MOVE-IN PROCEEDURE S 6


The following will outline the move-in procedures established for Manhattan View.

MANHATTAN VIEW CONDO ADMINISTRATOR

Once a purchaser has closed on a condominium at Manhattan View, the Condominium Owner will be contacted by the Condo Administrator. This person will be available to assist you with the move-in process. MOVE-IN PROCEDURES

In order to facilitate your arrival, Condominium Owners will move into Manhattan View on a prearranged basis, coordinated through the Condo Administrator Assistant, who may be reached at (646) 625-7735. When arranging your move-in date and time, please provide us with your moving company’s name, telephone number, and email a copy of their Certificate of Insurance to MahattanViewAdmin@related.com. Please see Exhibit VII for Manhattan View’s vendor insurance requirements.

NEW OWNER ORIENTATION

On the day of your move-in, please visits the management office located on the MC Floor. Please allow 15-30 minutes for us to conduct a short Owner Orientation. During this time you will meet our Management Team, enroll in M Club, sign up for automatic payment and receive Key-Fobs for your new home. We look forward to meeting you.

LOCATION

Move-ins will occur through the service entrance, which is located on 41st Street between Dyer Avenue and Tenth Avenue. The use of the service entrance is mandatory for all deliveries and moveins. The loading dock is available on a first- come- first served basis, we advise all movers to have one personnel remain with their vehicle throughout the duration of the move to prevent any possible tickets/ violations in case the loading dock is in use .

DAMAGE MITIGATION

To protect your belongings, as well as the building’s common areas, moving companies must protect all common areas from damage. Please be reminded that Condominium Owners are responsible for any damages incurred during their Movein. Before moving in, please fill out a “Move-In Date & Corridor Inspection Form” (see attached Exhibit I). The form is also available at Manhattan View Concierge Desk or from the Resident Manager.

REFUSE DISPOSAL

Please be reminded that your moving company is responsible for removing the boxes and refuse resulting from your movein. Small items may be placed in the refuse room located on each floor. If you do place small items in the refuse room, please notify the front desk to coordinate their removal. Please do not put any items into the trash chute unless it is regular refuse.

CONDOMINIUM ALTERATION GU IDELINE S 8


As a Condominium Owner of Manhattan View, please be reminded of certain requirements that must be satisfied prior to the commencement of any improvements or modifications in your home. All alterations are subject to the review and approval of the Board.

ALTERATION APPROVAL INSTRUCTIONS 1. Review and become familiar with the terms and conditions of the Alteration Agreement (available by contacting the management office) and the Condominium By-Laws. 2. Submit a proposed scope of work and (3) sets of complete plans and specifications prepared by a licensed architect and/or engineer. The plans should be submitted to: ManhattanViewAdmin@related.com 3. Prepare to submit (prior to Board approval) all requirements note in the Alteration Agreement, including but not limited to: •Architect and/or engineer’s letter certifying to the Board (a) that the electrical loads required as a result of Condominium Owner’s work will not be in excess of the present electrical capacity of the condominium and will not adversely affect the Building’s electrical service, and (b) whether Condominium Owner’s work will require an amended Certificate of Occupancy for the building. •List of names, addresses, and principals of every contractor retained by Condominium Owner and of every subcontractor retained by any such contractor. •Certificates of Insurance from each contractor and subcontractor as per the terms of the Alteration Agreement. •A cash security as designated by the Board in the Alteration Agreement. 4. Owner will be notified of additional information, revisions, or filings with governmental agencies that will be required for approval of the Alteration Application. 5. Resubmit, if necessary, all revisions. 6. If the alterations are acceptable, the Owner will receive one copy of the alteration agreement to be signed and returned for Board approval. The Board will approve the Alteration Agreement, and a counter- signed copy of the Alteration Agreement will be returned to the Owner. 7. Work may then be performed in the condominium in accordance with all provisions of the Alteration Agreement. 8. Upon completion of the work, the Condominium Owner shall obtain all inspections, file all necessary notices and certifications with the applicable governmental agencies, and submit to the Board: copies of all inspections, notices and certifications; a certificate of completion from the Condominium Owner’s architect or engineer; a waiver of lien from Condominium Owner’s general contractor; one full set of reproducible as- built drawings; and all other requirements as outlined in the Alteration Agreement. Please Note: An alteration deposit and an alteration management fee will be required to process the Alteration Application. Re- submissions may be subject to additional charges. The deposit does not include architectural or engineering review costs or reproduction costs of existing architectural drawings or plans; the costs of additional security or other costs associated with assuring appropriate conditions are maintained in the building for other residents during your alteration will be charged to the Condominium Owner

REFUSE DISPOSAL DURING CONSTRUCTION

Each Condominium Owner is responsible for the proper removal of trash and materials from renovations and/or alterations. Materials cannot be stored in common areas. Under no circumstances should construction-related debris be placed in the refuse chute, as it has been designed to accommodate household refuse only. This means that a private container must be obtained and used to remove such debris from the premises. The New York City Department of Sanitation is not required to remove construction debris from the building, and; therefore, we will not permit contractors to place such debris on the premises. Please contact the Resident Manager’s Office for more information regarding construction disposal removal. Any and all costs incurred by the Condominium for improper disposal of materials are the responsibility of the Condominium Owner.

ELEVATOR USE

Before allowing your contractor or delivery person to proceed to the service elevator, building staff will ask that they sign in, obtain passes, and verify that they have obtained the proper approvals as per the Alteration Agreement. All construction personnel, materials and tools are required to be transported in the service elevator designated for this use. We are not able to offer exclusive use of the elevators to Condominium Owners due to other alterations and move-ins that may be occurring at the same time. Please call the management office at (646) 625-7735 no less than 72 hours in advance for scheduling the use of the elevator.

LABOR HARMONY

All contractors or subcontractors working in the building must have a Certificate of Insurance on file with the management office as detailed in the Alteration Agreement. All contractors’ personnel may only enter and exit the building through the service entrance located on 41st Street between Dyer Avenue and 10th Avenue. The service entrance may only use the designated service elevator during the hours assigned. Contractors’ personnel may never enter the main lobby, other condominiums, or floors. The building’s management reserves the right to stop work and remove any contractors if they do not adhere to all rules and regulations in this reference guide, the By-Laws, and the Alteration Agreement. Hours of Operation: Monday- Friday 9am-5pm

BUILDING PERMITS

It is the responsibility of the Condominium Owner to obtain the necessary permits and to ensure compliance with all local building codes. You will be required to submit a copy of your permit(s) before commencing construction. Your design professional should help you determine where permits are required.

DAMAGE MITIGATION

Contractors working in an individual condominium on a particular floor must place “masonite” board protection on the common corridor carpeting of the entire floor as a result of your alteration. Any additional cleaning required by building staff to maintain common area standards will be charged to your account. Building maintenance staff may be available to assist you in protecting the corridors. Please contact the Resident Manager in advance to arrange assistance. When work is being performed in a condominium, the Condominium Owner will be responsible for any damages caused to the corridors, service entrance, stairways, and elevators during construction. It is expected that the Condominium Owner will either be present while contractors are working in the condominium, or will be represented by a competent supervisor. This will ensure that building Rules and Regulations are followed, and that common areas of the building are protected. Upon final completion of a contractor’s work and removal of the corridor’s protection, the Resident Manager or his representative will perform an inspection of the public areas with you or a designated representative. This inspection will ascertain that no damage has occurred, and that all areas have been cleaned and restored to their original condition

CONDOMINIUM KEY-FOB PROCEDURES

Upon moving into your condominium you will be issued a total of six key-fobs per household. In addition to accessing your condominium, the key-fobs are programmed to allow access from the garage and service entrance. A secure, locked key box is stationed behind the concierge desk, which houses a duplicate key-fob to all condominiums within the building. You and your authorized guests/service providers will have access to them with your signed authorization. It will also allow us, with your permission, to respond in a timely manner to your service requests while you are away from the building. It is critical that all key-fobs signed out at the front desk be returned to the desk no later than a 24hr timeframe to ensure you will have a key-fob available for you and/or your guest/vendor for the next time. In addition, we will not be able to perform service requests for you while you are gone if a key-fob is not left for our staff in the key box. You may also leave an extra key-fob in the key box on a short-term basis. We only ask that you pick the key up the same day it is left with us. If you or a guest are locked out of your condominium and our staff must perform a lock out because the spare key-fob was not returned to the key box, your account will be assessed a lock out fee. Lock Out Fee: 7am-3pm- $10 3pm-11pm-$30 11pm-7am-$50

VENDOR ADMITTANCE

If you are performing an alteration, as per your Alteration Agreement, you will be responsible for providing access to vendors. The building staff will not issue condominium key-fobs to vendors. If specific arrangements have not been made, or the name of the individual or the company does not appear on the list that you have relayed to the building manager, and you cannot be reached, your visitor will not be allowed to enter the building. These procedures are necessary in order to maintain an orderly and appropriate environment for all residents. With your cooperation and the capable assistance of our staff, we hope to avoid admittance problems.

CONDOMINIUM ACCESS CONTROL 1. No visitors shall be permitted into the building unless they have been announced by the concierge desk. If you are not at home, and a guest arrives seeking access, your guest will not be allowed up to your condominium unless you have given us written instructions to allow their access. 2. ALWAYS use the “peephole� before opening your door. 3. Your condominium has door locks and security latches for your security and privacy. You are advised to use these locks at all times. 4. You are required to provide the Resident Manager with a set of keys if you add special locks to your condominium door. (Additional locks become a permanent fixture of the door.) The locks must be approved by the management office prior to installation. 5. Concierge will contact you on your intercom or home number to announce all guests. 6. The building will not provide lock out service or issue a key-fob for anyone without your prior written permission. 7. Soliciting is NOT ALLOWED on the premises. 8. Under no circumstances will entry to your condominium be provided to delivery or service persons without prior written notice from you. 9. If you note any suspicious behavior, please call 911 and contact the concierge desk immediately. 12

E-SERVICES AND MANHATTAN VIEW RESIDENT WEB SITE

Manhattan View’s condo Web site and E-services enable you to handle a number of day-to-day activities electronically, including tracking service requests, accessing messages from building staff, submitting guest authorizations, and receiving notification of package deliveries. You can also keep track of building notices and packages on electronic message boards in the mailroom. The condo web site also lets you pay your common charges and view your account information online, check out building amenities and technology options, offer feedback, and read important announcements. Everything you need to know about your building and your account is accessible at this private space on the Internet whenever you need it. In order to access the condo web site, please visit www.Condocafe.com with your user name and password, which will be emailed or mailed to you shortly after closing. Once you login at the site, you must change your login information. Please contact your Condo Administrator with any questions.

IPAD INTERCOM SERVICES

The iPad Intercom close to your door entry is a convenient way for you to communicate with the concierge team at the front desk. If you have a delivery or a guest, the concierge team will call you at your unit via the iPad to give you proper alert. It is also a great way to communicate with your Luxury AttachĂŠ concierge service. Please note that the iPad functions must be enabled with Wi-Fi service.

ELECTRIC SERVICE

No need to contact Con Edison for your electric, the condominium is sub metered, so we will add the electric bill to your common charges.

HEAT AND HOT WATER

Gas for cooking and heating hot water are included in the monthly Common Charges. The heat pump units in each condominium utilize Hot water provided by the building to heat the condominium. The unit in each condominium is powered by the condominium electric, and this consumption will be reflected on your monthly Con Ed electric bill. Please be reminded that if you are away from your condominium for any length of time in winter, each condominium thermostat unit should be set to a heating position to prevent any issues in your unit relating to the cold weather.

AIR CONDITIONING

The HVAC units in each condominium provide cooling capacity for each condominium via the internal compressor and fan unit. The electricity consumed by each component is supplied by the condominium electric and will be reflected on your monthly account statement. Please be reminded that if you are away from your condominium for any length of time in summer, each condominium cooling unit should be set to a cooling position to prevent any heat- and humidity-related issues. Each HVAC unit is capable of providing air conditioning year round, even when the building steam is on in winter

Manhattan View is managed on behalf of Manhattan View Condominium by Related Management (the “Management Company”), an affiliate of Related. DOORMAN

At times, the doorman may not be readily visible at the front entrance. The doorman may leave his post because of: Breaks: In addition to taking a lunch break, the doorman covers the concierge desk while the concierge is having lunch. Please understand that under no circumstances is the doorman at the concierge desk allowed to leave his post. Hailing cabs: The doorman may have to walk as far as a block away to secure cabs for residents. We appreciate your patience and understanding when the doorman is not immediately available to assist you.

MAINTENANCE STAFF

Maintenance staff is available to provide for the maintenance and repair of all common areas and mechanical systems of the building. If you require assistance in locating service providers to perform work in your condominium, please contact the Resident Manager, who will gladly assist you in finding such service providers in the nearby community. Condominium repairs, including HVAC and appliance repairs, are the responsibility of the Condominium Owners. Though you may arrange with the building staff to perform repairs or work in your condominium, they are prohibited from performing this work during their regular work hours. Any work performed by our staff in your condominium per your request is subject to all the rules and regulations specified in this Reference Guide, the By-Laws and the Alteration Agreement. Related Management will not be held responsible for any problems that may arise from this work. Please note that the staff is not covered by Related Management’s Workers Compensation policy, or other insurance, when providing services in your condominium by private arrangement. Workers will be subject to vendor insurance requirements for work performed on your behalf. Owners are responsible for any repairs or alterations to their condominium. However, our maintenance staff is available to assist in minor repairs in your condominium during their normal working shifts. If the work can be completed in less than 30 minutes and is in compliance with the approved Manhattan View budget, the cost of repairs will be covered by the Condo Board. Please contact the Condo Administrator for more information regarding minor repairs services. To report and schedule repair service, please contact the concierge desk. They will fill out a service request for your repair and schedule staff to perform the work. Owners will be responsible to provide access to the staff.

STAFF GRATUITIES

Gratuities for day-to-day building operations are not required or expected to be provided to the building staff. If you would like to acknowledge staff efforts for exceptional service provided during the year, you are welcome to do so either individually or collectively during the holiday season. Collective gratuities will be divided equally among staff members.

“M Club” is defined as the facility on the MC floor of the building located at 450/460 West 42nd street, New York, NY 10036. Guests cannot be left unattended inside of the M Club for any reason at any point in time. *Smoking is prohibited anywhere in the building, including M Club and the outdoor terraces*

Designed to seamlessly integrate fitness, relaxation, and wellness into your daily life, Equinox at M Club offers Manhattan View residents access to extraordinary fitness and spa facilities as well as special membership opportunities. Amenities include a Lap Pool and Sauna, Locker and Steam Rooms, Group Fitness Classes and Equinox Tier 3 Personal Trainers. Towels are provided. THE EQUINOX FITNESS CLUB AND M CLUB MEMBERSHIPS

Unit Owners who live at Manhattan View receive a complimentary membership to the Equinox at M Club at 42nd and 10th Avenue. The memberships are not transferable to other Equinox locations outside of 42nd and 10th Avenue. Residents have direct interior access to the M Club through a private entrance located on the MC Floor 450/460 West 42nd street. To activate your unit’s membership(s), please contact the onsite Condo Administrator located in Management Office on the MC Floor or call (646) 625-7735.

TECH LOUNGE

MAXIUM CAPACITY: 20 OCCUPANTS The Tech Lounge is reserved for M Club members and is located on the building’s 3rd floor. The Tech Lounge is equipped with a fax machine, a copier and a computer with high-speed Internet access. SMOKE AND CARBON MONOXIDE DETECTORS

Your home is installed with 2nd Generation Nest Protect, which uses its light ring and voice messenger to help you better understand what’s going on in your home. You’ll see the detector light up and have a voice messenger during setup or when smoke/ carbon monoxide is detected in your home. The detector will also notify you when batteries need to be changed. 1Nest Protect speaks and lights up so you don’t have to guess what it’s trying to tell you. With the Nest App you’ll receive an alert on your phone or tablet. Alerts will also be saved in the Nest app in messages. WINDOW GUARDS

No window guards or window stops shall be removed from windows. Each Manhattan View Owner shall notify the Management Agent in writing when a child or children under the age of eleven years lives or resides (even temporarily) in the Manhattan View. Each Manhattan View Owner shall install, at such Unit Owner’s expense, the legally required in all window guards of the Manhattan View. The Owner shall maintain all window guards installed in the Unit and shall not remove same until permitted by applicable Legal Requirements and in any event, without full knowledge of the Managing Agent.

BATHTUB

The tub should not be cleaned with abrasive cleaners. Use products such as Soft Scrub by Clorox, Spic and Span, Citra Solv Cleaner/Degreaser (concentrated or pre-diluted all-purpose cleaner spray), 7th Generation Tub & Tile Cleaner, Fantastik or Lysol Tub & Tile Cleaner. Use a sponge or nylon bristle brush to clean your bathtub to prevent abrasions to the surface.

WOOD FLOOR CARE

As with all hardwood flooring, it is important to properly clean and maintain wood floors to prevent substances, including but not limited to water, food and grease, from making the floor slippery. Please vacuum, sweep, or dust mop regularly. Never wet mop with water, as it may permanently damage the floor. Use a wood floor cleaner such as Bona® Swedish Formula® Hardwood Floor Cleaner from BonaKemi USA, as per product directions. Area rugs should be slip-resistant with a backing that will not discolor the floor. Please use floor protectors under heavy furniture to help reduce the risk of indentation by distributing weight properly and to help prevent scrapes and scratches when moving furniture. For additional care information, please consult the manufacturer’s recommended care instructions

REFUSE DISPOSAL and RECYCLING

All refuse, with the exception of recyclable materials, which must be placed in recyclable containers, may be placed in the trash chute located on each residential floor. Items too large to be placed in the trash chute can be placed on the floor of the trash chute room and will be picked up on a daily basis by the building staff. Please do not dispose of bulky items via the chute as it may cause blockage.

PEST CONTROL SERVICE

A pest control technician will be in the building to service the common areas once a month, and on an “as needed” basis. Condominium Owners can make individual arrangements with the technician through the concierge. If you suspect Bedbugs in your apartment, please notify the management office immediately for further instructions.

WHILE YOU ARE AWAY

Be sure to cancel your newspaper delivery and arrange for your mail to be held by the post office. Make sure all appliances except the refrigerator are turned off and unplugged.

INSURANCE

Owners are required to maintain comprehensive personal liability and “all-risk” property insurance for their unit. All of your personal property, such as clothing, furniture, jewelry, and items considered part of your condominium (appliances, heating and cooling unit, floors, fixtures, etc.) must be covered by your own homeowner’s insurance policy. Manhattan View Condominium Board and the managing agent, Related Management, are not liable for any theft, loss, or damage to such property. Please contact your insurance broker to make appropriate arrangements. See Exhibit VIII Homeowners Insurance Requirements. If an owner decides to rent their unit, it is the owner’s responsibility to ensure their renter obtains comprehensive renter’s insurance. COMMON CHARGES

If you have an emergency, please reach them by calling 911. If you would like to reach them for a non-emergency, call (212) 741-8211. IF YOU DISCOVER A FIRE, PLEASE: 1. Phone 911 on your outside phone. (This will connect you to fire, police and ambulance); and 2. Call the concierge desk on the house phone immediately thereafter.

IF THE FIRE IS IN YOUR CONDOMINIUM:

1. Get everyone out. Stay low as you go out. Close, but don’t lock, all doors in the condominium as you leave. 2. Go down the nearest STAIRWAY, holding the railing. 3. Call the Fire Department from a floor BELOW THE FIRE or from a street fire alarm box outside.

IF THE FIRE IS IN NOT IN YOUR CONDOMINIUM:

1. Stay inside rather than entering a smoke-filled hallway, especially if the fire is above your condominium. 2. Keep your door closed. 3. Seal the door with duct tape or wet sheets and towels. Seal ventilators and any other openings where smoke may enter. 4. Turn off air conditioners. 5. Fill your bathtub with water. If the front door gets hot, wet it down. 6. Unless flames and smoke are coming from below, open your windows a few inches at the top or bottom. Don’t break the windows; they may need to be closed. 7. NO SMOKING IN ELEVATORS OR CORRIDORS

New York City law prohibits smoking in passenger and service elevators. For the convenience and comfort of building residents and visitors, we ask that you refrain from smoking in all public areas. Public corridors have a sophisticated fire detection system, and it is possible that smoking may inadvertently set it off. EXHIBIT III MANUFACTURER’S RECOMMENDATIONS FOR PROPER CARE OF YOUR FLOORS

To keep your floor in good condition, it is important to protect it from its four main enemies: abrasives, pressure, water and light:

Abrasives

To protect your floor against premature wear: Place felt pads under chairs and furniture legs. Ensure that the pads are kept clean and in good condition. Sweep and vacuum the floor regularly to remove all sand and other abrasives. Placing an indoor carpet or mat at each door with exterior access will help keep gritty dirt from getting tracked through the house.

Pressure

To avoid marks on the floor: Protect the floor when moving heavy furniture such as a refrigerator. Use specially designed glides or slide the furniture on a piece of upside-down carpet. For furniture and chairs with castors, use only castors designed for hard surfaces (wide rubber). Avoid hard ones made of plastic or wood. When using furniture with wheels, the floor must be protected by using mats. Watch for high heels, a dangerous enemy for any type of floor covering. Broken or worn heels can even damage a cement floor! If you have pets, keep their paws well-trimmed.

Water

To reduce the risks of floorboard movement due to water damage: Keep relative humidity levels in your home between 40% and 55%. In summer, when the air is humid, keep rooms well ventilated and use a dehumidifier if necessary. In winter when heating dries out the air, use a humidifier. Wash floors with a damp mop. Immediately remove liquids spilled on the floor. Avoid indoor rugs with undersides made of rubber or any other material that prevents air from circulating properly beneath the rug. Be sure to place leak-proof saucers under your potted plants.

Light

To reduce discoloration from UV rays: Move rugs and furniture from time to time so that the same sections of floor are not permanently exposed to intense light.

It is our goal to maintain the highest quality living environment for our owners. To help achieve this goal, it is important to work together to minimize the potential for conditions that could lead to the growth of naturally occurring mold.

Tips for Owners

Owners can help minimize mold growth in their condominium homes by taking the following actions: Open windows. Proper ventilation is essential. If it is not possible to open windows, run the fan on the condominium airhandling unit to circulate fresh air throughout your condominium. In damp or rainy weather conditions, keep windows and doors closed. Periodically clean and dry the walls and floors around the sink, bathtub, shower, toilets, windows, and patio doors using a common household disinfecting cleaner. On a regular basis, wipe down and dry areas where moisture sometimes accumulates, like countertops, windows, and windowsills. Use care when watering houseplants. If spills occur, dry up excess water immediately. Ensure that your clothes dryer vent is operating properly, and clean the lint screen after every use. When washing clothes in warm or hot water, watch to make sure condensation does not build up within the washer and dryer closet; if condensation does accumulate, dry with a fan or towel. Thoroughly dry any spills on carpeting. Do not overfill closets or storage areas. Ventilation is important in these spaces. Do not allow damp or moist stacks of clothes or other cloth materials to lie in piles for an extended period of time. Immediately report to the Resident Manager any evidence of a water leak or excessive moisture in your condominium, storage room, garage, or any common area. Immediately report to the Resident Manager any evidence of mold growth that cannot be removed by simply applying a common household cleaner and wiping the area. Also report any area of mold that reappears despite regular cleaning. Immediately report to the Resident Manager any failure or malfunction with your heating, ventilation, air-conditioning system, or laundry system. Do not block or cover any of the heating, ventilation, or air-conditioning ducts in your condominium. Immediately report to the Resident Manager any inoperable windows or doors. EXHIBIT VIII: INSURANCE FREQUENTLY ASKED QUESTIONS

What is the minimum amount of coverage required by Manhattan View for homeowner’s insurance? Per the Offering Plan for the building, all unit owners are required to obtain and maintain comprehensive general insurance against claims for personal injury, death or property damage of at least $1,000,000 per occurrence, plus at least $3,000,000 umbrella liability coverage. Unit owners are also required to carry property insurance for damage to property and contents within their unit. What should the property insurance portion of the policy cover? The policy should cover all the improvements and betterments of your unit (everything that is not part of the common elements), including, but not limited to fixtures, appliances, finishes, HVAC equipment and all personal property. You and your insurance broker need to determine what the appropriate insurable value should be. If any improvements or alterations are made to your apartment, you should consult with your insurance broker to determine if the policy limits need to be adjusted. What does the Liability portion of the policy cover? If someone is injured in your unit or you cause damage to another unit owner’s property. What does the Umbrella Liability portion of the policy cover? This would cover a large liability claim covered by the general liability insurance and that exceeds the policy limit of the general liability insurance. What happens in the event of a property loss? In the event of a loss, you will need to formally notify both the management company and your insurance carrier. Your carrier will be responsible to process the claim, In all cases it is up to each insured party to look to their own insurance company regardless of fault. In the event that I sub lease my unit, does the building require the tenant to obtain Renter’s Insurance? Although the building does not mandate tenants obtain renters insurance, requiring your tenant to have renters insurance is strongly recommended for your protection. Amenity Rental Agreement Resident’s Responsibilities Resident is responsible for the private amenity space and its contents from the time of access key pick-up until the access key is returned to either the Concierge desk. C) All resident guests must comply with all rules governing the use of the common areas and M Club as set forth in the Lease and/or Owner’s House Rules and Regulations and the M Club Membership agreement. Guests are permitted only within the amenity space reserved and are not permitted to enter the M Club at any time unescorted. Guests are not permitted to use Equinox at M Club while attending a private event. D) No live or excessively loud music is permitted in the private amenity space and/or outdoor terrace, if applicable. E) Children under the age of 18 must be under adult supervision at all times F) Use of candles, glitter, and confetti is strictly prohibited. G) Smoking is not permitted in any common areas of the building, including outdoor area. Violation of this guideline may result in the immediate termination of your event. OPTION 1: Complimentary Membership

Use of M Club is considered an ancillary service and this service does not fall under Rent Stabilization Guidelines. Member understands that the preferential membership fee granted during this membership term is temporary and solely for this lease term. If Member chooses to enroll in automatic monthly billing, the fee will be debited on the first day of each month except if the first day falls on a weekend or holiday. It is understood and agreed that Member will not be entitles to any reimbursement of the membership fee or be granted 47


an extension of the membership term as a result of closing M Club for the performance of necessary repairs, maintenance, emergency, or private events scheduled by Manager. Any increase in the annual fee shall conform to the applicable rent guidelines rate. Landlord will bill the resident for the fee and the charge will appear on the resident’s rent bill/account ledger as a rentable item.

MEMBERSHIP TERM

The payment term of this agreement is monthly. For Option 1, this agreement shall be renewable at the end of the current term for a successive one year term, paid monthly, unless either party gives 30 days written notice of its intention not to renew, before expiration of the current term. In addition, Manager reserves the right to increase or decrease the membership fee upon automatic renewal in its sole discretion. The Membership term shall reflect the apartment lease term for each Member.

SALES TAX If Operator is required to collect Sales tax from Occupant, Occupant may be liable for Sales Tax payable to

the State of New York and City of New York. The payment of any Sales Tax which may be due is the sole responsibility of the Occupant. Notwithstanding the provisions of this Paragraph 12 to the contrary, if Operator is required by any taxing authority to collect Sales Tax, Operator shall collect such tax from Occupant, said sum to be added to the monthly Charge set forth in Paragraph 4 as the same may from time to time be charged.

MANAGER’S NON-LIABILITY Manager shall not be liable for personal injuries or property damage to any person or

property, nor shall Manger be liable for any loss caused by theft, mysterious disappearance, vandalism, wrongful action, fire, water, hurricane, act of terrorism, rain and explosion, act of God, or any other cause whatsoever, unless any such loss or damage is due to Manager’s willful wrongdoing or gross negligence.

BINDING EFFECT OF AGREEMENT This Agreement will bind and benefit Manager and Member and their

respective heirs, executors, administrators, successors and assigns. If any provision in this Agreement should be invalid or unenforceable, only that provision will be affected. The rest of this Agreement will remain valid, enforceable and in full force and effect.

END OF TERM AGREEMENT One the day the term of this Agreement ends, Member will notify the management office

of their intention to end membership. Any personal property not removed on the date of the term of this Agreement ends will be disposed of at a Member’s cost. If Member does not make known their intention to cancel membership as stated in paragraph 4, the membership shall renew for a one year term. Memberships are nontransferable, non refundable and cannot be temporarily frozen at any time. GUESTS member is permitted a maximum of two (2) guests at any one time in M Club. Guests must be accompanied by a Member at all times unless prior written approval is granted by Manager. Temporary guest access is available for Member’s guest by completing a guest authorization form. If a member would like to authorize their guest access to M Club for up to a maximum of 30 days please contact Manager. Member’s guest will be given a temporary access pin. A fee will be charged for temporary guest membership. Manager may refuse entry of a Members’ guest at its sole discretion. Members are responsible for the behavior of their guests. Any member who provides a guest unauthorized access into M Club, M Club Lower Level or surrounding outfox areas shall be in violation of this agreement and Manager may terminate this agreement . OBJECTIONAL CONDUCT As a member of M Club, Member will not engage in objectionable conduct. Objectionable conduct means anything which interferes with the right of others to properly and peacefully enjoy their membership, or causes conditions that are dangerous, unsanitary and detrimental to other members of M Club. Member is not permitted to take photographs or video of M Club at any time. Objectionable conduct by Member gives Manager the right to end this agreement.

MEMBERSHIP CANCELLATION Membership will be terminated if the member is not current with his rent including

but not limited to electrical charges, late, legal and any other fees. Delinquency will result in immediate deactivation of the member M Club access. When the account is paid in full, membership may be reinstated at the option of the manager. Any lease violations, including but not limited to apartment noise complaints can result in M Club membership termination.

PETS/DOGS Dogs, pets or animals of any kind shall not be permitted in M Club at any time. Due to the health hazard

and possible disturbance of other members which arise from the uncontrolled presence of animals, especially dogs, the strict adherence to the provision of this rule by each Member is a material requirement of this agreement. Members’ failure to obey this rule shall be considered a serious violation of an important obligation by Member of this agreement. Manager may elect to end this agreement based upon this violation. 48


M CLUB LOWER LEVEL Member further acknowledges being informed by the Manger that the lower level of M Club, which contains a full basketball court and activity room may no longer be available for use by Member after January 1, 2015, the date the Metropolitan Transit Authority (the “MTA”) has the right to utilize the lower level pursuant to an agreement with the Manager. In the event the MTA exercise its right s to utilize the lower level of M Club, only the lower level facilities will be affected.

RENTABLE AMENITY SPACE Members of M Club are entitled to reduced rates for amenity reservations. Please

contact the Resident Service Center for current rates. Manager reserves the right to change the reservation fees, without notice, in its sole discretion. BBQ’s 1, 2, 3 & 4 (rentable use only), . M1 & M2,Game Room, Screen/Golf & Karaoke and M-Play can be reserved for private use and will remain open to all M Club members when not reserved during hours of operation. Prep reservations will be included in the cost of M1, M2, Game or Screen reservations, but can also be reserved exclusively for a fee. Lawn, Terrace, Meet and Deck areas are not available for reservations at this time. All reservations require 72 hour advanced notice to manager and must be paid in full before the date of the event. A guest limit for each amenity space applies; please see the amenity reservation agreement for more details.

HOURS OF OPERATIONS Game, Screen, Lawn and the Field House will close daily at 11:30pm. These amenity spaces will be locked at 11:30pm and reopened at 7am. Members will continue to have access to meet (resident lounge), Tech, and Equinox health club 24/7. Pool hours may vary. Each Resident is allowed a total of 25 pages per day of copies/printing in the MAC TECH Lounge

FIELDHOUSE BASKETBALL Members are permitted to reserve half of the basketball court during specific times for private use. There is no fee for one hour, half court reservations. For a fee, the entire basketball court can be reserved exclusively for functions in four hour time blocks. A guest limit for the basketball court applies; please see the amenity reservation agreement for more details.

EQUINOX at M CLUB and M CLUB GUIDELINES Below is a list of member guidelines that are required to be

adhered to by all Members. Membership in M Club includes access to residents-only Equinox at M Club for the term stated in paragraph 3. M Club members receive exclusive member-only benefits and reduced rates for amenity space rentals. In addition, membership entitles members to common use of select amenity spaces during operating hours when they are not reserved for private events. M Club Membership shall be for the exclusive use of registered owners and/or residents of the building only. Guests are permitted on a temporary basis as outlined in paragraph 9. Private personal trainers are NOT permitted. Licensed and insured professional personal trainers are available through Equinox at M Club. Use of outside Personal Trainers in the Equinox at M Club is prohibited at all times. Members may not personal train other Members. Member represents that Member is in good health and has no disability, impairment, injury, disease or ailment preventing him/her from engaging in active or passive exercise or which would cause increased risk or injury or adverse health consequences as a result of use of M Club or its facilities in any manner. Food or beverages are not permitted in Equinox at M Club at any time. This includes but is not limited to, snack food, candy, soda, or alcoholic beverages. A pin number and handprint identity will be issued to each Member. Access to M Club will not be permitted otherwise. Minors under the age of sixteen (16), including infants in strollers, are NOT permitted to be present in the fitness area. This means that the use of the fitness equipment in the fitness area of Equinox at M Club by minors is strictly prohibited. Children are permitted to use the pool during children’s pool hours only. Minors who are sixteen (16) or seventeen (17) years of age may become members of M Club providing they are authorized by their parent or guardian resident. All membership fees apply. M Club hours may be modified from time to time.

Pool hours and regulations are subject to change at the discretion of Manager without notice. All members using the pool must wear swim caps and may NEVER enter the pool or surrounding area without a lifeguard on duty. Unauthorized access to the pool will result in immediate termination of M Club membership. Proper attire is required while using M Club and while traveling to/from M Club in the building. At a minimum, shirt, shorts, and footwear are required at all times. No street clothes or dress shoes permitted in M Club. Manager has the right to prevent the use of any equipment if the proper attire is not worn. Horseplay, ball playing, running through and around M Club, and/or objectionable behavior such as the use of loud, obscene or offensive language in M Club will not be permitted. Rollerblades, roller-skates, skate boards, hover-boards, bicycles, are not permitted to be used anywhere in the M Club. The use of a personal sound device (i.e. iPods, CD players, MP3 players and similar devices) is permitted providing noise levels are not audible to other members. Photos and or video of any kind are not permitted without prior written permission from Manager. Equinox at M Club is deemed a “Cell Phone Free Zone”. Member agrees to abide by all the membership rules, regulations and schedules which may be posted at M Club or issued orally, and which may be amended from time to time, at Manager’s sole discretion. From time to time Manager may make available to Members and their guests the services of independent contractors. We do not warrant or guarantee the quality of these services and do not guarantee that these services will remain available to Members or their guests for any period of time, and hereby disclaim all liability arising out of such services. Memberships may not be transferred. Lockers are provided solely for the benefit and convenience of Members. Manager will remove any articles left in a locker overnight. Members must provide their own lock. Members are urged to avoid bringing valuables onto M Club premises. Manager shall not be liable for the loss of, or theft of, or damage to, the personal property of Member or guests, including items left in lockers, with the coat check or elsewhere in M Club. Manager reserves the right to revoke and cancel this membership at any time for any reason, in which case Member will, no later than fifteen (15) days after such cancellation, receive a refund of all monies paid pursuant to this agreement, provided that Manager may retain expenses incurred or the portion of the total price of this agreement representing the services used or completed, and provided further, that Manager may demand the reasonable cost of goods and services which Member has consumed or wishes to retain after cancellation. Access is granted to Equinox at M Club only, and does not entitle use of any other Equinox health club.

GOLF SIMULATOR

In consideration of my use of the Manhattan View indoor golf outlet and all related equipment and facilities (collectively, the “Facilities”) provided by the Manhattan View center (the “Company”), I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the Company and its insurers, employees, officers, directors, members and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, or my guest in, on, or about the premises, or as a result of the use of the Facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the Company. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge the Company, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said Facilities.

I expressly agree to indemnify and hold the Company harmless against any and all claims, demands, damages, rights of action, or causes of action, including without limitation, attorneys’ fees, of any person or entity, that may arise from injuries or damages sustained by me, my guest or any other party directly or indirectly injured or damaged by me or my guest. I agree to be solely responsible for safety and well-being of my guest and myself. I understand that the Company does not provide supervision, instruction, or assistance for the use of the Facilities, or if it does, that I assume all responsibility for any injury or damage resulting from such supervision, instruction or assistance. I agree to comply with all rules imposed by the Company regarding the use of the Facilities. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment at the Facilities in a manner inconsistent with its intended design and purpose. I understand and acknowledge that the use of the Facilities involves risk of serious injury, including permanent disability and death. I understand and agree that the Company is not responsible for property that is lost, stolen, or damaged while in, on, or about the Facilities or adjacent premises.

M-Play

In consideration for participation in activities at the playroom located within the building commonly known as “Manhattan View ”, I hereby agree on my behalf and on behalf of the child(ren) listed below to the following: I understand that participation in the playroom and all activities relating thereto are risky and that risks of injury include without limitation, scrapes, bruises, cuts, and even more serious injuries, such as paralysis or death, regardless of whether such injuries result, in whole or in part, from the negligence of any of the Indemnified Parties (defined below), and I fully accept and agree to assume all of these risks (including risks arising from the negligence of other participants), for myself and all children listed below. I understand that it is my responsibility to supervise the children listed below when they are participating in activities at Manhattan View , not the responsibility of Manhattan View . I will obey, and will make sure that all children listed below obey, the rules posted at Manhattan View . I understand that violation of rules could result in expulsion from Manhattan View with no monetary reimbursement. With the full understanding of the risks stated above I, for myself and all the children listed below, hereby release, hold harmless and forever discharge 42nd and 10th Associates LLC, Manhattan View Tower Associates LLC, Manhattan View Investor Member LLC, RGM 42 LLC, Related 42 LLC, Manhattan View Unit A/B Investor Holdings LLC, IH 42 Holdings LLC, Related 42 Holdings LLC, Related 42 LIHTC, LLC and their respective insurers, employees, officers, directors, members and associates (collectively, the “Indemnified Parties”), from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of the playroom at Manhattan View . Furthermore, I covenant not to sue Manhattan View , the Indemnified Parties or any other persons acting on their respective behalf, for any injury at or related to the playroom at Manhattan View and agree to reimburse any attorneys’ fees and costs that may be incurred by Manhattan View or any of the Indemnified Parties. I expressly agree to indemnify the Indemnified Parties from and against any and all claims, demands, damages, rights of action, or causes of action, including without limitation, attorneys’ fees, of any person or entity, that may arise from injuries or damages sustained by me, my child and all children listed below or any other party directly or indirectly injured or damaged by me or any of the children listed below. I agree and understand that this agreement is binding on myself, my child and all children listed below and the heirs, successors and assigns of myself, my child, and all children listed below. By signing below, I certify that I am the legal parent or guardian of the child(ren) for whom I am signing. The smoke detector should be replaced on a regular basis in accordance with the manufacturer’s recommendation, but at least once every ten years. Carelessly handled or discarded cigarettes are the leading cause of fire deaths. Never smoke in bed or when you are drowsy, and be especially careful when smoking on a sofa. Be sure that you completely extinguish every cigarette in an ashtray that is deep and won’t tip over. Never leave a lit or smoldering cigarette on furniture. Matches and lighters can be deadly in the hands of children. Store them out of reach of children and teach them about the danger of fire. Do not leave cooking unattended. Keep stove tops clean and free of items that can catch on fire. Before you go to bed, check your kitchen to ensure that your oven is off and any coffeepot or teapot is unplugged. Never overload electrical outlets. Replace any electrical cord that is cracked or frayed. Never run extension cords under rugs. Use only power strips with circuit-breakers. Keep all doorways and windows leading to fire escapes free of obstructions, and report to the owner any obstructions or accumulations of rubbish in the hallways, stairwells, fire escapes, or other means of egress. 55


Install window gates only if it is absolutely necessary for security reasons. Install only approved window gates. Do not install window gates with key locks. A delay in finding or using the key could cost lives. Maintain the window gate’s opening device so it operates smoothly. Familiarize yourself and the members of your household with the operation of the window gate. Familiarize yourself and members of your household with the location of all stairwells, fire escapes and other means of egress. With the members of your household, prepare an emergency escape route to use in the event of a fire in the building. Choose a meeting place a safe distance from your building where you should all meet in case you get separated during a fire. Exercise care in the use and placement of fresh cut decorative greens, such as Christmas trees and holiday wreaths. If possible, keep them planted or in water. Do not place them in public hallways or where they might block egress from your apartment if they catch on fire. Keep them away from any flame, including fireplaces. Do not keep for an extended period of time; as they dry, decorative greens become easily combustible.

BUILDING INFORMATION Building Construction In a fire emergency, the decision to leave or to stay in your apartment will depend in part on the type of building you are in. Residential buildings built before 1968 are generally classified either as “fireproof” or “non-fireproof.” Residential buildings built in or after 1968 are generally classified either as “combustible” or “non-combustible.” The type of building construction generally depends on the size and height of the building. A “non-combustible” or “fireproof” building is a building whose structural components (the supporting elements of the building, such as steel or reinforced concrete beams and floors) are constructed of materials that do not burn or are resistant to fire and therefore will not contribute to the spread of the fire. In such buildings, fires are more likely to be contained in the apartment or space in which they start and less likely to spread inside the building walls to other apartments and floors. THIS DOES NOT MEAN THAT THE BUILDING IS IMMUNE TO FIRE. While the structural components of the building may not catch fire, all of the contents of the building (including furniture, carpeting, wood floors, decorations, and personal belongings) may catch on fire and generate flame, heat, and large amounts of smoke, which can travel throughout the building, especially if apartment or stairwell doors are left open. A “combustible” or “non-fireproof” building has structural components (such as wood) that will burn if exposed to fire and can contribute to the spread of the fire. In such buildings, the fire can spread inside the building walls to other apartments and floors; in addition to the flame, heat, and smoke that can be generat- ed by the burning of the contents of the building. Be sure to check Part I (Building Information Section) of this fire safety guide to see what type of building you are in. Means of Egress All residential buildings have at least one means of egress (way of exiting the building), and most have at least two. There are several different types of egress: Interior Stairs: All buildings have stairs leading to the street level. These stairs may be enclosed or unenclosed. Unenclosed stairwells (stairs that are not separated from the hallways by walls and doors) do not prevent the spread of flame, heat, and smoke. Since flame, heat, and smoke generally rise, unenclosed stairwells may not ensure safe egress in the event of a fire on a lower floor. Enclosed stairs are more likely to permit safe egress from the building, if the doors are kept closed. It is important to get familiar with the means of egress available in your building. Exterior Stairs: Some buildings provide access to the apartments by means of stairs and corridors that are outdoors. The fact that they are outdoors and do not trap heat and smoke enhances their safety in the event of a fire, provided that they are not obstructed. Fire Tower Stairs: These are generally enclosed stairwells in a “tower” separated from the building by air shafts open to the 56


outside. The open air shafts allow heat and smoke to escape from the building. Fire Escapes: Many older buildings are equipped with a fire escape on the outside of the building, which is accessed through a window or balcony. Fire escapes are considered a “secondary� or alternative means of egress, and are to be used if the primary means of egress (stairwells) cannot be safely used to exit the building because they are obstructed by flame, heat, or smoke. Exits: Most buildings have more than one exit. In addition to the main entrance to the building, there may be separate side exits, rear exits, basement exits, roof exits, and exits to the street from stairwells. Some of these exits may have alarms. Not all of these exits may lead to the street. Roof exits may or may not allow access to adjoining buildings. Be sure to review Part I (Building Information Section) of this fire safety guide and familiarize yourself with the different means of egress from your building. Fire Sprinkler Systems A fire sprinkler system is a system of pipes and sprinkler heads that when triggered by the heat of a fire automatically discharges water that extinguishes the fire. The sprinkler system will continue to discharge water until it is turned off. When a sprinkler system activates, an alarm is sounded. Sprinkler systems are very effective at preventing fire from spreading beyond the room in which it starts. However, the fire may still generate smoke, which can travel throughout the building. Apartment buildings constructed before March 1999 were generally not required to have fire sprinkler systems. Some apartment buildings are equipped with sprinkler systems, but only in compactor chutes and rooms or boiler rooms. All apartment buildings constructed after March 1999 are required by law to be equipped with fire sprinkler systems throughout the building. Be sure to review Part I (Building Information Section) of this fire safety guide to learn whether your building is equipped with fire sprinkler systems. Interior Fire Alarm Systems Although generally not required, some residential buildings are equipped with interior fire alarm systems that are designed to warn building occupants of a fire in the building. Interior fire alarm systems generally consist of a panel located in a lobby or basement, with manual pull stations located near the main entrance and by each stairwell door. Interior fire alarm systems are usually manually-activated (must be pulled by hand) and do not automatically transmit a signal to the Fire Department, so a telephone call must still be made to 911 or the Fire Department dispatcher. Do not assume that the Fire Department has been notified because you hear a fire alarm or smoke detector sounding in the building. Be sure to review Part I (Building Information Section) of this fire safety guide to learn whether your building is equipped with an interior fire alarm system and whether the alarm is transmitted to the Fire Department, and familiarize yourself with the location of the manual pull stations and how to activate them in the event of a fire. Public Address Systems Although generally not required, some residential buildings are equipped with public address systems that enable voice communications from a central location, usually in the building lobby. Public address systems are different from building intercoms, and usually consist of loudspeakers in building hallways and/or stairwells. Starting in July 2009, residential buildings that are more than 125 feet in height are required by law to be equipped with a one way voice communication system that will enable Fire Department personnel to make announcements from the lobby to building occupants in their apartments or in building stairwells. EMERGENCY FIRE SAFETY AND EVACUATION INSTRUCTIONS IN THE EVENT OF A FIRE, FOLLOW THE DIRECTIONS OF FIRE DEPARTMENT PERSONNEL. HOWEVER, THERE MAY BE EMERGENCY SITUATIONS IN WHICH YOU MAY BE REQUIRED TO DECIDE ON A COURSE OF ACTION TO PROTECT YOURSELF AND THE OTHER MEMBERS OF YOUR HOUSEHOLD. THIS FIRE SAFETY GUIDE IS INTENDED TO ASSIST YOU IN SELECTING THE SAFEST COURSE OF ACTION IN SUCH AN EMERGENCY. PLEASE NOTE THAT NO FIRE SAFETY PLAN CAN ACCOUNT FOR ALL OF THE POSSIBLE FACTORS AND CHANGING CONDITIONS; YOU WILL HAVE TO DECIDE FOR YOURSELF WHAT IS THE SAFEST COURSE OF ACTION UNDER THE CIRCUMSTANCES. General Emergency Fire Safety Instructions Stay calm. Do not panic. Notify the Fire Department as soon as possible. Firefighters will be on the scene of a fire within minutes of receiving an alarm. Because flame, heat, and smoke rise, generally a fire on a floor below your apartment presents a greater threat to your safety than a fire on a floor above your apartment. Do not overestimate your ability to put out a fire. Most fires cannot be easily or safely extinguished. Do not attempt to put the fire out once it begins to quickly spread. If you attempt to put a fire out, make sure you have a clear path of retreat from the room. If you decide to exit the building during a fire, close all doors as you exit to confine the fire. Never use the elevator. It could stop between floors or take you to where the fire is. Heat, smoke, and gases emitted by burning materials can quickly choke you. If you are caught in a heavy smoke condition, get down on the floor and crawl. Take short breaths, breathing through your nose. If your clothes catch fire, don’t run. Stop where you are, drop to the ground, cover your face with your hands to protect your face and lungs, and roll over to smother the flames. Evacuation Instructions If The Fire Is In Your Apartment (All Types of Building Construction) Close the door to the room where the fire is, and leave the apartment. Make sure EVERYONE leaves the apartment with you. Take your keys. Close, but do not lock, the apartment door. Alert people on your floor by knocking on their doors on your way to the exit. Use the nearest stairwell to exit the building. DO NOT USE THE ELEVATOR. Call 911 once you reach a safe location. Do not assume the fire has been reported unless firefighters are on the scene. Meet the members of your household at a predetermined location outside the building. Notify responding firefighters if anyone is unaccounted for. Evacuation Instructions If The Fire Is Not In Your Apartment “NON-COMBUSTIBLE” OR “FIREPROOF” BUILDINGS: Stay inside your apartment and listen for instructions from firefighters unless conditions become dangerous. If you must exit your apartment, first feel the apartment door and doorknob for heat. If they are not hot, open the door slightly and check the hallway for smoke, heat, or fire. If you can safely exit your apartment, follow the instructions above for a fire in your apartment. If you cannot safely exit your apartment or building, call 911 and tell them your address, floor, apartment number, and the number of people in your apartment. Seal the doors to your apartment with wet towels or sheets, and seal air ducts or other openings where smoke may enter. Open windows a few inches at top and bottom unless flames and smoke are coming from below. Do not break any windows. If conditions in the apartment appear life-threatening, open a window and wave a towel or sheet to attract the attention of firefighters. If smoke conditions worsen before help arrives, get down on the floor and take short breaths through your nose. If possible, retreat to a balcony or terrace away from the source of the smoke, heat, or fire.

If conditions in the apartment appear life-threatening, open a window and wave a towel or sheet to attract the attention of firefighters. If smoke conditions worsen before help arrives, get down on the floor and take short breaths through your nose.
