The Return of the 3% Down Payment In December Fannie Mae and Freddie Mac announced the release of Home Possible Advantage(SM), an affordable conforming, conventional mortgage with only a three percent down payment requirement. “The new lending guidelines released by Fannie Mae and Freddie Mac will enable creditworthy borrowers who can afford a mortgage, but lack the resources to pay a substantial down payment plus closing costs, to get a mortgage with 3 percent down. These underwriting guidelines provide a responsible approach to improving access to credit while ensuring safe and sound lending practices,” said the Federal Housing Finance Agency (FHFA). The California Association of REALTORS® President Chris Kutzkey commended the move, especially as it allows qualified first time buyers into the market. “Saving enough money for a down payment is the biggest hurdle for most first-time home buyers,” Chris said, “but this program will help remove that barrier, and at the same time, lenders can be assured they are providing a safe, affordable loan to creditworthy borrowers.” To mitigate risk, Fannie Mae and Freddie Mac are utilizing their automated underwriting systems, which include compensating factors to evaluate a borrower’s creditworthiness as well as requiring homeownership counseling, which improves borrower performance. The program is open to buyers who haven’t owned a home in the last three years and are purchasing a single-unit primary residence with a fixed term rate. They have also opened a refinance option on a 97 percent loan-to-value for homeowners with a mortgage owned by Fannie or Freddie.
CREDIT AVAILABILITY INCREASES AS MORTGAGE RATES CONTINUE TO FALL Mortgage credit availability increased in November according to the Mortgage Credit Availability Index (MCAI), report from the Mortgage Bankers Association (MBA) which analyzes data from the AllRegs® Market Clarity® product. The MCAI increased 1.2 percent to114.6 in November. A decline in the MCAI indicates that lending standards are tightening, while increases in the index are indicative of a loosening of credit. The index was benchmarked to 100 in March 2012. “Credit availability increased in November, largely due to the addition of jumbo loan programs that permit cash-out refinancing,” said Mike Fratantoni, MBA’s Chief Economist. “Home price appreciation and larger equity cushions have likely made some lenders more willing to allow certain borrowers to take cash out, while still low mortgage rates may make this a more attractive opportunity for some.” In the following weeks report Fratantoni addressed falling interest rates, “Amid plummeting oil prices and heightened concerns regarding global economic growth, interest rates dropped sharply through the course of the week (12/17), with longer-term Treasury yields falling more than 10 basis points. The average mortgage rate also dropped during the week, with several lenders offering 30-year fixed-rate loans with rates below four percent. The 30-year conforming rate was at its lowest level since May 2013, and the 30-year jumbo rate averaged 3.99 percent for the week.” ~MBA 6
KEY REAL ESTATE TAX PROVISIONS PASSED On December 17, 2014 National Association of Realtors® President Chris Polychron applauded the final passage of legislation to extend key real estate tax provisions, “The package of tax extensions approved by the U.S. House and Senate, and headed to the President’s desk for signature, includes important provisions that will help distressed homeowners and commercial property investors with transactions made during 2014. NAR applauds Congressional leaders in both chambers for their effort to pass this legislation before adjournment. “Realtors® strongly supported the bipartisan Mortgage Forgiveness Tax Relief Act, which was included in the package to prevent underwater borrowers from paying taxes on any mortgage debt forgiven or cancelled by a lender in a workout or after their home was sold for less money than was owed. We are grateful to Sens. Debbie Stabenow, D-Mich., and Dean Heller, R-Nev., and Reps. Tom Reed, R-N.Y., and Charlie Rangel, D-N.Y., for championing the provision.” ~N.A.R

Borders (DRWB), a non-pro¬fit 501 (c) (3) organization that rescues homeless dogs from the streets and high-kill shelters of Baja California after being found on a street in Baja’s Wine Country. We are so delighted to report that our friend Lee, who happens to also be the owner of AT-HOM Design & Staging in Little Italy and Palm Springs, is now giving this little guy the best forever home. We’ll let Lee take it from here and tell you his and Canelo’s happy story. “I cannot tell you how much Canelo has changed my life. I have found a truly loving, caring and grateful soul and I’m so grateful for him. DRWB is an amazing organization that changed both Canelo’s life and my own. They nursed him back to health, fostered him for a year, gave him all his shots, paid for his vet bills, brought him across the border to meet me, and asked for a mere $200. How might Fannie Mae and Freddie Mac’s new guidelines affect homebuyers?
There are a lot of things happening on the financing front in housing. Financing doesn’t tend to be the sexiest topic, but it’s the most important one. Finding a home is one thing, but without money, you can’t buy it. In the rearview mirror, it’s easy to see that we had loose lending standards leading to the real estate crash. If you could fog a mirror, you were qualified to buy a home. Unfortunately now the standards have tightened up and even good buyers are being squeezed out of the market. The new guidelines lowered the minimum down payment from 5 percent to 3 percent. I believe that loosening the standards a bit can help the market. The marketplace needs more products for self-employed borrowers, and those who suffered one time issues

from the crash. Some programs exist, but not enough. That being said, if you start hearing about “subprime” loans again, then I’d be concerned. Let’s not revisit that era.

What should buyers and sellers expect in the San Diego housing market – specifically in the luxury market – coming out of the holiday season?
A
Every situation is different, so should be the advice. You will typically see quite a bit of activity during this time of year. San Diego doesn’t have the winters that keep people from home shopping.

Could the effect of record-low oil prices trickle down to the housing market?
It’s nice at the pump, but not necessarily a good thing for the economy. Things that aren’t good for the economy are never good for housing, unless they are causing mortgage rates to drop. So my answer is no, it means nothing. Someone saving a few bucks on gas shouldn’t use that as a tipping point to buy a home.
If someone is buying at this time of year, they are likely a serious buyer. I would focus on interest rates. They are low – REALLY low! And they won’t stick around for your New Year’s resolution to buy a home. Interest rates are driven by the market, and 2015 will bring higher mortgage rates. I encourage any reader who owns a home to visit me online to explore refinancing into these low rates. I have the best in my network I can refer you to.

Do you predict millennials will enter the San Diego housing market in 2015? Why might San Diego’s trend be different than the nationwide trend?
A
Millennials are an interesting breed. They can definitely help housing. I see this generation needing a bit more of an education on the opportunities with owning a home. Our partners can provide a rent vs. own analysis to anyone who is interested. The numbers are astonishing right now.

FHFA will allow some foreclosed homeowners to repurchase homes at market value. Is this a good thing? How might it affect the San Diego housing market?
With anything like this, there have to be other compensating factors that show the borrower has the ability to repay the loan. A foreclosure can happen from negligence, or can be a byproduct of the market crash, a lost job, an adjustable rate, etc. As long as the repurchase is done by someone who has other criteria that support a good borrower, I’m all for it. More buyers are good for the market, as long as they are legitimate.
