Current Treatment Approaches to Lower Back Pain - Torey Lam, Pharm.D. Lower back pain is a very common complaint for patients seen in the primary care setting. In fact, most of us will have an experience with lower back pain. Unfortunately, 15 percent of patients will suffer from lower back pain beyond six weeks. Non-pharmacologic treatment should be the cornerstone of therapy. Patients should be encouraged to seek physical therapy and stay active with activities such as Yoga. Viniyoga or Iyengar with an experienced Yoga instructor who understands patients with low back pain is recommended. For persistent pain or severe cases, NSAIDS or acetaminophen are often used. In cases of neuropathic pain, low dose tricyclic (amitriptyline) or an anticonvulsant (gabapentin, pregabalin) or SNRI (duloxetine, etc.) for pain plus depression or anxiety can be considered. Oral and epidural steroids, nerve blocks and joint injection benefits have not been shown to outweigh their risks.

How Does TRID Affect You? PRESENTED BY TITLE GUARANTY

Two new disclosure forms, the Loan Estimate and the Closing Disclosure, will replace the Good Faith Estimate, Truth in Lending and HUD-1 forms.

On October 3rd 2015, significant regulatory change for the

real estate industry will take place in the form of the TILA RESPA Integrated Disclosure (TRID) rule. The new TRID rule applies to loan applications taken on or after October 3rd for most consumer closed-end mortgage loans. TRID requires mortgage lenders to provide two new disclosure forms to the consumer, the Loan Estimate (due 3 business days after loan application), and the Closing Disclosure (due 3 business days prior to closing the loan). A set delivery period of 3 business days may also apply to the Closing Disclosure if mailed to the consumer. These two new forms replace the Good Faith Estimate, Truth In Lending and HUD-1 forms. Changes to either form once they have been issued to the consumer carry rigorous procedural requirements for the lender to meet. The consequences for mortgage lenders not complying with the TRID rule can result in significant fines being assessed. With mortgage lenders motivated to be fully compliant with TRID, the question then becomes, how does TRID affect you?

The new forms enable the consumer to compare loan terms and costs from multiple lenders earlier in the loan process.

Guaranteed review of figures:

A set 3-business day review period is provided to the consumer to evaluate transaction and loan figures before signing loan documents.

Requesting changes late in the game may delay:

Requested changes to the loan or sales contract terms late in the transactional period may delay the closing date. Mortgage lenders are required to follow specific procedures for a changed circumstance that may require a mandatory re-disclosure and review period to pass before closing.

The new TRID regulations will require all parties – lender, realtor, title and escrow, and consumer – to work together to ensure a smooth transaction. The REALTOR® Longer sale contract timelines:

A National Association of REALTORS® (NAR) survey from August 22nd, 2015, indicated nearly 56% of REALTORS® surveyed plan to adjust purchase agreements with a longer contract timeline. The increased timeline is based largely upon the timelines TRID mandates for delivery and review of the Closing Disclosure by the consumer.

Earlier delivery of transactional fees to escrow:

Mortgage lenders will look to engage escrow companies earlier in the loan process to obtain accurate fees and costs, including commission amounts to meet the targeted closing date. An earlier pre-closing walk through inspection may also be required. Mortgage lenders will want to account for credits issued by the seller on the Closing Disclosure delivered to the consumer.

Limited ability to change figures late in the transaction: One of TRID’s primary goals is to avoid last minute surprises for the consumer at the closing table. Mortgage lenders may scrutinize any changes requested after the Closing Disclosure has been mailed to the consumer.

TRID’s goal is for the consumer to “know before you owe”, and eliminate surprises at the end of a mortgage loan transaction. To meet that goal, all parties involved in a real estate transaction subject to the rule must communicate effectively and assure accurate fees and costs are available well in advance of the targeted closing date.
