Career Advancements Cindy Jacobson from CCD Counseling of Denton received the 2012 June Bucy Award for Excellence from the Texas Network of Youth Services. The award was presented to Jacobson Jacobson during the organization’s conference in August in San Antonio. The award recognizes Jacobson for program excellence, leadership and significant contributions to the field of youth services in the state. “It was wonderful. It was a nice honor to be selected. It came as a huge surprise to me,” Jacobson said. “It was a staff [member] that recommended me for it. It is nice to see that your work is valued in that way.” Jacobson has served as a counselor and director of CCD Counseling of Denton since 1990. She previously worked for many years at the Texas Health and Human Services Commission and the Denton Community Counseling Center. Jacobson is certified with the American Counseling Association. She is a University of North Texas graduate, with a Master of Education in marriage and family counseling and a Bachelor of Science in therapeutic recreation. The award was named after June Bucy, former executive director of the National Network for Youth. Texas Network of Youth Services is a nonprofit membership association of agencies and advocates, dedicated to enhancing the professionalism and effectiveness of community-based agencies serving youths and fam-
ilies in Texas. I R. Scott Alagood of Alagood & Cartwright PC was recently named to the Texas Super Lawyers list as one of the top attorneys in Texas for 2012 in real estate. Less than 5 perAlagood cent of lawyers in the state are selected to be part of the list, according to a news release. Alagood received Super Lawyer recognition in 2003 and 2004. His firm was also named second place in the Best of Denton readers’ poll this year. Alagood is a 1985 graduate of Denton High School. He received his Bachelor of Business Administration in finance from Texas A&M University in 1989, followed by his law degree from Texas Tech University School of Law in 1992. Alagood and Brian T. Cartwright formed their firm in 2003. Now in its 10th year, Super Lawyers recognizes excellence in Texas law. Since 2010, the magazine has partnered with Thomson Reuters business data provider. The Super Lawyers list recognizes lawyers from more than 70 areas who have attained a high degree of peer recognition and professional achievement. Annual selections are made using a rigorous multi-phased process that includes a statewide survey of lawyers, an independent research evaluation of candidates, and peer reviews by practice area. I Argyle resident Ann R. Earley, an administrative assistant for Modern Woodmen of America,
has completed a four-day educational program at the organization’s home office in Rock Island, Ill. The program provides experienced administrative assistants with an Earley advanced understanding of their position and how it interacts with home office functions like office organization, time management and other topics, according to a press release. Founded in 1883, Modern Woodmen of America is a fraternal financial services organization that offers financial products and fraternal member benefits to individuals and families throughout the country. I Leigh Hilton, a Denton attorney, was recently certified as an accredited estate planner by the National Association of Estate Planners & Councils. The accreditation is providHilton ed as a graduate level specialization in estate planning, a news release said. Hilton has more than 15 years of legal experience in the practice areas of estate planning, elder law and probate. Hilton was born in Dallas but grew up in Denton. She earned her bachelor’s from the University of North Texas, graduating with honors in 1989. She earned her law degree at the South Texas College of Law in Houston, graduating summa cum laude in 1992. The National Association of
Estate Planners & Councils is a national organization of professional estate planners and affiliated local estate planning councils focused on establishing and monitoring the highest professional and educational standards. NAEPC fosters public awareness of the quality services rendered by professionals who meet these standards, its website said. I DATCU’s Melanie Vest, senior vice president and financial officer, was recently chosen as one of the 2012 Women to Watch by the Credit Union Times, a magazine that covers Vest news related to the credit union industry. “The list is far from complete, but we thought this Women to Watch focus report would be a good start to showcase those who choose to champion the credit union mission every day,” officials with the magazine said in their annual report. Vest was listed under the category “The Driven” for her competitive spirit. The 2012 Women to Watch list appeared in the Oct. 3 edition of the publication. I Dee Leggett, vice president of program development for the Denton County Transportation Authority, was named to the Mass Transit Magazine’s Top 40 Under 40 List for 2012. The list honors professionals younger than 40 for their contributions to the public transit industry. The honorees were nominated by their peers, magazine officials said. They were also judged based on their job commitment, indus-
try involvement and contribution as well as achievement in their position, according to a news release. Leggett joins fellow DCTA staff member Jarod Varner, vice president of transit operations, who was recognized in the magazine’s 2011 list. The Top 40 Under 40 list appeared in the September/ October edition of the magazine. I Bill Utter Ford honored two of its longest tenured employees in October. Margie Sickles and Steve Prince both have over 40 years of service to the customers of Bill Utter Ford, Sickles according to a press release. Margie Sickles has been with Bill Utter Ford for 45 years, and she has been a part of Bill Utter Ford family even longer because her father was the Bill Utter Ford parts manager for many years. She is in the Accounting Department and has done everything from payroll to accounts receivables. Steve Prince’s career at Bill Utter Ford spans over 40 years. He started in the New Car Make Ready Department on July 1, 1972. He was promoted in 1973 to line technician in Prince the Service Department and in 1986 became the shop foreman. Bill Utter Ford was founded in Denton in 1956 and is a familyowned and operated Ford dealership located at 4901 S. I35E in Denton.
That campaign concluded the 2011 year with more than $1.8 million in donations and pledges. This year’s drive began in July.
Money raised from the campaign will support United Way’s 22 partner agencies, which provide various services including mentors for at-risk youth, educational programs for young
children from low-income homes, food, clothing, crisis, housing, utility and medication assistance.

hat could be more logical than seeking outstanding value?
Jonathon FITE | Finding bargains is the key task of value investing, which has pro-
market, fueling an epic stock bubble. When the bubble burst, millions of investors were hurt. Many swore off stocks altogether. Ironically, these hapless investors and their advisers actually did not learn the correct lesson from their debacle. Instead of looking for outstanding value, many of these same —now older — baby-boomers are today plowing dollars into over-valued bonds and bond funds. Along with the Federal Reserve’s reckless policies (see our previous articles in this column), this is fueling a bond bubble. We expect
duced many of the world’s greatest fortunes. Yet sadly, human nature and misguided notions about asset allocation prevent most people from investing successfully. In the late 1990s, lots of financial advisers were putting their clients into stocks, at a time when the market was severely over-valued. Baby-boomers, then in their prime earning years, ploughed trillions in savings into the stock

In his article referenced above, Russell further elaborated what the shrewd, wealthy investor does: “When bonds are cheap and bond yields are irresistibly high, he buys bonds. When stocks are on the bargain table and stock yields are attractive, he buys stocks. When real estate is a great value, he buys real estate. When great art or fine jewelry or gold is on the ‘give away’ table, he buys art or diamonds or gold.”

When should I use a Quitclaim Deed? veyance of an interest, not just a conveyance by the grantor. A Special Warranty Deed limits the warranty against any conveyance of an interest, but only if it occurs “by, through or under” the grantor. That is, the grantor is only warranting against matters that he or she may have conveyed to others, but not matters that someone else may have conveyed to others. A Deed Without Warranty is just what it says it is. There is no warranty, and thus no contractual promise by the grantor that he or she will stand behind the promised conveyance. However, since the Deed Without Warranty uses the “words of grant,” it is a deed regardless of its lack of warranty and transfers the interest described therein. To the contrary, a Quitclaim Deed under Texas law does not constitute a conveyance of real property. A quitclaim conveys only the grantor’s rights in the described property, if any. A Quitclaim on its face conveys doubts about the grantor’s inter-
est in the property and a buyer or grantee is automatically put on notice about these doubts. As such, a Quitclaim is not a deed and cannot be used to establish title to a particular parcel of real estate, whether by the grantee of the Quitclaim or anyone else claiming under him. Also, a Quitclaim Deed does not contain any warranty of title. As such, the buyer or grantee receives nothing more than a chance at title. There are several disadvantages through the use of the Quitclaim that are not present when using a true deed: I No express warranty of title nor implied warranties of title; I A person claiming under a Quitclaim cannot rely on the 5year statute of limitations to establish title; I A buyer or grantee claiming under a Quitclaim cannot avail themselves of the benefits of the Texas recording statutes that protects innocent purchasers against prior unrecorded deeds; and I The after-acquired title doc-

Quitclaim Deed in Texas is somewhat of an oxymoron. Believe it or not, a Quitclaim Deed is really not a deed. To understand the reasons why, you must know a little background about the type of deeds typically used in Texas to transfer real property. There are three basic types of deeds in Texas, which are used to convey real property: a General Warranty Deed, a Special Warranty Deed and a Deed Without Warranty. Each of these deeds primarily accomplishes the same thing. That is, they actually convey the interests owned by the grantor in the real property being conveyed. The granting clause contained in each of these deeds affirmatively grants “all right, title and interest” that the grantor holds in the particular real property being conveyed. The typical words of grant used in a deed to show intent to convey are “grant, sold and conveyed.” However, other words, such as “transfer” or
Scott ALAGOOD | “alienate” may suffice. Words such as “release,” “wish” or “dedicate” have either caused confusion as to the grantor’s intent or have been held ineffective as words of conveyance. The use of the proper words of grant will imply that certain warranties exist by law. There are differences between the three basic types of deeds. Each deed “warrants” the grant in differing manners. A warranty is effectively a contractual promise by the grantor that the interest being conveyed in the deed is the full and complete interest described. A General Warranty Deed “warrants” the conveyed interest against any prior con-
trine cannot be invoked by a Quitclaim grantee to claim an interest in real property obtained by the Quitclaim grantor after the date of the Quitclaim. Effectively, a Quitclaim Deed only acts as an “estoppel” or defense against the Quitclaim grantor who is claiming an interest in the real property quitclaimed to the Quitclaim grantee. Therefore, the use of a Quitclaim Deed should typically be limited to situations where a buyer or grantee can otherwise stand on his or her own title, but needs to make sure that another potential claimant will not have a valid claim to defeat such grantee’s claim in the same real property. In those instances, a Quitclaim may be used essentially as an estoppel document, rather than a tool to obtain title to or an interest in real estate. If you are ever presented with a situation in which you are being advised to use a Quitclaim or believe a Quitclaim is adequate, you should seek legal advice from an attorney specialized in real estate transactions to make sure you are fully aware of ALAGOOD | CONTINUED ON PAGE 6

During my time here, it has been my pleasure to work with a wonderful woman, friend and colleague, Linda Ratliff, director of economic development for the City of Denton. At the end of this year, Linda will be retiring after working 22 years with the city and serving as director for 16 years. As part of the Denton Economic Development

ness partner and I have learned so much from her through the years. During Linda’s time with the city, her accomplishments have been many. State legislature to convene in January
T
he regular session of the state legislature normally meets in odd numbered years for 140 days. The 83rd Session will formally convene on Jan. 8 in Austin. Co-chaired by Kimberly Reasoner and Rich Reynolds, our State & Federal Relations Committee is coordinating a series of meetings with representatives from the City of Denton, the Denton Independent School District, all area higher education institutions and the United Way. They are identifying Denton area needs and issues that may be addressed by the Texas Legislature. Between now and the start of the session, the group will consider possible joint backing for public and higher education budgetary requests, the agendas of the Dallas Area Chambers Legislative Coalition, the Texas Economic Development Council, as well as applicable issues being pursued by the Texas Municipal League and the Texas Association of School Boards & Superintendents. Detailed discussions are being conducted on water conservation and resource development,

the consequences of such actions, as well as obtaining other possible options, such as using a Deed Without Warranty. Otherwise, you may find yourself or your heirs or assigns litigating an unintended title dispute at some point in the future. There are other types of deeds which deal with mineral estates in Texas real property such as a mineral deed or a royalty deed. It should be noted that unless otherwise reserved to the grantor or through a prior transfer, the

Common Divorce Questions Answered: Assuring Peace of Mind for Clients and Their Families It is a true statement of fact that more than half of married couples will come to a situation in their life in which they will need the guidance of an attorney. The family law attorneys at KoonsFuller, P.C. advise that if you can stay married, they encourage couples to do so. However, if you find that it is inevitable that the marriage is going to end in divorce, it is imperative that your choice be governed by reason and diligence. Here are the answers to some of the most common divorce questions we face. Q: What is the most common concern encountered regarding custody? People often express fear that, should they divorce their spouse, their children will be “taken away” from them or they will “never see them.” However, unless a parent is found to be dangerous to the child’s immediate health and welfare, the fear of losing regular and normal access to your children in a divorce is a myth. The legal presumption in Texas is that it is in the best interest of a child that both parents be appointed “joint managing conservators”— often referred to as “joint custody.” The reality is that, in most cases, the court is going to award joint custody, where both parents share equally or independently in most parental rights. In today’s modern world of divorce, it is rare for a parent to be awarded sole custody. .............................................................. Q: Does “joint custody” mean all rights and possession are equal to both parents? Although Texas is slowly moving toward more equality in co-parenting, joint custody doesn’t mean all things are always equal. One parent may be granted certain decisionmaking rights over the other parent, and although equal (or 50/50) possession schedules are ordered by the court under the proper circumstances, Texas statutes that govern family law provide for a specific default possession schedule—referred to as a “Standard Possession Order”—that is not quite equal, although very close if the expanded version is ordered. Many parents perceive this lack of total equality as unfair. However, the issue is not fairness to the parent—it is what is in the best interest of the child under the specific circumstances. ............................................................. Q: How much should I expect to pay or to receive in child support each month? The monthly child support obligation is generally based on a certain percentage of a person’s net monthly income. This is commonly referred to as “guideline child support.” This percentage varies depending upon the number of children for which there is a legal obligation to provide support. The monthly net amount upon which the child support calculation is based is usually capped at a percentage of the first $7,500 net available funds per month. However, like many issues that arise in family law, the court has the discretion to deviate from the standard guidelines under specific circum-
stances. Medical insurance for the children is also a child support obligation, but in addition to the guideline child support. It is also very common to require that the person paying the child support—referred to as the “obligor”—name the children as beneficiaries on a life insurance policy insuring the obligor’s life that will pay out an amount that is sufficient enough to satisfy the remaining child support obligation. ............................................................ Q: As far as property is concerned, everything is divided in half, right? Equal division of community property happens a lot, but it is not a legal rule. Texas is a community property state, so the initial legal presumption is that everything owned by the spouses is community property until proven otherwise. As the case pro-

gresses, the attorneys gather information to assist them in determining whether the property is possibly separate, community, mixed in character, owned or affected by an entity or trust or otherwise subject to other claims, such as offsets or reimbursement. This process is often referred to as characterization and tracing and can be very complicated and complex depending upon the content of the estate. At the end of the case, if the parties are unable to reach an agreement, the court will divide the community in a way the court deems just and right under the particular facts and circumstances of that case. So, a just and right division might be 50/50, or it may be disproportionately in favor of one spouse, depending upon the underlying circumstances as presented to the court. ............................................................ Q: Does Texas have alimony? Alimony is governed by the Internal Revenue Code (federal law), not the Texas Family Code, and in Texas, alimony only occurs by contractual agreement between the spouses. In other words, one spouse must contractually agree to pay alimony to the other. However, Texas law does contain provisions that give the court discretion to award spousal maintenance after divorce under very specific facts and circumstances, if the spouse qualifies to receive it. ............................................................ Q: How are family finances handled while my divorce is pending? In most larger counties, a contested divorce can take up to a year or longer to complete. In some counties, the court system provides
associate judges to assist district judges to help protect the children, the parties and the marital estate while the divorce is pending through temporary orders that govern temporary custody, temporary child support and temporary use of property, among many other things. ............................................................ Q: Does my case have to go to trial? Although many divorces begin as contested and court appearances are often necessary during the litigation process, most cases ultimately do not go to final trial, but rather settle through mediation or settlement negotiations. The collaborative law process is also an option. Only a very small percentage of divorce cases actually go to trial, in which case the judge will hear the evidence and make all the decisions for you regarding the issues you are unable to agree upon. .................................................................. When my business partner and I started our investment partnership, we were firm on our philosophy of long-term, value investing. But we deliberately retained the flexibility to invest across asset classes. Since different assets get cheap at different times, we realized we needed to be nimble in our quest for value. In 2008-09, the credit crisis tossed high-yield bonds and real estate investments into our laps. In 2010, the energy sector offered great values, especially after the BP spill. In 2011, highquality U.S. stocks like Walmart and Johnson & Johnson showed up in the clearance bin. Longtime readers of this column will recall that these all provided lucrative returns. Today, high-quality stocks have largely appreciated to fair value. Still, they are poised to compound nicely. Because of their pricing power, these com-

panies ought to grow their dividends faster than inflation. Residential real estate is still cheap, but stocks of real estate investment trusts are significantly overvalued. As for bonds, enough said above about the bond bubble. So, where are the outstanding values today? As the advent of vast new shale gas and oil resources turns America into an energy superpower, intriguing energy bargains have emerged. Our partnership owns several companies whose stocks are trading at deep discounts to the oil and gas assets that they own. More recently, we have also noticed some tantalizing bargains in the much-maligned coal industry, in which many stocks have fallen 60-80 percent. This sector has suffered “collateral damage” from low natural gas prices which have, in turn, depressed thermal coal prices used in power plants. But our recent study of several players
in the industry revealed that they are taking intelligent steps to curtail production. A bounce-back in natural gas prices should relieve the pain for coal prices. Also, it is apparent that the industry is benefiting from a surge in coal exports to Europe and Japan, which are shuttering their nuclear power plants in the wake of the Fukushima disaster. Other markets, such as Korea and India, are also emerging as significant destinations for American coal. We would not be surprised to see foreign players buy up American coal assets. Even as an industrial renewal is taking place in America, the shares of many well-managed, midcap U.S. manufacturers have become cheap amid fears about their exposure to Europe’s economic slowdown, a consequence of the sovereign debt crisis in Greece, Spain and Italy. For some time, this column has warned about the
deep-seated problems in Europe’s political and monetary system. Not surprisingly, these problems took a toll on the profitability of the European operations of U.S.-based multinationals in recent quarters. We have found several companies that we believe are taking decisive measures to improve efficiency and restore profitability in Europe. Once the market realizes this, we expect these stocks to perform very well. We are also finding dominant information technology companies trading at bargainbasement prices. The overvalued darlings of the 2000 bubble have become the value investments of 2012! These companies dominate their industries globally and generate huge profits. Most significantly, these companies have tens of billions of dollars of cash from past international profits sitting overseas. We expect that the U.S. government will eventually remove perverse tax penalties
and allow these companies to bring their cash back to America. Once that happens, these firms can hire more employees in America and also reward shareholders with bigger dividends and share repurchases. We should all be on the prowl for outstanding values, and wait patiently for bouts of market fear to fetch us compelling bargains. Today’s values will generate tomorrow’s investment returns. There is a lot of optimism about the upcoming holiday shopping season. Some store representatives say the momentum began early this year, others are preparing to offer their best deals for Black Friday, Cyber Monday and appealing layaway options. But a local economist says he has seen mixed signals for the retail industry this year. The National Retail Federation is predicting holiday sales will increase 4.1 percent over last year. Sales are expected to be $586.1 billion, the federa-
tion reported in its annual holiday forecast and historical report. In 2011, holiday sales represented 19.5 percent of total retail sales in 2011, according to
the data. The NRF reviews sales in November and December — a total of 61 days — to determine holiday sales.

Because Christmas will fall on a Tuesday this year, consumers have an extra weekend to finish their shopping, according to the NRF. Although retailers are seeing a strong fall shopping season and that is keeping them hopeful, three economic factors may impact their sales projections, said Terry Clower, director of the Center for Economic Development and Research at the University of North Texas in a statement. First, unemployment will remain high and job growth will not be sufficient to greatly boost
year-over-year holiday sales, he said. In its latest Economic Outlook report, the state comptroller’s office reported that only 48 percent of recession-hit jobs have been recovered nationally through August 2012. Still, the Texas unemployment rate has been at or below the national rate for 69 consecutive months. Retailers are expected to hire between 585,000 and 625,000 seasonal employees this year, the NRF reported. Last holiday season, 607,000 seasonal employees were hired. Clower said the second factor

that will affect sales is that retailers still do not know how storms in the Northeast will affect retail spending. “Some folks will be buying clothes, toys and household goods to replace items damaged in the storm, which will be inseparable from holiday shopping,” he wrote. “Others will have to forego or curtail some holiday shopping to pay for repairs to housing, autos and other big ticket items.” The third factor is how the U.S. Congress deals with the pending questions of sequestration, Clower said. “The media stories will increasingly cover the impact of losing existing tax cuts on middle class households,” he wrote. “Hearing that you may owe thousands of dollars more in taxes in 2013 may alter some folks’ holiday spending.” Still that has not deterred some shoppers.
HOLIDAY SHOPPING AHEAD OF SCHEDULE The shopping momentum apparently started early in Denton. Matt Ludemann, manager of the Golden Triangle Mall, said the mall begins seeing holiday shoppers as early as September. The first week of November is when the mall usually begins decorating for Christmas and this year it has a new setup for Santa photos to go along with the new center court that went up as part of the mall renovations started earlier this year. “We’re wrapping up the interior renovations,” Ludemann said. “During the holiday season we won’t want to disrupt traffic flow.” The exterior renovations will begin in January, he said. As part of the renovations, there will be charging stations by some of the chairs for customers to charge their cell phones and laptops. Ludemann said he expects it to be a solid holiday shopping season. There will also be a new food court lineup that will be announced later in November. He said there has been a push to drive sales by the national retailers this year, which may have something to do locally

with the remodeling of their stores and storefronts. “It’s good to see that big push on the national retailers,” he said. Wal-Mart manager Tony Quintero said the store on Loop 288 is already seeing holiday shoppers. “Prices are going to be a lot better this year than last year,” Quintero said. The second week of November is when the store begins to see heavier holiday traffic. John Vinson, manager of Target in Denton, said the store starts seeing more and more shoppers as it nears Thanksgiving. The store begins putting out holiday decorations throughout the month of October. But Black Friday, the day after Thanksgiving, appears to be the true kickoff for the holiday shopping season. DEALS AND STEALS With just days until the first official shopping day, the website BlackFriday.com has 25 shopping deals on its front page. Among the companies that have already released their bargain sales include Radio Shack, Bath

Saturday (Dec. 22) and the date Dec. 15. In 2011, Black Friday sales generated $11.4 billion in retail purchases, according to the website. Just like Black Friday, its successor, Cyber Monday — for those who only shop online on the Monday after Thanksgiving — will also get its share of fans. Last year, an estimated 112.9 million shoppers bought something for their loved ones online, according to Shop.org, the digital division of the National Retail Federation. The CyberMonday.com website not only offers deals during the holidays but also deals allyear long on Mondays. The NRF said retailers will be offering free shipping and promotions available only online during the holidays. The 2012 eHoliday survey conducted by the NRF’s pollster

weeks, we will be getting an overload of ads and they will all be posted online, as well.” The website is also offering their own deal — a cashback program for members who sign up. The cashback program is available via online applications on the iPhone and iPad, Dykstra said. In 2011, Black Friday sales increased by 6.6 percent compared to the prior year, according to the retail technology company, ShopperTrak. Founded in 1995, the Chicago-based company counts people, analyzes data and provides opportunities to increase revenue for retails, mall developers and entertainment venues, according to its website. ShopperTrak ranked Black Friday (Nov. 23) as the retail event generating the most traffic and sales, followed by Super
BIGinsight, showed six in 10 people planned to start their holiday shopping on Halloween. Another 43.2 percent will still wait until they see the early promotions and start in this month, according to the survey. Online holiday sales are expected to increase by 12 percent this year, the NRF said. With mobile adding to the shopping trends, sales this year could be between $92 billion to $96 billion, according to the survey. MAKING IT EASIER Wal-Mart will be offering layaway again this holiday season after last year’s success. The retailer began offering it in September and it will run through Dec. 14. The store began offering it a month earlier this year and added select items of sporting goods and housewares as well as toys and electronics, said

On Nov. 11, Wal-Mart released its sales ad to kick off the holiday shopping season. “We expect to have a very positive sales increase throughout the holiday,” he said, adding that sales will be much stronger than last year. He expects TVs and Blu-ray players will probably be on the top of everyone’s wish list as well as video game consoles. Toys “R” Us also introduced its layaway program in September. The retailer received a positive response and officials decided to extend it through Dec. 16. Katie Reczek, a spokeswoman for Toys “R” Us, said in an e-mail her company became the first retailer to offer a free layaway program. “Extending the program, which was originally slated to
end on Oct. 31, allows customers to take advantage of the flexible payment terms...” she wrote. The retailer cut its upfront service fee of $5 for the entire holiday shopping season nationwide. It also encouraged customers to pay off their balances and, in return, the company would give back $200 worth of toys to the Toys for Tots Foundation — up to $1 million worth of toys. In 2009, Toys “R” Us introduced layaway in its stores for “big-gift” items such as bikes, swing sets, dollhouses, play kitchens and more. In 2011, the layaway program was expanded to include all playthings at Toys “R” Us stores nationwide. Still, a 20 percent down payment is required for layaway, according to its plan rules. And 50 percent of the total price of

Sears has eliminated layaway service fees through Dec. 3 and Kmart, which is owned by Sears Holdings, removed layaway service fees through Nov. 21, according to a news release. Starting Nov. 7, all products purchased through online layaway at both Kmart and Sears are available for ship-to-home delivery. The company also introduced its Shop Your Way Rewards program for both Sears and Kmart where customers could pay a $79 yearly membership fee, get free two-day shipping and get a faster shipping option
A BIT OF CONSUMER CONFIDENCE, MAYBE? While Target doesn’t offer layaway, it has expanded its ad match policy. It will match several other retailers’ ads, including price and refund difference, said Vinson, manager of the store in Denton. Previously, it was more restrictive. “Target is expecting a good holiday season,” Vinson said. The retailer is cautiously optimistic, he added. The store had a good back-toschool season, which can be a good indicator for what the holiday season will be like for retailers, Vinson said. “People seem to be feeling pretty good about things over all,” he said. And he could be right. The

U.S. Conference Board’s Consumer Confidence Index improved from 68.4 percent in September to 72.2 percent in October. The job market appears to drive the current optimism, the board said in its Nov. 1 release. Lynn Franco, the director of the economic indicators at the board, said in a statement that people are feeling upbeat, but only for the short-term. “And [they] appear to be in better spirits approaching the holiday season,” she said.

Number of Peterbilt layoffs not disclosed Peterbilt Motors Co. had another round of layoffs but officials didn’t release the exact number. Peterbilt is Denton’s largest
private-sector employer with a truck manufacturing plant at 3200 Airport Road. The company, which is headquartered in Denton, laid off 250 employees in July. Unless Peterbilt submits a notice under the Worker Adjustment and Retraining Notification Act, the exact number of employees laid off doesn’t have to be disclosed to the city or the state.

Retail developers ask for financial help RED Development, the retail developers of Rayzor Ranch, asked the city earlier this year for the special district to help finance public infrastructure needed on the south side of University Drive, between Interstate 35 and Bonnie Brae Street. The City Council planned a public hearing on Denton’s first likely public improvement district —with $65 million in new bonding and taxing authority— for Election Day, Nov. 6. According to city documents, the list of items the special taxing district could help pay for is long and includes such things as grading and drainage work, streets and sidewalks, water and sewer lines, and street lights and traffic signals. The district would also fund work along the freeway frontage road. The developer’s plans for the south side include an open-air shopping mall, a park, apartments and single-family homes on about 200 acres. Property owners inside the public improvement district would pay an assessment in addition to city, school and county taxes. The assessments would be calculated based on the parcels and tracts and would be used to repay up to $65 million in bonds. Collecting the assessments would be the city’s responsibility, as the city would have the power to foreclose in order to collect. 10-10
Officials look for way to connect corridor To keep up with the needs and demands of a growing region, transportation officials are starting to look at ways to connect to the Cotton Belt Corridor. North Central Texas Council of Governments transportation director Michael Morris lauds the opportunities presented in this corridor to expand transportation in the region and better accommodate
the rapid population growth. The Cotton Belt connection would provide a 62-mile corridor extending from southwest Fort Worth to Plano and Richardson and provide a connection to Dallas/Fort Worth International Airport.

Officials hold meetings to inform public on plan Denton city officials conducted the first of two meetings designed to update the public on the city’s comprehensive plan. The meetings are to help residents learn more about the process before planners launch the first community forums in November. The meeting was led by Abra Nusser, senior city planner, who went through the steps the city will take to update the plan, including using consultants, getting feedback from the public and drafting a document on which the City Council will have the final say. The updated plan will need to take into consideration the likely influx of 100,000 more people over the next 20 years, planning consultants have told city leaders. 10-14

Department wins award for reworked calendar Denton’s Solid Waste Department reworked a classic communication tool this year — the calendar — and saw enough change that department employees submitted the project to a national association and won an award. The department received the Best Education/Public Outreach Award for its 2012 residential
services calendar from the North American Hazardous Materials Management Association. Based in Colorado, the association is a 20-year-old professional organization dedicated to preventing pollution and reducing hazardous waste from entities that may be exempt from regulations, such as households and small businesses. 10-17
DME seeks public input on grid changes
told the City Council it plans to seek more public input as it plans for, expands and upgrades its grid over the next five years. DME is pursuing more than $302 million in capital improvements, including about $208 million in substation and transmission line projects beginning this year. The utility must acquire between 60 and 80 acres for substations as well as 25 miles of easement in and around Denton, according to General Manager Phil Williams.
