CALIFORNIA’S SOLAR MANDATE AND WHAT IT MEANS FOR LUXURY REAL ESTATE - By: Christina Dube -

The newly passed solar law will mandate the inclusion of solar panel photovoltaic systems on newly constructed residential buildings with three stories or less, effective Jan. 1, 2020.

T

he five-member California Energy Commission, voted unanimously to adopt updates to the state’s building energy efficiency standards. This is the most aggressive move toward curbing green house gas emissions and solidifying California’s position as the national leader in green energy adoption. This sounds like overwhelmingly good news for consumers, conservationists and The Solar Industry. The vote immediately had a positive impact on stock prices for solar companies and ensures an expected 10% increase in demand over the next few years. Speculation is that the increase in demand, combined with ever improving technology, could result in lower solar equipment costs by the time the law takes effect in 2020. Currently, the CEC estimates that the updated Title 24 building codes will increase building costs by $10,000, causing some opponents to argue against the law, citing already sky-high housing prices in California. While $10,000 may be enough to hurt buyers in a lower end, buyers in the $1M plus market will be unaffected. So what effect will this have on the higher end market? Well, first let’s examine exactly what the state is requiring for new buildings. Updates to the Title 24 standards mean that an average home’s energy use can be reduced by up to 53% by including a required solar system of 2-3 kilowatts with the largest projected model at a 7-kilowatt system. So, in terms of your energy bill, what does that get you? Surprisingly little if you own a large, luxury estate. According to Green Tech Media, “the average residential solar system installed by California homeowners in 2017 was 7 kilowatts”. This doesn’t even assume that those systems reach “net metering” or “net zero energy” (producing more energy than used, resulting in energy going back to the grid).

We at SAN DIEGO PREMIER know that luxury properties are far from average. The luxury home buyer can expect top properties to include upgrades such as pools and spas, guest houses, electric car-charging stations, air conditioning, outdoor kitchens, temperature-controlled wine storage, or security gates and cameras. These amenities are big energy guzzlers and, of course, the larger the house and the more outbuildings, the higher the energy bill. So, while the state’s new requirement of solar systems will help offset some costs for a large luxury property, it will by no means, enable new luxury estates to reach California’s goal of 53% energy reduction using a maximum 7-kilowatt system. This gap leaves room for some interesting expectations from potential buyers, but also opportunities for luxury real estate developers who will have to compete with existing properties that already offer net zero systems. One of the areas where developers can “sweeten the pot” besides offering larger solar systems, would be to include energy storage systems. These are essentially large batteries that store energy produced during the day, to be used in the evenings when rates are higher. California also offers rebate incentives for these energy storage systems. Real estate agents have long known that home buyers, especially in California, where our energy rates are among the highest in the nation, value solar systems to offset high energy bills. Current and future California homeowners alike need to by savvy about the cost of invested solar systems and the true value based on ever increasing energy rates and consumption models. Overall, this is very good news for homeowners, and our beautiful, sunny state of California.

VIRTUAL REAL ESTATE SERVICES ARE “FLEXIBLE� FEES WORTH ALL THE SACRIFICES? - By: Kathryn Holt -

Recently, I was involved in a real estate transaction in which I represented the Sellers of the property. The Buyers hired a Virtual Real Estate Assistant (known as a “VA�) to represent them. These Buyers aren’t alone. An increasing number of people are opting to go on-line for their real estate needs including and, perhaps, especially Millennials.

F

or many Millennials, a recent home purchase will be their first and only purchase to date, which is part of the challenge. First time Buyers lack previous experience working with a Real Estate Agent (“RE Agent�), and are unaware of what they’re sacrificing by not having an experienced Agent at their side. Most VA’s are not licensed as RealtorsŽ, they specialize in data entry-related tasks: entering/updating/ researching information, scheduling appointments, and managing social-media. Consequently, there are important considerations and differences that prospective Buyers should keep in mind...

WHAT IS THE MAIN ENTICEMENT OF HIRING A VA? Perceived savings and money... Clients can negotiate the commission. For example, of the 3% (Buyer’s Agent) commission, a predetermined amount will go to the Buyer, with the remainder going to the VA. Or, alternatively, the VA receives a at fee; however, this fee could be non-refundable if the deal falls through. In our case, the VA received 30% of the 2.5% commission which was high given the work they performed and lack of real estate knowledge. Remember the adage, “You get what you pay for.â€?

VA’s can arrange for an Agent to take their place, however, RE Agents in this position typically know little about the property since they’re briefly standingin. This forces the Buyer to pick up the slack, as the Buyer in our case learned. RE Agents work hard for their commissions, so it’s in their best interest to ensure everything stays on track and escrow closes. VA’s receive only a portion of the commission, so they’re not as invested in the ďŹ nal outcome and successful close. Being a RealtorÂŽ involves guiding and educating your clients, and negotiating

ARE THERE ADVANTAGES TO HIRING A RE AGENT OVER A VA? If you’ve ever been involved in a real estate transaction, you know there are lots of moving parts and opportunities for things to go wrong. For this reason, it’s important to know the legal risks. It’s important to consider the following: During a real estate transaction, a VA maintains a remote relationship. Their contribution is handling assigned paperwork. It is up to the client to verify the accuracy of the paperwork/contracts, because it’s their neck on the line. Also, non-licensed VA’s lack the protection of, and access to, the California Association of RealtorsÂŽ (CAR) legal hotline and/or a Brokerage’s legal counsel. If something goes wrong, the Buyer may discover they’re on their own. Review the Virtual Real Estate Company’s policy regarding legality/liability before committing yourself. VA’s seldom meet their clients face-to-face. Instead, each client is one of multiple â€œďŹ lesâ€?. Likewise, the VA will likely never see the property, so they won’t be able to detect the faint smell of mold, or other potential “red agsâ€? a seasoned RE Agent will detect. It also means they have never seen exactly what’s on the line: your home!

RE Agents have professional connections and relationships (with Lenders, Inspectors, Escrow & Title); an expansive network of contacts and colleagues; and direct access to Legal/Risk Management advice. RealtorsÂŽ also have cutting-edge technology. The MLS/Multiple Listing Service, Docu-sign, industry software, and the internet have streamlined real estate, making contract signing easier than ever. This saves time and energy, without sacriďŹ cing personal service.

Technology is a benefit to the real estate industry; however, to have a smooth and successful transaction, and protect your investment, it’s wise to have an expert at your side, especially someone who performs well under pressure. In our case, the VA became so overwhelmed by the pressure she “shut down� and stopped communicating, sometimes for up to a week. We asked the Escrow company to step in on behalf of the Buyer to assure the time-sensitive contracts/deadlines were met, and to keep the deal on track.

Moments after we closed escrow, I received frantic messages from the VA requesting the property address, so the Buyer could pick up the keys. (Let that sink in for a moment and I think you’ll find the humor in it.) All things considered, do I think VA’s provide a useful service? Yes. raditionally, this small rural town, named in 1887, has been largely dedicated to agriculture (oranges, lemons and avocado) due to its warm-summer Mediterranean climate. But more recently homeowners have taken up another crop‌Grapes, thanks to Mike Schimpf. Schimpf, a San Diego Premier Builder of Custom Luxury Resort Estates, has now also created an Award-Winning Winery, Hill Top Winery, right here in Valley Center. Mike Schimpf started Schimpf & Associates, Inc in San Diego in 2000, coordinating a team of highly experienced and skilled professionals to work together to make custom luxury resort estates. With developments around San Diego, Schimpf estates can be seen in Chateau Charmont, Duck Pond, Villa Sienna, Villa Bellagio, Bella Villa, Santaluz and now at Hill Top Ranch, a 25acre gated community in Valley Center. According to Hill Top Winery, grass needs 1.3 million gallons of water annually per acre, citrus groves 1 million, avocado orchards 800,000 gallons, and grapes‌ only 35,000 gallons. So with San Diego’s water conservation in mind, Grapes win, and Schimpf likes the appeal of owning his own vineyard and winery and is excited with the possibilities of helping new homeowners flourish with their own backyard vineyards.
