Membership Gives You a Platform

I

’m only a few months into my role as president of NCBA, but I’ve already had the chance to travel all across this great NCBA President country and meet Gary Voogt many of the cattle producers that make up NCBA. It’s been an incredible experience.

The diversity of cattle production in this country is a sight to see. One week I might be talking with a group of public lands ranchers in Idaho, and the next I’m sitting down with smaller operators from North Carolina. Some of the challenges of cattle production vary region by region. But a great many are universal to our industry, like private property rights, the Death Tax, and burdensome regulations.

Whether you’re faced with a local issue or one that affects all cattle producers, I know that many of you wonder how you can get involved.

By joining NCBA, you’ve already taken the first step. Membership in a national organization like this amplifies your voice so that your concerns can be heard by legislators in Washington, D.C. Hopefully you are also a member of NCBA’s affi liate organization in your state. We work closely with our affi liates to have a strong response to both state and national issues.

But there are other ways you can get involved. One of the biggest fallacies is that one person can’t make a difference in this country unless you have a lot of money or a lot of power.

run for re-election every two years.

They’re always in danger of losing their jobs, so they make sure to listen to their bosses — you. All you have to do is share your opinion. If enough people do that, they’ll be likely to vote your way.

Sometimes the political process can be overwhelming. There are so many bills and rules in development, it can be hard to track which ones matter most to you and your operation. NCBA simplifies that process for you by having our staff follow national legislation and policy and alerting you to the most important issues.

If you give us your e-mail address, we’ll send you a weekly newsletter with updates on the pressing issues of the day. We’ll also help you get in touch with your members of Congress. The level of your involvement is up to you. We can give you a phone number or an e-mail address to share your thoughts with a congressional staffer. We can give you some talking points to help start your conversation. We can even arrange meetings for you with your senators and representatives.

You can also get involved by persuading your neighbors to join your cause. Write a letter to the editor of your local paper. Call in to the farm broadcast on the radio.

Around NCBA Board Decisions Supported NCBA qualified voters agreed with the policy passed on Jan. 31 by members and the Policy Division Board of Directors at the NCBA Membership Meeting in Phoenix.

The 288 mail ballots that were returned by qualified NCBA voters were not enough to certify the mail ballot election. Even so, the voters agreed with the vote of the board

on every issue, usually with a 90%+ approval. The ballots were mailed with the March issue of National Cattlemen.

To certify an NCBA mail ballot election, there must be a 20% overall return with a 20% return from four of the seven NCBA regions. The results were tabulated by the accounting firm of EKS&H.

NCBA to Launch Center of Excellence for Beef NCBA will close its culinary center in Chicago and will launch a Center of Excellence for Beef in Denver in 2010. A committee of producers, state beef council staff and culinary experts researched location options and provided those to NCBA’s senior management. They determined the move to Denver made the best financial and business sense and brought the decision to the NCBA officers, who accepted the recommendation unanimously.

NCBA’s Executive Committee voted to support the recommendation as well.

In the Denver NCBA office, culinary services will become one of the foundation programs in NCBA’s Center of Excellence for Beef. The center will enable NCBA to enhance and leverage programs such as culinary services, beef innovations, producer education, market research

and product enhancement within NCBA and with its external partners.

The center will provide opportunities to leverage NCBA’s industry knowledge and expertise with the beef industry through cooperative research and ideation sessions, as well as training and education programs.

Texas continues to lead the nation in terms of total cattle inventory, beef cows, cattle-on-feed, and feeder cattle and calves. Kansas and Nebraska switched positions on this year’s Total Cattle list. The herd in Kansas declined by 350,000. None of the Top 10 grew.

Water Act Is Land Grab

CBA and the Public Lands Council are working to prevent passage of the Clean Water Restoration Act, a bill which would significantly expand federal jurisdiction over private farms and ranches. Currently, waters under the jurisdiction of the federal Clean Water Act are defined as “navigable waters of the United States.” Other waters are subject to regulation by individual states, which are better equipped to manage their own unique geographical concerns.

The Clean Water Restoration Act would remove the word “navigable” from the definition, expanding federal regulatory control to unprecedented levels. In addition, it would grant sweeping authority to regulate all “activities” affecting those waters.

“This bill is a dangerous infringement on private property rights and amounts to nothing less than a giant land grab on the part of the federal government,” says Tamara Thies, NCBA chief environmental counsel.

By placing all waters under federal control, any wet area could be subject to the strong-arm of the government.

“All waters are not equal in terms of their environmental function and value, and they should not be regulated the same,” Th ies explains.

“Whereas rivers and lakes that are important to interstate commerce are best regulated at a national level, small and intermittent waters are not.”

The Clean Water Restoration Act would give the federal government control over most wet areas, including things like road ditches, ponds,

drainage ditches, creek beds and mud holes. Farmers and ranchers could be required to obtain permits for common, everyday operations near these wet areas.

NCBA does not oppose efforts to keep our waters clean, but the Clean Water Restoration Act would actually hamper the government’s ability to maintain clean waters. It already is struggling to handle a backlog of 15,000 to 20,000 permit requests.

“When our resources are already stretched thin, it’s ridiculous to expand the government’s responsibility to mud holes and other wet areas with little to no environmental value to the public,” Thies says.

The Clean Water Act as written has increased and maintained the cleanliness of our waters, thanks to the strong partnership that exists between the federal and state governments. That allows states flexibility to manage their own land and water in a way that makes sense.

It also recognizes the rights of private property owners.

NCBA is working with members of Congress on both sides of the aisle and explaining to them how this bill would reduce our ability to keep our waters clean, and how it takes away from your right to manage your land.

NCBA also has been writing letters to the editor and doing interviews with reporters.

Those Pesky Congressional Terms When it comes to Congress, Washington tends to speak its own language.

We have terms and acronyms for every part of the Elizabeth Bostdorff legislative process.

And our terms are different than then ones used on the state level.

Almost every week I get questions about the terminology used on a bill. So here are a few of our most commonly used terms and what they mean. chamber: Congress is made up of two chambers – the House and the Senate. mark-up: This is the term used when a committee is voting on a bill. Prior to the mark-up, they will hold issue hearings (about the issue in general) to weigh the pros and cons of a whole issue, not just the subject matter in the bill. Then they will hold a legislative hearing at which they can “mark-up” bills. conference committee: A conference committee is the last step before a bill is sent to the president for his signature. Each chamber can make changes (amendments) to the bill as it is heard in their body. Once both chambers have passed the bill, the conference committee meets to iron out the differences between the House and Senate versions. This final version of the bill is again voted on by the House and Senate and then sent to the president for his signature or veto.

YOUR CAPITOL CONCERNS U.S.-EU Beef Trade Dispute Improves The U.S. Trade Representative (USTR) on May 6 announced a meaningful first step in the longstanding trade dispute between the United States and European Union (EU) over the use of growth promotants in cattle. NCBA has been working with the USTR on this issue for years.

“Once approved, this will be a positive step in our goal of expanding U.S. beef market access, but we still have a long way to go before this issue is resolved to our satisfaction,” says Gregg Doud, NCBA chief economist.

Under the current tariff-rate quota, the EU annually allows 11,500 metric tons of hormone-free, highquality, grain-fed beef imports from the United States. Upon approval, this new accommodation provides an additional 20,000 metric tons at zero duty. After three years, it will allow a total of 45,000 metric tons at zero duty.

If the agreement is not carried out satisfactorily, the United States reserves the right to reinstate carousel duties on EU exports. Since 1999, the World Trade Organization has approved the United States imposing $116.8 million in annual retaliatory tariffs on various European goods. The EU for 20 years has banned U.S. beef from cattle raised with growth-promoting hormones despite Food and Drug Administration testing, as well as EU studies, that have proven the beef is safe.

EPA Finding Poses Threat A recent Environmental Protection Agency finding says that greenhouse gas emissions endanger public health and welfare. This is the first step in a process that could require greenhouse gas regulation under the Clean Air Act and greatly impact livestock producers, as methane is a greenhouse gas.

“The Clean Air Act is not equipped to address global climate

change,” explains NCBA Chief Environmental Counsel Tamara Thies.

“Congress never intended to regulate greenhouse gas emissions under the Clean Air Act, and any attempt to use it for this purpose would devastate the U.S. economy.”

If the Administration and Congress decide to regulate greenhouse gases, a cap-and-trade program would be more appropriate, rather than the Clean Air Act’s command-and-control regulatory program.

“Regulating greenhouse gases should be thoughtfully considered and voted on by Congress,” says Thies. “Allowing the EPA to regulate greenhouse gas emissions under the Clean Air Act would impose untenable burdens, expenses and restrictions on industry, families, and our nation.”

Last year USDA estimated that even very small operations would meet the 100 tons per year emissions threshold to require regulation.

Dairy facilities with 25+ cows, beef cattle operations with 50+ cattle, swine operations with 200+ hogs, and farms with over 500 acres of corn may need to get a Title V permit.

“America has over 2 million farms.

It would be virtually impossible to permit a majority of them,” says Thies. “Plus, most ag producers simply would not be able to afford the regulatory compliance costs and would be forced out of business.”

According to the EPA, in 2006 greenhouse gas emissions from the entire agriculture sector represented 6.4% of total U.S. greenhouse gas emissions in teragrams CO2 equivalent. (A teragram is equal to a million metric tons). At the same time, land use, land use change, and forestry activities resulted in a net carbon soil sequestration of approximately 14.8% of total U.S. CO2 emissions, or 12.5% of total U.S. greenhouse gas emissions. This means that agriculture provides a net benefit to the climate change equation.

NCBA will submit comments to EPA during the public comment period.

USDA Extends Certain CRP Contracts USDA Secretary Tom Vilsack on May 1 said that USDA will extend certain Conservation Reserve Program contracts expiring this September. Sign-up for an extension runs through June 30. Producers can apply for an extension at the local Farm Service Agency county office.

U.S. Beef Trade with China NCBA is urging Congress to strip a provision from the 2010 agriculture appropriations that effectively bans imports of some Chinese chicken products. The provision was included in the recently passed 2009 Omnibus Appropriations Act and has prompted China to request a World Trade Organization consultation.

China has been closed to U.S. beef exports since the December 2003 BSE detection. NCBA is concerned that the chicken dispute will impede efforts to open up China to U.S. beef.

NAIS Privacy Ruling A federal court has ruled that records collected under the National Animal Identification System (NAIS) will be protected by the U.S. Privacy Act, meaning they will be exempt from disclosure under the Freedom of Information Act (FOIA).

This is a positive decision for producers’ privacy rights under NAIS, because sensitive information about their premises, businesses, and animals will be shielded from public release.

However, NCBA remains concerned that any system fully contained under the umbrella of the federal government risks producer privacy, whether through FOIA requests or accidental release of sensitive information.

YOUR CAPITOL CONCERNS NCBA favors a voluntary adoption of individual animal identification programs that support genetic improvement, source verification, and disease surveillance. The private sector should have a role in providing ID solutions that fit the varying needs of America’s cattle producers.

Under a private sector plan, state and federal government officials would be provided with adequate information to improve the nation’s animal health surveillance systems.

NCBA Continues Call for Death Tax Reform U.S. House and Senate conferees stripped an important provision from the fiscal 2010 Budget Resolution. The provision — sponsored by Senators Blanche Lincoln of Arkansas and Jon Kyl of Arizona — passed as an amendment during Senate consideration of the Budget Resolution. The amendment provided for further estate tax reform within the budget but did not have the force of law.

The Lincoln-Kyl budget amendment would have raised the Death Tax exemption to $5 million per individual and $10 million per couple, indexed for inflation, at a reduced rate of 35%. Instead, under the budget conference report, the tax will be frozen at its current levels ($3.5 million exemption at a 45% rate) through 2010, and allowed to revert to its pre-2001 levels (55% of estates worth more than $1 million) in 2011, unless Congress takes further action.

Although the budget resolution is nonbinding, when it comes time for debate on tax legislation, it is an important win for NCBA to have senators who voted for the Lincoln-Kyl amendment on record supporting relief from the death Tax.

Public Lands Council: Key ESA Provision Overturned Secretary of the Interior Ken Salazar and Secretary of Commerce Gary Locke on April 28 announced

that the two agencies were overturning the Endangered Species Act (ESA) regulation — passed during the previous Administration (December 2008) — regarding consultations for possible listing of species. NCBA and the Public Lands Council are disappointed as this key rule would have made the consultation process more efficient.

Under the overturned regulation, proposed federal actions that are determined to have no effect on a species listed under the ESA would no longer be required to be approved through consultation with the Fish and Wildlife Service.

In a positive move on the ESA, Secretary Salazar did elect to continue implementing the section 4(d) special rule, which concerns listing the polar bear as a threatened species. The ESA and listing of the polar bear are not appropriate vehicles for regulating greenhouse gas emissions and PLC is pleased that the government recognized that and acted accordingly.

Public Lands Council:

Horse and Burro Provisions Set Dangerous Precedent

T

he Public Lands Council on April 29 sent a letter to the House Committee on Natural Resources opposing H.R. 1018, also known as the Restoring Our American Mustangs (ROAM) Act. The bill radically overturns longstanding management of public lands.

The ROAM Act would prohibit any access to lands designated as horse sanctuaries. It authorizes the

secretary to designate additional range on public lands as sanctuaries exclusively for horses following consultation with the wildlife agency of the affected state. Multiple use would be displaced in these newly designated areas. Excess animals can’t be removed by destruction or sale and the bill makes the adoption process time consuming.

It also makes any transportation for processing criminal.

H.R. 1018 bars the use of helicopters or any other airborne device to gather horses, and horses can’t be kept in holding facilities for more than 6 months. This departs from the period of time BLM often is forced to keep horses in holding facilities.

Much of the range is overpopulated with little demand for adoption. It is inhumane to allow overpopulation on designated range.
