It’s the perfect time to highlight food as summer winds down. I love hiking my favorite trail and picking blueberries and walking down my street for raspberries to add the finishing touches to fresh muffins. Farms and gardens are bursting with freshness, and it seems more and more of our local restaurants are using the farm-to-table approach on their menus. In this issue, we highlighted some area foodies who are using the freshest ingredients at their tables and in their products. Peppe’s Bistro in East Stroudsburg plans the majority of their summer specials around the seasonal flavors from owner, Tom Farda’s garden—read about them on page 26. Truly Italian, whose authentic and delicious tomato sauce is a highlight at the Monroe Farmer’s Market, shared their history and a recipe with us on page, and Barley Creek introduced “The Morning Toast”—fresh breakfast from 8:01am -11:01am daily—to their lineup. It’s a must try for the freshsqueezed OJ alone. It’s also food festival season in the Poconos! I am excited to be judging the “Chopped” competition at The Garlic Festival again on September 4th at Shawnee Mountain. This year I will also be judging the Pennsylvania Wing Festival on August 13th at Pocono Raceway. Proceeds from the Wing-Off will benefit Meals on Wheels—so come out, eat some wings and show your support! Who makes the best wings in Pennsylvania? Contenders from across the state will compete for the bragging rights as well as prize money at the 21st annual Pennsylvania Wing Festival (formerly the Pocono Wing Off) hosted by Pocono Raceway and benefitting Monroe County Meals on Wheels. The proceeds from the event will be used to bridge the gap between what Meals on Wheels clients can afford to pay and the actual cost to produce and deliver.
Categories include hottest wing, best buffalo wing, best alternative wing and chef/VIP choice, and winners will be awarded $1,000 each. Fans will get in on the judging by voting on the best buffalo wing and best alternative wing, while judges will determine hottest and chef/ VIP choice. It will be fun for the whole family with live music and children’s entertainment. “We are tremendously grateful to Pocono Raceway and its staff for creating the new Pennsylvania Wing Festival to benefit Monroe County Meals on Wheels,” said Monroe County Meals on Wheels Executive Director Heidi Fareri. “Having lost our usual venue and with no suitable replacement, we were on the verge of canceling our wing off. Now, thanks to the commitment and generosity of Pocono Raceway, we can continue to help the elderly and disabled homebound of Monroe County receive nutritious meals and remain independent in their homes.”

The Buck Hill Skytop Music Festival, a summer concert series dedicated to bringing world class artists up close and musical to its audiences in the Pocono Mountains, will hold its seventh annual festival July 29 th through August 7th at various locations in the Pocono region. The festival kicks off at Pocono Mountain East High School with a collection of star Broadway performers who will give guests an inside look into their journey–from the audition room all the way to their opening night of the Broadway show that put them on the map. The performers include Broadway and West End veteran Alton Fitzgerald White (The Lion King, The Who’s Tommy), Tony Award winner Faith Prince (Guys and Dolls, Disaster!), Tony nominee Kerry Butler Disaster!), and Drama Desk Buck Hill Skytop (Xanadu, nominee Daniel Reichard (Jersey Boys). The first weekend of concerts will continue to bring the best of New York City to our neighborhood with a presentation by Lincoln Center’s The National Chorale. The Chorale will feature well known Opera arias, duets, and trios sung by top singers in the industry, followed by Carl Orff ’s Carmina Burana. Orff ’s cantata will include the Chorale plus three soloists, two pianos, and six percussionists all under the musical direction of Dr. Everett McCorvey. The first weekend will conclude at the Skytop Lodge where attendees can hear the speakeasy stylings of The Hot Sardines, who are touted by Forbes as “one of the best jazz bands in New York today.”

The Festival’s second weekend begins with the world renowned chamber music of the Harlem Quartet. These four string players made their public debut at Carnegie Hall and have gone on to perform at the White House for President Obama and First Lady Michelle Obama as well as play on the Grammy award winning album Mozart Goes Dancing. See them perform on August 4th at Tennis Tea in Buck Hill Falls. The weekend continues with two concerts at East Stroudsburg University. First, the world premier of Catch the Wind, a new musical by Daniel Larson and Michelle Elliot, will be presented in collaboration with NYU Tisch School of the Arts Graduate Writing Program. Second, there will be a presentation by the students as a part of the festival’s brand new Music Fest Performing Arts Camp, which is currently accepting applicants on the festival’s website. The Buck Hill Skytop Music Festival wraps up by bringing an alumnus of Pleasant Valley High School, Tony Yazbeck, back to where it all began for a presentation of his cabaret show, The Floor Above Me. After moving out of Pennsylvania, Yazbeck has become the star of multiple Broadway shows including Finding Neverland, and Tyne Daly’s Gypsy. Last year, Yazbeck received a Tony Award nomination for his role in On the Town.

Whether you call it gravy, red sauce, or marinara, there’s no question that Truly Italian gourmet pasta sauce is molto delizioso. You might imagine that it’s made by a little Italian grandma standing over an aromatic, simmering pot, but that’s not the story here. Her to-die-for sauce, however, has its roots firmly in Italian soil. Jasko began selling the sauce in 2003, but the origin of Truly Italian goes way back—all the way to 1942. That story begins during World War II, when a handsome young sergeant named James Atkinson (Jasko’s father) was stationed in Italy. He and his fellow servicemen enjoyed the Sunday spaghetti suppers prepared by an Italian-American soldier which he sold for a dollar a plate. Those meals were legendary, but no matter how they pleaded with the soldier/ chef, he wouldn’t share his treasured family recipe.

It was the roll of the dice—literally—that finally forced the soldier to give up the secret to the sauce. Atkinson won $200 from him in a game of craps, but the soldier didn’t have the cash to pay him. To settle the debt, he handed over the recipe with the stipulation that Atkinson never reveal his name, as his family would never forgive him. After the war, Atkinson traveled back to the U.S., and the recipe came with him. He met and married Zella in 1945, and she began the family tradition of making the sauce in their home in Ohio. “It is the only recipe my mother made that I ever paid attention to,” says Jasko. When Jasko married, she followed her mother’s custom of making the sauce every week. She started sharing jars with friends and neighbors, and they were in hot demand. After years of having people tell her that she should really sell the sought-after sauce, Jasko decided to give it a try, selling her first jars at the Monroe Farmers Market in 2003. The business has grown, with Jasko now making the sauce two or three times a week in a large commercial kitchen in Stroudsburg. She has expanded beyond the original recipe, and now offers variations including Burgundy Wine, Fra Diavolo, Portabella Mushroom, Hot Banana Pepper, Ultimate Garlic, and Vodka. You can still find her on Saturdays at the Farmers Market, but Truly Italian is also on the shelves of grocery stores all over northeastern Pennsylvania. If not for a bit of buona fortuna across the ocean nearly seventy-five years ago, Truly Italian would have never found its way to the Poconos. ROOTIN’ TOOTIN’ HOTDOGS

To Brian Crawford, owner of Rootin’ Tootin’ Hot Dogs in Stroudsburg, local means everything.
For 27 years Crawford worked for Aramark, a large food services company. Tired of the corporate rat race, he decided to open his own restaurant specializing in hot dogs. At the start, he was buying national brands, but found himself not entirely satisfied. The quality of the those national dogs just didn’t meet the standard to which he aspired. Was there a local, healthier option, Crawford wondered? Indeed there was. A Google search turned up Stryker Farms in Saylorsburg, just 15 miles from Rootin’ Tootin’ Hot Dogs.
Crawford’s partnership with Stryker Farms has been a rewarding one. The farm raises pasture fed, heritage breed pigs—their diets are supplemented with high quality, non-GMO feed without antibiotics or hormones. After Crawford learned how healthy these hot dogs were, he planned a taste test. He took seven national brand hot dogs alongside the one from Stryker Farms, and let the taste do the talking. The all-natural Stryker dog was the hands down winner. Once Crawford found the top dog right in his own backyard, the rest fell in place. Customers can feel good knowing that the hot dogs from Stryker Farms are farm to fork, all-natural and gluten free. To add a little variety, Crawford came up with daily specials like “The Napoli,” a grilled dog topped with mozzarella cheese, marinara sauce and fresh basil, and the “Kraut Dog,” grilled and topped with genuine Pennsylvania Dutch sauerkraut, among other creative recipes. The restaurant has a 1950s diner feel, with red and white tiled floors and a large lunch counter made from a 130-year-old tree from the owner’s backyard. The vibe when sitting at the counter is just what Crawford wanted—there are no televisions, customers are rarely on their phones and are welcomed into conversations with complete strangers. A jukebox awaits a quarter to play the hits, retired residents remember their childhood, and new generations appreciate a timeless atmosphere and the music we can all relate to. Crawford found most of the furnishings close to home, with both the booths and dishes from the Saylorsburg Inn and his cash-only register from a yard sale in Bangor, Pennsylvania. He sources his food from within the neighborhood as well. Their organic corn on the cob comes from a farm in Mount Bethel, the eggs and honey are from the nearby farmers market, and they make their own chili, potato salad, cheese sauce, and potato dipping sauce. Crawford explains, “A lot of people talk, but not a lot of people do. I said if we’re going to do this, we’re going to go the whole way. We may not be 100 percent local yet, but we’re growing.” Brian cannot say enough about how rewarding this career choice is for him. Throughout the 14 months they have been open, people from 48 countries and all 50 states have come to the restaurant to see what Rootin’ Tootin’ Hot Dogs is all about. For people who want a great, local experience, this is it. Brian states his philosophy simply—“If you’re going to say you serve local products, you have to mean it and support it with everything you have.” With that kind of commitment, Rootin’ Tootin’ will remain the top dog in town.

Stroll through the front door of the recently renovated Silver Birches resort in Hawley, and you may feel as though you’ve stepped back in time. The property, which sits on the shores of Lake Wallenpaupack, has a distinctive vintage, mid-century lake house vibe—welcoming, casual, and taking full advantage of the spectacular lake views.
Lodging at Silver Birches is available in cottages, houses, suites, or rooms, each with its own unique nostalgic décor, but all offering every modern amenity. The cozy decor, (most rooms have a fireplace) includes works by local artists, antique show finds, and carefully curated pieces, combining to create a charm that also harkens back to a bygone era.
The Dock on Wallenpaupack, as the resort’s restaurant is now called (formerly known as Ehrhardt’s), showcases views of the lake with a newly extended outdoor deck. Silver Birches offers rentals of kayaks, paddle boards, ski and fishing boats, as well as parasailing for the truly adventurous. And if you just want to relax and soak up the magnificent sunsets on the lake, sit back in the Adirondack chairs around one of several firepits by the shore. You may never want to leave.
Inside the restaurant, which also looks out on the lake, there is a fun, nautical feel, complete with a boat—yes, a sleek 1967 Mahogany Century Resorter is perched in the midst of the patrons. Sarah O’Fee, the director of marketing for resort owner, the Settlers Hospitality Group, explains, “When we added the extra seating on the deck, we were over capacity for what the kitchen could accomodate. We needed to take out some seating inside, so the boat was a creative—and beautiful—solution.” Around the boat, vintage rattan chairs are upholstered in nautical fabrics. The nod to the nautical continues at the bar, where the light fixtures are fashioned from old boat propellers. If a special occasion is in your future, the Waterfront event facility below the restaurant accommodates up to 250 guests in an elegant setting. An experienced staff is there to see to every detail, from planning to execution, with the promise that “The only thing we overlook is the lake.”

Bushkill may be best known for its namesake waterfalls, but the spectacular show of Mother Nature isn’t the only game in town. The elegant Steakhouse at the Bushkill Inn and Conference Center, a mere .3 miles across the road from the famous attraction, should be added to everyone’s must-go list.

combination of sweet and savory succulence. The desserts here do not disappoint, either—all are housemade, with selections to satisfy both the sweet tooth and the chocoholic.
The recently renovated restaurant is sleek and minimalist, and feels as though it could just as easily be in New York or Miami. Modern furnishings and white linens suggest a fine dining experience—one that lives up to expectations.
At the heart of the Steakhouse is Chef Dina Stack. Stack has been cooking since she was a child growing up as part of a big Italian family in Queens. Her family’s inn in Callicoon, New York gave the then seven-year-old Dina her first experience in a restaurant kitchen. She recalls giving her adult cousin (who was in charge there) advice, saying, “If this were MY restaurant, I would do it THIS way.”
The seasonal menu offers far more than a traditional steakhouse. Start with greens that are more sculpture than salad, and meant to share, with baby romaine rising up like plumes of a peacock nestled in smoked salmon—truly food as art. Continue with tender steamed clams tossed in white wine, garlic, butter, tomatoes, onions, sausage and cilantro, or sample the Asian-inspired calamari in sweet dragon sauce, bean sprouts, cherry peppers and scallions.
The precocious young girl went on to graduate from culinary school, honing her skills along the way. With twenty years of experience, Stack has learned to balance classic techniques with her creative mind. Now that she is at the helm at Bushkill Inn, she takes recipes from the past and makes them relevant to today’s way of dining. The seasonal offerings she has created are a pleasure for the eye and a delicious surprise for the palate.
For an entree, the fresh trout stuffed with garlic, onions, tomatoes with a white wine sauce is divine, as is the maple dijon half chicken, which is glazed to crispy perfection. And of course, the steaks are superb—after all, the restaurant is called The Steakhouse. Try the honey bourbon flat iron steak with frizzled onions for the perfect

When Trip and Eileen Ruvane first laid eyes on the old ski shop on Sullivan Trail and Camelback Rd in Tannersville, it didn’t look like much. There were a few mismatched pairs of antiquated rental skis, an old Pepsi vending machine, and a handful of 1887 newspapers stuffed inside the walls, probably used as insulation from the building’s humble farmhouse beginnings. But the location—right between Camelback Mountain Resort and the Crossings Factory Outlets—was the perfect place for the Ruvanes’ dream of opening Barley Creek Brewing Company, the first “brewpub” (restaurant and microbrewery combined) in Northeast Pennsylvania since Prohibition. “We were doing the daily commute from the Poconos to Wall Street,” Trip remembers, “but what we really wanted to do was create a business with a unique atmosphere where guests and staff could have fun.”
Whether it’s inventing a game called Firkin Curling (think Olympic curling, only with mini kegs called firkins), taking a few busloads of guests on a tailgate and baseball adventure, or throwing a fundraising festival with live entertainment and a stellar assortment of games (inflatable twister, anyone?), Barley Creek is anything but ordinary.

THE MORNING TOAST As a breakfast lover himself, for quite some time Trip has had his eye on providing a truly outstanding a.m. offering for his customers. The “Morning Toast” will be served daily from 8:01 to 11:01 in the Onyx Bar Room off Barley Creek’s main dining room. The new menu includes specialty benedicts, crepes and breakfast burritos. Pancakes and waffles are sure to be popular choices, particularly in the winter for skiers looking to “load up” on carbs before heading to the slopes. Thirsty breakfast enthusiasts can also choose between refreshing fresh squeezed juices and healthy smoothies, as well as mimosas, Bloody Marys, and other breakfast cocktails.
Barley Creek’s main building—a traditional post and beam timber-frame custom designed by Benson Woodworking, the renowned team that has been featured on PBS’s This Old House—also includes some unique and whimsical touches of its own. Where else can you see a canoe suspended over a rack of 600 personalized mugs? Where else can you tour a working brewhouse and distillery? From the copper-topped brick brewkettle to the Kentucky Hillbilly still to the “Alebox” made out of a keg, there’s always something interesting to see at Barley Creek. “We like to do things a little differently here,” Trip says. “We like to create fun for our guests.”

In June of 1980 when Peppe’s first opened its doors, long before the present day farm-to-table trend, we were farm stand shopping. For a brief four-month period from June to September, local farm fresh produce in Northeastern Pennsylvania is amazing. The first year we were open I can still remember Mr. Danato coming to the kitchen door selling bushels of basil. We would pick those leaves for hours to make pesto sauce for the whole year. By the time August came, we would have over one hundred quarts of pesto sauce. The next item would be tomatoes—big, juicy, ruby red, beefsteak tomatoes. It is hard to find big tomatoes in June, but by the end of July, August, and September, they are fantastic. Produce is a funny thing—when prices are high, selection and quality are low. When the price of produce comes down, the quantity, quality, and selection go up. These days Chef, Patrice, and I do the farm stand shopping. We like to keep it local. We shop at Werksheiser’s farm in Tannersville, The Farmers Basket in Stroudsburg, and Howells Farm Market in Newfoundland, and my backyard. I get the season started in late May. I have over 55 asparagus plants which are in their tenth year. That’s a lot of asparaguses, more than Patrice and I can eat. I bring the asparagus to Peppes, where we make prosciutto and asparagus bundles with aged provolone, asparagus in Bearnaise sauce over salmon Oscar, grilled lemon asparagus with herb crusted rack of lamb, and many more dishes though late spring and early summer. June brings fresh strawberries, peaches, mint, and basil. Butter crunch, red leaf, and romaine lettuces are also available. I like to use the mint, peaches and strawberries in different chutneys. The fresh lettuce is used for mixed greens with black mission figs, prosciutto, aged provolone, and our house-made raspberry vinaigrette. The sweetness of the figs and the savory saltiness of the prosciutto and provolone is a taste sensation.
Mid-summer brings beef steak tomatoes, sweet peppers, zucchinis, and cucumber. My options are endless when the tomatoes come in. One time honored favorite is Peppes phyllo pizza—seven layers of seasoned phyllo pastry dough topped with two thick slices of beef steak tomatoes with fresh basil and thin slices of fresh mozzarella— three minutes in our Earth Stone brick oven at 725 degrees brings Peppe’s phyllo pizza to perfection. August and September brings more of everything. The harvest comes in. This is truly the time of year when freshness, quantity, quality, and selection are at their peak! The sweet corn is sugar, and chef is busy with sweet corn polenta, sweet corn and red pepper relish, sweet ctorn fritters and of course sweet corn on the cob. As the nights get cooler and the days get shorter, the farm stand shopping turns to turnips, apples, butternut squash, and Brussel sprouts. The last of the summer harvest for us is when the local garlic is in. One of Peppe’s favorites is a whole clove of roasted elephant garlic. Chef roasts the garlic with extra virgin olive oil and Italian seasonings. We then serve the garlic with gorgonzola crostini. Just make sure everyone at your table gets a taste. It’s a sensation that needs to be shared (and that way no one will notice the garlic breath).

Pocono garlic farmers need a whole weekend to celebrate the harvest of the beautiful culinary must-have—garlic! Not forgetting what the festival is about, Chef Dan Rothman of Slow Food Pocono Mountains Chapter will be giving a cooking tutorial with garlic 101 and hosting the third annual cooking competition “garlic chopped”. If you didn’t get enough of the stinking rose, speakers including garlic farmer, Bob Dunkel, will both give daily informative lectures on growing garlic, garlic history and garlic health benefits. Don’t forget to bring plenty of mints, for the festival will feature the daily Pocono Garlic-Eating Contest each day at noon. Hosted under the “Big Tent,” twenty entries will have a minute to consume the most raw chopped garlic cloves. A panel of judges will determine the winner to be crowned the robust-breathed contest’s King/Queen of the 2016 Pocono Garlic Festival. Last years winner consumed 4.75 ounces of raw garlic. Continuing the tradition of supporting the local community, each year the Pocono Garlic Festival donates all the festival water sales to the Salvation Army of East Stroudsburg. In 2015 the festival donated $500 and to date have raised over $4,500 in funds for the non-profit.

Living the Sweet Life at callie’s candy kitchen
I
t’s truly a family affair at Callie’s Candy Kitchen. The Poconos institution, popular with locals and tourists alike, was founded in 1952 by Harry and Carol Callie, who were then just young newlyweds. Harry Callie became legendary for his candy-making demonstrations and his larger-than-life personality. Later, daughter Gretchen Callie Reisenwitz and husband Mark became involved in the business, and when Harry and Carol both passed away three years ago, took the reins. To honor her father’s memory, Gretchen opened the Callie’s Candy Museum in 2015, and it is now the first stop for the tour buses of visitors frequenting the area. “I wanted it to be educational, as well as to honor my dad,” says Gretchen. “It really tells the history of candymaking. There are antique candy molds and videos of the Enrober— the candy-making assembly machine like the one in the I Love Lucy episode—it’s really interesting!” In addition to the confections of the candy store is the Pretzel Factory, which was added in 1985 just south of the original shop. There the kids can enjoy a hands-on experience twisting fresh dough and watching the pretzels being made. If there is a southpaw in your life, be sure to visit the Left Hand Shop (owner Mark is a lefty), located within the pretzel store. Also not-to-be-missed is the holiday tradition of candy cane making—visitors can witness the process every weekend from Thanksgiving to Christmas at 2:00. ucked away from the main road, there is a 3,100 square foot home that sits beside the woods. Just off Sullivan Trail in Tannersville, this new construction by RW Buff is being transformed into a couple’s dream home. Owners Bud and Rhonda Bonser have decided it’s time for a new, low-maintenance, energy efficient house for their next steps in life together.
The exterior of the beautiful two-story home features a stone front that complements its wooded surroundings. Inside, the spacious living room features a stone fireplace and expansive vaulted ceilings with custom wood beams. Windows flanking the fireplace bring the outdoors in, with a view of the pond on property. It’s no wonder that this is Rhonda’s favorite spot.
The majority of Americans over the age of 45 want to continue living in a familiar environment throughout their maturing years. According to AARP, older homeowners prefer to age in place, which means living in their homes safely, independently and comfortably, regardless of age. Joe Holbert of RW Buff explained that for them, it is not just about the modifications of a home, but the complete design in general: “We are working with a mature clientele who have raised their families, many now having grandchildren, but are very active and want a new home that reflects their lifestyle and will allow them to enjoy life more. The gleaming white and granite counter kitchen opens up to the living room, and in the hallway is Rhonda’s must-have: a large pantry with a sliding wood door and LED lighting for visibility. In the couple’s master suite there are two sets of french doors leading out onto the front porch, where Rhonda says she will spend a lot of time sitting.
The Bonsers have lived together on Sullivan Trail since 1974. When it came time to build a home for the next phase in their lives, there was no question as to where it would be. Bud has spent his entire life in the area, and his 20 acres of land have been in the family for generations. The question of who would build on the property was one that the couple researched. RW Buff Construction was referred by friends and by their church, and once they met builder Joe Holbert, they knew they were in the right hands.
Additions to the original plan include the finished the basement for Bud’s “man-cave” and the “most adorable little cubbyhole” that Rhonda found in the attic space for her art studio. She smiles,“I still don’t feel like it’s mine. It’s like an episode of Home and Garden.” Bud and Rhonda Bonser said that after 40 years, it’s time to sell not only their original home, but the Pocono Ski business next door. Rhonda says, “If not now, when? I saved for my education, my children’s education, and now it’s just time to enjoy.” The couple moved into their new home this summer, beginning a new chapter in their lives. We think this next chapter may just be the best yet.

A stormy evening didn’t deter the 2nd Annual Concert in the Park, held on rain date Wednesday, June 24th and hosted by the Rotary Club of the Pocono Mountains at the former Barrett Elementary School. Blue skies prevailed as concert-goers enjoyed food and refreshments from the restaurants of Barrett and Paradise Townships. Regina Sayles & Erin McClelland entertained the crowds, as well as Stephanie Grace & Band, who delighted the children by singing and dancing with them on the lawn. The kids also enjoyed face painting and games. The Auxiliary of the Pocono Medical Center hosted its Annual June Luncheon on June 6th in the private dining room at Siamsa’s Irish Pub and Restaurant on Main Street in Stroudsburg. Nearly 40 guests were in attendance as Auxiliary President Rose Berardi welcomed all. Following the yearly reports that were presented by the Auxiliary board, Rose and Past President Edward DeFebo presented awards to three members of the Auxiliary. Paul and Judy Schuchman were the recipients of the Auxilian of the Year Award and Auxiliary Vice President Shawn Thoms received the Marilyn Naessig Award. The Board members presented Jeff Snyder, President and CEO of the Pocono Medical Center, with a check for $50,000. Mr. Snyder thanked all Auxilians for their dedication and volunteerism. This donation has officially completed the Auxiliary’s six year pledge of $500,000 to the new Dale and Frances Hughes Cancer Center of Pocono Medical Center. With the completion of their pledge, The Auxiliary will announce their next pledge by the end of the summer.

Through transparency, good faith and in a mutually respectful manner, all parties involved will decide the value of combined assets (i.e. family business or retirement assets) and how to divide them in a way that protects both parties. Collaborative Divorce goes beyond just winning.
When I am notified about a divorce, the first steps involve having empathy and making sure that the client knows that we will help them through the financial side of divorce. We mark the file so that everyone who may assist with the household is aware of the situation. When they are both my clients, which is more likely the case, I reach out to the other spouse and let them know that I am aware of the situation and answer any questions they may have. Many scenarios lead to the decision for a couple to decide to divorce, but they will need their financial advisor more than ever to help them navigate through the tough decisions. Simply splitting all assets down the middle does not always fit. When there is real estate, a pension benefit, an age disparity, or unique situations involved, putting together a game plan can save a lot of taxes, fees, and money in the end. HOW DO YOU HANDLE JOINT ACCOUNTS AND TRUSTS?
Joint accounts require that both owners sign forms electing to move assets to an alternate name or form. Additionally, joint accounts do not require legal documents to be split or retitled. I will caution that executing any change in joint accounts should occur after meeting with your attorney to fully understand the implications on a settlement. Often these types of assets can be used in the final stages to offset assets that are not as easy or not in best interest to split. For example: if it is agreed upon that one spouse retains ownership of the home, the alternate spouse may receive a larger portion of a joint investment account in lieu of payment. Trust accounts, on the other hand, will need an attorney to review the trust documents and discuss options with trustees and beneficiaries. HOW IS THE DIVISION OF ASSETS MANAGED? DO YOU RECOMMEND THAT SECURITIES BE SPLIT PURSUANT TO THE DIVORCE DECREE, OR LIQUIDATED AND DISTRIBUTED IN CASH?
Sometimes the division of assets are predetermined between the parties and their attorney without the advice of a financial advisor. We must comply with what the documents order, even if there is a way that would be more beneficial. When in this situation, I reach out to the attorney to point out issues with the agreement in hopes that we can work a better solution. An example would be receiving a notice to sell all assets and split the accounts into cash. The client plans for the assets after the split plays heavily in the recommendation of whether assets are sold or distributed in kind. For situations in which the goals, time horizon, and risk tolerance remain the same it is best to distribute in kind avoiding possible tax ramifications and new commissions or fees.
