Corinth sets aside funds for emissions models CORINTH — The City Council agreed to spend $4,000 of a $15,000 contingency fund on several natural gas emissions models, to be completed by Sage Environmental. Council members Bruce Hanson and Randy Gibbons, who also serve on the council’s gas well committee, said the work should help the committee as it rewrites the city’s drilling and production ordinances to protect the health, safety and welfare of residents. Hanson told the council that he’d learned that the Texas Commission on Environmental Quality recently proposed new rules for oil and gas production equipment. The rules, which were unveiled this week, should go into effect in February. 9-5
City inundated with gas code feedback Denton city leaders were bombarded with letters and emails opposing new natural gas drilling regulations in the days leading up to the July 21 vote, a Denton Record-Chronicle analysis found. The correspondence shows the extent to which residents of Robson Ranch, pushed by the developer of the south Denton retirement community, tried to lobby city leaders to exempt the devel-
opment from new regulations. And while gas industry representatives vigorously attacked the code changes in a series of public meetings, the documents show that few offered written feedback in the days surrounding the vote. The city received only three letters from industry representatives, all of whom heartily objected to aspects of the proposed ordinance. The Record-Chronicle asked, under the Texas Public Information Act, to review all letters and e-mails received by the city manager’s and mayor’s offices on the code changes between July 7 and Aug. 6. The city released correspondence from residents and industry representatives, but city attorneys are asking to withhold some internal documents they say are exempt from release under the law. That request is pending before the Texas attorney general’s office.
Beth Marie’s opens small shop at UNT A new location of Beth Marie’s Old Fashioned Ice Cream and Soda Fountain has opened at the University of North Texas. The ice cream shop serves 27 ice cream flavors, including Mean Green Pistachio, and will be a miniaturized version of the two Denton stores. The other Beth Marie’s locations, which located on the downtown Square and at Unicorn Lake, serve up 65 fla-
vors at any one time, he said. University officials approached the owners of Beth Marie’s about the UNT location, he said. 9-8
City OKs improvements to embattled shelter SANGER — The City Council approved a budget amendment for $15,000 worth of improvements to the animal shelter, after touring the facility. The city is expected to spend somewhere between $15,000 and $20,000 upgrading the facility to bring it into compliance with state laws. The building needs repairs, better insulation and new kennels, Mayor Thomas Muir said, along with a separate room for cats. The city also is constructing an outbuilding for euthanasia, although Muir said that city leaders hope few animals would need to be put down — now or in the future.

Denton residents may be able to influence the design of a planned pedestrian bridge across Loop 288 near Golden Triangle Mall. The city hosted a meeting at the Civic Center to gather feedback on the proposed bridge, which would allow people to walk, jog or ride bikes over Loop
288 along the Denton Branch Rail Trail. The pedestrian bridge would run along the east side of a railroad bridge under construction at the loop between Colorado Boulevard and Brinker Road as part of the Denton County Transportation Authority’s A-train passenger rail project. The pedestrian bridge would be designed to offer safe passage over Loop 288, a six-lane state highway, for trail users. City officials hope to build stairways to the bridge on each side of the highway so shoppers at nearby retail stores could use it, too, Bob Tickner, the city’s superintendent of parks planning, said. The rail trail closed a year ago to allow construction of the A-

train, a 21-mile passenger rail line that will link Denton to the Dallas Area Rapid Transit system in Carrollton, with five stations along the way. The route, expected to open in June, is following the former MissouriKansas-Texas Railroad corridor, which in the Denton area served primarily as a hike-and-bike trail for most of the past decade. City officials hope to build and open the pedestrian bridge by the end of 2011, he said.

Profitable lessons from a legendary investor “Ben Graham was the smartest man I ever knew.” — Warren Buffett
B
enjamin Graham was one of the greatest investors in history. Every $100,000 investment by Graham in 1926 turned into more than $23 million by 1955. What makes this 230-fold return even more astonishing is that his career span included the 1929 stock market crash and the Great Depression. Known as the “Dean of Wall Street,” Graham established investing as a discipline involving systematic analysis rather than wild speculation. As a professor at Columbia University, he taught his valueinvesting principles to students who also went on to become legendary investors (most famously, Warren Buffett). Graham educated them to view stocks as ownership stakes in businesses. They had real, intrinsic value based on the company’s assets, profits and business prospects, and were not merely ticker symbols ran-
Jonathon FITE | domly fluctuating in price. Graham particularly relished “net-net” bargains, which he defined as stocks that were trading at discounts to their net current asset value (NCAV) — a company’s current assets minus its liabilities. To illustrate: Let’s say a company has $50 million in liquid assets such as cash and inventory, and owes $10 million to the bank and to its suppliers. Its NCAV would be $40 million. If the company has 5 million shares outstanding, NCAV would be $8 per share. If someone bought the whole company for less than $8 per share, they could simply liquidate the company and pocket a quick profit. If the business was
operated profitably rather than just liquidated, it would potentially be worth much more. Net-nets can be amazing bargains! Graham achieved outstanding returns with net-nets in the years following the Great Depression. But in recent decades, such net-net bargains became very scarce as company financials became more widely accessible. The sorts of companies that pop up on net-net stock screeners today are often obscure Chinese Internet companies or dubious cash-burning biotech outfits. I wouldn’t touch such speculations with a 10-foot pole. However, the financial crisis and market turmoil made stocks much cheaper. Last year, my business partner and I discovered a rare gem: an electronics distributor whose stock was trading at a significant discount to its NCAV. We typically avoid the electronics and high-tech industry because of its fastchanging and unpredictable nature. As a net-net, however, this
company largely sidestepped such objections, since its assets were solid, consisting mainly of cash, accounts receivable (from creditworthy customers) and inventory (mostly returnable to vendors at cost). We also examined the company’s major vendors, which were mostly publicly held companies with improving finances and promising business prospects, lending further credibility to our net current asset valuation. While the company’s sales and profits had declined significantly in the recent downturn, we were pleased to see the company had maintained excellent cash generation by deftly managing its inventory levels and cutting costs, while paying down much of its debt. As the overall industry recovered from recession, the company reported improvements in orders and profit margins, especially in Asia. We decided to invest, since this company was trading very cheaply, at half-off its net current asset value. Our analysis and patience through market volatility was
rewarded in less than one year. A larger distributor recently acquired the company — for twice our entry price! While we made a handsome return, the acquiring company was actually making a shrewd investment too. It bought the electronics distributor for the price of its “hard” tangible assets such as its electronics inventory, and effectively got the “soft” intangible assets, such as intellectual property and customer relationships, for free. Plus, as it merges the company into its own operations, it will squeeze out warehouse and overhead costs and improve its profits. The key to this success story was simply finding a decent business trading at a ridiculously cheap price — at a discount to its NCAV. Our investment thesis did not require some sucker to pay some silly price for our business in order for us to make money. We just spent the time applying Graham’s lessons to today’s marketplace. ctober marks the launch of the city’s Shop Here on Purpose — or S.H.O.P.— campaign. The purpose of the campaign is to spread the word about the importance of shopping in Denton. The news has been filled the past few months with stories about area cities that have had to make serious cuts in programs and some who have had to let employees go. To balance the city’s budget, we have to cut expenditures and increase revenues. Unfortunately, our sales tax revenues have been down for the past few years. People are spending less, which is why we need to consider shopping in Denton when we make our purchases. When you shop here on purpose, you support your community in two ways. First, you are supporting your local business owners. When we have strong, healthy businesses, they are able to provide more jobs and purchase more from other local businesses. The second way you support the community is through the sales tax generated from your purchase. Each time you spend money here — on dining, retail, entertainment and more — you are charged 8.25 percent sales tax. A portion of that sales tax (1.5 percent) goes into the city’s general fund to support vital

University Drive, Suite 1090 — will officially open for customers Thursday but will host special celebrations Monday and Tuesday, according to a news release. Jordan Tillius, a veteran of restaurant management, will manage Denton’s Freebirds location. The restaurant has hired 75 employees. First State Bank will open Friday at Rayzor Ranch Marketplace. As part of its grand opening, customers who open a checking account with direct deposit at the new branch are automatical-
ly entered into a drawing to win an Apple iPad. According to a news release, the contest will continue for four weeks, and any name that is not drawn will go back into the pot for a chance to win the following week. 9-15
Council takes stand against power line route Denton City Council members on Tuesday said they won’t support a route for a new high-voltage power line that crosses the Greenbelt Corridor — a stance that drew applause from a crowd of area residents fighting to protect the natural area. Council members voted to deny a resolution proposed by city staff that would have supported Oncor’s use of an existing
transmission line crossing through the Greenbelt for a new transmission line. They asked staff members to return next Tuesday with a new resolution opposing any crossing of the Greenbelt, which connects Ray Roberts and Lewisville lakes. Officials with Denton County and cities including Aubrey, Pilot Point and Sanger have already passed resolutions opposing routes through their jurisdictions. The 345-kilovolt transmission line project includes up to 95 alternate routes in four counties. The Public Utility Commission of Texas is expected to decide the final route by March 7. The new line is part of a $4.93 billion project to bring more wind power from the Panhandle and West Texas to

the Dallas-Fort Worth area and ease congestion on the electrical grid, Oncor officials have said. The project is scheduled for completion in 2013. 9-16
Company receiving tax breaks made public Schlumberger Ltd., a leading worldwide oil services company, plans to set up a centralized maintenance facility at a business park on Interstate 35W in south Denton, said Stephen Harris, the North American communications manager for the company, in a written statement. The company will provide maintenance, remanufacturing and testing of equipment at the Denton location, he said.
When Denton City Council members approved the tax incentives agreement in August with Tuscaloosa, Ala.-based Grand Mesa LLC, which purchased the building for its client, not all council members knew they were giving tax incentives to Schlumberger. But Mayor Mark Burroughs said the decision to offer a tax incentives agreement didn’t rest on the company’s name. 9-17

Cencor Realty Services and The Weitzman Group are overseeing Golden Triangle Mall with plans to revitalize the property and bring in more namebrand retailers. The Dallas-based sister companies were hired to manage the Denton mall and handle leasing as of Sept. 1 by JPMorgan Chase & Co., which purchased the mall following foreclosure proceedings in July. “It’s a good sign to have somebody of that caliber who is in charge of the mall,” said Linda Ratliff, the city’s economic development director, referring to Weitzman and Cencor, which have locations in each of the state’s major cities.
Golden Triangle Mall’s on-site management team of eight was recently transitioned from Feldman Mall Properties Inc. to Cencor. “We’re excited about the transition,” said Matt Ludemann, manager of Golden Triangle Mall. “Obviously, we’re going to see some good things as we move forward.” Jim Greenfield, Cencor’s senior vice president for property management in the Dallas-Fort Worth area, said that the mall has a lot of potential and is already successful, citing its 97 percent occupancy rate and steady traffic. Interstate 35E and South Loop 288 “is the start of a power corridor in Denton,” Greenfield
said, “so we think there is a great future for the mall.” “Our goal is to keep bringing in stronger tenants and work with existing tenants,” he said. Passersby may notice the parking lot repairs already under way and recent repairs to signage — the first steps to renovating and updating the look of the mall, Greenfield said. “Our first initiative is to work on strengthening the interior and work on bringing back as many shops into the mall as we can,” he added. The mall was recently sold at auction for $19.4 million to Arizona-based En Pertignus Holding Corp., a wholly owned subsidiary of JPMorgan Chase & Co., the bank that had previous-
ly opted to foreclose on a $24.6 million lien against the Denton mall, officials said. In corporate documents filed in Arizona, En Pertignus officials said the company was formed to take the title of a foreclosed property and sell it. Several factors, including the 765,000-square-foot mall’s retail mix, the structure’s age and the global economic downturn, likely contributed to the mall’s foreclosure, local business officials said. Having local management as well as updating the look will help disperse perceived competition that has hurt the mall in recent years, he said. The new management company hasn’t changed the day-to-day
business for owners inside the mall, said Rick Cheatham, owner of Dance and Costume World, a 30-year Denton business housed in the mall property. Retailers recently received memos from mall management outlining mall procedures and rules, such as employee dress code, keeping mall hours and lighting, he said. But they seemed standard, he said. “They just kind of emphasized they want people to follow the rules … but I haven’t noticed any real big change,” Cheatham said. Despite its age and ongoing concerns about a nearby property’s proposed outdoor shopping center, Golden Triangle Mall is strategically located in the North Texas region, officials say. “There’s good activity at that mall,” Greenfield said. “We’re going to show it’s much better to shop in air conditioning than outdoors in Texas.”

likely will continue for the next year or two, officials said. There were 578 homes posted for foreclosure for the upcoming October auction, a 19 percent decrease compared with the same month last year, according to data released from Foreclosure Listing Service Inc. But the monthly decrease in foreclosure postings isn’t particularly exciting, said Bonnie Brown, a spokeswoman for the Addison-based company. The year-to-date foreclosure postings for Denton County are worrisome, she said. Figures show an increase of 10 percent compared with last year, which is higher than any other Dallas-Fort Worth county. The number of foreclosure postings in the four-county Dallas-Fort Worth area increased 4 percent to 53,107 postings for the year, according to the data. The housing market likely won’t recover until after the mortgage resets settle out, sometime in 2012, Brown said.
Budget approved with tax, utility rate hikes Denton City Council members voted to adopt a $594.4 million budget that includes a tax rate increase and higher utility rates. The 7-0 vote — which came with little discussion — culminated months of “difficult” work during a tight budget year, Mayor Mark Burroughs said. The budget for the 2010-11 fiscal year, which starts Oct. 1, includes a 3.5 percent property tax rate increase. That’s expected to add $43 to the annual tax bill for a house valued at $152,891, the average value in Denton. Also, the average resident will pay an extra $5.30 a month in higher water and trash rates. The budget avoids layoffs and reduced service hours for city parks, libraries and recreation centers. Instead, the city will leave about 22 open positions vacant, which will save an estimated $1.5 million but likely result in reduced service levels, officials have said. Also included in the budget are utility customer service
hours at City Hall East which were reduced to 8 a.m. to 5 p.m. weekdays, eliminating evening and Saturday hours added when the city closed its customer service office at Golden Triangle Mall last year.
Krum leaders chugging along with depot plans The Krum economic development corporation has committed $35,000 to build an Amtrak rail depot in the city, if it can also obtain a federal matching grant. City leaders have been in talks since 2008 about a possible stop for the Heartland Flyer passenger train. The train runs on the Burlington Northern Santa Fe tracks between Fort Worth and Oklahoma City. It makes no stops between Fort Worth and Gainesville. Krum Mayor Terri Wilson said Krum has chosen two possible sites for a station just south of the railroad’s intersection with McCart Street. Wilson said town leaders expected to learn by the end of
September whether they will receive the federal grant. Such a rail stop in Krum would generate enough traffic to boost the city’s sales tax revenue by 10 percent, she said. Wilson said Krum’s proximity
to Denton would be beneficial. She cited a study by the organization Passenger Rail Oklahoma that estimated a stop in Krum would increase ridership on the line by 5 percent. — Compiled from staff reports

Halloween may be the beginning of a more profitable holiday season this year in North Texas as shoppers spend at 2008 levels, leaving the haunting 2009 season behind. Some national economists suggest holiday sales could range from 2.5 percent to 3.5 percent above last year’s shopping season — a season that begins with Halloween, encompasses Black Friday and ends in January with the postChristmas sales.
Predictions from a national standpoint are the strongest in several years, according to Ian Pierce, director of corporate communications with Cencor Realty Services, which is now overseeing management at Denton’s Golden Triangle Mall while its sister company, The
Weitzman Group, handles leasing. “Since the D-FW area is one of the strongest economies in the country, we would hope to be doing better than that good number here,” he said. With job growth and an unemployment rate lower than
national figures, the combination could prove fruitful for the upcoming season. “I’m not saying it’s going to be great, but it’s certainly looking better than what we were looking at in holiday 2009 or 2008. So everything’s moving in the right direction,” Pierce said. As employers continue to add jobs and consumers’ personal income increases, the North Texas region is on the recovery side of the recession, says Terry Clower, an economist with the University of North Texas’ Institute of Applied Economics.
One problem, however, remains: low consumer confidence across the nation. “How this translates into the next three months, that’s hard to say,” Clower said. “I would expect that local folks feel a little more confident about spending.” Early economic predictions for Halloween show Americans spending an estimated average of $66.28 on costumes, candy and decorations — up from $56.31 last year and just under $66.54 in 2008, according to a National Retail Federation report released in September.
ICSC-Goldman Sachs’ chain store sales index for the week ending Sept. 25 improved 0.4 percent on a sequential weekover-week basis, while sales momentum accelerated 3.6 percent year-to-year. The national trends, coupled with increased sales tax allocations locally, portend a better season for Denton area businesses, officials say. According to statistics compiled by the Texas comptroller’s office, the 2010 payments to Denton coffers — at $16.42 million — are up 11 percent from the $14.76 million allocated during the same period last year. The most recent allocations show a 15 percent hike year over year. “There for a while, we were seeing big drop,” said Linda Ratliff, the city’s economic development director. “Over the last five months, we’ve seen it pick up but at least it has been on that positive trend.” In recent months, a spate of new restaurants have opened their doors in Denton — from independent eateries to chain restaurants such as Freebirds World Burrito. Others will soon follow, including new Chick-filA and Whataburger locations and several new additions near the city’s downtown Square. In addition, the city could see a boost in sales tax from the opening of Denton’s first Sam’s Club and a second Walmart — both anchor stores in the new Rayzor Ranch Marketplace at U.S. Highway 380 and Interstate 35. “I think we’re starting to see that things are picking up in Denton,” Ratliff said. “People are going to be cautious. They are going to spend more but maybe not as much as before [the economic downturn].” The multimillion-dollar Rayzor Ranch development, on what used to be Rayzor family property, is well on its way to filling up the northern section of the 410-acre area. Updated plans for a town center on the southern side — complete with an entertainment district and a number of retail clothing shops — are expected to be revealed in the near future, with plans to open in late 2012. cones and construction equipment following the years-long widening of Loop 288’s southwestern section near the mall — a project that backed up traffic and limited accessibility to the city’s only indoor shopping center. holiday shopping. Aida Zihuatanejo, director of marketing for Golden Triangle Mall, said the mall has several plans in place for the season — including handing out free gift cards and posting promotions on Facebook and the mall’s website. “The greatest challenge is making everyone else understand the importance of keeping our dollars in Denton,” she said in an e-mail. “We want to continue to stimulate Denton and keep a positive outlook for our tenants, their employees — just simply moving forward.” Emma’s Boutique, off Brinker Road, uses smartphone mobile alerts to update customers on its latest arrivals, said co-owner Crissy Camp.
Stephen Plyler, owner of The Antique Gallery, Western Heritage Gallery and The Antique Experience at Stonehill Center, is planning a Western show for Nov. 19-21. A benefit auction also is planned, along with food drives. We have reached out more on social networks and become more involved in community efforts.” The longtime businesswoman says estimates from national economists appear to be on target, from her perspective. “I believe consumers are still being careful with their finances and have some fear of the future; however, we have noticed an increase in spending,” Schiada said. Ratliff agreed. “We were at a place in Denton where we had so much retail leakage going on — people going
to Lewisville, Frisco or wherever to shop,” she said. “We have the market here already, so we’re seeing the stores open right here.” In the 41 years since its doors first opened, J.T. Clothiers has seen several market fluctuations, Tritt says. “It’s been a rough couple of years, but I’m cautiously optimistic,” he said, adding that he hears the talk of economic concerns about the future but also believes Texas is lucky. “I hope this Christmas and this season will be better,” Tritt said.
