Weld County Commissioners Present a Recommendation to Change the Use by Right of Oil & Gas Development in Weld County

by Bob Grand At last Tuesdays Weld County Planning Commission an unusual sight. All five Weld County Commissioners presented a proposed modification to the Weld County Code. Specifically to Chapter 23, Zoning Code, Section 23-3-20, dealing with the use by right definitions. It would delete 23-3-20-l and remove oil & gas production facilities as a use by right. Applications for oil & gas production facilities would be moved under Section-23-3-40 which defines Uses by Special Review falling under section 23-3-20-A-3. Having served on the Weld County Planning Commission for six years I would say this was highly unusual as the Planning Commissioners vote on issues or procedures and make recommendations, either for or against, to the County Commissioners for their final review and approval. So when all five Weld County Commissioners make this kind of recommendation it is making a statement. You have to ask why such a Weld County Commissioenrs at Planning Commission dramatic change? If you have been following the activities of the Colorado Oil & Gas Conservation Commission, including the recent Weld County Commissioners public meeting where, Executive Director Matt Lepore of the COGCC got into a rather heavy discussion with the Weld County Commissioners on who had the final say on local property rights regarding oil & gas facilities. Property rights are a fundamental issue in Weld County, all property rights. When you look at oil & gas, there are surface owners, royalty owners and oil & gas production companies. They all have rights. Basically what the COGCC is saying is that the state has the fundamental approval on how things are to be done. The County Commissioners maintain that, when it comes to property rights and land use authority, those are county responsibilities, not the state’s and certainly not the prerogative of the COGCC. What really stands out in this, if you cut through the rhetoric, is that politics is getting in the way public policy making. Weld County, so far this year of 2015, has produced over 89% of all the oil pumped in the state of Colorado. So why is it that counties that have had no meaningful drilling or production in the last few years, because a portion of their voters are against it, have so much impact at the COGCC. It is constituency politics at its worst. We are a nation of laws and if you bend one thing now, what is next? Black’s Law Dictionary defines take as “to take possession or control, whether legal or illegally “. By taking or restricting access to a basic property right there is supposed to be compensation to the party affected at fair market value. Let us stop dancing around the political correctness and have the courts decide. Our Colorado Attorney General should review this. The state and communities all around the state have their hand out for revenues generated by oil & gas development. Everyone has a right to their opinion, but you do not have the right to adversely affect your neighbor without fair compensation. All decisions have consequences, some unintended, but very real. Let us see what happens when the effect of a “taking” is calculated into real dollars. Again having an opinion is an American right, something that our veterans have defended over the years, many with their lives. Let us see how strong that opinion is if there are hundreds of millions of dollars in compensation on the table to be paid. I applaud the Commissioners for standing up for the property rights of Weld County Citizens. It is a travesty that our State Government is attempting to trample on them so callously in the name of the greater good.. Your comments are invited: publisher@lostcreekguide.com

Open House at Wiggins Town Hall for Local Citizens to Review New Development Home Options

Robbie Minor of Braessler Homes and Jay Stoner of Genesis Development held an open house at the Wiggins Town Hall from 11:00 am thru 7:00pm last Thursday to review the planned layout of the proposed new development and offered potential housing options. They solicited recommendations for a name for the new development from the citizens, as well as ideas on housing plan layouts. Light beverages were provided and turnout was good. Hudson & Keenesburg Changing Police Coverage for their Towns

Earlier in the year the Weld County Sheriff’s office announced a change to their pricing for smaller towns that they had previously contracted with to provide law enforcement services. The new cost structure was prohibitive. Hudson will have its own Town Marshall. Plans are to begin the first of the year with the Town Marshal and one assistant. The Town of Keenesburg is in discussions with the Town of Lochbuie police department to provide 21 hours of coverage per week. More information will be made available as the details develop.

Teenage Young Republicans Hold Certification Celebration in Fort Lupton

TARS held a formal celebration on receiving their national registration as a Young Republican Club. Present were club members led by President Cody LeBlanc, and their advisors, Colleen Heitman, Genevieve LeBlanc and Jane Miller. Also in attendance were many friends and supporters. Megan Miller and Cody LeBlanc were presented with pictures of them with U.S. Senator Cory Gardner when they attended the Morgan County Lincoln dinner earlier in the year. Homemade refreshments were provided along with hot chocolate. Just a delightful event.
