boards to enact rules and laws that are hampering a thriving business. In 1995 when David and Lynne Clouse launched the online app, VRBO (Vacation Rentals by Owners), the industry skyrocketed. Now some local beach communities have more vacation renters than homeowners in their neighborhoods. Just to give you an idea of the money these online companies were making, in December 2015 Expedia purchased Homeaway for $3.9 Billion dollars. What once was a small industry, morphed into a mega industry with

more than 2,000,000 vacation rentals in 190 countries on Homeaway’s site alone. Homeowners find they can get far more money renting on these sites short-term than monthly or yearly through a property management company. Good deal for many homeowners, but not for their neighbors. What once may have been a quiet neighborhood, with many homeowners being absent due to 2nd and 3rd vacation homes, has now made neighbors packed with vacationers year round. But this gravy train for rental owners could be coming to a screeching halt depending upon where you live. The complaints to HOAs have been mounting for years. One reason is that it’s a hard rule to enforce. HOA’s have limited manpower (or womanpower) and usually don’t get involved until neighbors complain.

Although they have been successful in many cases, the problem is that the rules and regulations on short-term rentals are not uniform, vary from county to county, state to state, and even from neighborhood to neighborhood. And can be very confusing. For instance, in 2017 Del Mar permitted short-term rentals in the Residential-Commercial zone and the Visitor Commercial Zone, but that changed later in the year when the City Council adapted an Ordinance to establish new regulations for short-term rentals (less than 30 days). Coastal Commission approval is required for the Ordinance to become effective, which has yet to happen. For the latest rulings visit delmar. ca.us All this legal haggling does have a purpose. The Coastal

But coastal homeowners have marshaled their own lobbying group, claiming that, after all, it is their property and they can do what they like with it, despite the HOA rules.
Commission and other zoning organizations are trying to arrive at a compromise that will make short-term renters and rental owners and their vacationing clients happy.
In fact, the law is on their side. At least so far. A California appeals court ruled in March that a lower court should have blocked a homeowners association’s ban on short-term rentals in a beach community because Golden State law leaves it up to the city and the state Coastal Commission to decide whether to impose such a restriction.
Laws and restrictions will no doubt change over time, so for the latest information, go to the Airbnb online app or website and search for your city. It should have a summary of the legal requirements and restrictions pertinent to your area and helpful links for more detailed information.
And that might be a good thing depending on which side of the issue you’re on because these organizations wield a lot more clout than HOAs that are often beaucratic, comprised of volunteers, and feckless enforcers. Change requires procedure, compromise, and perhaps even joining the HOA, but not everybody has the time or patience for that.
Can’t find your city? Then check your local municipal or administrative code, which might be available online at your local government’s website. Still no luck? Then ring your city’s zoning board or local housing authority.
