The Herbert Smith Freehills Collection One of the most famous British artists of the last century, Bridget Riley’s extraordinary career continues unabated, despite the fact the grand dame of Op Art is now in her 80s. Riley has achieved that elusive artistic ideal; creating a body of work as pioneering as it is ubiquitous. Her graphic style came to epitomise the Swinging Sixties but her continued exploration of Op Art’s possibilities has proved it to be fertile ground. Despite focusing her work in a narrow field, she has managed to side-step the pitfalls of the cliché.

Whilst the results of her painstaking technique and careful colour-play display a technical understanding firmly rooted in the scientific, Riley firmly asserts that her artistic approach has always been intuitive. Beyond the initial optical illusion, her art sets out to provoke an emotional response in the viewer. The works in this sale date from a period of experimentation in the 1990s and early millennium. By this stage Riley had long abandoned the more rigid monochromatic structures

associated with her 1960s output, discovering that the ‘lozenge’ forms - featured in several of the examples here - endowed her juxtapositions of form and colour with more movement and depth than anything she had previously achieved. The nature of Riley’s work is to place demands on the viewer’s gaze but in these later works the calmer palette and the playful arabesque forms result in a series of works which are unequivocally fun and lighthearted to read.

The career of Patrick Heron is largely associated with the St Ives School, an artist’s colony formed around the Cornish studios of abstractionists Ben Nicholson and Barbara Hepworth in the late 1930s. It is to the generation of younger artists who gravitated there post-WW2 that the term generally refers. Heron had been brought up in Cornwall for much of his life, meeting Nicholson at the Leach Pottery in St Ives during his inter-war years spent as a conscientious objector. Like the other members of the school, Heron’s attraction to plains of colour and simplification of

form was primarily influenced by the French Moderns Matisse and Braque, and secondarily by the concurrent artistic developments of the Abstract Expressionists in the U.S.A. Heron was particularly impressed with the boldness of the scale on which Rothko and his group worked. Large canvases would increasingly become an aspect of Heron’s own oeuvre, as would a characteristic ‘flatness’ of shape, form and colour. Tonally, his earlier work contains echoes of Nicholson and his British precursors. Latterly, however, Heron would go on to embrace an

almost cartoon-ish palette of flat primary shades which engage with the aesthetic of Pop Art. His work, though abstract, always referenced reality and remained readable to the viewer; the aim being to present the audience with a new a way of seeing. Heron was also a respected art critic, theorist and author, contributing to the New Statesman, Studio International and The Guardian, as well as producing monographs on fellow artists George Braque and Ivon Hitchens.

Due to the outbreak of WW2, Frost’s path as an artist was somewhat unorthodox. Though he harboured a lifelong interest in art, he did not begin painting in earnest until he became a prisoner of war in Germany, an experience that served as something of an epiphany. Upon his return to the UK, Frost enrolled in both the Camberwell School of Art and the St Ives School, despite the fact he was in his thirties and had a young family to support. He was greatly encouraged by a period spent as assistant to sculptor Barbara Hepworth in 1951.

Initially adopting a Realist technique as a member of the Euston Road School, Frost soon followed his natural impulses towards abstraction and, alongside other prominent figures including Patrick Heron, William Scott and Roger Hilton, became a leader of the mid-century British avant-garde.

Jane MacAllister-Justin Dukes Art Collection and Archive Richard Demarco O.B.E. is an Edinburgh artist and art promoter who has played a crucial role in placing Edinburgh on the map as an international arts hub, significantly contributing to the development of the Edinburgh Fringe festival. A co-founder of the Traverse Theatre in 1963, Demarco went on to run the Richard Demarco Gallery between the years 1969-1992. As well as nurturing young native talent including artists such as Damien Hirst, his most outstanding achievement has been the promotion of Eastern European artists during the Cold War; strengthening ties between the UK and countries like Poland, Romania and Yugoslavia. In particular, Demarco provided a Western European platform for the careers of the now internationally renowned and critically lauded avant-garde artists Joseph Beuys, Tadeusz Kantor, Paul Neagu and Marina Abramovich. Throughout the 70s and 80s Demarco hosted famously unorthodox ‘Summer Schools’, creating a melting pot of ideas and collaborations between local and international artists. The collection on show pertains to this important

period in Scottish, and indeed, European art. Jane MacAllister, initially Demarco’s assistant and ultimately the Deputy Artistic Director of The Demarco Gallery in its latter phase, coorchestrated the exhibitions and events based around the gallery. In 1990 Jane married Justin Dukes, joint Managing Director of the FT Group and founding Managing Director of Channel 4. Before Justin’s tragically early death in 2008 the couple built up an extensive collection of contemporary art. The collection consists of over 150 paintings, works on paper, prints, posters and

sculptures, all of which reflect the energy and range of the Demarco Gallery’s activities, and represent a unique record of the exhibition programme during this period. Local heroes include works by Byrne, Crozier, Demarco, Douthwaite, Hamilton Finlay, Hanson, Howson, Knox, McCann, McNeish, Wyllie and Yule. The Internationalists include works by Beuys, Christo, Flanagan, Hambling, Neagu, Newcomb, Rabinowitch, Swan and Uecker. As controversial as he was influential, Joseph Beuys pushed the boundaries of Western contemporary art from the 1950s until his death in 1986. Loosely definable as a sculptor/installation/ performance artist, Beuys approached his work in a spiritual fashion and sought to connect with and ‘heal’ his audience through, as he saw it, art’s restorative powers. Via his self-created persona of the artist as teacher/shaman, Beuys popularised the anticommoditisation of art, promoting creativity as something to be experienced by everyone in the everyday. Alongside a selection of

famous installation pieces, the majority of his work was to be experienced as ‘actions’, the remnants of which exist as photographs, recordings, props and other forms of documentation. The influence of his ethos on continued contemporary German, and indeed European, art practise remains hugely relevant today. Beuys’ connection with Scotland was initiated in 1970 by Richard Demarco. Demarco became aware of the extraordinarily progressive visual art activity in Dusseldorf at the time and decided to approach its key protagonists and talents. His concept was to stage a

Festival exhibition entitled Strategy: Get Arts, to be held in the Edinburgh College of Art. It was to serve as instructive to the art students of tomorrow and enlighten the British art world to the avant-garde developments taking place out with the UK. Thirty five artists participated including Blinky Palermo, Sigmar Polke, Gerhard Richter, Dieter Rot, Günther Uecker and, in a real coup for Demarco, Joseph Beuys himself. Their brief was to create new work in direct response to their experience of Scotland. Beuys created an action which he entitled ‘Celtic (Kinloch Rannoch): a Scottish Symphony’. Performed for eight hours a day for six consecutive days, it involved performance and projections set to a soundscape by Henning Christiansen. Beuys was greatly drawn to the wilds of North West Scotland and found much to inform his interest in Celtic tradition and feed his innate sense of connection to the

environment. This remarkable association with Scotland would continue right up until the artist’s last years, during which time he created works inspired by Barlinnie Prison’s Special Unit and Greyfriar’s Bobby. To Beuys, Scotland was the ‘key’ to Europe’s Celtic history, a period, in Beuy’s mind, entwined with the root of the human condition and the elemental. Germany’s Celtic past held extremely negative associations at this time due to its appropriation by the Nazis. Beuys sought to reclaim it and found inspiration in Scotland as a country that understood the importance of looking to its past in order to forge a strong foundation for the future. The works in this sale represent aspects of these seminal excursions to Scotland, including ‘Celtic (Kinloch Rannoch): A Scottish Symphony’, which is internationally and historically recognised as one of the artist’s masterworks.

Best known for his repetitious use of the humble nail as an artistic prop, Uecker’s artwork transmutes the boundaries of sculpture, painting, installation, film and design. Originally from East Germany, Uecker elected to pursue an art education in Dusseldorf where students were able to practise modernism and exercise a greater freedom of expression. He remained here for many years, teaching at the Kunstakademie between 1974 and 1995.

Uecker, alongside Heinz Mack and Otto Piene, was a founding member of the important group ZERO in the early 1960s. ZERO functioned as a catalyst in rejuvenating the German art scene, largely in reaction to the dominant ‘art informel’ movement of the 40s and 50s which favoured spontaneous, gestural artistic impulses. ZERO proposed that the process should be secondary to the concept and effect.

illusion of movement. Uecker is also interested in religious and social philosophies. His nails create forms that are suggestive of the homogenized movements of mankind both physically and mentally, and hint at the concept of collective thought.

In 1956 Uecker first introduced the use of nails to his art. Later he would suggest that his connection to nails as a means of expression originated from having barricaded his family home against the approaching Russian front during WW2. When hammered into patterns, at different depths or affixed to moving constructions, nails also proved effective in the pursuit of his fascination with the use of light to create the optical

Uecker - whose associations with Demarco date back to the late 1960s - exhibited in Edinburgh on several occasions and was one of the participating Dusseldorf artists in Demarco’s Strategy: Get Arts show in 1970.

“Christo” is the collective name of the artist duo Christo and Jeanne-Claude Javacheff, whose series of immeasurably ambitious public installations have provided some of the most visually striking and enduring imagery of the last forty years. Christo Javacheff was born in Bulgaria in 1935. In 1957 he escaped from behind the Iron Curtain to study art in Vienna. Stateless and impoverished, Javacheff moved to Paris to make a living as a portrait painter where he met the Moroccan born philosophy graduate Jeanne-Claude Denat. Though engaged to another man, Jeanne-Claude fell pregnant by Javacheff and, in the face of severe disapproval from her family, eloped with him despite having initially gone ahead with her marriage and honeymoon. The pair started

to collaborate together artistically and, having begun to build a reputation in Paris, settled in New York in 1964 where they would remain until Jeanne-Claude’s death in 2009 at the age of 74. With a combination of staggering logistical capability, fearless imagination and limitless drive, the couple became known for their high-profile public art installations which involved “wrapping” famous monuments including the Reichstag in Berlin and the Pont Neuf Bridge in Paris. Never accepting sponsorship, Christo would raise the necessary funds – often amounting to millions of dollars – solely by selling preparatory pastels, charcoals, collages and lithographs pertaining to the project. Interestingly, Christo insist that there is no socio-political

concept behind their work; that the visual impact alone is the objective. Though obviously playful, the sheer scale of the enterprise lends an undeniable grandeur and beauty to their work. Throughout the canon of art history the drapery has played a significant and often symbolic role, as has the veil or shroud of religious ritual. The fabric reveals the essence of form and holds transformative powers, in this case turning the iconic and the familiar into the extraordinary: enhancing

monumentality by simplification of form. Braver still is the fact that these works are all transitory. Years in the planning and in situ for as little as a few days at a time, nothing but the plans and photographic records remain once the installation has been dismantled, lending the works a legendary quality. The Pont Neuf project took 9 years of bureaucratic wrangling to come to fruition in 1984. It is represented in this sale in a series of images taken by their official photographer Wolfgang Volz.

Demarco devoted much of his career to the promotion of Eastern European art; strengthening ties between the UK and countries like Poland, Romania and Yugoslavia. In particular, Demarco provided a platform for the careers of a triumvirate of now internationally renowned artists; the German Joseph Beuys, Polish Tadeusz Kantor and Romanian Paul Neagu.

When the embargo on international movement was lifted for a brief eight month period in 1969, Demarco took the first flight from the UK to Bucharest – its only passenger. He offered Neagu an Edinburgh show which was readily accepted. As a direct result of this opportunity, Neagu remained in the UK for the rest of his life.

Neagu, born in Bucharest in 1938, found himself on the wrong side of the Iron Curtain to practise the abstractionist art to which he was impelled. Quietly, away from the socialist realism proscribed by his native art schools, Neagu began to explore

The works here are representative of the two predominant ciphers in his oeuvre. The sculptural assemblage ‘Hyphen’ is a version of a repeat experiment of Neagu’s, first explored in 1975 and consistently re-imagined

throughout the rest of his career. Its base materials echo the folk furniture of his homeland and the wedge-like form is said to be rooted in reminiscences of the tools of his cobbler father’s trade. To Neagu, the Hyphen form was representative of human energy and spirituality – an attempt to physically represent the metaphysical harmony that the artist felt underpinned mankind’s existence. The eight point Starheaded form is a further exploration of this ‘sacred geometry’. Neagu went on to teach in prestigious institutions such as the Chelsea School of Art and the Slade. His work, the forefront of the avant-garde at

the time, never led to commercial success. A large scale Starhead form, for example, was commissioned to be erected at Charing Cross, London, but the project was halted by factions within the council. Nevertheless, his conceptual approach to sculpture was to have a lasting effect on a generation of students, including Anthony Gormley, Anish Kapoor and Rachael Whiteread, each of whom cite his work as a significant influence. The Tate acquired Neagu’s archive and showed a retrospective of his work the year before the artist’s death in 2004 at the age of 66.

Stephen Conroy produces detailed preparatory drawings for his larger oil paintings using chalk, gouache and oil on paper. In these chalk studies he explores the drama created through light and shadow and gradually establishes the various components of his composition. The male head seen from behind is an important motif in his work. Conroy's depiction of groups of figures almost entirely facing away from the viewer, such as

Three Bob a Week (Aberdeen Art Gallery) is unusual in the history of art. Through avoiding a direct view of the face, he adds to the enigmatic and mysterious atmosphere of his oeuvre. The male figure has remained his primary subject since the 1980s and amongst his typical depiction of generic 'suited men', Conroy often includes a selfportrait. Conroy has depicted women comparatively rarely. The nude drawings offered here show his interest in Edgar

Lyon & Turnbull carries on business with bidders, buyers and all those present in the auction room prior to, or in connection, with a sale on the following General Conditions and on such other terms, conditions and notices as may be referred to herein.

6. PAYMENT

1. DEFINITIONS In these Conditions: (a) “Auctioneer” means the firm of Lyon & Turnbull or its authorised auctioneer, as appropriate; (b) “deliberate forgery” means an imitation made with the intention of deceiving as to authorship, origin, date, age, period, culture or source but which is unequivocally described in the catalogue as being the work of a particular creator and which, at the date of the sale, had a value materially less than it would have had if it had been in accordance with the description; (c) “hammer price” means the level of bidding reached (at or above any reserve) when the auctioneer brings down the hammer; (d) “terms of consignment” means the stipulated terms and rates of commission on which Lyon & Turnbull accepts instructions from sellers or their agents; (e) “total amount due” means the hammer price in respect of the lot sold together with any premium, Value Added Tax chargeable and any additional charges payable by a defaulting buyer under these Conditions; (f) “sale proceeds” means the net amount due to the seller, being the hammer price of the lot sold less commission at the stated rate, Value Added Tax chargeable and any other amounts due to us by the seller in whatever capacity and however arising; (g) “You”, “Your”, etc. refer to the buyer as identified in Condition 2. (h) The singular includes the plural and vice versa as appropriate. 2. BIDDING PROCEDURES AND THE BUYER (a) Bidders are required to register their particulars before bidding and to satisfy any security arrangements before entering the auction room to view or bid; (b) the maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid, which must be raised before the next lot is offered, shall be settled at the auctioneer’s absolute discretion. (c) Bidders shall be deemed to act as principals. (d) Once made, no bid may be withdrawn. (e) Our right to bid on behalf of the seller is expressly reserved up to the amount of any reserve and the right to refuse any bid is also reserved. 3. INCREMENTS Bidding increments shall be at the auctioneer’s sole discretion. 4. THE PURCHASE PRICE The buyer shall pay the hammer price together with a premium thereon. 25% up to £25,000 / 20% thereafter. VAT will be charged on the premium at the rate imposed by law. 5. VALUE ADDED TAX Value Added Tax on the hammer price is imposed by law on all items affixed with an asterisk (*) or dagger (†). Value Added Tax is charged at the appropriate rate

(1) Immediately a lot is sold you will: (a) pay to us the total amount due in cash or in such other way as is agreed by us. We accept cash, bank transfer (details on request), Switch or Debit Cards and Visa or MasterCard (please note there is a surcharge of 2% (VAT included) when using credit cards). We do not accept American Express. (2) any payments by you to us may be applied by us towards any sums owing from you to us on any account whatever without regard to any directions of you or your agent, whether express or implied. 7. TITLE AND COLLECTION OF PURCHASES (1) The ownership of any lots purchased shall not pass to you until you have made payment in full to us of the total amount due. (2) You shall at your own risk and expense take away any lots that you have purchased and paid for not later than four working days following the day of the auction or upon the clearance of any cheque used for payment after which you shall be responsible for any removal, storage and other associated charges. (3) No purchase can be claimed or removed until it has been paid for. (4) It is the buyer’s responsibility to ascertain collection procedures, particularly if the sale is not being held at our main saleroom and the potential storage charges for lots not collected by the appropriate time. 8. REMEDIES FOR NON-PAYMENT OR FAILURE TO COLLECT PURCHASES (1) If any lot is not paid for in full and taken away in accordance with these Conditions or if there is any other breach of these Conditions, we, as agent for the seller and on their behalf, shall at our absolute discretion and without prejudice to any other rights we may have, be entitled to exercise one or more of the following rights and remedies: (a) to proceed against you for damages for breach of contract; (b) to rescind the sale of that lot and/or any other lots sold by us to you; (c) to resell the lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller; (d) to remove, store and insure the lot at your expense and, in the case of storage, either at our premises or elsewhere; (e) to charge interest at a rate of 1.5% per month above the current base rate on the total amount due, to the extent it remains unpaid for more than four working days after the sale; (f) to retain that or any other lot sold to you until you pay the total amount due; (g) to reject or ignore bids from you or your agent at future auctions or to impose conditions before any such bids shall be accepted; (h) to apply any proceeds of sale of other lots due or in future becoming due to you towards the settlement of the total amount due and to exercise a lien (that is a right to retain possession of) any of your property in our possession for any purpose until the debt due is satisfied. (2) We shall, as agent for the seller and on their behalf pursue these rights and remedies only as far as is reasonable to make appropriate recovery in respect of breach of these Conditions

9. THIRD PARTY LIABILITY All members of the public on our premises are there at their own risk and must note the lay-out of the accommodation and security arrangements. Accordingly neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property of persons visiting prior to or at a sale. 10. COMMISSION BIDS While prospective buyers are strongly advised to attend the auction and are always responsible for any decision to bid for a particular lot and shall be assumed to have carefully inspected and satisfied themselves as to its condition we shall if so instructed clearly and in writing execute bids on their behalf. Neither the auctioneer or our employees or agents shall be responsible for any failure to do so. Where two or more commission bids at the same level are recorded we reserve the right in our absolute discretion to prefer the first bid so made. 11. WARRANTY OF TITLE AND AVAILABILITY The seller warrants to the auctioneer and to you that the seller is the true owner of the property consigned or is properly authorised by the true owner to consign it for sale and is able to transfer good and marketable title to the property free from any third party claims. 12. AGENCY The auctioneer normally acts as agent only and disclaims any responsibility for default by sellers or buyers.

If we are satisfied from the evidence presented that the lot is a deliberate forgery we shall refund the money paid by you for the lot including any buyer’s premium provided that (1) if the catalogue description reflected the accepted view of scholars and experts as at the date of sale or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition. The right of return provided by this Condition is additional to any right or remedy provided by law or by these Conditions of Sale.

13. TERMS OF SALE

GENERAL

The seller acknowledges that lots are sold subject to the stipulations of these Conditions in their entirety and on the Terms of Consignment as notified to the consignor at the time of the entry of the lot.

17. We shall have the right at our discretion, to refuse admission to our premises or attendance at our auctions by any person.

14. STANDARD VENDOR FEES AND CHARGES (Subject to VAT) (1) Commission: 15% of the first £3000 and 10% thereafter is charged on the selling price of each lot (subject to a minimum charge of £30). Loss and damage warranty: 1.5% on value of lots sold. Photography: max £40 mono per lot, max £250 colour. Internet Marketing Service: £10 per lot. (2) If a vendor wishes to withdraw a lot organized for sale, a withdrawal fee will apply; (a) If withdrawn over 28 working days prior to the sale, this will be charged at 10% of the mid estimate along with any ancilliary incurred (such as photography), all subject to VAT at the current rate. (b) If withdrawn within 28 working days of the sale, this will be charged at 20% of the mid estimate along with any ancilliary incurred (such as photography), all subject to VAT at the current rate. 15. DESCRIPTIONS AND CONDITION (1) While we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably

18 (1) Any right to compensation for losses liabilities and expenses incurred in respect of and as a result of any breach of these Conditions and any exclusions provided by them shall be available to the seller and/or the auctioneer as appropriate. (2). Such rights and exclusions shall extend to and be deemed to be for the benefit of employees and agents of the seller and/or the auctioneer who may themselves enforce them. 19. Any notice to any buyer, seller, bidder or viewer may be given by first class mail in which case it shall be deemed to have been received by the addressee 48 hours after posting. 20. Special terms may be used in catalogue descriptions of particular classes of items (Books, Jewellery, paintings, guns, firearms etc) in which case the descriptions must be interpreted in accordance with any glossary or guidance notes appearing in the catalogue. These notices and terms will also form part of our terms and conditions of sales. 21. Any indulgence extended to bidders buyers or sellers by us notwithstanding the strict terms of these Conditions or of the Terms of Consignment shall affect the position at the relevant time only and in respect of that particular concession only; in all other respects these Conditions shall be construed as having full force and effect. 22. Scottish law applies to the interpretation of these Conditions.
