BELGIUM : NEW new law Camera legislation Context: The existing cameras law (21/3/2018) provides that for places that pose a security risk 1. It is allowed to direct the surveillance camera (s) to the perimeter directly surrounding the location 2. Images can be kept for up to three months instead of one 3. The images can be transmitted in real time to the police ( providing there is an agreement between the police department concerned and you) New legislation : the list of places that pose a security risk is determined by royal decree as from 18/12/2018* link Application Places determined by the royal decree* posing a security risk are as follows: • airports open to commercial traffic • railway stations • nuclear sites • military domains • prisons • international institutions or embassies determined by the King pursuant to article 137 of the law of 2 October 2017 regulating private and private security • the port installations referred to in article 5, 6 ° and 7 ° of the law of 5 February 2007 on maritime security • SEVEZO establishments • other places determined by the King pursuant to article 138 of the law of 2 October 2017 regulating private and private security • the National Bank of Belgium • Money counting centers within the meaning of Article 2, 20 °, of the Law of 2 October 2017 regulating private and particular security How to proceed ? 1. Before being able to direct surveillance cameras to the perimeter of these places, you will have to obtain a positive opinion from the communal council of the municipality concerned as to the demarcation of the perimeter. 2. Only the places mentioned above can keep mages for up to three months instead of one 3. Transmitting images in real time to the police can only be done for the following list of places, and providing there is an agreement between the police department concerned and you ▪ airports open to commercial traffic ▪ international institutions or embassies determined by the King pursuant to article 137 of the law of 2 October 2017 regulating private and private security ▪ the port installations referred to in article 5, 6 ° and 7 ° of the law of 5 February 2007 on maritime security ▪ places where events of a cultural, social, festive, folkloric, commercial or sporting nature, where the public is present, are organized as mass gatherings within the meaning of Article 22 of the Police Function Act
