the company is on track to exceed last year’s figures for rentals. NATIONAL TRENDS Home sales are at the highest level since November 2009 with 5.18 million single-family homes, town homes, condos and co-ops sold in May, according to the National Association of Realtors. This is a 4.2 percent increase over April and a 12.9 percent increase from May 2012. Distressed homes accounted for 18 percent of May sales, unchanged from April but down from May 2012 when distressed homes were 25 percent of all sales, the National Association of Realtors also reported. The number of first time buyers in May was lower than April and even last May. New buyers accounted for 28 percent of home sales nationwide for May while they were 29 percent in April and 34 percent in May 2012. With increased sales, available homes have decreased since last year, but are up from April, according to the National Association of Realtors. Signs of recovering economy beginning to show

s we all know, the Texas economy fared better than most during the economic downturn a few years ago, and has been able to bounce back more quickly, as well. For the third year in a row, Texas has ranked as America’s Top State for Business (CNBC, 2012). Even closer to home, the North Texas area has continued to thrive as one of the strongest economies in the state. Here in Denton, we’re begin-

the case, including questioning witnesses or parties and summoning witnesses to appear. Pretrial discovery may be allowed so long as the judge considers it reasonable and necessary, and only after written court approval is obtained. For all cases filed in court on or after Aug. 31, the new rules will apply.

For cases which were filed prior to Aug. 31, and not concluded by that date, the Supreme Court has authorized the courts to continue using the old rules where the use of the new rules would not be feasible or would work. Hopefully, the transition will be smooth, and practice in the justice courts will continue to be

an affordable and efficient way to resolve smaller disputes.

Walmart Supercenter is under construction at the northeast corner of U.S. Highway 380 and FM424. The 186,000-square-foot store, at a cost of $12.6 million, will include a pharmacy, a garden center and a grocery section, Cross Roads Mayor Steve Smith said. He said construction began earlier this year. “The new center is located 10 miles from Little Elm and 10 miles from the Denton Walmart,” Smith said. “Right now, we have a lot of interest, and a lot of things will be coming to the 380 Corridor.” The Walmart is the start of a retail development to be called The Village at Cross Roads, Smith said. The new development so far is set to include two restaurants — Fuzzy’s Taco Shop and Whataburger, he said.

Vigne Wine Shop moved into the former Cellar 22 location, after the owners announced its closing May 4. John Ryan, co-owner of Vigne, said he had been looking to downsize. Since acquiring the new location, he’s made interior changes to the 1,600-square-foot space, including new paint and new equipment. Vigne Wine Shop opened at 219 E. Hickory St. on June 4. Ryan said he leased Vigne’s previous location, 222 W. Hickory St., Suite 102, to Yvonne and Vince Wolf, who plan to open a barbecue restaurant. Gold Mine BBQ is scheduled to open in August in the 2,400-squarefoot space, which includes a 400square-foot patio.

A new Rusty Taco restaurant opened June 3 in Denton. Among its 34 employees is Heather Dorris, the former executive chef at the Fort Worth Boat Club and sous chef at the Stoneleigh Hotel in Uptown Dallas and the Sheraton Market Center. She is now the restaurant’s general manager. “I am overwhelmed that I have talent like her working with us,” said Conner Cupit, owner and CEO of Greenbriar Restaurant Holdings LLC, which owns the restaurant on East Hickory Street. Class-action lawsuit seeks damages A Highland Village law firm filed a class-action lawsuit in Denton County’s 362nd District Court last month, claiming that

Title Max of Texas kept its customers in the dark about the actual cost of borrowing against the titles to their vehicles. Christman Kelley & Clarke PC filed the suit on behalf of Denton County residents Kimberly Babb, Jose and Linda Casarez, Jennie Reed and Tammy Venable, who represent a class that could number more than 1,000 people, according to court documents. In the lawsuit, they claim the company did not provide financial disclosures as

required by state law and used illegal and deceptive trade practices. The lawsuit seeks more than $1 million in damages. 6-23

City commission grants 90-day reprieve Denton’s Health and Building Standards Commission has granted a 90day reprieve to the owners of the historic Travelstead build-

ing on Hickory Street after a contractor presented a rehabilitation plan for the property. Salty Rishel, owner of Denton-based Distinct Designs Construction, told the commission this week that his work would include not only reroofing the building at 211 E. Hickory St., but also updating its facade. At its meeting Thursday, the commission was considering for the second time in two months whether to declare the

80-year-old building substandard, which could be the first step toward demolition. Instead, Rishel is working with the property owners to prepare the building for leasing and expects to be finished about 75 days after all city permits for the work are granted. The building is one of several on East Hickory Street subject to the city’s recent code enforcement efforts.
